2017-11 Support OUA Treasure Island Project1 1 • RESOLUTION NO. 2017-11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA; EXPRESSING SUPPORT FOR A PROPOSAL BY THE OKEECHOBEE UTILITY AUTHORITY TO COMMENCE IMPROVEMENTS IN THE TREASURE ISLAND AREA OF OKEECHOBEE COUNTY, FLORIDA FOR PROVISION OF SOLID WASTE AND WASTEWATER COLLECTION, ENCOURAGING THAT THIS PROJECT BE INCLUDED IN THE LEGISLATIVE AGENDA FOR THE CITY AND COUNTY OF OKEECHOBEE FOR CONSIDERATION DURING THE 2018 LEGISLATIVE SESSION; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Okeechobee and Okeechobee County, Florida have jointly participated in the creation of the Okeechobee Utility Authority (OUA), which provides water and wastewater services to residents of the City, as well as within a defined service area within Okeechobee County; and WHEREAS, it is in the best interests of the City and County, and those residents within the combined service area of the OUA, that the provision of water and wastewater services be performed in a manner which is both efficient and environmentally sound, employing the best and most recent innovations in technology for provision of such services, for the preservation of Lake Okeechobee and the OUA service area; and WHEREAS, the State of Florida shares in this endeavor to work towards the elimination of septic tank collection of solid waste and wastewater, particularly near environmentally sensitive areas, such as Lake Okeechobee. NOW, THEREFORE, be it resolved before the City Council for the City of Okeechobee, Florida; presented at a duly advertised public meeting; and passed by majority vote of the City Council; and properly executed by the Mayor or designee, as Chief Presiding Officer for the City: SECTION 1: The City of Okeechobee, Florida herein offers its support for the efforts of the OUA to construct a system to extend solid waste and wastewater collection services into the service area which includes Taylor Creek adjacent to Lake Okeechobee. SECTION 2: That the environmental impact of septic tank collection of solid waste and wastewater adjacent to and virtually on the edge of Lake Okeechobee has the potential to contribute to a reduction in the quality of our lake waters and adjoining waterways, and it is an important issue that demands support not only locally, but on a State level as well. SECTION 3: That the City Council requests, and supports, that this project be included within the City and County legislative agenda for the 2018 State of Florida Legislative Session, for assistance from the State in bringing this project to fruition. SECTION 4: Conflict. All Resolution or parts of Resolutions in conflict herewith are hereby repealed. SECTION 5: Severability. If any section, subsection, sentence, clause, phrase or portion of this Resolution, or application hereof, is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion or provision and such holding shall not affect the validity of the remaining portions or applications here. SECTION 6: Effective Date. This Resolution shall take effect immediately upon its adoption. INTRODUCED AND ADOPTED in Regular Session this 14th day of November, 2017.
