Mayor Kirk moved item number fourteen to item number three and stated he would have to leave at 7:30 p.m. due to a conflict with another meeting that required his presence at the school and that he would pass the gavel to Councilmember E. NEW BUSINESS Watford, at that time. 1. Issue Proclamation for National Radio Month - Mayor Kirk. III Mayor Kirk read Proclamation No. 95-P-1 in its entirety as follows: "WHEREAS, radio broadcasting is an essential service in creating public awareness to constantly changing situations in community, state, nation and the world, and WHEREAS, radio advertising stimulates commerce which helps to maintain a stable economy, and WHEREAS, our radio stations consistently offer facilities for furthering civic projects that benefit all, and WHEREAS, radio broadcasters stand in constant readiness to give selfless aid in times of crisis, and WHEREAS, the radio broadcasting industry has endeavored to provide all listeners with programs designed to inform, educate, and entertain, now THEREFORE, I James E. Kirk, Mayor, by the authority vested in my by the people of Okeechobee, proclaim that January be observed as NATIONAL RADIO MONTH and call upon all people to note the record of achievements of the radio broadcasting industry, its personnel and the theme RADIO - THE SOUND OF YOUR LIFE" He then presented the proclamation to Jeff "Hollywood" Gunston, Disc Jockey for WOKC who thanked the Council for their continuing support of the local radio station. 2. Discuss the Insurance Bids - City Administrator (Exhibit 1). Administrator Drago explained the City received bids for general liability and property insurance. The companies submitting the bids did not return their proposal on the supplied list that would allow city staff to compare each bid on the same scale. Mr. Steve Patton of Poe and Brown was asked by Administrator Drago to review and evaluate the bids and give the Council a recommendation. 0 JANUARY 17, 1995 - REGULAR MEETING - PAGE 3 OF 10 E. Insurance bids continued: Mr. Patton discussed with Council at length the three bids: Florida League of Cities, Inc. did not submitt a proposal for the general liability insurance; Titan Indemnity Company represented by the Leonard Berger Insurance Agency, (who is the City's current provider), submitted a price of $178,788.00; And, Public Risk Management of Florida represented by John R. Smith Insurance Inc., a 'pool" type provider, submitted a price of $159,239, this is a contract for two years and the price for the second year is not given. Councilmember O'Connor moved to approve the proposal of Titan Indemnity Company; seconded by Councilmember Chandler. Councilm embers Oliver and Watford expressed their concerns that last year the council renewed the contract with Titan the night it expired and Council had given specific directions that that situation not happen again. A decision has to be made tonight, like last year, because the policy expires February 1, 1995 and Council does not meet again until February 7th. Councilmember O'Connor called the question. Consider appointments to the Utility Authority Board - Mayor Ill Before leaving, Mayor Kirk gave his two names for the Utility Authority Board - Jimmy Kirk. uu Minehan and Danny Entry. Councilmember Watford asked for all other Councilmembers to submit their names. Councilmember Oliver submitted Jimmy Minehan and Steve Nelson. Councilmember O'Connor submitted Jimmy Minehan and Tom Elmore. Councilmember Chandler submitted Jimmy Minehan and Nick Collins. Councilmember Watford submitted Jimmy Minehan and Monica Clark. Councilmember Oliver moved to appoint Jimmy Minehan as the two year member to the Utility Authority; seconded by Counciimember O'Connor. KIRK CHANDLER O'CONNOR OLIVER WATFORD MOTION CARRIED. Councilmember Oliver moved to appoint Steve Nelson as the four year member to the Utility Authority Board; seconded by Councilmember Chandler. KIRK CHANDLER O'CONNOR OLIVER WATFORD MOTION CARRIED. Motion to approve a taxi renewal permit to A-1 Taxi and All Councilmember O'Connor moved to approve a taxi renewal permit to A-1 Taxi and All County Taxi Corp. - City Administrator (Exhibit 2). 