Motion to appoint Mr. Roger Jones and Mr. L.C. Fortner, Jr. to the General Employees Pension Board for a 2 year term - City Administrator (Exhibit 1). 3. Motion to approve a partial pay request to Edens construction in the amount of $62,241.93 - City Administrator (Exhibit 2). Councilmember Watford made a motion to appoint Mr. Roger Jones and Mr. L.C. Fortner to the General Employees Pension Board for a two year term; seconded by Councilmember O'Connor. KIRK ENTRY O'CONNOR WALKER WATFORD MOTION CARRIED. Councilmember Entry made a motion to approve a partial pay request to Edens Construction (for the CDBG) in the amount of sixty-two thousand two hundred forty-one dollars, ninety-three cents ($62,241.93); seconded by Councilmember O'Connor. Engineer Reese answered Council's questions, stating that the contractor is running out of time, this pay request does represent the extended time frame Council approved. He will appear before the Council again with an amount of liquidated damages for going over the time limit. There have been some complaints and all are being documented. Public Works Director Elders explained to the Council this amount represents the ten _ percent (10%) retainage and paving of 5th Avenue. Phase One is finished and completed satisfactorily. Motion to approve a taxi driver permit for Mary Ann Councilmember Watford made a motion to approve a taxi driver permit for Mary Ann Hornack - City Administrator (Exhibit 4). Hornack; seconded by Councilmember Walker. Police Chief Mobley answered yes to Councilmember Watford's questions if an investigation had been performed and everything checked out alright. Motion to adopt Resolution 93-2 - City Councilmember Watford made a motion to adopt Resolution No. 93-2 (Reciprocal Fee Administrator (Exhibit 5). Resolution 93-2 continued. Attorney Cook read Resolution No. 93-2 by title only. "A RESOLUTION OF THE CITY OF OKEECHOBEE A UTHORIZING THE EXECUTION OF A RECIPROCAL FEE WAIVER AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION." Councilmember Watford asked Administrator Drago to explain this resolution; and was it to the City's benefit to adopt it? Administrator Drago advised there is a contract that goes with this resolution explaining both parties waive maintenance fee's concerning highway's only. Motion to adopt Resolution 93-3 - City Councilmember Watford made a motion to adopt Resolution No. 93-3 (being a Administrator (Exhibit 6). Resolution to Lease Equipment); seconded by Councilmember Entry. Attorney Cook read Resolution No. 93-3 by title only. "A RESOLUTION TO LEASE EQUIPMENT." Administrator Drago explained in answer to Council's questions, the resolution is basically for leasing of the police cars. There is no time frame. NEW BUSINESS 7. Resolution 93-3 continued. 8. Motion to approve engineering services for an Agricultural Use Plan to Knepper & Willard in the amount of $7,480.00 - City Administrator (Exhibit 7). Councilmember Watford informed the Council that it would be necessary for him to abstain from voting on this item because the company he works with was involved in the bidding process for the cars. Vote on motion to adopt Resolution No. 93-3: KIRK ENTRY O'CONNOR WALKER WATFORD MOTION CARRIED. *Councilmember Watford will file a Conflict of Interest Form No. 8B with the City Clerk as required within ten days from this date. Councilmember Watford made a motion to approve the engineering services agreement for an Agricultural Use Plan for the Wastewater Treatment Plant to Knepper & Willard in the amount of seven thousand four hundred eighty dollars ($7,480.00); seconded by Councilmember O'Connor. Administrator Drago responded to Council's questions by stating this amount is less than the first proposal, he feels this is something the City needs to do, there will be an additional $5,000.00 for the permit fee and we are currently looking for other sites. Motion to approve engineering services for the Councilmember O'Connor made a motion to approve engineering services for the demolition of the old Wastewater Treatment Plant demolition of the old wastewater Treatment Plant (at Southeast 6th Avenue and 7th and design of a new Master Lift Station to Knepper Street) and the design of a new Master Lift Station to Knepper & Willard in the amount & Willard in the amount of $24,420.00 - City of twenty-four thousand four hundred twenty dollars ($24,420.00); seconded by Administrator (Exhibit 8). Councilmember Entry. There was a brief discussion among Council and staff. Administrator Drago also pointed out this a budgeted item. Mayor Kirk advised there needed to be a motion to remove this item (10) from the table before it could be discussed. Councilmember Watford made a motion to remove from the table Ordinance No. 659; seconded by Councilmember