Presentation of a Proclamation to Mayor Kirk read the proclamation in its entirety as follows: Mr. Tom McGowan proclaiming the week of February 16-22, 1992 as Engineer's "WHEREAS, engineers help to design, construct, and maintain the Week - Mayor Kirk, infrastructure and facilities that contribute to a high quality of.life for all citizens of Florida; and WHEREAS, the future growth of Florida depends on engineers to execute innovative, creative, high -quality solutions to technical problems; and WHEREAS, the state purposes of the Florida Engineering Society are the advancement of the public welfare and the promotion off the professional, social, and economic interests of the engineering disciplines, and the stimulation to develop professional concepts among all engineers in proactive through education; and WHEREAS, current members of the Florida Engineering Society are interacting with schools at all levels of education to prepare future engineers to assure our economic leadership, our technical expertise, and our superior quality of life; and VES I NO X X X X X WHEREAS, it is appropriate that we recognize and honor the continuing contributions of our engineers with the motto: Engineers -- Turning ideas into reality. COLWCILMFMBFRS ACTION NOW THEREFORE, we, the City Council of Okeechobee, Florida, do hereby proclaim February 16 - 22, 1992, as "ENGINEERS' WEEK" in Okeechobee, and we urge all citizens to join us in paying tribute to the contributions of engineers to our society." Mr. Rick Creech accepted the proclamation and thanked the Mayor and Council. The Florida Engineering Society, the Treasure Coast Chapter, represents Okeechobee, Highlands, Martin and St. Lucie Counties. We basically provide several services in math counts which is middle school math competition among the four counties. Okeechobee, is representing two teams this year which takes place during the February Engineers Week. The other thing we do is sponsor scholarships on the State level. A young lady in Highlands County won a four year scholarship. We are currently working with Principal Raulerson to be able to talk to some of the physics and mathematics students on obtaining careers as engineers and just giving them a revelation as to what the universities and colleges are all about. I hope that I can live up to this proclamation, I think its a pretty high regard, but I believe that we are definitely going to try. And again I thank you for your time. Motion to adopt Resolution 92-2, Supporting the addition of State Road 70 to the Florida Intrastate Highway System - City Administrator (Exhibit 1). COUNCILMEMBERS ACTION Councilmember Collins made a motion to adopt Resolution No. 92-2, supporting the addition of State Road 70 to the Florida Intrastate Highway System; seconded by Councilmember Entry. Councilmember Watford expressed his concerns regarding... : the Florida Intrastate Highway System which is to be a highway network of Statewide limited access facilities and controlled access facilities...". We have enough problems with access to businesses, for example on Highway 441, are we going to make that worse for them now, or the Department of Transportation is, are we going to get into that situation here? Administrator Drago answered, no. What we are asking them to do is to support the current highway system they have and to improve that highway system by four-laning it and widen this in the City and it would get done. State Road 70 was part of the system and somehow somebody got it taken off and used a different route which would by-pass Okeechobee. A lot of the other counties like Highlands, Manatee, DeSoto, Pinellas are going to support this because State Road 70 goes through all those Counties so they want the road improved so that the public can use that road and therefore it would benefit the businesses in the Cities. Motion to adopt Resolution 92-3, delineating support for the Central Florida Regional Planning Council and urging the Florida Legislature to reinforce the role of the Regional Planning Councils in Florida - Councilmember Entry (Exhibit 2). 6. Motion to approve a contract between the City and CSX Transportation for repairs to the N.W. 9th Avenue Rail road Crossing in the amount of $16,000.00 - City Administrator (Exhibit 3). 27, 7 992 - RequtaA Meeting - COUNC7LMEMBERS ACTION Councilmember Entry made a motion to adopt Resolution No. 92-3, delineating support for the Central Florida Regional Planning Council and urging the Florida Legislature to reinforce the Role of the Regional Planning Councils in Florida; seconded by Councilmember Watford. Councilmember Watford commented that he thought the Regional Planning Councils do play a very vital role as far as local governments, it is a good step between the local and state governments. I think many times the legislature could use the Planning Councils in much better ways than they do, there are a lot of things they could do if the Legislature would allow them to. Councilmember Collins expressed he thought everything could be a lot more efficient if they (the Legislature) would listen to them (the Planning Councils) a little more. Resolution No. 92-3 reads by title only as follows: "A RESOLUTION DELINEATING SUPPORT FOR THE CENTRAL FLORIDA REGIONAL PLANNING COUNCIL AND URGING THE FLORIDA LEGISLATURE TO REINFORCE -THE ROLE OF REGIONAL PLANNING COUNCILS IN FLORIDA." Councilmember Watford made a motion to approve a contract between the City and CSX Transportation for repairs to the Northwest 9th Avenue Railroad Crossing in the amount of $16,000.00; seconded by Councilmembers Collins and Walker. Attorney Cook made a brief comment that in paragraph four, there is a legal question that he needs to clarify whether the Council we have today can bind, by contract a City Council fifteen years from now to bear the expense of re -doing that crossing which is what part of that paragraph indicates. Discuss a proposal from DOT for the purchase of City property at the corner of 441 and 70 - City Administrator (Exhibit 4). COUNCILMEMBERS ACTION Mayor Kirk asked Attorney Cook, whether the Council needed to amend this contract before they voted on it or can the language be worked out? Attorney Cook advised the language can be worked out and he did not think it was necessary for it to be in the motion. It is just not clear what their intent is. It is something I think I can "x" out and they will not object to it. Public Works Director Elders commented, just so it is not misunderstood later on, this is just for the repairing of the railroad tracks. The City is going to have to asphalt up to and in between the tracks, but it will still be considerably cheaper. Councilmember Watford, and this is a much better job than what we could ever hope for. Councilmember Entry made a motion to approve a proposal from the State of Florida Department of Transportation for the purchase of City property at the corner of 441 and 70 (Chamber property); seconded by Councilmember Watford (Purchase proposal amount: $12,500.00; Location: S.E. corner of 441 & 70 near Chamber property). Continued Administrator Drago then advised the approval of the Resolution regarding the sale of the property to the Florida Department of Transportation. 1 Councilmember Collins made a motion to approve Resolution No. 92-4 regarding the sale of City property to the State of Florida Department of Transportation for the purpose of transportation; seconded by Councilmember Entry. Attorney Cook advised that Council should make this subject to his confirming that this legal description matches the area and that it does not interfere with the use of the property. We do not want to be caught in a position with the trustees that the City is no longer using the property for what it was intended. Mayor Kirk asked the Attorney whether the motion should be amended subject to his request? Attorney Cook advised that if there is a problem he would let Mr. Drago know and they would get back to the Council before they sent it off to the Department of Transportation. 8. Discuss Water and Wastewater Rate Discussion began with Councilmember Watford stating that the Study - City.Administrator (Exhibit 5). majority of the rates will stay basically the same with the exception of the volume rate for the water and then the wastewater connection and capacity fees that are being lowered. It is evident that we would have to change rates particularly the debt service rate as we borrow more money for the improvements to the water system. I do not see us changing the rates now and then six or eight months down the road changing them again when there is no major changes to be made. I think to alleviate the problem with the wastewater connection and capacity fees, that maybe we just want to continue that roll -back until we have to change rates again. In my opinion there are not enough material changes to make. F. NEW BUSINESS 8. Continued . . . Januany 21, 7992 - Re '_an Meeting - Page 8 o6 16 LOUNCILMBMBERS ACTION Mayor Kirk asked, are you saying do not let it sunset? ( the wastewater connection and capacity fees). Councilmember Watford stated, do not let it sunset otherwise it would go back to the $1500.00 and I think obviously the study said we did not have to do that right now. Councilmember Collins, agreed with what Mr. Watford said about the wastewater because Council discussed that before and if the $765.00 is a fair price I could not see going back to the $1500.00 just because the 28th got here. He asked if this pertained to the water deposits too and are you talking about just leaving them like they are today? Councilmember Watford, yes, that is my suggestion. Councilmember Collins stated, I have a problem with the water deposits because they are too high. If we change anything I would like to see us take his (the consultant's) recommendation. Change the deposits to two and a half months until something comes up later on. But everybody knows the deposits are way out of line, especially on the water side, if they just have water. If we are going to keep everything like it is I wish we would keep everything like it is except the