Councilmember Watford commented that some of the items on the Special Meeting Agenda of July 1, 1993, he felt, should have been done at a regular meeting. Councilmember Watford made a motion to approve the Warrant Registers for the month of June, 1993 in the amounts: General Fund being five hundred seventeen thousand, five hundred one dollars, seventy-eight cents ($517,501.78) and Public Utilities Fund being six hundred sixty-three thousand, six hundred five dollars, sixty-three cents ($663,605.63); seconded by Councilmember Walker. 'AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA, PROVIDING THAT ALL AREAS WITHIN THE CITY LIMITS OF THE CITY OF OKEECHOBEE SHALL BE EXEMPTED FROM THE APPLICATION OF CERTAIN TERMS AND PROVISIONS CONTAINED IN OKEECHOBEE COUNTY ORDINANCE NO. 92-20 WHICH REPEAL OR SUPERSEDE CERTAIN OKEECHOBEE COUNTY ORDINANCES IMPLEMENTING THE CITY'S INTERLOCAL AGREEMENT WITH OKEECHOBEE COUNTY CONCERNING THE CONSOLIDATED OKEECHOBEE COUNTY BUILDING AND ZONING DEPARTMENT; PROVIDING FOR SEVERABIL TY; PROVIDING FOR AN EFFECTIVE DATE' Councilmember Entry made a motion to adopt Ordinance No. 660; seconded by Councilmember O'Connor. Councilmember Watford asked, when we adopt this, where does this put our zoning? Attorney Cook explained we go back to the City's old zoning as amended. This prohibits the City from falling under the guidelines of the County's Land Development Regulations (LDR's) until the City adopts their own. This will be revisited when the City does it's LDR's. Mayor Kirk asked for any public comments. Citizen Marvin Wheeler expressed his opinion that the City needs to keep all their rules and guidelines and not go by the County's. 'AN ORDINANCE OF THE CnY OF OKEECHOBEE, FLORIDA, AMENDING THE CITY OF OKEECHOBEE COMPREHENSIVE PLAN, ORDINANCE 635, AS AMENDED BY REVISING THE FUTURE LAND USE MAP; PROVIDING FOR INCLUSION OF ORDINANCE AND REVISED FUTURE LAND USE MAP IN THE COMPREHENSIVE PLAN; PROVIDING FOR SEVERABILHY, PROVIDING FOR AN EFFECTIVE DATE' Attorney Mike Morrell appeared before the Council updating them on the Comprehensive Plan Future Land Use Map adoption and problems found with the map after it was adopted. Which leads to the purpose of this public hearing. Applications for the Future Land Use Map Amendments are divided into two groups. Discussion of Application 1 thru 24 continued. The first group of applications are numbers one through twenty-four. These can be discussed all at one time. They are absolute errors in the future land use map because a pre-existing building was on the property when the land use designation was adopted. The second group, Applications 25-30 are not map errors but actual changes in land designation. There are two corrections to be made to Ordinance No. 661. Mr. David Hester's application, is to be withdrawn since his property's land use designation did not change. The second is, Mr. Frank Altobello's application legal description will be corrected. Council and Attorney Morrell also discussed a letter from Steve and Wanda Morgan. Attorney Morrell stated he is confident in the advice he is giving the Council and handling the Morgan's property and the other applications. Councilmember Watford brought to Attorney Morrell's attention corrections in sentences to be made on Page 22, first paragraph, second sentence is incorrect and should be deleted. Page 24, first paragraph, second sentence is incorrect and should be deleted. And Page 26, second paragraph, third sentence is incorrect and should be deleted. Attorney Morrell will correct these entries before the documents are sent to DCA (Department of Community Affairs). Mayor Kirk asked if there was any comments from the public. There were none. Discuss Application 25. Mr. Syed Abdullah filed Application No. 25. The property description is 112 of Lot 12, 13 through 16 of Block 3, City of Okeechobee. The existing zoning designation is Commercial, Professional Office. The future land use designation is Single Family. Mr. Abdullah is requesting the future land use designation be Commercial. At present there is not a structure on the property. Following discussion between Council, Attorney Morrell and Mr. Abdullah, Mayor Kirk called three times for a motion to delete Application No. 25. No action to delete was