Attorney Cook read proposed Ordinance No. 741 by title only as follows: "AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA AMENDING THE OFFICIAL ZONING MAP OF OKEECHOBEE BY REZONING A CERTAIN TRACT OF LAND MORE PARTICULARLY DESCRIBED HEREIN, FROM HEAVY COMMERCIAL DISTRICT (CHV), TO RESIDENTIAL SINGLE FAMILY ONE (RSF1) DISTRICT AMENDING THE ZONING MAP 11 ACCORDINGLY, PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE." 2. a) Motion to approve the first reading of proposed Ordinance No. 741. III Council Member Chandler moved to approve the first reading of proposed Ordinance No. 741; seconded by Council Member Oliver. b) Public comment. Mayor Kirk asked whether there were any questions or comments from the public. There were none. Attorney Cook called to the Council's attention the questions raised at the Planning Board meeting by surrounding property owners and that these questions would have to be addressed once this property goes before the Board of Adjustments for a Special Exception scheduled for February 22, 2000. 832 FEBRUARY 1, 2000 - REGULAR MEETING - PAGE 3 OF 7 VI. NEW BUSINESS CONTINUED. A. 2. b) Public comment continued. Council Member Markham disclosed he would have to abstain from voting on this matter due to his employment with III Culbreth Real Estate. c) Vote on motion. VOTE KIRK - YEA CHANDLER -YEA MARKHAM - ABSTAINED OLIVER - YEA WATFORD - YEA MOTION CARRIED. B. Consider proposed amendments to the Temporary Structures by Attorney Cook explained to the Council that the Code of Ordinances has more restrictions regarding Temporary Temporary Permit Section 681 of the Land Development Structures than the Land Development Regulations (LDR's) specifically temporary produce stands and off -premises Regulations - City Attorney (Exhibit 2). vehicle sales. In order to make these two documents consistent the LDR's need to be amended, if Council so desires. All amendments to the LDR's must be presented to the Land Planning Agency for review and the Agency then gives their recommendation to the Council. The Council may either uphold the Agency's recommendation or not. In regards to this proposed amendment, the Land Planning Agency recommended the Council leave the language as if is in the LDR's. Council Member Markham moved to amend the Temporary Produce Stands section of the LDR's to include the language as set out in Exhibit 2; seconded by Council Member Watford. Council Member Watford moved to amend the motion to include the additional language involving off -premises vehicle sales; seconded by Council Member Oliver. Attorney Cook suggested the Council not make specific motions at this time, but direct him to draft an ordinance for their consideration. Motion to amend and second was withdrawn from the floor. The original motion and second was withdrawn from the floor. There was a lengthy discussion between the Council and citizen Kirk Walker, who asked the Council whether they would consider allowing temporary produce stands on private property with a refundable deposit or bond. The Council stated they understood Mr. Walker's position and that it was unfortunate to penalize a few, but that allowing this would open pandora's box and they would have the problems they had before which resulted in the adoption of our current regulation codes concerning these matters. Consider proposed amendments to the Temporary Structures by Temporary Permit Section 681 of the Land Development Regulations continued. C. Consider a request to use city property located at Southwest 3`d Avenue and 23nd Street - Tom McCoin (Exhibit 3). D. Motion to enter into an agreement between the City and Craig A. Smith and Associates for professional services to seek and administer special funding projects relating to services and improvements within the City of Okeechobee - Dale Milita (Exhibit 4). Council instructed Attorney Cook to draft an ordinance for their consideration incorporating the amendments as set out in Exhibit Two. If anyone could come up with recommendations on how to allow the temporary stands as suggested by Mr. Walker to bring those recommendations and they would discuss them. Mr. Tom McCoin of Florida Youth Conservation Corp. addressed the City Council requesting permission to use City property located at the comer of Southwest 3' Avenue and 23`d Street. Block 5, Lots 7 and 8 of Royal Oaks Subdivision. This was the previous site of the Southwest Water Tower. Mr. McCoin is currently using the property to park his company vehicles on by permission of former City Administrator Robert Bradshaw. Mr. McCoin wishes to install a twenty foot by twenty foot shed on the property for tool storage, add electric and running water. He currently provides the City proof of insurance for use of the property. Following a discussion, Council instructed Attorney Cook to draft a license for use of the property, allowing for a provision to vacate the premises with notice, should the City decide they need to use the property. This matter will be considered again at the February 15, 2000 meeting. Council Member Oliver moved to enter into an agreement between the City and Craig A. Smith and Associates for professional services to seek and administer special funding projects relating to services and improvements within the City of Okeechobee; seconded by Council Member Chandler. Council inserted the effective date of March 1, 2000 in the contract. There was a brief discussion regarding this matter between the Council and County Commissioner, John Abney. This firm is also contracted by the County for the same purpose and has assisted the County in obtaining funds. Consider the adoption of proposed Ordinance No. 742 regarding a Council Member Markham presented the Council with a proposed ordinance for them to consider adopting regarding No Wake Zone on Taylor Creek within the City Limits - Council establishing No Wake Zones at least one hundred feet on both sides of the boat ramp on Taylor Creek, located at Member Markham (Exhibit 5). 