Invocation offered by Reverend Ken McDuffie; Pledge of Allegiance led by Mayor Kirk. C. Mayor and Council attendance: Mayor James E. Kirk Councilmember Danny P. Entry Councilmember Michael G. Lane Gamiotea D. Motion to dispense with reading and approve the Summary of Council Action for meetings of February 15 and 21, 1994; and for workshops of February 17 and February 22, 1994. Mayor Kirk called the regular City Council meeting to order on March 15, 1994 at 7:00 p.m. The invocation was offered by Reverend Ken McDuffie; Pledge of Allegiance was led by Mayor Kirk. F. NEW BUSINESS 1. Motion to appoint Dainae Venabies as the new executive secretary - City Administrator. MARCH 15, 1994 - REGULAR MEETING - PAGE 2 OF 9 Councilmember Watford made a motion to approve warrant registers for February 1994, in the amounts, General Fund - two hundred thirty thousand, five hundred four dollars, three cents ($230,504.03) and Public Utilities Fund - five hundred thirteen thousand, eighty-nine dollars, forty-seven cents ($513,089.47); seconded by Councilmember O'Connor. KIRK ENTRY O'CONNOR WALKER WATFORD MOTION CARRIED. Mayor Kirk asked if there were any additions, deferrals or withdrawals of items on today's agenda. There were none. Councilmember O'Connor made a motion to appoint Dainae Venables as the new executive secretary; seconded by Councilmember Entry. Mrs. Venables was present, Mayor Kirk extended a welcome. Hear from Mr. Roger Searles concerning Wastewater problems at River Bend Mobile Home Park - Mr. Roger Searles (Exhibit 1). 3. Motion to approve a partial Construction in the amount Administrator (Exhibit 2). pay request to Butler of $166,586.65 - City MARCH 15, 1994 - REGULAR MEETING - PAGE 3 OF 9 Mr. Searles, owner of River Bend Mobile Home Park appeared before the Council explaining various problems he and the other residents of the park have had due to malfunctions in the lift station for the park. Council and Staff explained to Mr. Searles and those present from the park that there were two other lift stations in the system that were in worse condition and had to be focused on first. This year's budget reflects monies to relocate and rebuild the lift station for the park. A time frame for design, permitting and bid award is six months, until that time, the new SCADA system has been installed on that lift station which will alert the wastewater plant a malfunction is happening before there is a spill. Mayor Kirk encouraged the residents to keep up with the City on the progress of this project and at this time the Council sympathized with the residents, and this is the best that can be done until the new lift station is built. Councilmember Entry made a motion to approve a partial pay request (number nine revised) to Butler construction in the amount of one hundred sixty-six thousand, five hundred eighty-six dollars, sixty-five cents ($166,586.65) (upon the recommendation of Engineer Reese, RMA Project #92-158-Ground Water Treatment Plant Phase 1); seconded by Councilmember Walker. Motion to approve a partial pay request to HCE Electric in the amount of $41,778.00 - City Administrator (Exhibit 3). 