Violation section 30-40(2)
That the property owner was required by court order to come into compliance with city
codes by August 26, 2005 and has failed to do so; that section 30-40-(2) in particular requires
that the property owner create lanes across the property every 100 feet at least 30 feet in width to
permit fire and emergency vehicles to have access into the property to fight fires, and confront
other emergencies; such lanes are not in existence; that there exists a substantial risk of serious
property damage and personal injury on the property due to the lack of access to the interior of
the property; this violation of code presents a serious threat to the health, safety, and welfare of
the city and its inhabitants.
As property owner is a repeat violator, this violation is to be immediately set before the
city of Okeechobee code board at its regular meeting of September 13, 2005 at the hour of 7:00
p.m., at which time the code enforcement officer will request:
1. That the violation presents a serious threat to the health safety and welfare of the city.
2. That the code board exercise its authority under F.S. 162.09(1) and notify the city
council of the violation, and to enter onto, and immediately make all necessary repairs to the
property required to bring the property into compliance with applicable city codes. The costs of
such repairs will be assessed to the landowner.

STATEMENT OF REPEAT VIOLATION AND NOTICE OF HEARING
Pursuant to Florida Statutes 162, & Chapter 18 Section 18-33 of the Code of Ordinances of the City of
Okeechobee, the undersigned Code Inspector, being first duly sworn, and with personal knowledge of the
facts, hereby alleges the existence of uncorrected repeat violations of the Code of Ordinances and gives
notice herein to the landowner or persons in possession, and hereby requests a public hearing before the
Code Enforcement Board, City of Okeechobee, to hear the following:
1. Violation of City Code Chapter/Section: Ch. 30 Sec. 30-40 (2) Junk
2. Location/address where violation exists: 1811 - 1905 S. PARROTT AVE.
3. Name and address of owner/person in charge of location where violation exists:

6. Date by which violation is to be corrected: 9/12/2005
Unless Respondent corrects the violation described herein by the date set forth above AND contacts the
undersigned Code Inspector at 863-357-1971 to verify compliance, NOTICE IS HEREBY GIVEN that the
alleged violation will be presented in the City Council Chambers, City Hall, 55 SE Third Avenue,
Okeechobee, Florida on the 13th day of September , 2005 , at 7:00 p.m.
If the violation is corrected and then recurs, the case shall be presented to the CODE ENFORCEMENT
BOARD even if the violation has been corrected prior to the BOARD hearing.
You have the right to obtain an attomey if you wish, and the BOARD will receive testimony and evidence
at said PUBLIC HEARING, shall make findings of fact as are supported by the evidence, and shall issue
appropriate orders as necessary to bring the alleged violation into compliance, including the payment of
a fine by the Respondent(s). It is your obligation to insure that an accurate record of the proceedings is
taken for an appeal.
