Mr. Bubba Fludd was in attendance with his mother Toemyka Peterson, OHS Principal Dylan Tedders, and Head
Football Coach Chris Branham to receive a certificate of achievement, presented by Mayor Watford and read as
follows: "Whereas, the City of Okeechobee deems it befitting to honor the youth of our community who
inspire to dream, do more and become more as a future leader, and Whereas, Mr. Bubba Fludd, a Senior
attending the Okeechobee High School was recently selected as a Utility Defense Player for the Class 6A
All -State First Football Team; and Whereas, Bubba's hometown, the City of Okeechobee, is proud to
recognize his dedication and achievements to Athletics and Academics as one of the most decorated and
greatest quarterbacks, cornerbacks and impact player in the history of the Football Program at Okeechobee
High School, to wit: 2013 OHS Defensive Player of the Year, 2014, 2015, & 2016 OHS Offensive Player (continued)

Therefore, 1, Dowling R. Watford, Jr., by virtue of the authority vested in me as Mayor of the City of
Okeechobee, Florida, proudly to recognize Bubba's achievements as an athlete, student, and young
mentor. May his leadership continue to serve as an example for the youth of our community."
The Mayor and City Council took a moment to share their memories of family members or themselves being on the
football team. Further, encouraging Mr. Fludd to seek appropriate guidance when he leaves for College to ensure
his continued success. He was also presented with "My City, I'm Part of It, I'm Proud of It" mementos.
March was proclaimed as American Red Cross Month. Mayor Watford presented the proclamation to Mr. John
and Mrs. Peggy Dubose, and Mr. Chuck Akers which was read as follows: "Whereas, we have a long history of
helping our neighbors in need. American Red Cross Month is a special time to recognize and thank our
heroes — those Red Cross volunteers and donors who give of their time and resources to help community
members; and Whereas, these heroes help families find shelter after a home fire. They give blood to help
trauma victims and cancer patients. They deliver comfort items to military members in the hospital. They
use their lifesaving skills to save someone from a heart attack, drowning or choking. They enable children
around the globe to be vaccinated against measles and rubella; and Whereas, the American Red Cross
depends on local heroes to deliver help and hope during a disaster. We applaud our heroes who give of
themselves to assist their neighbors when they need a helping hand, and Whereas, across the country and
around the world, the American Red Cross responds to disasters big and small. In fact, every eight minutes
the organization responds to a community disaster, providing shelter, food, emotional support and other
necessities to those affected. It collects nearly 40 percent of the nation's blood supply; provides 24-hour
support to military members, veterans and their families; teaches millions lifesaving skills, such as
lifeguarding and CPR; and through its Restoring Family Links Program, connects family members
separated by crisis, conflict or migration; and Whereas, we dedicate the month of March to all those who
support the American Red Cross mission to prevent and alleviate human suffering in the face of
emergencies. Our community depends on the American Red Cross, which relies on donations of time and
money to fulfill its humanitarian mission. Now, Therefore, 1, Dowling R. Watford, Jr., by virtue of the
authority vested in me as Mayor of the City of Okeechobee, Florida, do hereby proclaim March, 2017 as
`American Red Cross Month'."

meeting of February 21, 2017; seconded by Council Member Clark. There was no discussion on this item.

EXTENDING DATE OF MORATORIUM; PROVIDING FOR SUNSET PROVISION; PROVIDING FOR CONFLICT;
PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE."
Motion and second by Council Members Clark and O'Connor to approve the first reading of proposed Ordinance No
1153.
Mayor Watford asked whether there were any comments or questions from the public. There were none. Attorney
Cook stated the State Legislation should have regulations put in place prior to the expiration of the extension from
what he has read. Administrator MontesDeOca added, City Staff will be coordinating with the County regarding what
regulations they adopt for consistency.

Council Member Chandler moved to approve a Temporary Street Closing Application submitted by Okeechobee
Main Street, temporarily closing a portion of Southwest 2nd 3rd, and 4th Avenues between North and South Park
Streets from 5:00 P.M. Friday, March 10, 2017, to 3:00 P.M. Sunday, March 12, 2017, for the Speckled Perch
Festival; seconded by Council Member O'Connor.

Motion and second by Council Members O'Connor and Chandler to terminate the (January 21, 1992) CSX
Transportation, Inc. Crossing Maintenance Agreement (for Northwest 9th Avenue, U.S. DOT /AAR 628055-B).
Attorney Cook explained the executed Agreement was to replace and maintain the railroad crossing due to extreme
roughness. Section One provides the initial terms of the Agreement and reads as follows: "Railroad shall provide
track materials, labor and equipment necessary for removing the existing grade crossing surface and installing new
full depth rubber crossing surface material and any track rehabilitation required at the aforesaid location. City shall
provide for full depth rubber crossing material, barricades and resurfacing of approaches to said crossing."The City
paid $16,000.00 to CSX at the time of execution.
Recently, the City received an invoice for $38,000.00+/- from CSX to recoup the costs of the crossing replacement
that occurred in 2015. Section four of the Agreement provides terms on replacement procedures and reads as
follows: "After the full depth rubber crossing surface material has been installed at subject locations, it shall
hereafter be maintained in good condition by the Railroad through the useful life of such crossing surface material,
and when it becomes necessary to replace or rebuild the crossing surface, Railroad will replace and maintain the
crossing surface, but at the expense of the City. The City will instruct the Railroad what type of crossing surface
material is to be installed upon future reconstruction.

accept the award in the amount of $1,952.00 for the Okeechobee City
Police Department Community Policing Project - City Clerk (Exhibit 4).

