Swearing in of newly elected Mayor Kirk requested Judge William Hendry come forward to swear Councilmembers by Judge Hendry. in new City Officials. Judge Hendry administered the Oath of Office to Councilmembers Michael G. O'Conner and James E. Kirk congratulating them both. Clerk Thomas presented Councilmembers O'Connor and Kirk with a certificate of election, term beginning January 5, 1993 and ending January 7, 1997 (or until their successors are elected and qualified). a. Mayor Kirk presented a service plaque to outgoing Councilmember R.R. "Nick" Collins for his eight years service to the City. C"J 2. Election of Mayor. Mayor Kirk opened the floor for nominations of Mayor. Councilmember Watford nominated James E. Kirk to continue to serve a Mayor for two years, beginning January 5, 1993 and ending January 3, 1995; seconded by Councilmember Entry. Councilmember O'Connor made a motion that nominations for mayor cease; seconded by Councilmember Watford. Councilmember Watford expressed thanks to Mayor Kirk for his professional Chairmanship —Mayor service record. Further commenting, he felt the City is in a very delicate situation particularly with the County and the utility authority; and it would be in the best interest of the City to keep Councilmember Kirk in office as Mayor., Mayor Kirk thanked the Council for their confidence in appointing him to continue serving as Mayor and Chairman. Motion to appoint Mr. Jack Adams as Councilmember Entry made a motion to appoint Mr. Jack Adams as a a new Water Plant Operator — City new Water Plant Operator; seconded by Councilmember Watford. Administrator. Following questions from Council, it was explained by Water Plant Supervisor Long, Mr. Adams was a new employee. He will have to remain on probation status until he obtains his certification; and he is filling a new position that was added in 1992-93 budget. Mr. Adams was introduced and welcomed. French Construction request to G.E. French Construction Co. in the amount of forty .`� Co. in the amount of $40,027.50 — thousand twenty—seven dollars, fifty cents ($40,027.50); seconded City Administrator (Exhibit 2). by Councileember Walker. Administrator Drago answered the Council's questions stating the project was complete except for a punch list! sprinkler repair, traffic light repair and survey of the asbuilts yet to be done. Councilmember Walker, Watford and Entry commented that the job had gone well considering its location (Highway 441 and 70 intersection), and felt the company had done a good job. COUNCILMEMBERS ACTION NEW BIISINESS Motion to approve a partial pay request to Edens Construction Co. Councilmember Walker made a motion to approve a partial pay request to Edens Construction Co. in the amount of one hundred five in the amount of $105,633.18 - thousand six hundred thirty-three dollars, eighteen cents City Administrator (Exhibit 3). ($105,633.18); seconded by Councilmember Entry. Administrator Drago explained this is for the Community Development Block Grant for water line improvements in the Southwest section. Administrator Drago commented further, according to a letter from the consultant who filed the application for the City, the CDBG rule is payments are to be made within five days after the City receives the money from the State. We are breaking their rule due to our meeting dates (for payment approval by Council) and the time the contractor sends the requests for payments. The City may have to issue the checks for payment upon the recommendation from the engineer before the Council approves the pay request in order to meet the CDBG time schedule and keep the State from monitoring the City through the entire project. Discussion ensued among Council and staff. Council instructed Administrator Drago to see if the time period could be changed or obtain a waiver from the State on the five day rule. Council also expressed they did not want checks issued until pay requests were approved by Council. Councilmember Watford. Public Works Director Elders commented the project is moving along faster than expected and they are doing really well. Motion to approve a partial pay Councilmember Watford made a motion to approve a partial pay request to McKuhen Construction in request toMcKuhen Construction in the amount of seventeen thousand the amount of $17,100.00 - City one hundred dollars ($17, 100. 00) ; seconded by Councilmember Walker. Administrator (Exhibit 5). Q. Public Works Director Elders commented the project was almost complete, they still have a punch list which consists but is not limited to grass to be put out, repairs to gate around lift station, fill dirt and water retention in some places. Administrator Drago answered we are waiting to hear from the Pension Board Attorney. Mayor Kirk commented the Council may need a workshop to discuss the proposed ordinance revisions. 