taken, therefore, Application No. 25 remained in Ordinance No. 661 as presented. Discuss Application 26 Mr. Kim Glowacki filed Application No. 26. The property description is Lots 11 and 12 of Block 41, City of Okeechobee. The existing zoning designation is Residential General 1. Mr. Glowacki is requesting the future use designation is Single Family. q 9 The future land g g 1y land use designation be Commercial. The structure on this property is fire damaged. Following discussion between Council, Attorney Morrell and Engineer Mosley Collins (representing Mr. Glowacki), Mayor Kirk called for a motion to delete Application No. 26. Councilmember Watford made a motion to amend Ordinance No. 661 to delete Application No. 26 based on the future land use designation around this area. Motion died for lack of second. No action was taken to delete, therefore, Application No. 26 remained in Ordinance No. 661 as presented. Mr. Glowacki will pay the $500.00 deposit as required. It was understood by Engineer Collins' that his client will have to go through the proper procedures for a zoning designation change. Mayor Kirk asked if there was any comments from the public. There were none. Discuss Application 27. Mrs. Frieda Hamrick filed Application No. 27. Attorney Morrell explained to the Council Mrs. Hamrick requested to withdraw her application. Mayor Kirk asked if there was any comments from the public. There were none. July 6, 1993 - Regular Meeting - Page 7 of 16 ;` y AGENDA COUNCILMEMBER ACTION Y N A F. PUBLIC HEARING FOR ORDINANCE ADOPTION 2. b. Discuss Application No. 28 Mr. W.I. Rooks filed Application No. 28. The property description is Lots 7 through 12 of Block 254, First Addition to the City of Okeechobee. The existing zoning designation is Commercial 11. The future land use designation is Single Family. Mr. Rooks is requesting the future land use designation be Multi Family. At present there is not a structure on this property. Discussion ensued between Council, Attorney Morrell and Mr. Rooks on the legal description. Council instructed Attorney Morrell to amend the legal description on Mr. Rooks' application to include Lots 1, 112 of 2, 4 through 12 of Block 254 as it was advertised for the public hearing. Mayor called three times for a motion to delete this application. No action was taken to delete, therefore, Application No. 28 remained in Ordinance No. 661 as presented. Mr. Rooks will pay the $500.00 deposit as required. It was understood by Mr. Rook's, he would have to go through the proper procedures for a zoning designation change. Mayor Kirk asked if there was any comments from the public. There was none. Discuss Application 29. New Horizon's of the Treasure Coast filed Application No. 29. The property description is Lots 1 through 12 of Block 30, First Addition to South Okeechobee. The existing zoning designation is Commercial. The future land use designation is Single Family. New Horizon is requesting the future land use designation be Commercial. There was a lengthy discussion between Council, Attorney Morrell, Attorney Burton Connor representing New Horizon's) and Mr. Robert Marchner (Vice President of New Horizons) concerning evidence that a building existed, when the future land use map was adopted, and was recently demolished because it was a safety hazard. New Horizon's plans to construct a new office building on the property. There is a twenty year history on the properly as being used for commercial purposes. Council felt this change in land designation was an error and this application should be put with Applications 1 through 24. The $500.00 deposit requirement will be waived. 129 .30 July 6, 1993 - Regular Meeting - Page 8 of 16 AGENDA COUNCILMEMBER ACTION Y N A F. PUBLIC HEARING FOR ORDINANCE ADOPTION 2. b. Discussion on Application No. 29 continued: Mayor Kirk asked if there was any comments from the public. Ms. Dale Ann Underhill asked that the Council think about this decision. She explained she was representing herself and the neighbors who live behind where the proposed office complex will be. They are concerned about the type of clientele New Horizon's will draw. New Horizons Counselor Phyllis Walpole responded to Ms. Underhill that New Horizons will not be a residence type rehabilitation. It will be a walk-in