deposits and take his (consultants study) recommendation on the deposits. Councilmember Watford, I do not have any particular problem with that, I would prefer just to wait and we could do deposits and the rates at the same time, I am not going to object to it I just think it would be better to wait to do it. Councilmember Collins how long of a time are we talking about? Director Loftin stated he thought eight months would be reasonable. Within eight months we should have enough design work done that we could project the cost of the wastewater treatment plant expansion. VOTE VES I NO Januau 2 i , 1992 - Reau&n Meetino - VOTE F. NEW BUSINESS 8. Continued . . . . COUNCILMEMBERS ACTION Councilmember Collins stated, what I had in mind was, you got six, eight, nine months left before your can do what you need to do and that means the City is using that money above and beyond what they need for the normal deposits. Times are hard and people need their money and the city is paying no interest on that money and with the economy like it is there are people out there who could use that forty, fifty, sixty dollars, that would pay a lot of their water bills for three months. Councilmember Watford, we would not anticipate refunding differences would we? Administrator Drago and Director Loftin, No. Councilmember Collins-, I would, we have got a ninety dollar deposit up here and they got a thirty dollar two and a half months bill you would not anticipate refunding that difference between that thirty-five and ninety? There would be no point in changing them if we are not going to refund, if we are going to keep their money why notjust leave it like it is? Director Loftin, I believe the recommendation that Mr. Gonot made was based on us not refunding deposits when it goes down. Councilmember Collins, how can we justify that? If our bill is thirty-five for two and a half months and they have a ninety- five dollar deposit up how can we justify keeping that sixty- five dollars? Councilmember Watford, we do not automatically go back and we have put a procedure in place were someone is delinquent on their bill they have to upgrade to the current deposit but we have not automatically gone back, some people have five dollar deposits we have not gone back and told them just cause we are changing deposit you got to upgrade your deposit and we did'put the policy in place that if they were late on their bill a certain amount of times then they have to upgrade it to whatever the current deposit is whether its thirty-five or ninety-five. We don't go back and make everybody upgrade so I don't see why it should work in reverse. We are going to create an administrative nightmare. YES t NO F. NEW BUSINESS 8. Continued . . . . lt!z" C'v Januaky 27, 1992 - Regutan Meeting - LOUNCILMrMBE"RS ACTION After further discussion by Council and staff; Mayor Kirk asked where do we stand here? I do not think we are in agreement. Councilmember Watford, I think we agree not to change rates until we have to. Councilmember Collins, we agreed to leave the wastewater connection and capacity fee at seven sixty-five. Councilmember Watford, right, so we have agreed on that much, its the deposits that are the stickler. I will agree as much as changing them but I will not agree to refund any of them. Councilmember Collins, I would agree to change them and I would agree to give anybody'a refund that has got anything paid above and beyond the two and a half months. Councilmember Watford made a motion that we leave all the rates that are currently in effect in effect; that we continue the roll -back rate on the wastewater connection and capacity fees; and that we change the deposit amounts. We can argue about how we are going to change them (at a later date); seconded by Councilmember Entry. Councilmember Collins asked, has everybody agreed on the two and a half months for the deposits? It is just the refund that we do not agree on? Mayor Kirk commented, I do not think we are going to get it settled tonight, Director Loftin can give us some information at the next meeting what we are looking at dollar wise. Director Loftin asked in terms of producing refunds? Mayor Kirk inform Director Loftin that he needed to give Council some insight as to what is involved if we tried to refund. Councilmember Collins asked, couldn't we go on with what Dowling said tonight and we could agree about the refund two weeks from now and just implement what we need to do to take care of the roll -back rate and change it to two and a half months for deposits. VOTE VES i NO F. NEW BUSINESS 8. Continued . . . . 