Mayor Kirk called the regular City Council meeting to order on July 19, 1994 at 7:03 p.m. The invocation was offered by Reverend Ken McDuffie; Pledge of Allegiance was led by Mayor Kirk. CLOSE PUBLIC HEARING JULY 19, 1994 - REGULAR MEETING - PAGE 2 OF 11 Councilmember Watford made a motion to approve the Warrant Registers for June, 1994 in the amounts, General Fund five hundred seventy-seven thousand, five hundred one dollars, six cents ($577,501.06) and Public Utilities one million, three hundred eighty thousand, six hundred ninety-eight dollars, four cents ($1,380,698.04); seconded by Councilmember Walker. Mayor Kirk asked if there were any withdrawal of items on today's agenda. number six. requests for the addition, deferral or Mayor Kirk withdrew new business item Mayor Kirk opened the public hearing at 7:08 p.m. Councilmember Watford made a motion to table petition 94-417-R until August 16, 1994 at 7:00 p.m.; seconded by Councilmember Walker. Discuss the utility issue - Mayor Kirk (Exhibit 2). JULY 19, 1994 - REGULAR MEETING - PAGE 3 OF 11 Mayor Kirk requested Firefighter Jeffrey Varri come forward to the podium. Mayor Kirk then read a letter of commendation in its entirety for Varri's outstanding performance as a firefighter, continuing his education and receiving the 1994 Firefighter of the Year Award. Firefighter Varri thanked the Mayor, Council and his fellow firefighters. Mayor Kirk began discussion concerning the City moving forward with the concept of a Utility Authority. He encouraged the Council to move in the direction as set out by Dean, Mead & Minton and Hartman & Associates. Councilmember Walker made a motion that the City do their utmost to make a Utility Authority work; seconded by Councilmember O'Connor. There was a brief discussion among Council. This motion is based on the last joint workshop the Council held with the Utility Working Group. The next procedure will be for the Working Group to employ Dean, Mead & Minton and Hartman & Associates to begin negotiations between the City, County and Okeechobee Beach Water Association for a Utility Authority. Mr. Jack Coker was present from OBWA and expressed to the Council he was happy to be moving forward. Mr. John Abney from the Utility Working Group also stated he was excited and would relay this information to County Commission Chairman Harvey. KIRK ENTRY O'CONNOR WALKER WATFORD MOTION CARRIED. X X X X X 374 G. NEW BUSINESS 3. Motion to approve advertising a 15% increase in the roll back property tax rate - City Administrator. 4. Discuss providing dental insurance to city employees - City Councilmember O'Connor (Exhibit 3). JULY 19, 1994 - REGULAR MEETING - PAGE 4 OF 11 Councilmember Watford made a motion to approve advertising a 15% increase in the roll -back property tax rate; seconded by Councilmember Walker. KIRK ENTRY O'CONNOR WALKER WATFORD MOTION CARRIED. Council and Staff discussed adding the benefit of dental insurance to City Employees. Finance Director Parker presented to the Council, as requested by Councilmember O'Connor, a "quick list" from various insurance companies of their dental packages. Councilmember Watford made a motion to request dental insurance proposals be obtained and offered to employees as optional insurance; seconded by Councilmember O'Connor for discussion. NEW BUSINESS A Discuss providing additional pension benefits to the city's general employees - Pension Board (Exhibit 4). Discuss the fire department's budget - Mayor Kirk (Exhibit 5). JULY 19, 1994 - REGULAR MEETING - PAGE 5 OF 11 Mr. L.C. Fortner addressed the Council on behalf of the General Employees Pension Board restating what is requested from the Pension Board in a letter to the Council in Exhibit Four. Following brief discussion between Council and Mr. Fortner, Councilmember Watford moved to instruct the City Administrator to factor in the 4.22% increase contribution to the General Employees Pension for the 94/95 budget for Council consideration in the budget workshops; seconded by Councilmember Walker. KIRK ENTRY O'CONNOR WALKER WATFORD MOTION CARRIED. Item was withdrawn from agenda. 7. Motion to adopt Resolution 94-15 - City Administrator II Councilmember Entry made a motion to adopt Resolution No. 94-15 (increasing (Exhibit 6). the debt service fee); seconded by Councilmember Walker. Mayor Kirk read proposed Resolution No. 94-15 by title only as follows: "A RESOLUTION OF THE CITY OF OKEECHOBEE, FLORIDA AMENDING SECTION C OF THE PUBLIC UTILITY RATE RESOLUTION 89-5; PROVIDING FOR AN EFFECTIVE DATE." Council discussed putting off this increase. Administrator Drago explained the next payment is due in six months and it takes that amount of time to collect the money. X X X X X 376 G. Motion to approve a partial pay request to Butler Construc- tion Company, Inc. in the amount of $170,462.20 - City Administrator (Exhibit 7). 