Motion to approve Harold Mounts as a regular Wastewater Plant Supervisor - Director of Public Utilities. Councilmember O'Connor moved to adopt (proposed) Ordinance No. 677; seconded by Councilmember Watford. Mayor Kirk asked if there'were any questions or comments from the public. There were none. Councilmember Watford asked, these applications were divided up into "errors" and "non -errors," those that are non -errors, have they paid the five hundred dollar deposit? Administrator Drago answered that they have paid, and Watford, Inc. would get back five hundred dollars since one of his applications was not considered an error. Councilmember Watford expressed appreciation to the City Attorney and Deputy Clerk for the good job done on the Cycle II-1994 Amendments. KIRK ENTRY O'CONNOR WALKER WATFORD MOTION CARRIED. Mayor Kirk closed the public hearing at 7:09 p.m. Councilmember O'Connor moved to approve Harold Mounts as a regular Wastewater Plant Supervisor; seconded by Councilmember Entry. Motion to approve Resolution 94-20 - City Administrator III Councilmember Watford moved to adopt (proposed) Resolution No. 94-20 (increasing (Exhibit 2). the garbage collection rates); seconded by Councilmember O'Connor. This is due to the increase in tipping fees at the landfill. Councilmember Watford asked if all required documents were filed for this increase and we are sure there will be an increase in the tipping fees? Administrator Drago responded yes. Motion to approve Resolution 94-21 - City Administrator Councilmember Watford moved to adopt (proposed) Resolution No. 94-21 (amending (Exhibit 3). Resolution No. 89-5 "Backflow Prevention Devices"); seconded by Councilmem bers Walker and Entry. Council discussed the proposed resolution at length. Councilmember Watford moved to amend proposed Resolution No. 94-21 deleting the annual testing and maintenance fees; seconded by Councilmember O'Connor. Motion to approve a partial pay request to CenState Councilmember Watford moved to approve partial pay request number nine to CenState Contractors in the amount of $58,944.01 - Director of Public Contractors, Inc. for fifty-eight thousand, nine hundred forty-four dollars, one cent Utilities (Exhibit 4). Motion to award a lawn maintenance contract to Hawks Councilmember Entry moved to award a lawn maintenance contract to Hawks Lawn Lawn Service in the amount of $11,050.00 - Director of Service in the amount of eleven thousand, fifty dollars ($11,050.00) (Ground Water Public Utilities (Exhibit 6). Treatment Plant Site 3, inside fence and Wastewater Treatment Plant Site 2, grooming area); seconded by Councilmember Watford. KIRK ENTRY O'CONNOR WALKER WATFORD MOTION CARRIED. 7. Motion to award a lawn maintenance contract to M & M Councilmember Watford moved to award a lawn maintenance contract to M & M Service in the amount of $17,415.00 - Director of Public Service in the amount of seventeen thousand, four hundred fifteen dollars ($17,415.00) Utilities (Exhibit 6). (for Surface Water Treatment Plant Site 1, inside fence and Wastewater Treatment Plant Site 1, lagoon berms and both sides of road); seconded by Councilmember Entry. Discuss a Worker Compensation Claim - City Attorney Attorney Cook explained that the City was contacted by the Attorney hired by the City's (Exhibit 7). workman's compensation firm for the case against the City by Jack Adams. There is a settlement sitting on the judges desk, she is recommending in the best interest of all parities that it be approved. Attorney Cook stated he also recommended the Council 11 agree to the settlement of sixty-four thousand dollars ($64,000.00) Following a brief discussion, Councilmember Watford moved that the City accept the Attorney's involved recommendation to settle the Workman's Compensation Claim with Jack Adams as per their recommendation: seconded by Councilmember O'Connor. Consider an amendment to the Franchise Agreement with Councilmember Watford moved to approve the amendment to the L.P. Franchise L.P. Sanitation - City Administrator (Exhibit 8). 11 Agreement, Section 29. Annual Review changing the dates (from May 1 and June 30 to November 1 and December 31); seconded by Councilmember Walker. Discuss the dismantling of the 250,000 gallon water tank - Councilmember Entry moved to accept Pittsburgh Tank and Tower's bid to pay the City City Administrator (Exhibit 9). III seven thousand, eight hundred eighty-eight dollars ($7,888.00) to remove the -water tower; seconded by Councilmembers Walker and O'Connor. Councilmember Watford asked Engineer Reese if in his professional opinion the City does not need the tower and that there would be no problem with fire protection or pressure and that nothing out of the ordinary would happen with quantity and quality of the water? Engineer Reese responded that the tower has been valved off since the ground water treatment plant has been on line and he did not see any problems with fire flows, pressure, quantity or quality of the water. Item was withdrawn from agenda. Mayor Kirk stated the City needed to give direction to the Department of Transportation concerning the widening of State Road 70 West. Following discussion between Council, Staff, citizens Marvin Wherrel Sr. and Allen Lewis, Council agreed upon Alternate 2 (which would change the flow of traffic on North Park Street to be 1-way for West bound traffic this 1-way would start at S.W. 8th Avenue and end at 12th Avenue East bound traffic will be 1-way on South Park Street starting at 12th Avenue and ending at 8th Avenue). An amendment was made for an opening (exit) onto South Park Street (in order to allow traffic heading East to continue on South Park after 8th Avenue). _ Council also asked that a second request be sent for a traffic light to be installed at 70 and 9th Avenue If they turn down the request again Council wants to ask for a left turning lane on 70. There being no further items on the agenda, Mayor Kirk adjourned the meeting at 8:25 P.M. James E. T F be divided between The road will have a direct effect on eight businesses and one home on the south side of State Road 70. It will put four businesses out of business and destroy one home. The road will have a direct effect on eleven businesses on the north side Cf State Road 70(North Park Street). It will affect seven more businesses, one home, and one un ccupied house. When a minimum of 18 feet is taken off each side of the aforementioned property on State Road 70, the property is destroyed. A 150=foot lot less 18 feet or more does not leave enough room for a business. Today the cost of property prohibits mom-and-pop businesses. It would be better to take all the right -of --way from one side if you do not use North and South Park Streets for State Road 70 West. By using North and South Park Streets, it would substantially save taxpayers' dollars. I would lose all of Block 198 when the divided highway everybody else's property. The small amount of property that ouldbbe n ded fr ut itwould save destroying Western Wear and behind the home would be minimal. om behind Eli's At the city limits, I would lose more property. It is the first 414-foot road ontage on the south side of State Road 70. This property is deep enough that it would not dent 7oy the property.
