Mayor Watford proclaimed May 7 through 13, 2017, as "Tobacco Free Florida Week," presented the proclamation to
Ms. Courtney Moyett of QuitDoc and Okeechobee High School SWAT Advocate Miss Mariah Spelts, and read the
following into the record: "Whereas, smoking cigarettes is a costly addiction and costs many smokers their
health, their money and their time with friends and family; and Whereas, nonsmokers can also relate to the
emotional aspect, whether they are encouraging a loved one to quit or supporting someone going through
their quit journey; and Whereas, Tobacco Free Florida is a statewide campaign dedicated to saving money
for individual tobacco users and the state as a whole, while improving the health and well-being of
Floridians; and Whereas, since its inception, the program has resulted in a significant decrease in smoking
rates among both adults and teens in the state, leading to billions of dollars and countless lives saved; and
Whereas, in 2015 alone, an estimated $3.2 billion in smoking -related health care costs was saved as a result
of declines in adult smoking in Florida and the reduction in adult smoking rates from 2007 to 2015 (continued)

with Quit Your Way; and WHEREAS, QuitDoc Foundation is committed to the goals and objectives of
Tobacco Free Florida Week through a variety of public health activities and programs. Now, Therefore, 1,
Dowling R. Watford, Jr., by virtue of the authority vested in me as Mayor of the City of Okeechobee, Florida,
do hereby proclaim May 7 through 13, 2017, as Tobacco Free Florida Week."
Mayor Watford proclaimed May 21 through 27, 2017, as "Public Works Week," presented the proclamation to Public
Works Director Allen and the Public Works Staff, and read the following into the record: "Whereas, public works
services provided in our community are an integral part of our citizens' everyday lives; and Whereas, the
support of an understanding and informed citizenry is vital to the efficient operation of public works systems
and programs such as water, sewers, streets and highways, public buildings, solid waste collection, parks
and canal maintenance; and Whereas, the health, safety, and comfort of this community greatly depends on
these facilities and services; and Whereas, the quality and effectiveness of these facilities, as well as their
planning, design, and construction, is vitally dependent upon the efforts and skill of public works officials;
and Whereas, the efficiency of the qualified and dedicated personnel, who staff public works departments, is
materially influenced by the people's attitude and understanding of the importance of the work they perform;
and Whereas, this year's theme is "Public Works Connects Us" as we celebrate the hard work and dedication
of the many public works professionals throughout the world. Now, Therefore, 1, Dowling R. Watford, Jr., by
virtue of the authority vested in me as Mayor of the City of Okeechobee, Florida, do hereby proclaim May 21
through 27, 2017, as `NATIONAL PUBLIC WORKS WEEK' in the City of Okeechobee."
Mayor Watford proclaimed June 5 through 9, 2017, as "Code Enforcement Officers Appreciation Week," presented
the proclamation to Chief Smith, and read the following into the record: "Whereas, Code Enforcement Officers
provide for the safety, health and welfare of the citizens in this community through the enforcement of
building, zoning, housing, animal control, fire safety, environmental and other codes, and ordinances; and
Whereas, Code Enforcement Officers are often not credited for the jobs that they do in saving lives and
improving neighborhoods; and Whereas, every day, assisted by support and program staff, they attempt to
provide quality customer service to the public for the betterment of the community, and Whereas, too many
times their efforts go unnoticed, even after code compliance has been accomplished due to their efforts and
expertise; and Whereas, Code Enforcement Officers are dedicated, well trained, and highly responsible
individuals who take their jobs seriously and are proud of their department and the local government within
which they serve; and Whereas, the Florida Association of Code Enforcement has declared the first week of
June be set aside by local government to honor and recognize their Code Enforcement Officers. Now,
Therefore, 1, Dowling R. Watford, Jr., by virtue of the authority vested in me as Mayor of the City of
Okeechobee, Florida, do hereby proclaim June 5 through 9, 2017, as `Code Enforcement Officers

