1994 at 7.00 p.m.
The invocation was offered by Councilmember Dowling R. Watford, Jr,

Hear from Mr. Phil Berger regarding the City's package
insurance policies - Mr. Phil Berger (Exhibit 1).

Mayor Kirk asked if there were any additions, deferral or withdrawal of items on
today's agenda. There were none.
Mr. Phil Berger of Leonard Berger Insurance Company, the City's current
carrier, appeared before the Council with a package of proposals from four
different insurance companies that the Council must choose from to continue
their insurance coverage. (Current coverage is with CIGNA and expires at
midnight tonight).
The proposals are from TITAN (the least expensive in the proposal and
recommended by Mr. Berger). CIGNA (the City's current carrier). PENCO (the
highest proposal). And, Southwest Florida Intergovernmental Risk
Management Association (which is a "Pool').
Representatives from TITAN, PENCO and Southwest Florida Intergovernmental
Risk Management Association addressed the Council on the specifics of their
proposal, their companies rating and background.
Following much discussion, Mayor Kirk advised in the future that City Staff bid
this matter out differently, have a specific form made up for specifications and
treat it like any other bid the City does. He expressed further he did not like
the way the proposals were handled and City Staff should start earlier to give
all companies a chance to bid on the City's insurance.
Councilmember O'Connor made a motion to go with TITAN without uninsured
motorist since it's the low bottom line, we're still getting the same coverage we
got from CIGNA, the other two are considerably higher (accepting the TITAN
proposal for $190,703 to include the government risk insurance trust for
workman's comp): seconded by Councilmember Entry.
Council also instructed staff to begin the renewal process for the insurance
before November. 1994.

Administrator Drago explained this process is a complex package. He would
recommend, that the City retain a consultant to draft the specifications. If a
local insurance agent want's to draft the specifications he cannot bid the
policy. Offer it to the local's first but whoever wants to write the specifications
cannot bid the package. If nobody wants to write the specifications then we
will go out of town and send out quotes and get three, present them to
Council to pick out the one to write the specifications.
Councilmember Watford expressed he did not want to go hire someone to
write the specifications. Mayor Kirk stated he did not care how it was done
but that it should be done by a bid, not quotes as we have here.
Councilmember O'Connor called the question. Vote on motion is as follows:

Chief Mobley explained Sheryl has had a baby and her sick leave and annual
leave has run out. She is requesting this unpaid family leave to attend to the
baby. He has no problem with her having this time off, she is a good
employee. However, he would like the Council to know she has put in for a
transfer to the Public Utilities (Customer Service Clerk) because of the day
time working hours and there is no shift work. If she does get that position,
then this leave will end March 4th.
Councilmember Watford made a motion to approve a leave of absence,
without pay, for Sheryl Sellers for the period of February 21, 1994 to April 21,
1994; seconded by Councilmember Entry.

Council discussed the motion should state the leave is "family leave".
Councilmember withdrew his second to the motion, Councilmember Watford
withdrew his motion.
Councilmember Watford made a motion to approve a family leave of absence,
without pay, for Sheryl Sellers for the period of February 21, 1994 to april 21,
1994: seconded by Councilmember Entry.
Mayor Kirk asked if we are paying any insurance for Sheryl during this period
of time. Chief Mobley explained on family leave the City will have to continue
to pay if she has City insurance, if she has family coverage then she will have
to make arrangements to pay that part.

Council discussed the corrections made on the pay request and instructed
Administrator Drago to advise Engineer Reese to initial each correction he
makes on any and all pay request in the future.

Councilmember Watford moved to approve a contract with Trio Development
Corporation for rehabilitation of the raw water pump station in the amount of
seventy-three thousand, four hundred thirty-seven dollars ($73,437.00) as
recommended by Engineer Bill Reese; seconded by Councilmember
O'Connor.
Administrator Drago explained there are presently two pumps in the raw water
station. A year or so ago the Council paid someone to come in and do an
energy audit on the plants. One of the things they found out was the two
pumps that were presently in the raw water station are not energy efficient as
far as the size of the pump and their makeup. This contract will add a third
pump to the station and will correct the energy deficiencies in the other two
pumps by changing some mechanical things. It will reduce maintenance
costs and make the raw water pump station more efficient energy -wise and the
third pump will give you a back-up in case the other two fail.
Councilmember Watford requested Administrator Drago, as acting Public
Utilities Director, to give the Council a very brief summary, one page, of the
priorities that we need to be looking at, our problems and in what order we
need to be looking at them for the entire City's systems, all of public utilities.
Mayor Kirk agreed that would be a good request and so instructed
Administrator Drago to prepare the summary.