In the event funds are made available by Federal or State laws or regulations for the purpose of assuming, in whole
or in part, the expense of maintaining grade crossing surfaces, nothing herein shall continue to obligate the Railroad
to bear such expense to the extent that such public funds are made available for such purposes." Timber was used
instead of rubber causing the crossing to become rough again, and to the City's knowledge, no input was asked for
or given regarding the type of crossing surface material to be installed. Attorney Cook has written to CSX informing
them the City will not pay the invoice due to their failure to comply with Section Four of the Agreement. He is
recommending termination due to this fact.

Council Member O'Connor moved to ratify a Florida Department of Law Enforcement Grant Application No.
2017-JAGD-OKEE-1-F8-069; and accept the award in the amount of $1,952.00 for the Okeechobee City Police
Department Community Policing Project; seconded by Council Member Chandler.
Officer Ziegler applied for this Grant to receive funds to purchase one soft shell canopy imprinted with the City
Police Badge, two folding tables, eight folding chairs, one table throw, and one literature stand to be used for the
Community Outreach Program.

ORDINANCE NO. 1153
AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA AMENDING
ORDINANCE NO. 1146, MEDICAL MARIJUANA MORATORIUM; EXTENDING
DATE OF MORATORIUM; PROVIDING FOR SUNSET PROVISION;
PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the City of Okeechobee, Florida heretofore approved Ordinance No. 1146, which
created a moratorium on the issuance of any permits or Business Tax Receipts for the
establishment of a business to engage in the dispensing of medical marijuana, due to
lack of State legislation on the subject; and
WHEREAS, Ordinance No. 1146 by its language, is set to expire on or about April 1, 2017,
and the State of Florida has yet to announce any State regulations or legislative action
to offer guidance to local government, so the City deems it appropriate to extend the
moratorium previously enacted.
NOW, THEREFORE, be it ordained before the City Council of the City of Okeechobee, Florida;
presented at a duly advertised public meeting; and passed by majority vote of the City
Council; and properly executed by the Mayor or designee, as Chief Presiding Officer for
the City; that:
SECTION 1.
THAT the City Council of the City of Okeechobee, Florida, hereby enacts and imposes a
Moratorium which has the effect of prohibiting and preventing any Department of the
City of Okeechobee from accepting an application for Business Tax Receipt,
Occupational License, Land Use or Zoning change, Special Exception, or in any
manner acting upon a request of any person or entity for the establishment of a
business location within the City that is for the purpose of selling, distributing,
advertising, or in any manner promoting the sale and/or distribution of marijuana for
medical, or any other purpose.
SECTION 2.
THAT this Moratorium shall remain in effect for 180 days from the effective date hereof,
pending further action by the City Council of the City of Okeechobee, Florida, which
may then impose additional regulations, or Land Use or Zoning restrictions, on the
operation of such a business.
SECTION 3.
THAT this Moratorium shall expire automatically without further action by the City
Council of the City of Okeechobee, Florida, 180 days from final adoption of the
Ordinance unless the City takes further action to extend it.
SECTION 4.
THAT upon issuance of regulations or legislation by the State of Florida on the means,
method and location of dispensing organizations prior to the expiration of this
Ordinance, the City of Okeechobee may, at that time, address the adoption of local
Ordinances to further regulate the dispensing, Zoning, and location of such business'
within the City.
SECTION 5.
All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
SECTION 6.
Should any provision or portion of this Ordinance be declared by a court of competent
jurisdiction to be void, unconstitutional, or unenforceable, then all remaining provisions
and portions of this Ordinance shall remain in full force and effect.
SECTION 7.
This Ordinance shall take effect immediately upon its passage.

This Agreement, made and entered into this ?may} day of
1992, by and between CSX TRANSPORTATION, INC., a Virginia
corporation, hereinafter referred to as the RAILROAD and the CITY
OF OKEECHOBEE, FLORIDA, a municipal corporation under the laws of
the State of Florida, hereinafter referred to as the CITY;
WITNESSETH, THAT:
WHEREAS, in the interest of public safety and convenience,
the CITY desires and the RAILROAD is willing to install full
depth rubber crossing surface material at the following grade
crossing in Okeechobee, Florida:

ll; Railroad shall provide track materials, labor and
equipment necessary for removing the existing grade crossing
surface and installing new full depth rubber crossing surface
material and any track rehabilitation required at the aforesaid
location. City shall provide for full depth rubber crossing
material, barricades and resurfacing of approaches to said
crossing.
2. Simultaneously with the execution of this agreement by
the City, the City hereby agrees to deposit with the Railroad the
sum of $16,000.00, being the estimated cost of ninety (90) track
feet of full depth rubber crossing surface material, including
shipping and handling charges (($185.00 - $22.00) x 901+ shipping
and handling]. In the event said deposit is less than the actual
cost borne by the Railroad, the City shall also, upon receipt of
a bill rendered by the Railroad, promptly pay such additional
cost to the Railroad. In the event said deposit is in excess of
the actual cost borne by the Railroad, the Railroad shall
promptly refund the difference to the City. Railroad account
which supports bill rendered shall be kept in such a manner that
it can be readily audited by the City and actual cost readily
determined.
3. Promptly upon execution of this agreement, and payment of
the deposit to the Railroad, the Railroad hereby agrees to
proceed with the procurement of necessary materials and to
complete the installation of the aforesaid mentioned crossings.
After the full depth rubber crossing surface material has
been installed at subject locations, it shall hereafter be
maintained in good condition by the Railroad through the useful
life of such crossing surface material, and when it becomes
necessary to replace or rebuild the crossing surface, Railroad
will replace and maintain the crossing surface, but at the

expense of the City. The City will instruct the Railroad what
type of crossing surface material is to be installed upon future
reconstruction. In the event funds are made available by Federal
or State laws or regulations for the purpose of assuming, in
whole or in part, the expense of maintaining grade crossing
surfaces, nothing herein shall continue to obligate the Railroad
to bear such expense to the extent that such public funds are
made available for such purposes.
5. This agreement shall inure to the benefit of and be
binding upon the successors and assigns of the respective parties
hereto.
6. It is understood and agreed that this agreement shall not
be binding until it has been authorized or ratified by a proper
ordinance or resolution of the City Council of the City of
Okeechobee, Florida, a certified copy of which ordinance or
resolution is attached hereto and made a part hereof.

Mr. John R. Cook, City Attorney, has advised the City that

understanding that any future repairs and expenses will be handled
in a similar agreement negotiated at that time.

Attorney Cook advised the language can be worked out and he did
not think it
was necessary for it to be in the motion. It is
just not clear what their intent is. It
is something I think I
can "x" out and they will not object to it.
Public Works Director Elders commented, just so it is not
misunderstood later
on, this is just for the repairing of the
railxdad tracks. The City is going to have to asphalt to
up and
in between the tracks, but it will still be considerably
cheaper.

we could ever hope for.

The Florida Department of Law Enforcement is pleased to award an Edward Byrne Memorial Justice Assistance
Grant (JAG) subgrant to your unit of government in the amount of $ 1,952.00 for the project entitled, OCPD
COMMUNITY POLICING PROJECT. This subaward is approved under Florida's state JAG award 2016-MU-BX-0073
from the Department of Justice (DOJ). These funds shall be utilized for the purpose of reducing crime and improving
public safety and the criminal justice system.
Enclosed is a copy of the approved subaward application with the referenced contract number and standard
conditions. This subaward is subject to all administrative and financial requirements, including timely submission of all
financial and performance reports and compliance with all standard conditions.
Information from subawards and performance reports are provided to the DOJ Performance Measurement Tool
(PMT) and Federal Funding Accountability and Transparency Act (FFATA) systems to meet federal transparency
requirements. Contract and grant information is also provided to the State of Florida, Department of Financial
Services (DFS) via the Florida Accountability Contract Tracking System (FACTS). This grant agreement and all
correlating information including general contract, performance, amendment/modification information and a copy of
the grant document is provided to FACTS to meet requirements under Chapter 2013-54 and 2013-154 Laws of
Florida. If this agreement contains confidential or exempt information not subject to disclosure under Chapter 119,
F.S., please contact the Office of Criminal Justice Grants (OCJG) for guidance on requesting exemption.
Please complete and return the enclosed forms within 30 calendar days from the date of award. Completion of the
Certificate of Acceptance constitutes official acceptance of the subaward and must be received by the Department
prior to reimbursement of any project expenditures.
Some costs require prior written approval from OCJG and DOJ before beginning project activities. If your subaward
contains any such items or those listed on the Bureau of Justice Assistance (BJA) Controlled Expenditures List, a

Problem Identification
There is a problem with a lack of trust in police today. This is probably due to several different
reasons, one of which being the lack of the public's understanding of the multi -faceted role that
law enforcement plays in the local community. One of the most important roles the law
enforcement officer can perform is that of educator.
There is a increased need for crime prevention and education within the community. It is a proven
fact that crime prevention education and problem solving activities can bring about a decrease in
crime and more positives outcomes for the community.
Project Summary (Scope of Work)
We would like to purchase a reusable portable Police shelter, i.e., a specially fabricated heavy
duty portable soft shell canopy type structure along with folding tables and chairs and a special
display stand that will permit crime prevention materials to be displayed for the public.
This mobile shelter will be used in a variety of different locations in conjunction with many different
crime prevention related activities.

financial ledger as necessary to show proof of purchase and payments for all items purchased
with grant funds.