5. a. Motion to read by title only, and set April 5, 1994 as a Public Hearing date, Ordinance 667 - City Attorney (Exhibit 4). MARCH 15, 1994 - REGULAR MEETING - PAGE 4 OF 9 Councilmember Watford made a motion to approve partial pay request number two to HCE Electric Incorporated in the amount of forty-one thousand, seven hundred seventy-eight dollars ($41,778.00) (upon the recommendation of Engineer Reese, RMA Project #93-109 for the SCADA system); seconded by Councilmember O'Connor. Councilmember O'Connor made a motion to read by title only, and set April 5, 1994 as a public hearing date, (proposed) Ordinance No. 667; seconded by Councilmembers Entry and Watford. Attorney Cook read proposed Ordinance No. 667 by title only as follows: "AN ORDINANCE OF THE CnY OF OKEECHOBEE, FLORIDA AMENDING_ ORDINANCE 666 TO AMEND THE EFFECTIVE DATE OF SAID ORDINANCE: PROVIDING AN EFFECTIVE DATE." X X X X X X X X X X 306 F. NEW BUSINESS 5. b. Motion to approve the first reading of Ordinance 667 6. Discuss the revocation of an occupational license issued to Southern Automotive - Finance Director (Exhibit 5). MARCH 15, 1994 - REGULAR MEETING - PAGE 5 OF 9 Councilmember O'Connor made a motion to approve the first reading of (proposed) Ordinance No. 667; seconded by Councilmember Entry. Attorney Cook explained to the Council, the Department of Community Affairs notified us they have received the packet, and the Statute changed from the last cycle, this ordinance amends the effective date of Ordinance No. 666 and this in no way delays the process for the Future Land Use Map Amendments Cycle 1-1994. KIRK ENTRY O'CONNOR WALKER WATFORD MOTION CARRIED. Finance Director Parker appeared before the Council concerning the revocation of an occupational license issued to Southern Automotive. She stated Mr. Harlow, owner of Southern Automotive nor his attorney are present tonight, he had been notified of tonight's meeting, and did call yesterday (Monday) morning explaining his attorney had advised he request this matter be postponed. She advised him the issue was already on the agenda and it would be up to the Council to postpone the matter. Council discussed at length with Staff copies of complaints from residents that had been reported to the Police Department. All evidence has been turned over to the State's Attorney, the business has been closed down, and the owner is facing various charges. Attorney Cook explained the Council is within their right to: revoke the occupational license or wait to see what the State is going to do with case before they revoke the license. X X X X X 307 E. NEW BUSINESS 6. Revocation of an occupational license continued 7. Discuss the 1988 Anti Drug Grant - Police Chief (Exhibit 6). MARCH 15, 1994 - REGULAR MEETING - PAGE 6 OF 9 Councilmember Watford and Walker felt that Mr. Harlow should be present "to give his side of the story." All the paperwork in exhibit five are copies of complaints regarding the operations of Southern Automotive filed with the police department, copies of paid receipts or checks to Southern Automotive and other parts companies and review of the complainants vehicles from another mechanic. Councilmember O'Connor made a motion to follow the recommendation to revoke the Occupational License No. 26 of Mr. Harlow owner of Southern Automotive and refund any unused portion of that license fee; seconded by Councilmember Entry Discussion ensued, Councilmember O'Connor called the question. KIRK ENTRY O'CONNOR WALKER WATFORD MOTION CARRIED. Police Chief Mobley addressed the Council explaining the City has been involved in the 1988 Anti -Drug Grant for four years. The Sheriff's Department will be receiving the funds for this grant and a task force set up of County officers and one City Officer needs to be done. Chief Mobley explained further he needs authorization from the Council to draft an interlocal agreement between the City Police Department and the County Sheriff's Department stipulating the City will pay for the Life Insurance, Disability, FICA, Health Insurance and Workman's Compensation to the City officer who is assigned to the Drug Task Force. The County will pay the actual salary. This cost is estimated to be between $6,000 to $6,500. X X X X X F. NEW BUSINESS 7. 