Corporation contract in the amount of $72,000.00 for the
demolition of the old Wastewater Plant - City Administrator
(Exhibit 6).

Councilmember Entry made a motion to approve a change order to Kimmins
Contracting Corporation contract in the amount of seventy-two thousand
dollars ($72,000.00) for the demolition of the old wastewater plant as
recommended by Engineer Dan Willard, seconded by Councilmember
O'Connor.
Councilmember Watford asked, why didn't Kimmins bid on this project?
Administrator Drago responded he did not know.
Councilmember Watford then asked how can we in good faith put something
out for bid and then give it to somebody who did not bid on it just because
they said they could do it cheaper? Attorney Cook responded the City has a
right to reject bids, he did not know how this could have happened, but it
would be of some concern if this company knew what the other bids were and
decided to cut it by a couple of thousand. Administrator Drago responded,
which was not the case.
Councilmember Watford asked when Administrator Drago met with the
representative of Kimmins. Administrator Drago responded he thought the
engineers met with them around the 26th of January.

Councilmember Watford asked, when were -the bids opened? Administrator
Drago answered, prior to January 26th. Councilmember Watford continued,
so, that contractor could have had knowledge of the bids. Administrator Drago
interjected, they didn't because the bids were not posted.
Attorney Cook then interjected he could not remember the statute exactly, but
he thought the results have to be posted before they are public record.
Councilmember Watford stated he thought they had a real problem here. Why
ask for bids?" The proper procedure would be to reject the bids and let
everybody bid again. Change orders seem to bypass the spirit of the bid
process.
Mayor Kirk commented that he realized this looks like we are saving some
money but it doesn't really look good on our part. We may end up -spending
more money but he did agree with Councilmember Watford on this, if we are
going to bid it, we need to bid it.
Councilmember O'Connor withdrew his second to the motion, Councilmember
Entry withdrew his motion from the floor.
Councilmember Entry made a motion to put this (demolition of the old
wastewater plant) out for rebid: seconded by Councilmember O'Connor.

Mayor Kirk commented, in discussing (pollution liability insurance) with
insurance companies, this evidently is very difficult insurance to get.
Administrator Drago interjected, Mr. Berger has worked on and off on it since
April of last year. Mr. Berger commented there are two players in the field,
PENCO and Poe and Brown. PENCO could not ever get a proposal together.
This does not cover any other City owned property, only pollution at the
existing wastewater treatment plant. Administrator Drago also commented that
the City has to have this coverage.
Attorney Cook also commented if there was a pollution problem, the
Environmental Protection Agency looks to the landowner to pay for the clean
up so if we were to ever have a problem it could be a substantial expense and
he assumed this policy would cover that. Administrator Drago agreed that was
correct.
Discussion continued, Councilmember O'Connor made a motion to approve a
Pollution Liability Insurance Policy with Poe and Brown Inc. in the amount of
twenty-five thousand, fare hundred dollars ($25,500); seconded by
Councilmember Entry.

Administrator Drago advised the Council the City has completed the interview
taping of the remaining eight candidates for the Director of Public Utilities
position. The tapes total approximately six hours of viewing. The Council needs
to set some date and times to meet and view the eight tapes to narrow the list
down to three or four to bring them in for formal interviews. When the dates/
times are established you will get a copy of their resume, a copy of the oral
questions they had to answer and a copy of the questions the interviewer
asked them on the video. This information will be provided prior so that you
will have all the back ground material.
The meetings will be called as a workshop and open to the public.
Administrator Drago stated, there were some local people interviewed and out
of courtesy, the locals will not show up to look at the other video's.
One of the questions asked on video was, did they give their permission to be
interviewed and give the tape to the City of Okeechobee, and everyone said
yes, therefore the tapes are a matter of public record.
Council is to call Administrator Drago to -give the dates/time they could come
for a workshop to view the video's and then he would advise the City Clerk in
order to advertise the date of the workshop.
Councilmember O'Connor requested the Council approve a program for the
Police and Fire Departments to start awarding and wearing awards on their
dress uniforms.
Council and Chief Mobley discussed if wearing the awards/ribbons/medals
would be mandatory. Councilmember Watford felt it should not be mandatory.