111 County Taxi Corp; seconded by Councilmember Oliver. Motion to appoint Jim Palmore to the Code Enforcement III Councilmember O'Connor moved to appoint Jim Palmore to the Code Enforcement Board - City Administrator (Exhibit 3). Attorney Cook read proposed Resolution No. 95-2 by title only as follows: A RESOLUTION OF THE CITY OF OKEECHOBEE, FLORIDA SUPPORTING HOSPICE OF OKEECHOBEE IN ITS ATTEMPT TO OBTAIN A GRANT FUNDED THROUGH THE COMMUNITY SERVICES BLOCK GRANT, FEDERAL FISCAL YEAR 1995." Motion to approve the 1995 Grievance Committee - City Councilmember Chandler moved to approve the 1995 Grievance Committee Members: Clerk (Exhibit 5). Motion to appoint Kevin Rogers as a new water plant Councilmember O'Connor moved to appoint Kevin Rogers as a new water plant operator - Director of Public Utilities. operator; seconded by Councilmember Oliver. Motion to approve a partial pay request to CenState Councilmember Oliver moved to approve a partial pay request to CenState Contractors Contractors in the amount of $120,788.73 - Director of Public in the amount of one hundred twenty thousand, seven hundred eighty-eight dollars, Utilities (Exhibit 7). seventy-three cents ($120,788.73); seconded by Councilmember Chandler. Seventy thousand, three hundred fifty-seven dollars, twenty-three cents ($70,357.23) is for pay request number ten as recommended by Engineer Jensen of Reese, Macon & Associates for water distribution system improvements; and for pay request number one in the amount of fifty thousand, four hundred thirty-one dollars fifty cents ($50,431.50) as recommended by Engineer Willard of Knepper & Willard for Northeast 6th Avenue, Southeast 7th Street and Big Lake National Bank Lift Stations. Following discussion, Attorney Cook advised that the pay request could be voted on by motion as stated, however, in the future he suggested pay requests be separated into two motions especially when it is dealing with two different contracts such as this. Motion to approve an engineering services contract to Councilmember O'Connor moved to approve an engineering services contract to Reese, Reese, Macon & Associates in the amount of $58,000 - Macon & Associates in the amount of fifty-eight thousand dollars ($58,000.00) for the Director of Public Utilities (Exhibit 7). water system improvements for the downtown revitalization project; seconded by Councilmember Oliver. These improvements will be done in connection with the Downtown Commercial Grant (CDBG) but the monies to pay for these services will not come from the grant money. Motion to approve an engineering contract to Lawson, Noble Councilmember O'Connor moved to approve an engineering contract to Lawson, Noble & Associates in the amount of $19,950 - Director of Public & Associates in the amount of nineteen thousand, nine hundred fifty dollars Works (Exhibit 9). ($19,950.00) for 1994/95 sidewalk improvements; seconded by Councilmember Chandler. The following are the sidewalks that will be installed: Southwest 3rd Avenue (from South City Limits to Southwest 15th Street; Southwest 5th Avenue (from Southwest 21 st Street to Southwest 15th Street; Southwest 21 st Street (from Southwest 7th Avenue to Highway 441 South. Motion to approve a final pay request to Better Roads in the Councilmember Oliver moved to approve final pay request number six to Better Roads amount of $18,956.12 - Director of Public Works (Exhibit 10). in the amount of eighteen thousand, nine hundred fifty-six dollars, twelve cents ($18,956.12) for the 1994 Road Improvements as recommended by Engineer Kafer of Lawson, Noble and Associates; seconded by Councilmember Chandler. Discuss the Okeechobee Legislative Delegation Meeting - Councilmember O'Connor explained that he attended the last County commission Councilmembers O'Connor and Watford. meeting and they were getting together their requests for the Legislative Delegation to be held February 2, 1995 and he suggested the City bring up the non -supportive mandates and State Road 70 improvements. Should any others items need to be brought up, Councilmembers should get with Administrator Drago and tell him. He is to prepare a packet for Councilmember Watford to present on behalf of the City. Also Administrator Drago is to get with County Administrator Long and any items that the City is listing and the County is listing, the City would not list but support the County's list. Council also discussed the public hearing for State Road 70 West improvement project and appointed Councilmember O'Connor to attend and express at the hearing the City's concerns. A written statement is already on record. Because of the complexity of the bids, I asked Mr. S eve Patton from Poe and Brown to evaluate the bids and make a recommendation to the City. Mr. Patton is in the process of preparing his recommendation, but as of thi writing has not finished. I expect to receive his recommendation on Monday I will forward a copy of his letter to you. Mr. Patton will be at the Council meets g on Tuesday. Prior to reviewing said proposals let me state that the bid specifications were pertinent and specific and allowed the bidders an opportunity to execute a Z,,ontract with the city. The three bids reviewed, Florida League of Cities Inc, Titan Indemnity Co., represented by the Leonard Berger Insurance Agency, and Public Tusk Management of Florida, represented