COUNCIL ACTION - DISCUSSION - VOTE
Mayor Watford proclaimed the month of May 2017, as "Mental Health Awareness Month," presented the document to
Suncoast Mental Health Center's Lead Therapist Amy Ross and Board Member Bobby Keefe, and read the following
into the record: "Whereas, mental health is essential to everyone's overall health and well-being; and Whereas,
mental illnesses are real and prevalent in our nation, and half of us will have a mental health diagnosis at
some point in our lives; and Whereas, all Americans experience times of difficulty and stress in their lives,
and should feel comfortable in seeking help and support to manage these times; and Whereas, engaging in
prevention, early identification, and early intervention are as effective ways to reduce the burden of mental
illnesses as they are to reduce the burden of other chronic conditions; and Whereas, there is a strong body
of research that identifies behavioral health risks and supports specific tools that all Americans can use to
protect their health and well-being; and Whereas, with effective treatment before Stage 4, all individuals with
mental illnesses — even serious mental illnesses — can make progress toward recovery and lead full,
productive lives; and Whereas, jails and prisons have often become the default places of custodial care for
even non-violent people with serious mental illnesses; and Whereas, each business, school, government
agency, healthcare provider, organization, and citizen has a responsibility to promote mental health and
well-being for all. Now, Therefore, 1, Dowling R. Watford, Jr., by virtue of the authority vested in me as Mayor
of the City of Okeechobee, Florida, do hereby proclaim the month of May 2017 as `Mental Health Awareness
Month." Ms. Ross invited everyone to attend an event being held at Indian River State College on June 7, 2017, at
6:00 P.M. The movie "No Letting Go" will be shown with free pizza before the movie.
Mayor Watford asked whether there were any additions, deferrals, or withdrawals on today's agenda; there were
none.
Mayor Watford opened the floor for public comment on matters not on the agenda; there were none.
Council Member O'Connor moved to dispense with the reading and approve the Summary of Council Action for the
May 2, 2017, regular meeting; seconded by Council Member Clark. There was no discussion on this item.

Council Member Ritter moved to approve the April 2017, Warrant Register in the amounts: General Fund, five
hundred twenty-nine thousand, two hundred sixty-five dollars and nine cents ($529,265.09); Public Facilities
Improvement Fund, seventeen thousand, six hundred twenty-four dollars and ninety-one cents ($17,624.91); and
Capital Improvement Projects Fund, three hundred forty-seven dollars and ninety-nine cents ($347.99); seconded
by Council Member Clark. There was no discussion on this item.

Motion and second by Council Members O'Connor and Chandler to award Bid No. PW 02-00-03-17 in the amount
of $82,825.00 to Seminole Design Build, Inc. (as the lowest bidder) for for Sidewalk Rehabilitation Project (as
recommended by Staff).
This project is included in the Capital Improvement Projects Budget. The Bid was let on March 31, 2017, with a
mandatory Pre -Bid meeting held on April 11, 2017. The opening was April 20, 2017. In addition to Seminole Design
Build, Inc., bids were submitted by Platinum Performance Group, Inc. for $137,074.20 and Penrod Construction
Company for $147,412.50.
The awarded project locations are: Segment No. 2, Southeast 6th Avenue, from 4th Street to the north property line
of the Centennial Park (located at 6th Avenue and 7th Street), linear foot modified error corrected 1,470 to 1,000;
Segment No. 3, Northeast 3rd Street, from 2nd to 4th Avenues (modified from originally ending at 6th Avenue,
reducing the linear foot from 1,250 to 700); Segment No. 4, Northeast 4th Avenue, from 2nd to 3rd Streets as per
drawings; Segment No. 5, Northeast 5th Avenue, from 2nd to 3rd Streets as per drawings; Segment No. 6, Northwest
2nd Street, from 9th to loth Avenues; and Segment No. 8, Southwest 6th Street from 7th to loth Avenues, excluding
the existing portion of sidewalk along and in front of the Catholic Church.
Segments removed from the original scope of the Bid to bring it in line with the budgeted amount of $85,000.00
were: No. 1, Southeast 5th Street, from 4th to 6th Avenue; and No. 7, Southwest 5th Avenue, from Central Elementary
School to existing North of Southwest 9th Street. Administrator MontesDeOca confirmed the contractor is aware of
the reduction in the scope of work with the award. Mr. Billy White with Seminole Design Build, Inc. was in
attendance.