12. Discuss Jay Raulerson's water bill - Council discussed results from the Palm Beach County Water, City Administrator (Exhibit 7). Utilities Meter Testing Report attached in Exhibit Seven. The test results from the report indicate Mr. Raulerson's meter was found to be registering at ninety percent (90%) of water used. Which means this meter has been billed for only ninety percent (90%) of the water that has passed through it and the user was receiving ten percent (10%) of the water free of charge. Councilmember O'Connor made a motion to charge Jay Raulerson the highest water bill over the past eleven months in place of the October bill. Motion died for lack of second. Discussion ensued among Council, staff and Mr. Jay Raulerson. Mayor Kirk called for a motion three times. No motion was offered. Council could not find evidence the meter was defective. The October bill stands as is for Mr. Raulerson, at three hundred fifty-nine dollars, sixty-six cents ($359.66). Continued: Councilmember Walker explained his reasoning for the ranking is ,.` he felt Reese, Macon & Associates should remain the consulting engineer for water due to their current level of involvement at the water plant. And he had always heard good reports on Mock, Roos & Associates who are from the Glade area. Following discussion among Council, Attorney Cook pointed out to them should they negotiate a continuing services contract with one specific firm for water and/or wastewater the amounts of the projects cannot exceed $25,000.00. Should the Council rank three firms for water and three firms for wastewater and compare price with each firm for each project, the project amount cannot exceed $10,000.00. Councilmember Entry felt the ranking should be left as it is listed in Exhibit Eight which was done by the Public Utilities Supervisors Long, Sorensen and Birts as follows: Wastewater - Knepper & Willard, Inc; Reese, Macon & Associates, Inc; Kimball, Lloyds, Inc. Water - Reese, Macon & Associates, Inc; Knepper & Willard, Inc; Kimball, Lloyds, Inc. Discussion ensued among Council and staff. Councilmember Watford withdrew his second to the motion. Councilmember Walker withdrew his motion. I am kind of the one that requested this item in the first place and as I said last meeting ,,,I guess it is my fault for not making it clear or my personal preference,,,what I would like to see, as I said it last meeting. I would like to see preferably a different and preferable if at all possible a local firm so you can receive local service and that's not the way our staff ranked these engineers. I think that. Well, I have an idea of how I would like to see the ranking and when a motion is in order I would like to make that motion. KIRK - Okay, you can make a motion really at anytime because it is open for discussion. WATFORD - I'd like to move that the ranking for wastewater and rdbelchanged Incorporated Richard T. WALKER - For water is: Reese, Macon because I think we are in a time where if we don't utilize them down there at the plant we are going to be in bad shape. WALKER - The fact that they're established, they've did water and sewer for the City of Lake Worth for over thirty-five years and they're almost local, they came out of the glades on into Palm Beach County and I think they are responsive. I've seen a lot of their work in the fist and that's about all I can say, I think they are an outstandingly g ood ENTRY - Are we going to ask these people to come in here and give us a presentation and vote on them? WALKER - I think that's what Dowling wanted. ENTRY - Then vote on them afterwards? WALKER - I don't have any problem with that. WATFORD - I think before they begin the. I don't know the correct time. I don't know if they should come in and make a pres Intation nlike bef r see we actually begin, I guess the neat stage is negotiations. wouldthese three firms give us a presentation before the negotiation process. WALKER - That's usually procedure isn't it? WATFORD - Normally they don't make a presentation to the City Council, we're trying to put another step in here. -1- DRAGO - Right. Because that's. Yes that's right, you're asking for an additional step for them to come in and give a presentation, right. But, there wouldn't be any negotiations going on with the firms unless we started doing projects. I mean if there was no projects pending then the ranking would be there when a project had to be done. WALKER - Some of that water it's going to be so small though, I mean some of that water needs quickly looked at. WATFORD - I thought, no, no. I thought we were going to go ahead and negotiate and select one of these ranked firms as,,,or enter into a continuing service contract with one of these firms. That's what I thought this whole process was about, I thought that's what we were headed towards. WALKER - Maybe I misunderstood. If they came up and give this, then we would vote this would be the way they are ranked then we would enter with all three firms and let them negotiate the work each time, wasn't that the way you understood it? DRAGO - Yea. WALKER - Have the three firms available to pick from each time it came up. DRAGO - In other words what I would prefer is if I was going to, let's say I wanted to start the project to demolish the old sewer plant. I go to the wastewater one and bring Mock, Roos in and say here's the scope of service, what is your price, he gives it to me, I say okay thank you. I bring in Reese, Macon, I bring in Knepper and Willard and then I'd have to bring back to the Council the best price. WALKER - But you can go back to number one with this each time so you actually have three to work with each time instead of just a single firm. WATFORD- But we still haven't solved the day to day problems that I was trying to solve. DRAGO - The day to day problems, there