9. Discuss implementation of the Water Distribution Master Plan - Director of Public Utilities (Exhibit 6). Januany 21, 1992 - Regu�an Meeting - Page 11 o6 16 COUNCILMEMSERS ACTION Mayor Kirk, yes, that is what his motion states. Administrator Drago questioned for clarification, as recommended by the consultant, right? The deposit schedule as recommended by the consultant? Council commented in agreement. Councilmember Watford stated, we are not actually adopting that amount tonight, technically we could come back in two weeks and say we want it to be "two -hundred dollars". We are accepting the idea. Mayor Kirk, that is correct. Vote on motion is as follows: KIRK COLLINS ENTRY WALKER WATFORD MOTION CARRIED. Director Loftin stated to Council, gentlemen you have before you a memo from myself and a letter from Engineer Bill Reese. I will repeat a couple of items. The water distribution system master plan produced in September 1991 clearly identifies problem areas in our distribution system. For several reasons I feel that we should proceed as quickly as possible to implement the work that is outlined in the master plan. I will repeat two of the reasons that are in the memo: One is, these problems are clearly identified and they are well known by ourselves and by our customers. The second reason is, due to the current slow down of the economy if we move quickly, take bids and get this work done we can get this work done at less cost to the City than if we were to space this work out over several years. The economy is slow, contractors need work and frankly will bid very, very competitively, if we do this reasonably quick. VOTE YES I W X X X X X i y F. For these reasons my recommendation is that the City move quickly to implement the improvements outlined in the master plan. If the Council concurs with this recommendation, the Department will move forward with the planning and design work to implement that plan. Engineer Reese is here tonight, he wanted to expound a little bit on some of these things. Engineer Reese stated if the City plans to implement all the master plan he would recommend separating the plant project into two contracts. One would cover on -site plant work including the wells and the other would include all off -site distribution piping his reasons being: One, there is a large amount of distribution work that ties in with the master plan. "wo, is the City has gotten some letters in the last :north or so from the Department of Environmental Regulation and they have some concern regarding the quality of the water through the distribution system. They ask that you do certain things. And the final reason is work to be done on the elevated tanks. It seems work was bid out and I think the number was a couple of hundred thousand dollars. Basically the improvements in the master plan provide you the option to do away with the tanks. You do need to make a decision on this either to repair the tanks or move forward to another direction. Councilmember Collins stated, I do not see were that is a big decision (repairs to the storage tanks) to make, if we can get the storage capacity out there as opposed to keeping this, cheaper than we can paint this, and you have to go back and. paint every six to eight years, and that is ground level out there. I do not see were that is a big decision to make. Councilmember Watford, I think the cheaper part needs to be explained a little bit. We are going to spend more here than we would spend there. I understand we could put a storage tank out there cheaper than we could paint this tank. But, what he is talking about, we have got to do some of the improvements also, we are probably going to end up spending more here than we would VOTE VES f NO Januaky 21, 1992 - Regu&A Meeting - Page 13 o{ 16 VOTE COUNCHMBMBBRS ACTION �YBS F. NEW BUSINESS I 9. Continued . . . Engineer Reese, you are both right, it is not an apples to apples thing. The improvements we are discussing here are necessary for the distribution system whether you keep the tank or not. The point is, if you do these you also will get to do away with both tanks, or you have that option. Director Loftin, we do not have the option of doing or not doing the work. We have the option of doing the work within the next year or two or trying to space it out over a period of four or five years. If we space it out over a period of four or five years we may have to paint this tank at a cost of $200,000.00 plus, if we space it out over three or four years we will be paying more for work three or four years from now than we will if we bid it out during an economic down turn. The option is do it all in the package or space it out, and my recommendation is we do it all in a package. Alayor Kirk, do you have in your notes there a total dollar figure for this package? Director Loftin, that was outlined in the master plan. Administrator Drago, something like $1.2 million, you have to take out the work that is being done under the block grant. Engineer Reese, I should also mention we are talking to some people about a grant that would clean some lines. Director ?