type of professional office where people come for counseling. She assured Ms. Underhill that she, her children and neighbors were not in danger of their clients. Attorney Connor read a letter from one of the property owners in the neighborhood as follows: "I AM UNABLE TO ATTEND TONIGHT'S MEETING BECAUSE OF A PREVIOUS COMMITMENT. I RESIDE AT 306 S.W.15TH STREET AND WISH TO STATE THAT I AM NOT OPPOSED TO THE NEW OFFICE BUILDING TO BE CONSTRUCTED BY NEW HORIZONS. I HAVE BEEN ASSURED THAT THIS BUILDING WILL HAVE REGULAR OFFICE HOURS AND WILL NEVER BE USED AS A RESIDENTIAL FACILITY. AS DEAN OF STUDENTS AT OKEECHOBEE HIGH SCHOOL, I DEAL FREQUENTLY WITH NEW HORIZONS AND HAVE ALWAYS FELT THEY WERE MOST PROFESSIONAL CONSIDERING THE COMMERCIAL DEVELOPMENT ALONG HIGHWAY 441 SOUTH, I FEEL WE ARE FORTUNATE TO HAVE A PROFESSIONAL OFFICE BUILDING ON THIS PROPERTY, SINCERELY, PEGGY HUNT. - Citizen Dave Sorenson also expressed concerns on the increase of traffic in the area which may occur relative to the New Horizons Facility. Mayor Kirk called three time for a motion to delete Application No. 29. No action was taken to delete, therefore, Application No. 29 remained in the ordinance, and will be grouped as an error in the land use map. Mr.. Richard Vest filed Application No. 30. The property description is Block 24 located Discuss Application 30. on Highway 441 South. The existing zoning designation is Residential General /I. The future land use designation is Multi Family. Mr. Vest request the future land use designation be Commercial for a proposed two-story motel to be located by his restaurant, "Pogey's". July 6, 1993 - Regular Meeting - Page 9 of 16 . Motion to adopt Ordinance 661. Councilmember Walker made a motion to adopt Ordinance No. 661 as amended; seconded by Councilmember O'Connor. Councilmember Watford stated one of the applicants is his father, but he in no way has any financial interest in those properties, therefore, he would be voting on the adoption of the ordinance. CLOSE PUBLIC HEARING Mayor Kirk closed the PUBLIC HEARING at 9:13 p.m. Council and Attorney Morrell discussed briefly whether the Department of Community Affairs responded to our letter of invitation. There has not been any response. Mayor Kirk is to follow up with another letter to DCA. G. NEW BUSINESS 1. Hear from Beach Water Association - Mr. Burton Attorney Burton Connor, representing OBWA (Okeechobee Beach Water Association) Connor. appeared before the Council stating, at the last regular Council meeting, the Council agreed for the City to allow OBWA to serve the customers that were on OBWA's computer list, after it is reviewed by City staff and after Engineer Reese researched whether SFWMD (South Florida Water Management District) would decrease the City's consumptive use permit when the City sends the letter of their (the City's) approval to SFWMD. Engineer Reese explained to the Council, he was not able to find a definite answer to the question without going directly to SFWMD, which he did not want to do. July 6, 1993 - Regular Meeting - Page 11 of 16(.... AGENDA COUNCILMEMBER ACTION Y N A G. NEW BUSINESS 1. OBWA continued. Attorney Cook advised the Council not to approve OBWA's request. He felt if the City did, the issue of overlapping service areas would not be resolved. His recommendation was for the City and OBWA to come to an agreement on the entire service area now. The City could then provide OBWA with a letter on the customer service area to SFWMD to get a consumptive use permit for their proposed water treatment plant. Councilmember O'Connor made a motion that we follow the City Attorney's recommendation to pursue this, then he and Attorney Burton Connor can get together in earnest, unless OBWA wants to file a law suit. Motion died for lack of second. There was a lengthy discussion between Council and Attomey Connor. Councilmember Watford made a motion that we grant OBWA's request to service their existing customers providing it does not jeopardize. the City's consumptive use permit nor hinder the rights for the service area; seconded by Councilmember Walker. Comp Plan Litigation Update - City Attorney Attorney Cook advised the Council of a meeting between himself, County Attorney John Cassels and Planning Director Bill Royce concerning a