Motion to read by title only Ordinance 672 - City Attorney Councilmember Watford moved to read by title only, (proposed) Ordinance No. 672 (closing the alley partially in Government Lot 4 of the First Addition to City of Okeechobee and partially in Block B of Central Park for Hospice, Application No. 44); seconded by Councilmembers Entry and Walker. Attorney Cook read proposed Ordinance No. 672 by title only as follows: "AN ORDINANCE CLOSING, VACATING AND ABANDONING THE ALLEY AS RECORDED IN PLAT BOOK 2, PAGE 39 AND PLAT BOOK 1, PAGE 11, PUBLIC RECORDS, OKEECHOBEE COUNTY, FLORIDA, DESCRIBED AS THAT ALLEY LYING PARTIALLY IN BLOCK B CENTRAL PARK AND PARTIALLY IN GOVERNMENT LOT 4, FIRST ADDITION TO THE CITY OF OKEECHOBEE; ALL LOCATED WITHIN THE CITY OF OKEECHOBEE, AND DIRECTING THE CITY CLERK TO RECORD THE ORDINANCE IN THE PUBLIC RECORDS OF THE CLERK OF THE CIRCUIT COURT IN AND FOR OKEECHOBEE COUNTY, FLORIDA; PROVIDING AN EFFECTIVE DATE." b. Councilmember Watford commented that this was a unique alley closing, there being one property owner, no easements are needed and this is the Hospice project, he would not have a problem with the closing. 1. d. CLOSE PUBLIC HEARING 111 Mayor Kirk closed the public hearing at 7:08 p.m. F. NEW BUSINESS 1. Motion to appoint Nina Borenstein as a new executive Councilmember Walker moved to appoint Nina Borenstein as a new executive secretary - City Administrator. I secretary; seconded by Councilmember O'Connor. KIRK ENTRY O'CONNOR WALKER WATFORD MOTION CARRIED. 2. Motion to approve a partial pay request to Trio Development Councilmember Watford moved to approve partial pay request to Trio Development Corp. in the amount of $13,050.00 - Director of Public Corp. in the amount of thirteen thousand, fifty dollars ($13,050.00) (for the raw water Utilities (E-2). pump station rehabilitation as recommended by Engineer Tom Jensen of RMA); seconded by Councilmember Entry. Motion to approve a partial pay request to Trio Development Vote on motion to approve pay request number two is as follows: Corp. in the amount of $13,050.00 continued: KIRK ENTRY O'CONNOR WALKER WATFORD MOTION CARRIED. 3. Motion to approve a partial pay request in the amount of Councilmember Entry moved to approve partial pay request number one in the amount $65,745.00 and change order #1 in the amount of $8,803.25 of sixty-five thousand, seven hundred forty-five dollars ($65,745.00) and change order to Kimmins Contracting Co. - Director of Public Utilities (E-3). number one in the amount of eight thousand, eight hundred three dollars, twenty-five cents ($8,803.25) to Kimmins Contracting Company (for the demolition of the old wastewater treatment plant as recommended by Engineer Willard of K & W); seconded by Councilmember O'Connor. Following brief discussion, Mayor Kirk instructed Public Utilities Director Jones to research the amount the City has paid in the past for change orders, and in the future have the percentage amount spelled out in the contract, Council believes the amount should be ten percent; Kimmins change order is for fifteen percent. Motion to approve a partial pay request to Butler Construc- Councilmember O'Connor moved to approve a final partial pay request to Butler tion Company in the amount of $96,699.27 - Director of Construction Company in the amount of ninety-six thousand, six hundred ninety-nine Public Utilities (E-4). dollars, twenty-seven cents ($96,699.27) (for the Ground Water Treatment Plant Phase I as recommended by Engineer Reese of RMA); seconded by Councilmember Entry. Motion to approve a partial pay request to Butler Construc- Following brief discussion between the Council and staff, Attorney Cook explained tion Company in the amount of $96,699.27 continued: releases from Windenmueller Electric and Ringhaver Power have not been obtained. City Staff met with Butler Construction on the matter concerning the sub -contractors and decided to hold the monies until the situation between contractor and sub -contractor is resolved. Motion to approve an interlocal agreement between the City Councilmember O'Connor moved to approve an interlocal agreement between the City and the County for recycling - City Administrator (E-5). III and the County for recycling; seconded by Councilmember Walker. Council received a "new" (Exhibit 5) revised interlocal agreement, which is the one they are adopting. Administrator Drago explained the differences between the two. The one being adopted is exactly like the interlocal adopted with the County two years ago. He also thanked Mark Baggott from the Recycling Facility for all his help in making sure the City adopted the same interlocal as adopted before. KIRK ENTRY O'CONNOR WALKER WATFORD MOTION CARRIED. 