Call Special Meeting to order on June 19, 1997 at 6:00 p.m. Mayor Kirk called the June 19, 1997 Special Meeting to order at 6:00 p.m. B. Mayor and Council Attendance: Clerk Thomas called the roll. - Mayor James E. Kirk Present Council Member Noel A. Cook Present City Clerk Bonnie S. Thomas Present Deputy Clerk S. Lane Gamiotea Present 11 C. Discuss Employee Agreement - Mayor Kirk. Mayor Kirk opened the floor for discussion concerning the language in the proposed employment contract that the City will offer to the top candidate for the City Administrator position. The following items were noted to be reworded and/or revised in the discussion: Page 2, under Section 1. Employment, paragraph C. Council suggested "unsatisfactory evaluation" definition should be expanded in this paragraph. Page 3, under Section 2. Terms of Employment, paragraph D, second sentence. Reword to state: "A termination without cause shall require a fourth -fifth's vote." Same page and section, paragraph F, last sentence. Change paid in equal installments every two weeks to weekly. Replace "executive secretary" with "clerical support". Page 4, same section, paragraph D. Delete that the City will pay premium for group health insurance for spouse and children. (The City does not do this for other employees). Same page and section, paragraph E, first sentence. Reword: "The Administrator is entitled and encouraged to participate in such General Employees Pension Plan." Same page, Section 4. Termination and Severance. Instructed Attorney Cook to re -word so that it is perfectly clear that the term of employment is on an annual basis. If either side does not want to renew the contract notice has to be given sixty days prior to termination date of contract. If the City terminates the contract at any other time without cause the administrator is entitled to two months severance pay which is also one -sixth of his annual salary. If the administrator is terminated with cause, he quits or contract is not renewed then he is not entitled to severance pay. Order of Procedures - Mayor Kirk. Mayor Kirk advised the Council Members they should have before them a copy of the twelve questions that will be asked each applicant. He will explain to each candidate as they come in what the procedures will be. That he will be reading the questions. Once they respond to the question, if a Council Member wants that person to elaborate further they can ask so at that time. Council agreed with the procedures established. Candidates numbers were put in a hat and drawn out as to how the order would be for the interviews. Interviews: #8/James R. Threewits I The following is the order the candidates appeared before the Council for their interview: #15/Bill Veach #34/Robert Bradshaw, #15/Bill Veach, #48/Edward J. Schmidt and #8/James R. #48/Edward J. Schmidt Threewits. #34/Robert J. Bradshaw Candidate Review. III No candidate was asked to come back for further response to interview questions. G. Discuss Interview Results and Employment Agreement. ADJOURNMENT - Mayor Kirk. PLEASE TAKE NOTICE AND BE ADVISED that if a person decides to appeal any decision made by the City Council with respect to any matter considered at this meeting, he/she may need to insure that a verbatim record of the proceeding is made, which record includes the testimony and evidence upon which the appeal is to be based. Thomas, CIVIC City Clerk JUNE 19, 1997 - SPECIAL MEETING - PAGE 3 OF 3 After discussion Council did not feel they could make a decision on one individual candidate to fill the position of City Administrator at tonight's meeting. Council agreed for Attorney Cook to distribute a copy of the proposed employment contract with the changes discussed tonight included therein to each of the four candidates; let the candidate review the contract; and find out what their response to the contract is prior to the July 1 st Council meeting. Council then instructed Clerk Thomas and Police Chief Mobley to do complete background checks on each candidate and have the information provided to the Council by the July 1st meeting so they may make a selection to fill the position at that meeting. There being no further items on the agenda, Mayor Kirk adjourned the June 19, 1997 Special Meeting at 9:00 p.m.