1988 Anti Drug Grant continued: 8. Discuss SR 70 improvements - City Administrator (Exhibit 7). MARCH 15, 1994 - REGULAR MEETING - PAGE 7 OF 9 At this time it appears, if money for the 94/95 budget has to stay the same as the 93/94 budget, there will be sufficient funds to cover this expense. It has not been decided who, if any one, from the Police Department will volunteer for the Task Force or a new person hired on. It will be with the understanding, if the "grant dries up," so does that position, unless there is an opening at the Police Department or Council approves for a new position. Council concurred it was a good oroiect and authorized Chief Mobley to work with the County on an interlocal agreement to be brought back for the Council to approve. Administrator Drago also informed the Council the Fire Department is applying for two grant's. One is with the county to help the community to coincide with the State's Emergency Preparedness Peace Time Plan and the other is for a light rescue truck for the City. Administrator Drago explained to the Council the copies of correspondences between Florida Department of Transportation (FDOT) and the City in exhibit seven are for the Council's information. He wanted them to be advised the City will have to move an existing 12-inch water main located between Northeast 17th Avenue and Northeast 34th Avenue at a cost of two hundred twenty-five thousand dollars ($225,000.00). The reason for this location is FDOT is improving State Road 70. Administrator Drago also advised the City asked for any type of reimbursement for relocating this main. He has contacted Senators Dantzler and Foley, requesting any help they might be able to provide the City in obtaining some type of reimbursement. 309 F. NEW BUSINESS 9. Discuss refunding the Public Utilities Bonds - City Administrator (Exhibit 8). 10. Discuss short listing candidates for the position of Director of Public Utilities - Mayor Kirk. MARCH 15, 1994 - REGULAR MEETING - PAGE 8 OF 9 Administrator Drago obtained authorization from the Council to "go shopping" to refund the 1987, 1989 and 1992 Bonds a few meetings ago. He sent request for proposals to all local banks and various others. Exhibit eight is the listing of the four that responded. This is only to refund the bonds to save money and not obtain new monies. According to the list in exhibit eight the City's total net present value savings if they choose First Union to refund the bonds would be $1,228,322.00. Council authorized Administrator Drago to proceed with negotiations to have First Union of Miami refund the 1987, 1989 and 1992 Bonds. Council discussed short listing the candidates for the Director of Public Utilities. It was decided that the position would be for the director and not the assistant director. Mayor Kirk asked each Councilmember to give three names and the ones listed the most would be called for an interview with the Council. The following are the three that will be called by Administrator to appear at a regular Council meeting for an interview: Wayne Jones, Gilbert Sowders, John Baker and Thomas Markham as the alternate. 