�oftin, the total amount of that grant is $100,000.00, however we have to supply half of the funds $50,000.00 either by actual or in -kind, for a net gain to the City of $50,000.00. Administrator Drago explained to those present this was the grant that Susan Groover brought to the Councils attention when she asked for $2,900.00 for an energy study and the grant is predicated on the Council going forward with their recommendations which is basically to clean a lot of lines. There is money in the budget to cover the $50,000.00 cost. January 27, 7992 - Regutan Meeting - Page 74 o� 16 VOTE F. NEW BUSINESS 9. Continued . . . . LOUNCILMFMBFRS ACTION The other improvement item to take into consideration is that Engineer Reese indicated to me that sometime in June he is going to have the plans and specifications prepared for the water plant, the City would need a sixty day window to secure the sale of the bonds which means I am going to have to start that in April and I probably contemplate some type of engineers report to be included with the bond package. If the Council says go ahead and implement as much as you can in this master plan then Engineer Reese can figure that portion into the engineering report when we go out for the sale of the bonds. The City has historically borrowed $5 million at a time so if you use that figure as a barometer, the water plant plus the master plan items would definitely cover the $5 million very nicely. And the work needs to be done, the faster you get it done then the faster the system 'is put into what the Department of Environmental Regulation considers compliance and then you do not 'lave hassles with the Department of Environmental Regulation. I think if you try to piece -meal it, historically I do not think you will be able to do it because of the cost. Director Loftin added if we piece -meal it then the last twenty percent of it will probably cost as much as the first eighty percent of it. Administrator Drago, what we need is some formal direction to authorize the staff to proceed with implementation of the master plan incorporated with what Engineer Reese is saying, separate plans and specifications for the water plant, separate set of plans and specifications for the distribution system. Mayor Kirk, I would assume from the complaints that we are getting and the problems we are having that we need to do this (proceed with the implementation of the master plant). The only thing is the dollar amounts. Councilmember Watford, somewhere in the process will somebody be able to look at this and tell us in a simpler way for us to understand these millions of dollars, is somebody going to look at it and say okay when we spend this $3 million and this $1.2 million and when we get through, whatever year it is going to be, this is basically what our rates are going to be? Our Debt Service is going to be approximately this and our water rate wL1_ probably be approximately? Continued . . . . %OUNCILMEMBBRS ACTION Administrator Drago commented that part of the bond documentation would be to show the investors what the present system looks like financially and where the rates need to be in the future to meet the financial obligation of the new issue I would assume that you would be looking at an increase in the connection and capacity fees not necessarily an increase in the water rates as long as the system operates efficiently and meets its obligation. I do not see a need and I think the consultant pretty well pointed that out in his several reports saying that you do not need a volume metric rate increase for quite a while. We are still going to try and structure the bond deal so that the debt service does not kick in until two years down the road. By then the water plant should be on line and allow us to hook up some new customers with the volume and blend the debt service in. To answer your- question, yes. The same scenario will happen when the Council goes to address the wastewater plant, you will have to run the same numbers. Mayor Kirk, do we have this money already set aside or is this going to be in the bond. Administrator Drago answered yes, it is going to be in the bond, we are going to tell the bond holders that "x" number of dollars is. for the water plant and "x" number of dollars is for the distribution system so they know where the money is being spent. Councilmember Watford made a motion to instruct the Public Utilities Department to implement the corrections as outlined in the master plan in conjunction with the ground water treatment plant; seconded by Councilmember Entry. Following lengthy discussion, Councilmember Walker commented that he thought we have a good master plan, its just like Dowling brought up, as long as we are technically covered to continue on with the same engineer and we are not abusing the competitive negotiations act in any way. Attorney Cook, I am told that this engineering work for the distribution system was included in previous requests for proposals that we have obtained other engineers beside Reese and we selected him to proceed. Councilmember Watford stated he wanted to express that he found it extremely interesting that when the Saturday meeting that was hosted by the Business Council was over his understanding was that the County, the City and Okeechobee Beach Water Association were all going to try to work together, let each other know what each one was doing. I am sure they advertised it, however, I did not see an advertisement for it.