11 Southeast 4`h Street. Council discussed the proposed ordinance at length. Mr. Ray Cobb, also addressed the Council on this matter explaining what a dangerous and frustrating situation it is to load boats at this ramp since there is not a no wake zone posted. Council Members Chandler, Oliver and Watford were concerned how this ordinance could be enforced and the liability the City would have on the markers placed in the water and the maintenance on those signs and markers. Chief Farrenkopf advised that as far as enforcement, all that is needed is obtaining the number off the side of the vessel and mailing the citation to the owner. The consensus of the Council was Council Member Markham and Mayor Kirk were in favor of it. Council Members Chandler, Oliver and Watford were not. No official action was taken on this matter. F. Discuss the purchase of a Lift Truck for the Public Works Attorney Cook advised the Council he researched the purchasing regulations and according to Florida Statute Department - Interim Public Works Director (Exhibit 6). 287.057(3) requires a competitive bid for commodities in excess of Category II cost which is fifteen thousand dollars, unless the Council determines there is an emergency or only a single source for the item. This purchase could be considered an emergency due to the letter the City received this week from OHSA and a sole source purchase since it is a demo. Council Member Watford stated he did some research on this item and according to figures on the State Contract, if the City purchased a 2000 Chevrolet or a Ford and had the lift installed on the truck for the amount listed in Exhibit Six, it would save approximately three to five thousand dollars. However you then have to add the cost of bidding out the trucks and there would be at least a two month wait for the truck to be delivered. Interim Public Works Director Lamb advised the Council that due to other projects during the holidays his crew was three months behind on tree and shrub trimming. Council Member Oliver moved to approve the emergency purchase for a 1999 Chevrolet Demo Unit Lift Truck from Stamm Manufacturing in the amount of thirty-four thousand, four hundred fifty dollars; seconded by Council Member Markham. FEBRUARY 1, 2000 - REGULAR MEETING - PAGE 6 OF 7 .835 VI. NEW BUSINESS CONTINUED. F. Discuss the purchase of a Lift Truck for the Public Works VOTE Department continued. Review and discuss the Public Works Director Applications -Mayor Council requested Council Members list by file number their top three choices of the Public Works Director Applicants. (Exhibit 7). The top four applicants are File No. 2 Paul Edward Carlisle, File No. 4 Ray L. Denis, File No. 9 Paul Swiech and File No. 10 Brad D. Woods. Deputy Clerk Gamiotea was instructed to contact the applicants and advise them they are invited to attend the February 15, 2000 Regular City Council Meeting for interviews. She was also instructed to make sure each applicant understands the residency policy they will be under. H. Discuss fire hydrants - Mayor. Mayor Kirk advised the Council that the topic of whether the Okeechobee Utility Authority (OUA) pays for the installation of fire hydrants when installing new water lines within the City or the City pays has never been resolved. The City has received notification of a water line upgrade and whether we wish to have the fire hydrants installed, at our expense. There is the issue of road cuts for water and wastewater line extensions and repairs. There are several road cuts that were not patched properly and causing dips in the roads due to the asphalt settling. The City is not charging the OUA for permits to perform roads cuts nor are they charging for well points performed by the City Fire Department. Following a lengthy discussion between the Council and Staff, Attorney Cook was instructed to notify the OUA on Wednesday by letter that any outstanding permits they have received from the City for road cuts are considered null and void. The one permit they are prepared to begin work on at Southwest % Avenue and 14ah Court can be completed. That the City wants the road cuts that were not done properly to be fixed and that we will be updating our permitting process allowing for inspections and compaction test on road cut pavements. That the City's interpretation of the Fire Hydrant Interlocal is that the OUA will install fire hydrants by NFPA regulations, at the OUA's cost and that the City is considering adopting an ordinance similar to the one in effect _ in St. Lucie County whereby the utility customers are responsible for fire hydrant costs. Discuss regulations for all adult entertainment establishments, book stores, etc. within the City and other outstanding City issues as listed in the Status Report - Council Member Oliver (Exhibit 8). VII. ADJOURNMENT - MAYOR. THOMAS, CMC, CITY CLERK Council Member Oliver stated that in light of recent events in the County he wanted to make sure the City was covered as far as implementing as many restrictions as possible on adult entertainment businesses of all kind. Attorney Cook advised the City was covered as far as prohibiting public nudity and linking it with alcoholic beverage sales but that there are a few areas that are not addressed as far as book, video and merchandise stores. The Land Development Regulations have adult entertainment establishments listed in Industrial Zoning Districts as a Special Exception with minimum distance regulations. However the County is currently reviewing and considering