OCTOBER 19, 2017 - PLANNING BOARD - PAGE 2 OF 3 ACTION - DISCUSSION - VOTE CHAIRPERSON HOOVER OPENED THE PUBLIC HEARING AT 6:03 P.M. Comprehensive Plan Small Scale Future Land Use Map (FLUM) Amendment Application No. 17 -003 -SSA, is being requested by the applicant, Mr. Mark Mattson, authorized representative of The Revocable Living Trust of Gwendolyn Adams (property owner) to change the classification from Single Family Residential (SF) to Industrial on 0.321± acres, located in the 900 block of Northwest 3rd Avenue. Planner Brisson reviewed the Planning Staff Report and explained the application is for two vacant lots encompassing approximately 14,000 square feet of land. The applicant intends to use the property as a contractor's office. Planner Brisson recommends approval, based on the findings within the Planning Staff Report (listed in Item 5.a.). Mr. Steven Dobbs, P.E. with SLD Engineering was present on behalf of the applicant and available for questions from the Board. There were none. Chairperson Hoover asked whether there were any comments or questions from those in attendance. There were none. Chairperson Hoover asked Board Members to disclose for the record whether they had spoken to anyone prior to this meeting regarding the application or whether they visited the site. There were none stated. Planning Staff's findings are as follows: The application was found to be consistent with the City's Comprehensive Plan, specifically Policy 2.2 and Objective 12 of the Future Land Use Element. Properties to the immediate North of the subject property are designated Multi -Family Residential on the FLUM, zoned Residential Multiple Family and developed for multi -family use. The properties to both the South and West are designated Industrial on the FLUM, zoned Industrial and developed with industrial uses. The lot immediately East of the subject property is designated SF on the FLUM and zoned Residential Single Family -One with a single family home ori it. The remaining lots in this block are either vacant or developed in single-family use, except for the two multi -family structures in the northwest corner. The subject property can be considered appropriate for industrial use although the applicant should recognize the minimum side and rear yard requirements adjacent to residential zoning are forty feet, which may limit the size and location of the structure. There will be no significant change in traffic levels between the likely maximum traffic generation for a two-story structure and for the more likely scenario of a one-story use should the application be approved. Based on the Institute of Traffic Engineers traffic generation rates, a single-family home will generate 1.01 trips in the peak hour and for general light industrial use 0.97 peak hour trips per 1,000 square feet. Demand for potable water and waste water treatment will be greater for an industrial or heavy commercial use than for the one single-family home. While 1 1 1 AGENDA V. PUBLIC HEARING ITEM CONTINUED. The existing developed site contains no environmental sensitive areas, wildlife habitat, unsuitable soil conditions, or susceptibility to flooding. A motion and second was offered by Members Baughman and McCoy to recommend approval to the City Council for Comprehensive Plan Small Scale FLUM Amendment Application No. 17 -003 -SSA, from SF to Industrial on 0.321± acres, located in the 900 block of Northwest 3rd Avenue, Lots 17 and 18 of Block 37, CITY OF OKEECHOBEE Plat Book 5, Page 5, and find it to be consistent with the Comprehensive Plan based on the findings within the Planning Staff Report. No additional Police stations are scheduled. The existing Police station should be able to maintain its level of service standard with the proposed amendment given that the project is immediately adjacent to an existing area already designated for commercial uses. Service availability from the Police Department will be determined by the local government review. Fire The nearest fire station is located at 55 SE 3rd Avenue. No additional fire stations are scheduled. Service availability from the Fire Department will be determined by the local government review. Solid Waste Waste Management operates the regional solid waste landfill. Waste Management has previously indicated they have a 20 year capacity left in their facility. Stormwater Management The project is located in the City of Okeechobee and according to the attached FIRM panel 12093C0415C, this parcel is in Flood Zone X There are no wellfields within 1,000 feet of the parcel. Potential adverse impacts to ground and surface waters will be minimized by implementation of appropriate erosion control measures during construction in accordance with the NPDES Generic Permit for Stormwater Discharge from Large and Small Construction Activities. Erosion control measures that may be implemented include stabilization practices such as temporary seeding, permanent seeding, mulching, geotextiles, or sod stabilization; structural practices such as silt fences, earth dikes, diversions, swales, sediment traps, check dams, or storm drain inlet protection; and sediment basins. Stormwater runoff quantity and quality are strictly regulated by the City and the SFWMD to ensure that pre -development drainage conditions are maintained. The proposed rate of discharge from the site will be less than or equal to the existing discharge rate from the site. The drainage system will be owned, operated and maintained by the owner, who's past record of compliance has beens shown to be a responsible property owner and should be acceptable to the City and the SFWMD. The Stormwater Management System will employ, wherever practical, a variety of Best Management Practices (BMP). The proposed FLU of Industrial with a maximum development rate according to the City LDRs is 50%, which would yield 6,970 sf of commercial development. Therefore, development of the property would most likely not exceed 13,993 square feet of floor area, and would more likely be only one story in height with about 6,997square feet of floor area. 2. Proposed Use The Applicant, intends to use the property as the site for his building contractor's business, which is a permitted use in the Industrial Future Land Use Category (FLUC) Comprehensive Plan Anal sis A. Consistency and Compatibility with Comprehensive Plan and Adjacent Uses. Policy 2.2 of the Future Land Use Element recommends that the City protect the use and value of private property from adverse impacts of incompatible land uses, activities and hazards. Objective 12 states that the City of Okeechobee shall encourage compatibility with adjacent uses, and curtailment of uses inconsistent with the character and land uses of surrounding areas, and shall discourage urban sprawl. Properties to the immediate north of the subject property are designated Multi - Family on the Future Land Use Map (FLUM), zoned RMF and developed for multi- family use. The properties to both the south and east are designated Industrial on the FLUM, zoned Industrial and developed with industrial uses. The ITE trip generation factor for General Light Industrial use 0.97 peak hour trips per 1,000 square feet. The likely maximum traffic generation for a two-story structure would be 13.6 peak hour trips and for the more likely scenario of a one-story use, 6.8 peak hour trips. These potential levels of traffic generation should not significantly affect traffic levels in the immediate area. Demand for Potable Water and Sewer Treatment The estimated demand for potable water and waste water treatment for one single- family home approximates 308 gallons per day (114 gallons per person per day at an average household size of 2.7). Demand for potable water and waste water treatment will be greater for an industrial or heavy commercial use than for the one single-family nome. Appiyina an estimate of 016 ga!Ions or water peT oay per square foot of nonresidential use indicates a demand of between 1,046 and 2,091 gallons of potable water and waste water treatment per day. While the demand is greater than that for the potential development of one single-family home, it would not represent a significant demand upon available capacities of OUA's potable and wastewater treatment facilities. The Applicant has included in his submission letters from the Okeechobee Utility Authority indicating that service is available and that there is adequate excess capacity to accommodate the demand that would be associated with the proposed use as well as more intense industrial uses allowable on the subject property. C.