9. Motion to approve a final pay request to R.P. Hamby, Inc. in the amount of $6,172.04 - City Administrator (Exhibit 8). Councilmember Entry made a motion to approve partial pay request (number thirteen) to Butler Construction Company, Inc., in the amount of one hundred seventy thousand four hundred sixty-two dollars, twenty cents ($170,462.20) (upon the recommendation of Engineer Reese of RMA for the Ground Water Treatment Plant - Phase 1); seconded by Councilmember O'Connor. Councilmember Watford made a motion to approve partial pay request number four to CenState Contractors, Inc. for the amount of forty-nine thousand, four hundred eighty-seven dollars, seventy cents ($49,487.70) (upon the recom- mendation of Engineer Reese of RMA for Water Distribution Improvements); seconded by Councilmember Entry. Councilmember O'Connor discussed with Mr. Tom Jensen representing RMA, the complaints he received from property owners that CenState workers were not cleaning up after they have worked an area putting in new water lines and also the "patch quilt work" paving done on N.E. 2nd Street. Mr. Jensen stated he had gone over the sites with Public Utilities Director Jones and was meeting with the contractor tomorrow to go over problem areas and they would be taken care of. Motion to approve a lease agreement between the City and County for the library property - City Attorney (Exhibit 10). 12. JULY 19, 1994 - REGULAR MEETING - PAGE 8 OF 11 Councilmember Entry made a motion to approve a lease agreement between the City and County for the library property; seconded by Councilmember O'Connor. Council discussed this fifty year lease and if there was any stipulation stating the County had to use the land as a library. Councilmembers Watford and Walker suggested a reverter clause be inserted and language specifically stating the County is to use this land for a library only. Councilmember O'Connor withdrew his second; Councilmember Entry withdrew his motion. Attorney Cook is to insert the appropriate language and bring back to the Council for their approval. Application No. 43 is submitted by Mr. Charles Farmer and Mr. James Crowe. They are requesting that the alley located in the Block in Price Addition be closed and Northwest 2nd Street from 12th Avenue to 13th Avenue be closed in order to join their parcels of land. Councilmember Watford made a motion to instruct the City Attorney to draw up the ordinance for alley & street closing Application No. 43� seconded by Council - member Walker. KIR K ENTRY O'CONNOR WALKER WATFORD MOTION CARRIED. IIThe Council interviewed Mr. Robert Delorme, Mr. Jeff Fadley and Mr. Tony Moore for the Director of Finance position. After the interviews Council discussed each applicant at length. Councilmember Watford moved to offer the position to Jeff Fadley. Motion died for lack of second. Our cursory anal on our own calculations. D the City Council ,e not able to meet his matter as they not able to travel sis was then based in direct terms, we have found that the concept could work for the benefit of the citizens of the City of Okeechobee. The tentative rate figures do derive sufficient funds for the system, however, it is important to note that the tentative rates did not include the debt service for the 1992A bond issue, which is about to commence. One other point of extreme significance is that the suggested annuity amount in the tentative proposal is not sufficient to equate to the true value of the utility system. The formula generates a current figure of approximately $435,000 annually. Based on current information, the amount necessary to return the equity to the City of Okeechobee is approximate", $755,000, This figure must be recalculated to determine the rue equity at the time of negotiation settlement. The issue of the true value and how the City will be compensated is, of course, an item for negotiation. We do not suggest that we have started this process because it is inappropriate at this time. This figure is merely offered as a frame of reference for the City Council when, and if, negotiations do begin. while discussing this matter with Mr. Meese to the true value of the system, we thought that item with the Council may be appropriate.