rough draft for language change in the County's Comprehensive Plan. There were a few items that needed to be changed. He gave the amendments to Attorney Morrell to draw up a final copy. He spoke with Attorney Cassels before the last County Commission meeting explaining he had not gotten the final copy back from Attorney Morrell and instructed him not to present the document until the final draft was forwarded to him with the corrections. Later he learned Attorney Cassels presented the draft to the Commissioners, they approved it, signed it and sent it back to us. He did not understand why it was presented to the Commissioners since it was not the final draft. Attorney Cook will get the final draft from Attorney Morrell, and send it to Attorney Cassels for approval by the Commissioners. 3. Discuss a rate increase for L.P. Sanitation - City Council, Administrator Drago, and Mr. Pat Yancy (Operations Manager of L.P. Sanitation) Administrator (Exhibit 3). discussed at length a 5.8% rate increase proposal from L.P. Sanitation that is will go into effect October 1, 1993. This would be the first increase in two years. Citizen Marvin Wheeler addressed the Council with concerns of the rate increase. Councilmember Entry made a motion to authorize the City Administrator to draft a Resolution for the rate increase to be presented at the next regular meeting: seconded by Councilmember O'Connor. Discuss a Preliminary Plat for Oak Ridge Estates - Mr. Bill 'Royce (Exhibit 4). 5. Discuss the purchase of property for the relocation of the N.E. 6th Avenue Litt Station - City Administrator (Exhibit 5). Planning Director Bill Royce appeared before the Council requesting approval of the preliminary plat for Oak Ridge Estates. He explained further it is a simple plat. Consistent with future land use designation. Conforming with City's specifications. City staff has reviewed and approved them. The Planning and Zoning Department approved it. Mr. Robbie Hoover (representing the developers) also addressed the Council showing the blue print construction drawings of the proposed preliminary plat. There was a brief discussion among Council and Mr. Hoover. Councilmember Walker made a motion to approve the preliminary plat and construction plans for Oak Ridge Estates: seconded by Councilmember O'Connor. KIRK ENTRY O'CONNOR WALKER WATFORD MOTION CARRIED. Administrator Drago explained to the Council, they approved for Knepper and Willard, Inc. to draw plan for the ABC Liquors (N.E. 6th Avenue) Lift Station late last year. The lift station will be relocated. By working with Tucker and Williams Real Estate, the property owner of the South 112 of Lot 1 in Block 150, City of Okeechobee has agreed to sell that portion of property to the City for $10,000.00 to put the lift station on. There was brief discussion between Council, Administrator Drago and Program Coordinator Threewits. Councilmember Watford made a motion, upon the recommendation of the engineer that we purchase the property (South 112 of -Lot 7 in Block 150 City of Okeechobee) for the relocation of the lift station not to exceed ten thousand dollars ($10 000 00) • seconded by Councilmember Entry. Discuss advertising an increase in the roll -back Administrator Drago advised the Council if they are going to proceed with the property tax rate - City Administrator. recommendations for General Fund employee raises, he recommends the advertisement for an increase in the roll -back property tax rate be 20% to 25% instead of the normal 15%. Following brief discussion Mayor Kirk instructed that this item be put off until the next regular meeting to give the Council time to research it further. Councilmember Walker made a motion to award a Filter Media Contract to Standard Sand and Silica Company in the amount of nineteen thousand, eight hundred eighty-nine dollars, fifteen cents ($19,889.15); seconded by Councilmember Watford. Read letter of commendation for the Wherrell Mayor Kirk read letters of commendation to Police Chief Mobley, specifically for Sergeant Auto parts Fire - Mayor Kirk (Exhibit 8). Kelly Ammons, dispatcher Rebel Manson and the Police Auxiliary; Public Works Director Elders and his department, and City Administrator for the Public Utilities Department. All the letters read. `I WOULD LIKE TO