310 ADJOURNMENT Mayor Kirk. THEY ISSUED A LETTER TO COMPL. STATING THIS. COMPL. RETAINED BILL SELMI AND FILED A CIVIL SUIT. IN ADDITION TO THE ORIGINAL $600.00 GIVEN TO SOUTHERN AUTOMOTIVE, IT COST COMPL. ANOTHER $1807.27 TO HAVE THE ENGINE PUT BACK TOGETHER. I MADE CONTACT WITH DANNY AT AUTO CLINIC, HE ADVISED THAT ALL THEY DID WAS PUT THE ENGINE BACK TOGETHER, THAT NOTHING NEEDED TO BE REPAIRED, IT WAS ALL IN GOOD WORKING ORDER. COMPL. BOUGHT STARTER AND HAD TONY PUT IT ON, TONY CHARGED HIM $50.00 FOR LABOR AND ALSO TOLD HIM THAT HE NEEDED A NEW FUEL INJECTION MOTOR AND A MAP SENSOR. TONY TOLD IIIM THAT IF HE (VARRI) PICKED UP THE PARTS, HE (TONY) WOULD PUT THEM IN. VEHICLE RAN OKAY FOR A FEW DAYS AND AGAIN STARTED RUNNING ROUGH, COMPL. TOOK IT BACK TO TONY, ALONG WITH THE FUEL INJECTION MOTOR HE HAD PURCHASED. WHEN COMPL. GOT THE VEHICLE IT WAS STILL RUNNING ROUGIIT. VARRI PUT THE MAP SENSOR IN HIMSELF. COMPL. DROUGHT VEHICLE BACK, LEFT :IT, TONY TOLD IIIM IT NOW NEEDED A OXYGEN SENSOR. COMPL. WENT TO NAPA AND ORDER THE SENSOR, THE PRICE WAS $70.00. COMPL. ASKED TONY IF HE REALLY NEEDED THE SENSOR, THAT HE HAD ALREADY SUNK A COUPLE OF HUNDRED DOLLARS INTO THE VEHICLE, TONY TOLD IIIM TO JUST GIVE 11114 $40.00, THAT HE WOULD GET THE SENSOR WHEN THEY CLOSED, THAT HE RECEIVED A DISCOUNT AFTER HOURS. COMPL. GAVE HIM THE FORTY DOLLARS AND CANCELLED THE ORDER FOR THE SENSOR. COMPL. WENT BACK A COUPLE OF DAYS LATER AND SAW HIS VEHICLE SITTING IN THE SHOP, HOOD OPEN, A LARGE MARINE BATTERY SITTING ON TOP HIS ENGINE. COMPL. LOOKED AT TONY, AND TONY TOLD HII4 HE HAD GOOD NEWS AND BAD NEWS. THE GOOD NEWS WAS THAT HE COULD FIX THE VEHICLE, THE BAD NEWS WAS THAT HE HAD TO TAKE TILE BATTERY OUT TO CHARGE IT, THAT HE HAD LEFT THE DOOR OPEN ON THE VEHICLE ALL NIGHT AND IT HAD RAN THE BATTERY DOWN, THAT HE THEN LEFT IT ON THE CHARGER AND IT EXPLODED. TONY THEN POINTED UP TO THE CEILING (APPROX. 20 FEET) AND SAID "SEE THAT STAIN, THAT'S WHATS LEFT OF YOUR BATTERY". COMPL. ADVISED THAT HE ALSO LOOKED AROUND THE SHOP BUT COULD NOT SEE THE REMNANTS HIS BATTERY. • • TONY THEN TOOK EIGHTY DOLLARS OUT OF HIS WALLET AND TOL1. -IOMPL. 'VE GOT YOUR BATTERY, DON'T WORRY ABOUT IT." COMPL. RETURNED LATER, GOT VEHICLE, RETURNED HOME, VEIIICLE STILL RAN ROUGH, HE RETURNED AND A BY TONY THAT THE VEHICLE NOW NEEDED A THROTTLE POSITION SENSOR. COMP PURCHASED THE SENSOR AND GAVE IT TO TONY TO PUT IN. COMPL. WENT BACK A COUPLE OF DAYS.LATER, VEHICLE STILL RUNNING POORLY, TONY TOLD HIM IT L NEEDED A NEW BRAIN. COMPL. WENT TO WHERELLS AUTO PARTS, ORDERED THE BRAIN, PAID $150.00, AND TOLD 'THEM TO DELIVER IT TO SOUTHERN AUTOMOTIVE. WHEN COMPL. WENT TO GET HIS CAR, TONY TOLD HIM HE REFUSED ACCEPTANCE OF THE BRAIN, THAT HE WAS ABLE TO FIX IT BY SOLDERING SOME PARTS, REPLACING A CABLE HARNESS, AND A COUPLE OF SWITCHES. TONY TOLD COMPL. HE JUST OWED HIM A COUPLE OF HUNDRED DOLLARS FOR LABOR. COMPL. RETURNED TO WHERELLS, GOT HIS MONEY BACK FOR THE BRAIN, RETURNED TO TONY, GAVE HIM A HUNDRED DOLLARS AND TOLD HIM HE WOULD GET THE OTHER HUNDRED IF THE VEIIICLE WAS RUNNING PROPERLY. COMPL. TOOK THE CAR HOME, RAN GOOD, WENT TO GO OUT THAT NIGHT, STARTED THE CAR UP AND IT SOUNDED BAD, HE OPENED THE HOOD AND FOUND THAT THr BATTERY TONY HAD PUT IN THE CAR WAS AN OLDER AND SMALLER BATTERY AND HAD NOT REPLACED HIS NEW ONE WITH ANOTHER NEW ONE OF THE SAME SIZE AND TYPE. COMPL. AGAIN TOOK THE CAR BACK AND COMPLAINED TO TONY ABOUT THE BATTERY. TONY THEN TOLD HIS ASSISTANT, JEREMY, TO TAKE THE BATTERY OUT OF THE CORSICA AND PUT IT THE COMPLS. THIS WAS ACCOMPLISHED, BUT, THE BATTERY WAS A LOT SMALLER AND WAS ALSO A SIDE POST, WHEREAS THE COMPLS. WAS A TOP