are some ongoing water and wastewater projects that we are currently doing. We've got the bids in for the SCADA System for the alarm for the lift stations, that's being reviewed. We've got the minimum standard for both water, wastewater and roads that are being finished up so there's some miscellaneous work that's still going on. But there are some new projects that have not begun. One is the demolition of the old plant; two is building the new lift station where the old sewer plant is. Pegging the lines for both water and wastewater and that would require an engineer to draw up the specifications so that we could send it out for bid, so I would go again, if its a water pegging I'd go to Reese, Macon; Mock, Roos; Knepper & Willard and get your prices. WALKER - Don't we need to move some stuff down there to the water plant? DRAGO - Yes. WALKER - It would take an engineer to figure how we needed to move that. Soon! DRAGO - Right. Now on the other hand, Dowling, if its real small stuff, okay? The better way to handle the real small stuff is for the City to send out a scope of services because we can solicit quotes under $10,000.00 firm prices, best person wins. WALKER - Can't you work with these same people, these firms? DRAGO - Yes you can. WALKER - I don't think it would give you that long, I don't think it would slow the process down to have three to talk to, I really don't. DRAGO - No. -2- WALKER - And I'd feel better if we had three instead of just one. I think we would get over this being nervous of having one person having it all the time, maybe I just misunderstood it or understood it differently than what you did, I think. WATFORD - It's turned into something completely different than what I had wanted to see. O'CONNOR - Mr. Mayor, are we having a problem with the two engineers that we have now doing the work for us? WALKER - No, they're under big contracts though, this is for day to day stuff. KIRK - The * answer is no we're not. WATFORD - The problem is, if I can start all over again, and I guess I'm the only one that dislikes engineers, doctors and lawyers, I don't know. But, it seems like if you go through the engineering bills that we pay, we pay a bundle of money in engineering. A lot of that we have officially allocated for certain projects. For example, we are designing a new water plant, we hired an engineer, we have a scope of services and so forth and so on, that's fine and we agreed to pay him so much money to design that water plant. Well, in the mean time every time something minor comes up. For example, what size line do we need to put to this housing development, or what size line do we need to put here to put to serve this mobile home park. Same thing with the wastewater plant. We're doing it, we have an engineer hired to do an expansion of the wastewater plant, so every time we have a question what size should this line be or can we hook this line into our present lift station, we call that engineer, but we have no legal authority to call that engineer, we've never ente4into an agreement with him to do the small stuff. We have an agreement with him to do the whole plant, but not to do the small stuff. And in my opinion he is not authorized, the City is not authorized to expend, or maybe it is, I don't know but in my opinion we need some legal way to say okay if we have a question about water engineering problems, this is who we call and we have a schedule of fees that he will charge but right now we're calling Reese, Macon because he's doing the plant over there. We call Knepper & Willard for anything about sewer because they're doing the sewer plant and I don't think that's right. I think we're spending a lot of money and I don't think they've been necessarily authorized to do that, there is a, and apparently I'm having trouble conveying what it is, but there is an entity called a continuing services contract, whereas you enter into an agreement with an engineer for these type services and he tells you - okay this amount is how much I charge for this, this, per hour or what have you and we then as a Council would say, Mr. Engineer, whatever your names is, you are authorized to do this type of engineering work for the City of Okeechobee and City Finance Department you are authorized when they do something that falls under that category, you're authorized to pay them for that. And we don't have that now. It's now - we like Knepper & Willard so we call Knepper & Willard, we like Reese, Macon, so we call Reese, Macon. And that's fine I don't have any problem with them, their great engineers we've had absolutely no problems with them. But we have never official said that's who we're going to use and we spend a bundle of money. I guess maybe I should have gone through and added it up in the last couple of years how much we've spent in that area that aren't in a particular contract but I can assure you it's a large sum of money. And if I was local engineer I'd be hot, I would be extremely hot but I'm not a local engineer. WALKER - Let me ask something. You're saying that it would be too cumbersome to call these three people, we've got to move a line what would you do? Like you would call up somebody local, would it be too cumbersome to have the three or should we have the dog and pony show and pick one of the three? DRAGO - I think that