VII. PUBLIC HEARING ITEMS. A. Disposition of Cases presented by Code Officer Sterling: This being a quasi-judicial proceeding, an oath was administered to those offering testimony, all responded affirmatively. Officer Sterling advised all events occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony, photographs, and supporting documents were all entered as part of the official record. Case No. 17-012 Officer Sterling testified notice of violation/notice of hearing sent via certified mail was received by property owner. Officer Juan & Lydia Almodovar. 1804 NW 71h Avenue Sterling stated the property has several disabled vehicles with expired tags. He said he spoke with Ms. Almodovar and she is Ch 30 Sec 30-41 Disabled vehicle trying to get the vehicles removed. Mr. Sterling suggested since she is making some progress to allow her more time to bring Ch 30 Sec 30-44 General cleaning & beautification 11 the property in complaince. Member Close moved to find Case No.17-012, Juan & Lydia Almodovar,1804 NW 7ch Avenue, in violation of Ch 30 Sec 30-41 Disabled vehicle and 30-43 Public nuisance, based on the testimony of Code Officer Sterling, imposing a fine of fifteen dollars per day beginning thirty (30) days after receipt of proper notice if property is not in compliance at that time; seconded by Member Denisuk . Code Billy & Jerri Lynn Hill. 1005 NW 8" Avenue Officer Sterling stated property had been mowed but the building is a safety hazard and needs to be boarded up. He said he Ch 30 Sec 30-43 Public nuisance spoke with Ms. Hill and explained the building needed to be secured, she said they would do what they could. Chairperson Ch 30 Sec 30-44 General cleaning & beautification suggested having the City board it up so that the nuisance can be abated quickly, Member Close moved to find Case 17-015, Billy & Jerri Lynn Hill,1005 NW 8`h Avenue, in violation of Ch 30 Sec 30-43 Public nuisance and find in compliance of Ch 30 Sec 30-44 General cleaning & beautification, based on the testimony of Code Officer Sterling, imposing a fine of fifteen dollars per day beginning thirty (30) days after receipt of proper notification; seconded by Member Denisuk . Case No. 17-022 Officer Sterling testified notice of violation/notice of hearing sent via certified mail was returned, therefore notice was posted. Brenda Kemp. 800 SW 2" Avenue He spoke to the property owner's son, Wayne Purvis, about getting the property cleaned up. After that conversation the property' Ch 30 Sec 30-43 Public nuisance was haphazardly mowed. However, it is still considered to be overgrown with dead trees and debris in the yard. Chairperson Ch 30 Sec 30-44 General cleaning & beautification Gamiotea noted this property is located in a very visible area across from the school board office. Ms. Jennifer Tewksberry addressed the board stating she lives at 801 SW 3`d Avenue, just west of the property in violation. She said this property has been continually overgrown since October of 2015 with debris, a truck hood, dilapidated fence and rodents. Member Close moved to find Case 17-022, Brenda Kemp, 800 SW 2nd Avenue, in violation of Ch 30 Sec 30-43 Public nuisance and Sec 30-44 General cleaning & beautification, based on the testimony of Code Officer Sterling, imposing a fine of ten dollars per day beginning fifteen days after receipt of proper notification; seconded by Member Denisuk.