01-00-02-17 - City Administrator (Exhibit 2).
COUNCIL ACTION - DISCUSSION - VOTE
Motion and second by Council Members O'Connor and Clark to award Bid No. PW 01-00-02-17 in the amount of
$547,318.25 to Seminole Design Build, Inc. (as the lowest bidder) for the Centennial Park Storm Water
Improvements Project (as recommended by Staff).
This project is partially funded by Florida Department of Environmental Protection Agreement No. NS018, in the
amount of $367,260.00 of which $183,630.00 is City matching funds; and South Florida Water Management District
Agreement No. 4600003556, in the amount of $250,000.00 of which $175,000.00 is City Matching funds. These
grants were approved January 17, 2017.
The Bid was let on February 22, 2017, with a mandatory Pre -Bid meeting held on March 2, 2017. The opening was
extended to March 29, 2017, from March 15, 2017. In addition to Seminole Design Build, Inc., bids were submitted
by Penrod Construction Company for $651,250.14 and Dickerson Florida, Inc. for $657,413.00. Mr. Billy White with
Seminole Design Build, Inc. and Mr. Phil Baughman of B&B Site Development, Inc. were in attendance. There was
a brief discussion on the comparison of pay item number 1000, Manatee Protection.
Council Member Chandler noted for the record he has a conflict of interest and will be abstaining from voting on this
matter as the company by which he is employed, B&B Site Development, Inc., is the subcontractor for Seminole
Design Build, Inc. on this project.

Storm Water Improvements Project No. PW 01-00-02-17 - City Storm Water Improvements Project Bid No. PW 01-00-02-17 (reducing the award amount from $547,318.25 to
Administrator (Exhibit 3). $411,412.27; a detailed list of the items was distributed as Exhibit 3 at the beginning of the meeting); seconded by
Council Member Ritter.
Administrator MontesDeOca briefly summarized the amendment to the project which was mostly the landscaping
portion. A possible second amendment will be forthcoming in June in regards to a design change for the baffle box.
Council Member Chandler noted for the record he has a conflict of interest and will be abstaining from voting on this
matter as the company by which he is employed, B&B Site Development, Inc., is the subcontractor for Seminole
Design Build, Inc. to which this project was awarded.

identification, and early intervention are as effective ways to reduce the burden of mental illnesses as they are to

being; and Whereas, with effective treatment before Stage 4, all individuals with mental illnesses - even serious

The Bid was let on February 22, 2017, with a mandatory Pre -Bid meeting held on March 2, 2017. The opening was
extended to March 29, 2017, from March 15, 2017. In addition to Seminole Design Build, Inc., bids were submitted by
Penrod Construction Company for $651,250.14 and Dickerson Florida, Inc. for $657,413.00. Additional negotiation to

WHEREAS, smoking cigarettes is a costly addiction and costs many smokers their health, their
money and their time with friends and family; and
WHEREAS, nonsmokers can also relate to the emotional aspect, whether they are encouraging a loved
one to quit or supporting someone going through their quit journey, and
WHEREAS, Tobacco Free Florida is a statewide campaign dedicated to saving money for individual
tobacco users and the state as a whole, while improving the health and well-being of Floridians;
and
WHEREAS, since its inception, the program has resulted in a significant decrease in smoking rates
among both adults and teens in the state, leading to billions of dollars and countless Iives
saved; and
WHEREAS, in 2015 alone, an estimated $3.2 billion in smoking -related health care costs was saved
as a result of declines in adult smoking in Florida and the reduction in adult smoking rates
from 2007 to 2015 resulted in approximately $17.7 billion in savings in cumulative smoking -
related health care costs; and
WHEREAS, Tobacco Free Florida and QuitDoc Foundation educate tobacco users in Okeechobee on
what smoking costs them and encourages smokers to use Tobacco Free Florida as the solution
to quit smoking with Quit Your Way; and
WHEREAS, QuitDoc Foundation is committed to the goals and objectives of Tobacco Free Florida
Week through a variety of public health activities and programs.