O'Connor. KIRK X ENTRY X O'CONNOR X WALKER X WATFORD X MOTION CARRIED. Following lengthy discussion among Council and Attorney Cook concerning "repeat violators", Council instructed Attorney Cook to amend the Ordinance from five years to two years concerning the time period a property owner is considered a repeat violator and bring the Ordinance back to the next Council meeting. - of 1 - Regular Meeting Page 8 1 993 R Y � 9 9 9 AGENDA COUNCILMEMBER ACTION Y N1[ A F. NEW BUSINESS 11. Discuss liens to be foreclosed - City Attorney Attorney Cook explained to the Council the listing in Exhibit Ten represents property (Exhibit 10). owners who have not paid fees to the Code Enforcement Board. He also explained the cost to foreclose on these properties could be from three hundred ($300) to five hundred ($500) dollars. Council instructed Attorney Cook to meet with Administrator Drago and research exactly how much it would cost to foreclose on the properties listed in Exhibit Ten. 12. Hear from Mr. Bill Reese regarding a meeting with Engineer Bill Reese appeared before the Council explaining his opinions from the Bion Technologies and DER - Mr. Bill Reese meeting between Bion Technologies and the Department of Environmental Regulation (Exhibit 11). (DER). Engineer Reese and Administrator Drago were present at the meeting upon instruction of the Council. The topic of discussion was a proposed expansion of the City's Wastewater Treatment Plant. Engineer Reese stated all of DER's concerns further explaining they are not against Bion's methods, only that more testing and research needs to be done before permitting will be granted. There was a lengthy discussion among Council and Staff. Mayor Kirk stated his concerns that it seems we are "a far cry from where we started" and the City does not have the time to wait for Bion's methods to be permitted. Councilmember Watford asked Administrator Drago to discuss with Knepper & Willard if they are looking for a new area for a wastewater treatment plant and what would be their recommendation to upgrade the existing wastewater treatment plant to .9 gpd. Council agreed with Councilmember Watford's suggestion and instructed Administrator Drago to meet with Knepper & Willard on those issues. Administrator Drago stated Knepper & Willard will be at the next Council meeting. a reW May 18 1993 - Regular Meeting- Page >: AGENDA COUNC►LMEMBER ACTION Y N A F. NEW BUSINESS 13. Hear from Mr. Mike Morrell regarding the Attorney Mike Morrell appeared before the Council giving a overview of the amendments to the City's Comp Plan - Mr. Mike Comprehensive Plan Amendment Process - Cycle 1. There are thirty applications for Morrell. amendments from twenty-five property owners. A total of thirty-five acres is involved and will be considered. He further commented on discussions with Doug Leonard of the Central Florida Regional Planning Council (CFRPC) and Jeff Hopper (formerly associated with CFRPC) who did the City's Future Land Use Map. Attorney Morrell also explained to the Council a new law that will become effective July 1st. This law will expedite the process in which the Department of Community Affairs (DCA) reviews the plan amendments. He recommended to the Council that they wait until after July 1st to submit the thirty plan amendments to DCA. There are three phases the amendments will go through: 1) Council submits amendments to DCA. DCA has forty-five days to review, (If they chose or if a citizen requests a review. Under the new law DCA does not have to review the amendments); 2) Council will hold a public hearing for the amendments and adopts them. DCA has forty-five days to find the amendments in compliance. 3) Citizens have twenty-one days to oppose any amendment. Total of one hundred ten days before amendments will be adopted and in compliance. There was a lengthy discussion among Council, Attorney Morrell, Citizens Red Larson, John Prevatt, Mary Ann Newcomer, Wanda Morgan, Frank Altobello and Mac Simpson. Councilmember O'Connor made a motion to follow staff recommendation to wait until July 1st to submit the Comprehensive Plan Amendments and set the Public Hearing for July 6th: seconded by Councilmember Walker. Councilmember O'Connor made a motion to start Cycle lI immediately. Motion was withdrawn. Discussion ensued concerning the opening date of Cycle ll. Mayor Kirk stated the Comprehensive Plan Land Use Map needs to be advertised with the notice the City is opening Cycle ll. Councilmember Watford made a motion to open the Comprehensive Plan Amendment Process - Cycle // on July 12th and keep it open for eight weeks (September 7th): seconded by Councilmember O'Connor. He also requested Administrator Drago submit to the Council a listing of positions that are up for raises.
