As you recall the property was found to be in violation of Ch 30 Sec. 30 -44 General cleaning by the Code Enforcement Board on June 10, 2008. They imposed a fine of $25.00 per day which began on June 30, 2008. Since the fine has been accruing for several months, the City Council has recommended foreclosure on the property. Davis Code Enforcement lien Dear Mr. Underhill: It has come to our attention at the City that you purchased the Arthur Davis lots in the Northwest Addition, on March 17, 2010. We are advising that these lots were cited by the city code enforcement board, and liens filed against the lots in the public record on July 25, 2008, which can be found at OR book 657, Page 840, and OR Book 679 Page 966. I imagine that no title search was done for this purchase; however, Mr. Davis was notified by the city on many occasions of the code violations, and was well aware of the liens when he sold the property to you. The lien operates much like a mortgage; the debt is against the land itself, and continues to be a debt even if ownership changes hands. This lien will remain against the property until the liens are paid. From the date of filing to the date of your purchase, the amount owed to satisfy the liens is a total of $ 20,175.00. If you are unable to resolve this with Mr. Davis, there are other means available to possibly reduce the liens to a lower amount, so if you have any questions please contact me at 467 -0297.