POST. JEREMY WAS SENT FOR AN ADAPTER. UPON INSTALLING THE BATTERY IT WAS DISCOVERED THAT ONE OF THE CABLES WAS TO SHORT DUE TO THE SMALLER BATTERY. TONY TOLD JEREMY TO TAKE ONE OF THE CABLES OFF OF THE TRUCK BELONGING TO COLLEEN HODGES. COMPL. HAD MET COLLEEN A FEW DAYS PREVIOUS WHEN SHE WAS IN COMPLAINING ABOUT THE CONDITION OF HER VEIIICLE AND KNEW IT WAS HER TRUCK HE WAS TAKING THE CABLE FROM. COMPL. QUESTIONED TONY ABOUT THIS AND WAS TOLD THAT HE WOULD REPLACE THE BATTERY AND CABLE LATER. COMPL. THEN DROVE HIS VEHICLE HOME, ON THE WAY A VEHICLE PULLED OUT IN FRONT OF HIM AND COMPL. HONKED HIS HORN, IT DIDN'T WORK. HE TOOK VEIIICLE BACK, TONY TOLD HIM IT WAS JUST THE FUSE, TONY ONE FROM A CHEY S-10 THAT WAS IN FOR REPAIRS AND TOLD COMPL. HE WON'T MISS IT, HE HAS MORE THEN HE NEEDS. COMPL. THE CHECKED HORN, IT WORKED, HE WENT HOME. THAT EVENING WHEN COMPL. WENT TO GO OUT AFTER DARK, HE OPENED THE CAR DOOR AND NONE OF THE INTERIOR LIGHTS CAME ON. AGAIN HE RETURNED TO TONY, THIS TIME TONY TOOK A FUSE OUT OF THE THUNDERBIRD AND PUT IT IN COMPLS. VEHICLE. VEHICLE RAN FINE, THE NEXT MORNING THE CAR KEPT STALLING AND RUNNING POORLY, THE SAME AS THE ORIGINAL PROBLEM. COMPL. TOOK IT BACK TO TONY, WAS TOLD IT NEEDED A NEW ALTERNATOR, THAT HE (TONY) FELT ALL ALONG THAT THIS WAS THE PROBLEM. COMPL. LEFT, HE HAD ENOUGH OF TONY. ON 1/5/94 ACTING ON MY RECOMMENDATION COMPL. TOOK IIIS VEIIICLE TO AUTO CL.I.NIC TO HAVE 'THEM CHECK IT TO SEE IF THE PARTS COMPL. BOUGHT WERE ACTUALLY REPLACED ON IIIS VEIIICLE. COMPL. WAS TOLD THAT THE OXYGEN SENSOR DID NOT APPEAR TO HAVE BEEN CHANGED, THE SWITCH IN THE INJECTOR MOTOR WAS NOT NEW, AND SOME WIRES THAT WERE SUPPOSED TO HAVE BEEN REPLACED HAD JUST BEEN WIPED OFF. ICOMPI,.S VEHICLE TO THIS DAY STILL HAS THE SAME ORIGINAL PROBLEM. COMPL. PAID TONY $190.00 FOR LABOR/PARTS. PAID ANOTHER $320.00 FOR PARTS HE PURCHASED HIMSELF THAT TONY SAID WERE BAD. Note that this project is between NE 17th Avenue and NE 34th Avenue, which requires the City's existing 12-inch water main to be removed/replaced due to FDOT improvements. Our Engineer's estimate of construction for this water main modification is $225,000.00. Our attempt to have FDOT reimburse the City for these modifications have been denied as outlined in the FDOT letter of February 16, 1994. FDOT anticipates starting roadway construction in August 1995. We will need to complete the water main modifications prior to their anticipated start date of August 1995. However the fact is, no one can predict what our future construction needs will be, and regretfully today those needs will require the relocation of the water main. We have sent you marked up FDOT plans which outline the new routing of the water main in order to avoid conflicts with the new roadway construction. The modifications outlined were estimated to have a construction cost of $225,000. Enclosed for your review is a copy of the preconstruction meeting minutes of April 1987 for the original installation of this main. On page 4, 5 and 6, note the discussion by Bob Humphrey of FDOT. Mr. Humphrey was relaying FDOT's position on the location of the 12-inch water main in order to avoid conflicts with future roadway improvements. The City, through the Consultant at that time, revised the plans to meet FDOT's request. Due to this information as discussed above and in the attached meeting minutes, we respectfully request that FDOT review this case as it relates to implementing a reimbursement program for the City for the cost of relocating the 12-inch water main.
