Following discussion Councilmembers Watford And Entry withdrew their motion. Councilmember Watford made a motion to approve a final pay request to McKuen Construction, Inc. in the amount of one thousand nine hundred dollars ($1,900.00) for the Southeast 8th Avenue Sidewalk Phase I, subject to the City receiving the letter from the property owner stating the excess soil has been removed, seconded by Councilmember Entry. Motion to approve additional inspection services to Councilmember Entry made a motion to approve additional services to Reese, Reese, Macon and Associates for the CDBG Project Macon and Associates for CDBG Project in the amount of two thousand six in the amount of $2, 600.00 - City Administrator hundred dollars ($2, 600.00); seconded by Councilmember O'Connor. (Exhibit 7). Engineer Reese commented the Council granted Edens a ninety day time extension at the last meeting and this is to cover the inspections for the extra time. Hear from Mr. Vincent LaMariana concerning Council discussed with Mr. Vincent LaMariana his proposal to sublease one subleasing one acre of property at the Wastewater acre of property at the Wastewater Treatment Plant. Attached in exhibit nine is Plant - Mr. Vincent LaMariana (Exhibit 9). a letter from the Department of Natural Resources listing all the things which must be completed in order for Mr. LaMariana to sublease the acre. Council instructed Mr. LaMariana to resubmit his proposal at a later date. 39 F. AGENDA NEW BUSINESS 10. Discuss the Utility Appraisal - Mayor Kirk (Exhibit 10) 11. Hear from Bion Technologies - Mr. Mike Norman (Exhibit 11). April 6, 1993 - Regular Meeting - Page 10 of 12 COUNCIL ACTION Mayor Kirk updated the Council on the Utility Appraisal issue. Stating further, before the meeting tonight he was told the maximum the County would be willing to put into the authority was $2 million and this amount being stated before the appraisal of the City's system is complete. This news is very upsetting, and is not in the direction he was under the impression the meetings and discussion had headed. At this time he explained if the Council wished to continue in the same direction with holding meetings with the County they would need to appoint someone else. Councilmembers commented this information was very disappointing. No action was taken on this item. Mr. Mike Norman of Bion Technologies appeared before the Council requesting a another appearance with the Council to go into their proposal more thoroughly for a wastewater treatment plant. Mayor instructed Administrator Drago to watch the agenda and if the next meeting was heavy to call a workshop with Bion Technologies representatives for presentation and discussion of their proposal. Discuss awarding a construction contract to Butler Councilmember Watford made a motion that we accept the low bid from Construction for the Ground Water Plant - Mr. Bill Butler Construction in the amount of two million seven hundred sixty-five Reese (Exhibit 12). thousand dollars ($2, 765, 000.00) for the Ground Water Treatment Plant; seconded by Councilmember Entry. There was lengthy discussion held among Council and Engineer Reese. Council also discussed the additional estimated $1.3 to $1.5 million cost for the pipeline to connect the groundwater plant and repair some existing pipe. The proposal is this, and the County is looking forward to formal acceptance by the City. 1. As a result of the appraisal process, the City Water System will be contributed to the "Authority". The value as derived by the appraisal will be matched by the County and contributed to the "Authority". No funding will be afforded to the City for the contribution to the Authority. 2. The County would request that spending of the recent bond issue (5.5 million) money, be curtailed until the process of the Utility Formation has a clear direction between the City and the County. 3. The County would request that any additional indebtedness not take place until the process of the Utility Formation has a clear direction between the City and the County. Please let me know the City's position on this matter as soon as Possible, as any delays on this matter can be costly to the resident users of the system. Bion's proposal will describe an MSR based permittable wastewater treatment system that has the following features: 1. Provide the City with 1.3 million gallons per day (average daily flow) of FDER permitted wastewater treatment capacity. 2. Produce final effluent quality that meets or exceeds regulatory requirements. 3. Provide the City with a design, permit and build, fixed cost system for 2.6 million dollars. 4. Provide a system with low operation and maintenance costs. 5. Provide full capacity by the end of 1994. 6. Provide expansion capability at low cost to treat 2.0 million gallons per day (average daily flow) through adding offsite reuse or securing a discharge permit. 7. Meet FDER environmental enhancement goals for wastewater treatment and reuse. Okeechobee City Council April 2, 1993 Page 2 8. Provide distinct enhancement of the public image of the City by creating a large wetlands -like environmentally sound habitat. 9. Eliminate need for immediate acquisition (through lease or purchase) of additional offsite water disposal areas. 10. Provide the City with Bion's assistance in all regulatory interfaces concerning this project. 11. Will not require the City to pay for the plant until the modifications are complete and the plant is accepted by FDER. Bion believes that this represents an extremely sound wastewater treatment system expansion for the City. It will enhance the economic attractiveness of Okeechobee by providing additional capacity at an early date while holding debt service costs and customer rate charges at a lower level than might otherwise be possible. A bid tabulation is enclosed for your reference. The low bid is from Butler Construction Company, Inc. in the amount of $2,765,000. This is well within the original construction cost estimate. We have investigated the qualifications of the low bidder and the various named subcontractors. Copies of the information supplied by the low bidder are enclosed. Our investigation has revealed that, in our opinion, Butler Construction Company, Inc. has suitable credentials to perform this work. This project will be amongst the largest of this type they have completed. However, they received an excellent reference from Indian River County on a similar size effort. We do have some reservations related to some of the named subcontractors. Under the contract we have the right to request a change in subcontractors after award, subject to adjustment of cost. We will plan to watch this very closely and make the adjustments if performance so dictates. We recommend award to Butler Construction Company, Inc. in the low bid amount of $2,765,000. Please advise if Council elects to proceed with this recommendation. We will prepare contract documents and direct the Contractor to proceed with securing bonds immediately after award.
