The CITY hereby grants this revocable license for the use of a portion of the Alleyway and Right -of -Way as follows: That part of the 15 -Foot wide Alleyway lying between Lots 3 and 4 through 6 (that is parallel to Lot 3); Block 192, CITY OF OKEECHOBEE; and the West 35- Feet of Southwest 6th Avenue, from the South boundary line of Southwest 5th Street to the North boundary line of the East/West Alley in Block 192, CITY OF OKEECHOBEE; According to the Plat thereof recorded in Plat Books 1 and 5, Pages 10 and 5, of the Public Records of Okeechobee County, Florida. 2. The OWNERS understand they will maintain the Alleyway and Right -of -Way. Should it ever become necessary to remove any fencing /gates, or improvement thereon, in order to allow either the installation or maintenance of water, sewer, or other utility lines or any other type of installation or construction, or for any other reason chosen by the CITY, the fencing /gates, or any improvement thereon, will be removed by the OWNERS or their agents and /or assignees at the OWNERS expense within seven days of receipt of written request by the CITY for such removal. Should the CITY, for valid reasons, require the removal of the fencing /gates, or any improvements thereon, less than seven days' notice, the OWNERS agree to exercise reasonable efforts to comply with such requests. 3. OWNERS agree to contact their insurance company and require an endorsement be added to their General Liability Insurance policy listing the CITY as an additional insured with a Certificate of Insurance, as well as a certified copy of the endorsement, furnished to the CITY showing the part of the 15 -Foot wide Alleyway lying between Lots 3 and 4 through 6 (that is parallel to Lot 3); Block 192, CITY OF OKEECHOBEE; and the West 35 -Feet of Southwest 6th Avenue, from the South boundary line of Southwest 5th Street to the North boundary line of the East/West Alley in Block 192, CITY OF OKEECHOBEE; According to the Plat thereof recorded in Plat Books 1 and 5, Pages 10 and 5, of the Public Records of Okeechobee County, Florida, as herein described, to be used by them, insuring the CITY against any liability arising out of alleged injuries or other activities which may occur within the Alleyway and Right -of -Way. OWNERS shall not, by such improvements made to that described Alleyway and /or Right -of -Way, obstruct, close or otherwise restrict access to the Alleyway and /or Right -of -Way for travel thereon by the CITY or the general public, except as otherwise provided in this agreement. a) OWNERS understand and agree that gate(s) must be installed at the North and South ends of the Alleyway in said Block 192. 6. OWNERS agree this license is non - assignable without the express written consent of the CITY; and if owners sell or transfer the subject property, their covenants and agreements shall run with the land. 7 The City Clerk shall cause this license to be recorded in the public records of Okeechobee County, Florida. 8. The second is a copy of an excerpt of our City research map I made for General Services when you initially came in asking about the potential of obtaining use for the East /West alley, a portion of the North /South alley (between Lots 3, 4, 5, 6) in Block 192 and the portion of (unimproved) $W 6th Avenue between Lot 6 of Block 193 and Lot 1 of Block 192, CITY OF OKEECHOBEE subdivision. 1 I would add one clarification on the checklist, the fourth row reads, "The Property Owner obtains letters from adjoining property owners whether this do or do not object." This includes both parties listed on the deeds. For example if a husband and wife are both listed on the deed (Mr. and Mrs. John Doe), both have to provide signatures of objecting or not objecting. For convenience, it can be done together on one letter. If you proceed as originally requested, you'll need letters from all the owners within Block 192 and 193. You'll want to complete each step in order listed as we cannot proceed until our City Public Works Director (Mr. David Allen) conducts the initial field study, followed by the notice from OUA regarding the location of lines.