if you want the dog and pony show that's up to you. But, I would prefer to keep three in the rankings..... WALKER - That's the way I understood it.... -3- DRAGO - Because the small jobs. As Mr. Walker was saying, lets say if I want to double check a water meter, okay Dowling? They pick Reese, Macon, they got Mock Roos and Knepper & Willard. In other words I could go to their hourly schedule and determine whose the cheapest and say okay Mock, Roos it should take you one hour to tell me the right size water meter and its $50.00. But the bigger jobs, for instance the demolition of the wastewater plant, Council would have to approve that contract because I'm sure it's going to be over $7,500. worth of design or something along those line. I'd have to go through the normal procedure, here's the scope of services.... WALKER - But it would be with these firms? DRAGO - Absolutely. WALKER - We'd already have them on line. COOK - I was sort of thinking along the same lines as Dowling on this whole proposal here I guess. And just to bring everybody up to speed, the Statute requires the agency, which is the County or Municipality, advertise each occasion when professional services are required to be purchased for a project and of coarse they have category cost where they exceed category five and that is were John mentioned construction cost in excess of $120,000. or engineering fees in excess of $10,000. So those areas were engineering fees would not exceed $10,000. don't fall under the competitive act. But if what we're seeking here is a continuing contract with a firm, and the key word there is "a contract", I think if or what I anticipated was the Council was going to eventually rank the order of preference that they want to negotiate with the firm to provide continuing services for a certain time period, whatever you want to set on it, a year or whatever. And that negotiations commence with that firm and if its successful then that firm is selected for that particular time period. Not going down a list each time there is a project. Because under a continuing contract, for and there is exceptions based on how the advertisement or request for services was worded that was sent out by the City but, for general City work capital projects as needed, a continuing contract would raise that amount, we would not have to seek other competitive bids for projects up to $500,000. and engineer or special servicing fees not to exceed $25,000. So what a continuing contract does is basically raise the City from, instead of having to go out that particular year, if the fees are going to exceed $10,000. the continuing contract allows us to not have to competitively negotiate the contract up to $25,000. That give us that extra $15,000. During that year, any project construction cost, exceeding $500,000. or engineer fees over $25,000. would have to go under the act all over again just like we always have. So that's how I envisioned it and if we're going to enter into a continuing contract I don't really think we can list three engineering firms and say each time we're going to go down this list and pick and choose from you guys. WALKER - Well than I think they should do a presentation like Dowling's talking about, then we should pick one of these three. COOK - We can do that for projects under $10,000. if you want to. WATFORD - That's what I was going to say, if we can, and I don't necessarily agree with it... WALKER - We can jao to $25„000. if we Dick one of these three... COOK & WATFORD - If we pick one of the three.... And do the negotiations with the first. on that list as we always have. WALKER - Alright, I'm agreeable to do it that way. I'd just, I'm like Dowling, I feel comfortable to sit down and discuss this, and get somebody to do it on a continuing basis then you can call and get whatever you wanted on the smaller stuff. Do it however we have to do but I'm like him, I'd like to look at them, talk to them and if they really want to work they'd be willing to show up, I really do, works pretty scarce out there. KIRK - The only thing that bothers me is, and I'm guilty of having done this in the past myself. But we're asking our own people to rank here and were basically ignoring the ranking that they've submitted. I think in the last meeting I made the comment and I will stand behind that comment that unless somebody can present something that shows me that their ranking should be ignored that I would vote accordingly, so I just wanted to say that four the record. WALKER - We have all the firms except for Kimball, Lloyds, Inc. coming if we go with this one. WATFORD - I'd still like to see all of them. There is one local firm and I would like to see that local firm. KIRK - I think any time we can give business to local people we're far ahead of the game to do so. WATFORD - I can't understand... O'CONNOR - But did the local firm, the local firm's not in here, correct? Who is the local firm Dowling? WATFORD - Richard T. Creech, Incorporated. WALKER - He's got an office here, but he's got one in Martin County too. C. LONG - He is not a local firm, he has an office here. D. SORENSON - He only has an office here. WATFORD - He has an office that makes him a local engineering firm, just like Hoover, Thompson Associates they have an office here, they are a local firm. KIRK - If you want to