6. Motion to approve an interlocal agreement for mutual id for The mutual aid agreement is between Indian River County, City of Indian River Shores, fire protection and emergency rescue services continued: Martin County, City of Stuart, Okeechobee County, City of Okeechobee, and the St. Lucie County -Ft. Discuss a waterline on Southwest 11th Drive -Director of III Mayor Kirk asked for discussion concerning a waterline installation in Southwest 11th Public Utilities (E-7). Drive. Public Utilities Director Jones explained to the Council in a memorandum attached in Exhibit Seven that the City had planned to install a 6" water line on S.W. 11th Drive. This line would be installed between S.W. 11th Street and S.W. 15th Street to improve service throughout the area and provide fire protection. One of the property owners in the area, Sandra Pearce stated her objections to the installation of the water line. She has a fence across S.W. 11th Drive in the area of S.W. 14th St. Council discussed the cost of re-routing the line. Director Jones stated it would cost an additional $2,800.00. Mrs. Pearce addressed the Council stating that as long as no damage would be done to her oak trees and if she could be shown the "line up" of where the water line was being installed she would not object to it. Council instructed Director Jones to proceed with the project of installing the line down S.W. 11th Drive and notify Mrs. Pearce of the line up where the installation would be. WHEREAS, the statewide goal of the Solid Waste Management Act of 1988 (hereinafter referred to as the "ACT") is to reduce the amount f municipal solid waste being disposed of at solid waste management facilities by at least 30 percent (30%) by the end of 1994; and WHEREAS, in an effort to reach this goal the ACT requires counties to develop e material and implement recycling programs within their jurisdictions to return valuabls to productive use, to conserve energy and natural resources, and protect capac waste management facilities; and ity at solid WHEREAS, the ACT requires that said recycling program 1989; and be initiated by July 1, WHEREAS, the ACT encourages counties and municipalities to form cooperative arrangements for implementing solid waste recycling and education programs; and WHEREAS, the ACT created the Solid Waste Management Trust Fund to provide incentive grants to assist qualifying counties and municipalities In the operation of solid waste management recycling and education programs; and WHEREAS, municipalities with populations of less than 50,000 may not apply for grants individually, but may apply for incentive portions of recyclin and education grants jointly with counties; and WHEREAS, in order to apply for the incentive grants the County and the municipalities must enter into interlocai agreements that determin how the grant funds, if awarded, shall be used; and WHEREAS, grant applications submitted to the Florida Department of Environmental Protection (hereinafter referred to at "FDEP") must include copies of the interlocal agreements between the County and participating municipalities; and WHEREAS, the participation and cooperation of the CITY and the COUNTY is essential to the successful award of the state Incentive grant and the development and implementation of a successful recycling and education program in keechobee County; and • WHEREAS, it is the desire of the CITY that the COUNTY apply to FDEP on behalf of the CITY and the residents of the CITY and the unincorporated area of the COUNTY for available recycling and education incentive grants. NOW THEREFORE, the COUNTY and the CITY hereto mutually agree as follows: 1 • This Agreement shall be effective from the date it is filed with the Clerk of the Circuit Court of Okeechobee County and shall remain in effect until September 30, 1997. The agreement may be terminated In writing by either party after the first grant year. None of the parties hereto shall be indebted to any of the other parties for services rendered. 7. Each of the parties hereto agrees to waive any and all claims against any of the other parties which may arise out of their activities outside their respective juridictions under this Agreement, and each of the parties hereto shall indemnify and save harmless any of the other parties from all claims by third parties for property damage or personal injury which may arise out of the activities of the parties outside their respective jurisdictions under this Agreement. 8. The terms of this Agreement shall 1 extend indefinitely; Provided, however, that any party hereto may terminate this Agreement, at any time and for whatever reason, by serving upon a 1 of the other parties hereto a n 0 inety (90) day written notice to that effect in advance.