THANK YOUR DEPARTMENTS FOR THEIR SUPPORT ON JUNE 11, 1993. BECAUSE OF THE SUPPORT OF ALL THE DEPARTMENT IN THE CITY WE WERE ABLE TO CONTAIN THE FIRE (AT WHERRELL AUTO PARTS STORE) AND KEEP OUR COMMUNITY FROM HAVING AN ENVIRONMENTAL DISASTER. County Ordinance ho 74-1, the County's zoning ordinance; County Ordinance No. 85-1, which amended the County's z n'ng ordinance to extend jurisdiction over real property located within incorporated areas of the City which also adopted the City's zoning district regulations and zoning districts as part of the CountyCountysc ning ordinance; and County Ordinance No. 87-1 which amended the County's zoning ordinance to create and establish zoning district regulations for certain commercial zoning districts in the incorpor t d and unincorporated areas of Okeechobee County. (J) By exempting, or opting out, all of the areas within the City limits of the City of Okeechobee from the application of those specific tem, s and provisions of Article 1, Section 1.09.00 contained in County Ordinance No. 92-20 which purpor lo repeal or supersede County Ordinance Nos. 74-1, 85-1, 87-1 and any other Okeechobee County finances expressly cited in Article 1, Section 1.09.00 which properly implemented the terms of the hterlocal agreement as amended, a municipal purpose is served, that purpose being the orderly and proper conduct of municipal government zoning and land use regulatory authority, the exercise of the municipal function of zoning and land use regulation which is essential to protect the health, morals, safety, protection and welfare of the City of Okeechobee, the provision of consolidated Okeecho a County Building and Zoning Department services to residents and property owners located with the City limits of the City of Okeechobee and other benefits of interlocal cooperation received by b t i the City of Okeechobee and Okeechobee County as a result of having entered into the interlocal greement as amended. The vehicles currently used by the City Building. and Zoning Department shall be transferred to the County Building and Zoning Department and owned by the County. Upon the termination of this Agreement, all vehicles so transferred to the County Building and Zoning Department and which remain 'n service to the County shall be transferred back to the City. 4. The County shall amend i Zoning Ordinance (Ordinance 74-1) to extend its jurisdiction ver the City. This amendment shall also include 7 a. adoption of the City's Zoning District [regulations and zoning districts currently in eff-ct within the City. b. the provision that the fanning Commission1 and Board of Adjustment shall have a total of 3even (7) members,f a minimum of two (2) of whom must reside within the City. The remaining members may reside anywhere within the County, All members shall be appointed by they Board of County Commissioners. C. the provision that all proposed rezonings for real property within the City shall, after consideration by the Planning Commission, be submitted for final disposition to the City Council. d. the provision that appeals from variance and special exception approval or denials shall be handled pursuant to Section 163.250, Florida Statutes. 5. The City shall be responsible for defending litigation regarding any rezoning, special xceaption, variances or appeal on property located within the CO. 6. The County shall amend its Building and related codes (Ordinance 83-5) and Construction Licensing Board Ordinance (Ordinance 70-2) to extend their jurisdiction over the City. Amendment shall also include a piovision that fees for permit$,., shall be uniform throughout the County's incorporated and unincorporated areas, as wellas a provision that all applications for building Permits involving property within the City shall be submitted to the City public Works and Utilities Department and City Fire Chief for approval as to compliance with City water, sewer and drainage plans and fire, safely code prior to the issuance of any permit. 7. The City shall repeal all ordinances relating to Building and Zoning, effective at ;he date the County Ordinances cited above are amended. 8. The County Code Enforcement Board shall have sole Jurisdiction over all zoning and building code matters that may arise within the City. /4. 9.