a very good ordinance that he suggests the City also adopt. Following a brief discussion, Attorney Cook was instructed to contact County Attorney Cassels to research what the County's time schedule was on adopting the ordinance and if they were going to only discuss it for a few months, that the City proceed without them on adopting it. He was also instructed to research how this will impact current video stores that have adult films in separate rooms. In regards to other outstanding items on the Status Report for the Attorney, Council Member Oliver suggested Attorney Cook review the Status Report prior to its printing deadline and give better updates to the Council and the progress he is making on these items. Council agreed. Consider a proposed amendment to City Land Development Attorney Cook gave an overview of the Agency's discussion at December 21, 1999 meeting. He stated that the Regulations, Section 680 Temporary Structures. Attorney proposed amendments would make the Land Development Regulation consistent with existing Ordinance No. Cook - (Exhibit 1 ). 703. One specific area of discussion has been temporary produce stands, which were prohibited by the Ordinance, but is permitted by the Land Development Regulations. Attorney Cook continued, the produce stands the City has are considered permanent business locations that has an occupational license or like any other business. Citizen Kirk Walker addressed the Agency and asked them to consider temporary produce stands in the City and require a deposit or bond to make sure the area that is used is cleaned up once the produce stand is no long f,I in use. The Official recommendation of Agency to the Council is to leave the language in the land Development Regulation's as it is. B. There was discussion regarding towers being engineered for wind and the distance of lattice towers Planning Consultant Jock Robertson stated he received a letter from Attorney Alan L. Gabriel, Attorney for Nextel, which raised some questions so he would like to table the action until he met with City to get their interest on this matter. "Slow Speed Minimum Wake Zone" means the vessel must be fully off plane and settled in the water. It may not proceed at the speed greater than that speed which is reasonable and prudent to avoid the creation of an excessive wake. Section Three. DESIGNATION AND POSTING. The City Council of the City of Okeechobee may designate by Resolution any area as an official "No Wake/Idle Speed Only Zone" or "Slow Speed/Minimum Wake Zone." Any area so designated shall be posted in such a manner and place that the designation may be reasonably expected to be seen and read by a person in operation of any vessel within the area. These areas shall be posted within close proximity to public boat ramps and public docks, to which the zones have been legally established within the jurisdictional boundaries of the City of Okeechobee, Florida. The provisions of this ordinance shall apply to all vessels and water craft including those that are powered by a propulsion devise, including "Jet Skis" and similar craft. For purposes of enforcement, the City of Okeechobee adopts and incorporated herein the provisions of the Chapter 327, Florida Statutes, throughout navigable waters within and adjoining the City of Okeechobee. Section Five. PENALTIES. Five, including the one that was stopped on Friday have not been completed. Six are completed. Of those six, one was a jack and bore, one was no problem and four have dips in the roads due to the asphalt settling. My recommendation to the City Council in addition to drawing up a better permit, if Council so desires, is to honor the remaining five permits issued contingent upon the OUA correcting the less than acceptable patch work on the four completed road cuts. Whatever the Council's action is at Tuesday nights meeting concerning road cuts, fire hydrants and well points, I will relay Wednesday morning to LC and the OUA. I need to know the Council's wishes in respect to these five permits. In regards to the entrances and exists along South Parrott Avenue, DOT advised Monday that they will perform a study on this dangerous situation and advise us of their recommendations. The traffic light study at SW 4' Street and Parrott Avenue is scheduled sometime soon and Debra will notify us as soon as she gets the date. The discussion regarding telecommunications and cellular towers in zoning districts was tabled until the February 22"d meeting. Met on Tuesday, January 25, 2000 and recommended approval of a Rezoning Application submitted by Sylvia Nelson in order to rezone Lot 8 of Block 253, 1 st Addition to the City of Okeechobee from C2 to RSF (corner of SE 2"d St & 511 Ave). Survey work by Lawson, Noble and Webb for the City Hall Park has begun. A boundary survey and topographical survey is included. After the survey is completed, LNW will prepare a site plan for the Park. In addition the deed change documentation changing the site from a municipal pool to municipal park has been prepared and forwarded to Gil Culbreth. Once he signs it, it will be sent to David Hamrick for his signature. The web page is up and running though Julie is still working on a page for the police dept as well as on the Okeechobee Information Page. Since the web page has been online, Julie has gotten many requests for information regarding Okeechobee. Julie has made up a small visitors guide that is posted online and can be printed by visitors to our site. The visitor's guide can be found at www.citvofokeechobee.com/visitor'squide.htm.. Hopefully this will assist visitors and will cut down on having to send via regular mail. Since the page has been online, we have received 7934 hits for the entire site and has 1252 user sessions.