- Safety Meetings — Meetings continue with staff as noted with topics including; general
safety, CPR training / certification, Fire safety / extinguisher usage, workers
compensation procedures and active shooter training. Trainings are done in-house by
staff and community partners. (Meetings are typically once a month on Tuesday
Morning following staff meeting).
- FDOT signalization North 9th —ON GOING— Continuing to work FDOT and HRTPO
to gather additional information on projected traffic at the intersection. (Project Ranked
#2 in HRTPO Grant ratings March 2017). Additional information forwarded to FDOT
for justification ongoing.
In addition, FDOT is being scheduled to discuss this issue and 441 & Hwy 70 signal in
upcoming meeting. Pending for June or July council meeting.
- Commerce Park — Awaiting meeting with project new representatives (business model
has expanded), to be scheduled at their convenience in upcoming weeks.
- CRA designation and/or TIF — Speakers are pending for Continued discussions for
both, speakers sought in presentation for potential establishment of CRA. Working on
scheduling speaker for July Council meeting.
- County / OUA inter -local — Sub -committee appointments by County / City and OUA —
pending meeting date. Committee appointments by all have been completed.

No personal emails for Martin commissioners
after lake Point wins lawsuit
The Martin County Commission on Tuesday, May 9, 2017, unanimously voted to
implement a policy that forbids county commissioners from using personal email
and social media accounts to discuss public business.
MARTIN COUNTY — County commissioners no longer can use their
personal email and social media accounts to discuss public business and are now
bound to use their county email accounts.
The change is imposed as a result of an arbitrator's conclusion that the county and
some commissioners failed to comply with public records requests made by the
Lake Point rock mine.
The County Commission on Tuesday unanimously voted to implement the policy.
State law establishes requirements for complying with public records requests. But
it has no provision addressing whether county commissioners can use personal
email accounts, such as Yahoo or Gmail, or social media accounts, such as
Facebook, to conduct and discuss public business, said Barbara Petersen, president
of the First Amendment Foundation.
In Martin County, commissioners get a county -issued email account. Under the
new rule, if a commissioner gets an email about public business in a personal email
account, that commissioner has to forward the email to his or her county email.
The policy is being imposed after the court required the county adopts a policy to
ensure the timely gathering and preservation of public records, County Attorney
Sarah Woods said at Tuesday's meeting.
The court mandated the change after arbitrator Howard Googe concluded in a Feb.
15 report that the county and some sitting and former commissioners failed to
comply with Lake Point public records requests.
Lake Point, about a mile east of Lake Okeechobee's Port Mayaca Locks in Martin
County, years earlier had requested emails, notes and other public records that
pertain to its project from Commissioners Sarah Heard and Ed Fielding and former
Commissioner Anne Scott. It eventually sued the county, claiming it violated state
law because it failed to or delayed producing the records, according to court
records.
Googe determined that Fielding's and Scott's delays in producing the records were
"unjustifiable" and Heard's claim her Yahoo email was hacked was "suspicious."
"There was a pattern and practice of non-compliance and lack of diligence by the
county and certain County Commissioners in preserving and producing public
records pursuant to the public records requests in this case," Googe wrote.
Fielding, Heard and Scott have pointed out they are not named defendants in the
lawsuit and have said they complied with the public records requests.
Martin County agreed to pay the $371,801 in attorneys' fees Googe said the county
owes Lake Point.