by the John R. Smith Insurance Inc., and Vie Arthur J. Gallagher & Co. While all proposed insurance coverages, the vehicles usCAl to provide the coverages vary in their degree of delivery. Florida League of Cities, Inc. The proposer offered all coverages with the exception of general liability. It would be my suggestion to not separate this important coverage from a property carrier. Titan IndgMniLy Co. The proposer offered all property and general liability coverages with the above mentioned carrier and workers compensation coverage true GRrI. It should be noted that these are your current carriers of insurance coverages and an offering renewal coverages reflecting good relationships and loss ratios for the 1 -95 insurance year. My primary concern with Titan III demnity Co is the financial strength, as it is rated A -VI according to Best Guide, art insurance rating service. Mr. Yarborough informed me of various counties, cities, and municipalities insured by Titan and just recently to include Walt Disney World Corp. Please see attached list. ublic Risk Management: In my review, I took the liberty to contact Mr. Paul Erickson, tf, e senior Account Executive representing Public Risk Management true the insuran a broker Arthur J. Gallagher & Co. Mr. Erickson was quite informed on The Publ a Risk Management Pool and his proposal was professional and comprehensive provi Jing coverages equal or greater per the insurance specifications. As per Titan Indemn ty my primary concern was the financial strength of the organizations pproviding coverages and was advised that Lloyds of London and CIGNA Insurance Companie were the providers of excess coverage above the self insured retention of the members Df the Public Risk Management Pool. While the said bid specifications required " " rated carriers it must be noted that the Lloyyd's of London syndicates are not rated, an the CIGNA Insurance Company in the last 30 days the rating has dropped to B+, again true the Best Guide, an insurance rating service. Mr Drago, while the two remaining bids provided coverages and limits required per the City of Okeechobee bid specifications, I would ask the city council to consider to remain with the current carrier verses changing to a pooled type coverage, subjecting the city to a two year commitment per the contractual arrangement between the city and Public Risk Management of Florida. Mr. Drago time does not permit an indepth review of all pertin information in regards to a true comparison of an insurance company verses an surance pool and the ramification of either selection. You and your staff have a busi s relationship with the current carrier and if satisfied with all elements from billing, ngineering, claims monitoring, loss control, I would state that retaining the current rovider for 1995-96 insurance year would not be an inappropriate selection. In addition, we understand that the water system in this a ea will also be upgraded as a part of this Project. We will work with the City's water consultant in the preparation of the construction documents. The compensation for this work shall be a lump sum fee of $32,800, excluding on -site project representative services. Should the City require an on -site representative during the construction period, we would be Mf ased to provide this service for a lump sum fee of $19,300. This fee is based upon a construction contract time of 180 days. Cur project representative will be on - site during periods when the contractor is undertaking significant work, which in our prof sional opinion, requires observation and reporting to the City. However, It is anticipated that there will be times during which it will not be necessary for our representative to be on site. This would be during times of mobilization, de -mobilization, clean-up, etc. Should waterline and gravity main work be performed concurrently, it may be more efficient and less costly for the City to provide one on -site representative for the entire Project. Any variance above these amounts will require yout prior authorization. Invoices for work accomplished, including reimbursable expenses, will be submitted and payable monthly. The work will include the following: 1. Obtain aerial survey within the construction limits, which will include ground survey work to set the aerial targets. This work may be performed once for both the water and sewer portion of the Project and Included herein. 2. Field verify existing utilities within the area of construction. 3. Prepare plans and specifications suitable for bidding the Project, which includes gravity sewer main, manholes, services, grease traps and a lift station at the site of the elevated water tank, whkh shall be demolished prior to this job being bid. 3030 N.