Following discussion between the Council and Chief Mobley, Councilmember
Entry made a motion to approve a request for the Police and Fire Departments
to start an awards (ribbonslmedals) program (it would be mandatory for the
employees to wear these awards on their dress uniform): seconded by
Councilmember O'Connor.

Mr. Marvin Wheeler addressed the Council expressing his concerns for the
amount -of time it has taken to get a Public Utilities Director. Mayor Kirk
reminded Mr. Wheeler of the discussion on a previous item concerning the
Utilities Director position and that the Council was working toward hiring
someone very soon.
Mr. Wheeler then addressed the Council concerning the City/County Planning
and Development Department Expressing that he felt the City should take this
Department back and run it. Mayor Kirk advised other than Mr. Wheeler, the
City has not been getting any complaints concerning the Planning and
Development Department and if he knew citizens with complaints to
encourage them to also addressed the Council on them.
In exhibit seven is a memorandum from Administrator Drago to the Mayor and
Council detailing how much money it would take to start a building department
from scratch. Attorney Cook also advised that the Planning Director, Bill
Royce has contacted him on items to be sure he is carrying out the City's
rules and regulations.

13. Discuss the Cycle 2 Comprehensive Plan Amendments -
City Attorney (Exhibit 8).

Attorney Cook advised the Council in exhibit eight are the applications for the
Comprehensive Plan Future Land Use Map Amendments '93 Cycle ll.
Continuing further that as discussed at the last meeting he was able to
complete a review of each application with the help of the Clerk's office. Each
location was individually viewed. "We completed over a three day period a
rough draft of the applications that we will be sending to the Department of
Community Affairs (DCA). However the Statute calls for, as opposed to our
regular ordinance passage, two newspaper advertisements for the public
hearings on comprehensive plan amendments. To comply with the Statute we
would have had to have gotten the ad into the paper last Tuesday (the 25th of
January). The ad has to include not only a geographic location map, but the
land use designation as it exists and as it is requested by the applicant. It was
not possible to get the ad in Tuesday.
The purpose in discussing this item tonight is to let the Council know that the
applications have been reviewed and are in final form subject to meeting with
some of these applicants this week and perhaps amending some applications.
And having a first reading of the ordinance at the next meeting."
If the Council wants to expedite it, we could have a special meeting on the
21st of February which would save seven days to get this to DCA as opposed
to waiting until March 1st, for the next regular City Council meeting.
The majority of these applications appear to be oversights and errors at the
time the original map was adopted, some are not. These applications are
requests by land owners for a different land use designation on the map. The
burden is on the landowner to provide City Staff sufficient information to
.evaluate the application and send it on to DCA.
Attorney Cook continued explaining that contrary to popular belief someone
coming and saying "I had Commercial on this property for fifteen years and
now you have made it single family, it's an obvious map error" is not
necessarily the case. However, his evaluation of each of these applications are
just that, evaluations. He has made some conclusions on some of these that
he had some problems with."

Attorney Cook continued, as a City Council, you are not required to, anytime a
landowner wants his land use designation changed, to accept that or to
"champion" that up to DCA. In fact the City Council, is bound to, upon
recommendation of staff, to keep within the comprehensive plan and the
goals, objectives and policies that were adopted in this whole process. Some
of these applicants are going to be disappointed, some of these things cannot
be helped, some we could not change if we wanted to.
Attorney Cook further commented that some of the applications, Mr. Berger,
Mr. Domer's, Mrs. Freeman, the vacant areas off of N.W. 9th Street (Mr. Vest
and American Land Trust Corp), he cannot tell or give an opinion at this point
that they would be called obvious map errors. There are some legitimate
planning policies that may have been advanced by the CFRPC when they
recommended these. Others are obvious mapping errors. He plans to get with
the above landowner's prior to the February 15th meeting and get some more
information on the applications since there is a question whether they are map
errors or not.
The application itself needs to change, we give the applicant one line, "why do
you want the change and what justification do you have for it" and it really
does not provide a lot of space or guidance to the applicant as to what they
are suppose to do.
No official action was taken on this item, the first public hearing will be
advertised and held on February 15, 1994.