speak please raise your hand. WATFORD - Mr. Chairman, a lot of these have offices in more than one City I would venture to say that several of these if I remember looking through their proposal they have offices in fact some of them have them in many States. O'CONNOR - How can you be local if youi-4in all these different areas? You've got to find one place youirtgoing to call home, that's local. L -5- • WATFORD - Well, out of all these, out of all the firms these only one on the list that has a local office, period. None of the other firms have a local office. ENTRY - Mayor we got... My statement is I heard one of the Councilman mention that we would have to hire an engineer to tell us what size pipe we needed or what size meter we needed. We've got a book of standards for that. That will tell you anything that goes in the City of Okeechobee, that's what they've been doing for the last six or eight months, getting up a book of standards. If you're going to build a motel you can walk right in there and it tells what exactly you've got to have for a 10-unit, 20-unit, 50-unit whatever, now that was the statement. My question is I'd like to ask Mr. Walker, you mentioned Mock, Roos when you were working South of here did you have working relationship or work with these people? WALKER - No, they never did any State work. COLLINS - I said you I'm talking about any, I'm not talking about State I'm asking you, did you have a working relationship with them in any way? WALKER - No, I just knew of them. KIRK - There was one more hand up, I'll recognize that them we need to keep this up here so we can get this accomplished. D. SORENSEN - Just to clarify why we did not have Creech Engineering on the list is simply because the SCADA System, he showed no familiarity, no background in it at all and no direct reference in his ability to do it so therefore with the set of specs we were given we had to decide. KIRK - You're saying they showed no background in water and sewer? D. SORENSON - No, background in the SCADA System. DRAGO - SCADA, that's our system for the lift stations for the alarms. ENTRY - Mayor I'd like to Dut on the record, I'd like to take the Department Heads or Supervisors suggestion whatever, and keep Reese, Macon and just take their suggestion of how they are ranked, Reese, Macon and Willard. Just those two and keep them as they are. KIRK - I think it would have been nice if we were going to do this if we would have started out approaching it from a different view and maybe we'll learn from this. I think that this conversation is ending up in a place were `none of us really wanted it. Most of these firms I'm not that familiar with, Y I'm AaL" n&ig.not that educated in the service that they provide I think we went jf and did this before, like Councilman Watford stated earlier maybe what he was trying to accomplish wasn't presented clearly and I think some of us didn't state our ideas clearly at the same time. I just feel bad that we asked our staff to do work and then ignored and like I said, I was guilty of doing that once before myself so I know that we've changed rankings before but,I want all of us to think what's best for the City and lets try to move in that direction no matter which firms we use. a- O'CONNOR - Councilman Watford said that in his opinion what he thought about this, is it legal or is it not legal for us to make or to ask Reese Macon if he's over here to do something other than what their suppose to be over here for on the water plant or whatever job that they are working on and we needed to know something about pipes or something like that is it legal for them to do that work without a contract? COOK - Under the purchasing ordinance we have, we can I think, in the past we have obtained services like that up to a certain dollar amount that's authorized under ordinance yea. O'CONNOR a The other thing that I would question there is if it was a Tuesday or Thursday and Reese, Macon was over here or Knepper & Willard were over here and we needed to know something but yet we have to call West Palm Beach to get somebody to come over here and they are going to charge us nxn number of dollars to drive all the way over here and tell us that when we've got these people already here in town, it seems to me like we are wasting some money for that guy to drive out here when we have the answer right here with either Reese, Macon or Knepper & Willard. COOK - Let me also while we're talking about that. This came up at a prior meeting sometime last fall and we've discussed this in the past. There's a blank spot so to speak in the ordinance because technically the purchasing ordinance excludes professional services so we don't really have anything in place in the ordinance to obtain engineering services less than $10,000. unless it comes up on the agenda and we vote on it so we either need to for professional services have it on the agenda and vote on it each time it comes up which is kind of cumbersome if they guys need an answer you know the first of the month and we're not going to meet for a week. Or two, amend the purchasing ordinance to provide for professional services up to a certain dollar amount by the administrator or whomever you want to do it without having to actually have a vote on it by the City Council. KIRK - Did that help any gentlemen? DRAGO - Even if you go through the procedure of bringing them in here and letting them give their presentation Council would still have to rank three and we would still have to negotiate with the three and its not to say that the number one guy that the Council picked is going to be the number one guy because of his price. I mean I'm not going to know that until I go through the list. Lola and I did that with the auditor and number two was the best candidate. WALKER - I think Dowling and I both would feel better if we did have them come up and give us some more background on themselves. I know I would anyway. KIRK - Is there other discussion because we do have a motion that is still on the table here. ENTRY - We know the background of Reese, Macon and Willard, do we have to have them come up again. WALKER - Well I wasn't here when we first hired them and I've dealt with them some as Councilman, but I think it would be sort of funny if we had somebody else come and not have them too. KIRK - I think if your going after a continuing services contract that they should show up. WALKER - Yea this is a different kind of contract than what we have now. WATFORD - I think we need to decide, maybe this is a terrible idea, maybe we don't even want to do this. I think we need to decide if we want to do it. Then I think we need to determine how we want to do it. If we want to do just the one firm or if we want to do just the three firms on a list. I think we need to determine that. WALKER - Did you say it could be we could pick and sign a continuing contract with them. -7- WATFORD - One firm, that's right. Or we could do it like Councilman Walker had suggested, as the Administrator had in mind, we're going to have these three firms on a list and then we'd, you know whichever one we felt, for all projects under $10,000. Well this would have to be under, I'm sorry I mean $25,000. DRAGO - John, can we do both? Could the Council select one firm out of the three and give them a continuing services contract but still keep the three firms for other work that's not covered under the continuing services contract, bigger jobs? Then you could have the best of both worlds. KIRK - The first thing we are going to have to do; one, are we going to have to rank these firms. WATFORD - I think we should give them a time limit and say Mr. Engineer you have "z" number of minutes, how many? THOMAS - Fifteen. WATFORD - I was thinking five. DRAGO - You've got to give them time to get through their resume and that takes ten. KIRK - You would rather have more than the three then? WATFORD - Because I want to have that local firm on there and he wants to have. WALKER - I picked my three. WATFORD - I don't have any problem with his three. I want to add one more. C. DRAGO - Well the Civil is a little more ,,,its got a little different twist to it because of the nature of the work and there are some firms that can do certain works and some can't so I think as I mentioned to you last meeting you're probably looking at a couple of different categories and I think that should be done at a latter date, but I still would want Chuck and whoever else in Public Utilities and probably Cleveland go through that civil engineer pile I've got in my office there. Hopefully after this exercise is done we've got a little better idea about how the procedure is and we'll get it a little smoother. KIRK - Alright we need to either.... O'CONNOR - I think that the next time something like this comes up that we ought to be a little bit more professional and courteous to our department heads who we put out on a limb and let them go through all of this and then we've just taken everything away from them what there responsibilities were. Its just kind of astonishes me the way that this happened. I'd be scared to death if I was those people to do anything again. This is an education. KIRK - I think that that has basically been said up here but I do appreciate your comments. -9- WATFORD - I take exception to that because, and like I say maybe its my fault but I don't feel like this process, like I intended or like I envisioned a month or two ago when this came up. It did not turn out and I will remind the Council that this has happened before and we thought we'd learned from our mistake then when we had certain firms ranked and when it came back we said hey wait a minute this isn't anything like what we said we wanted. And I hope .the City staff doesn't take this is in any way a reflection on their work because I know how many hours it takes to go through those things and I know how difficult they are to go through and I know it's not easy as all. It did not accomplish what I had envisioned. KIRK - I think next time around we can do this if we want to get firms for us in a way without putting ourselves in a adversary position with the Department Heads involved. I think we can do a better job next time. We just need to get across what we want to see and we did not do that. DRAGO - Regardless of what the outcome should have been the process still had to be the same. KIRK - We have nothing that covers professional services at this time? COOK - The only thing we have is like I said we had a vote one night a couple of years ago that we are not to retain outside attorney's for any purpose unless it is put on the agenda and Council approved.
