FEBRUARY 7, 2017 - REGULAR MEETING - PAGE 2 OF 8 COUNCIL ACTION - DISCUSSION - VOTE Police Officer Aurelio Almazan, accompanied by his parents Maryanna and Nicandro Almazan, joined Chief Peterson and Major Hagan at the podium where Officer Almazan's promotion to Sergeant was announced. He was pinned with his Sergeant Badge by his mother. Sergeant Almazan thanked the Council, Chief, and Major for this opportunity. On behalf of the City, Mayor Watford and Police Chief Peterson presented Mr. Jeremy LaRue with an engraved Cross pen and a framed certificate which read, "In recognition of your 5-years of service, hard work, and dedication to the City, its citizens, and your fellow employees from February 10, 201Z to February 10, 2017." On behalf of the City, Mayor Watford and Fire Chief Smith presented Mr. Mitchell Brydebell with an embossed portfolio and a framed certificate which read, "In recognition of your 10-years of service, hard work, and dedication to the City, its citizens, and your fellow employees from February 16, 2007, to February 16, 2017." On behalf of the City, Mayor Watford presented Fire Chief Herb Smith with a Longevity Service Award in the amount of $500.00 and a framed certificate which read, "In recognition of your 25-years of service, hard work, and dedication to the City, its citizens, and your fellow employees from February 3, 1992, to February 3, 2017." Council Member O'Connor moved to dispense with the reading and approve the Summary of Council Action for the meeting of January 17, 2017; seconded by Council Member Clark. COUNCIL ACTION - DISCUSSION - VOTE Attorney Cook read proposed Ordinance No. 1149 by title only as follows: "AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA; AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF OKEECHOBEE BY REZONING A CERTAIN TRACT OF LAND MORE PARTICULARLY DESCRIBED HEREIN, FROM INDUSTRIAL TO HEAVY COMMERCIAL ZONING DISTRICT (PETITION NO. 16-005-R); AMENDING THE ZONING MAP ACCORDINGLY, PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY, PROVIDING FOR AN EFFECTIVE DATE." Motion and second by Council Members Ritter and O'Connor to adopt proposed Ordinance No. 1149. Mayor Watford yielded the floor to Mr. Bill Brisson, the City Planning Consultant, LaRue Planning and Management Services, Inc., who explained Petition No. 16-005-R was reviewed by the Planning Board on December 15, 2016, and is recommending approval based on the findings within the Planning Staff Report. The requested rezoning is consistent with the Comprehensive Plan and will eliminate existing inconsistencies between the Future Land Use and Zoning Maps. Lots 6 and 7 have existing commercial uses. It is anticipated those will remain in operation. Lots 8 through 10 have a proposed use for outdoor sales and storage. As required for this type of use, the owner applied and obtained approval for Special Exception Petition No. 16-005-SE on December 15, 2016. The proposed use will not have an adverse effect on the public interest, property values or living conditions. The proposed use will actually raise the value of each property. All non -vacant properties in the neighborhood are currently developed with either commercial or industrial uses. There should be little or no need to buffer surrounding uses from the proposed use on the property. The proposed use will not create a density pattern that would overburden public facilities such as schools, streets, and utility services as the proposed use is not residential. The proposed use should result in little to no incremental increase on the demand for potable water, wastewater treatment and disposal, solid waste collection and disposal, or impact on the local roadway system. A potential traffic impact relating to deliveries was addressed with possible solutions, should this become an issue. The proposed use should not create flooding problems and has not been inordinately burdened by unnecessary restrictions. Mayor Watford asked whether there were any questions or comments from the public. There were none. Clerk Gamiotea reported 16 notices were mailed to surrounding property owners, three signs were posted on the property, and notices were published in the local newspaper. No objections or comments have been received to date. Mr. Goodbread was present to respond to questions. There was no discussion from the Council. MAYOR WATFORD CLOSED THE PUBLIC HEARING AT 6:23 P.M. Motion and second by Council Members O'Connor and Ritter to read proposed Ordinance No. 1150 by title only and set a Final Public Hearing date for February 21, 2017, amending Alcoholic Beverage Hours, Sunday and Holiday Sales, Code Section 6-1. Attorney Cook read proposed Ordinance No. 1150 by title only as follows: "AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA AMENDING CHAPTER 6 ALCOHOLIC BEVERAGES, CODE OF ORDINANCES; PARTICULARLY SECTION 6-1, 6-2 AND THEREOF, TO PROVIDE FOR SALE OF LIQUOR ON SUNDAYS IN LIMITED CIRCUMSTANCES; TO PROVIDE FOR SALES OF LIQUOR ON SUNDAYS BY BONA FIDE RESTAURANTS; CREATING PROVISION FOR SPECIAL PERMIT FOR RESTAURANT SALES; PROVIDING FOR PENALTIES; AMENDING DISTANCE FROM CHURCH, SCHOOLS OR DAYCARE CENTERS; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE." Motion and second by Council Members O'Connor and Clark to approve the First Reading of proposed Ordinance No. 1150. Mayor Watford opened the floor for public comment. Ms. Anita Nunez, owner of Parrott Island Grill, voiced her support for changing the regulation, noting concerns with the loss of income caused by the lack of liquor sales at her restaurant on Sundays. Mr. Robert Jameson, an Applebee's bartender, voiced his support for changing the regulations. Further stating patrons are consuming the same percentage of alcohol with one mixed drink as they are with one beer or a glass of wine. He gave examples of times when customers left and went to a County business due to not being able to serve them liquor. Ms. Nikki Brewster, Manager of Beef O'Brady's, echoed Mr. Jameson's comments and added the City is losing revenue to coastal businesses because of the current code. Ms. Dakota Marciano of Tin Fish Restaurant and Ms. Patty Suarez of Parrott Island Grill stated their support for the amendment to allow liquor sales on Sunday. Ms. Jennifer Tewksbury, Executive Director of the Economic Council of Okeechobee, spoke on behalf of the Board of Directors, stating they do not have a moral stance. They do support the City streamlining the laws with the County to ensure equal distribution of revenue to businesses. FEBRUARY 7, 2017 - REGULAR MEETING - PAGE 5 OF 8 AGENDA VIII. NEW BUSINESS CONTINUED A.2.b) Public comments and discussion on proposed Ordinance No. 1150 continued. c) Vote on motion. COUNCIL ACTION - DISCUSSION - VOTE Before discussion from the Mayor and Council, City Attorney Cook explained they have the option to amend the proposed language in Ordinance No. 1150 to be the same as the County, which is one sentence, "No alcoholic or intoxicating beverages may be sold for on or off -premises consumption within the unincorporated areas of Okeechobee County between the hours of 2:01 a.m. and 7:00 a.m., Monday through Saturday, and between the hours of 2:01 a.m. and 1:00 p.m. Sunday." Council Member Ritter reiterated his position on the proposed amendment citing he has an obligation to help make City businesses prosper and feels that mirroring the County regulation will do that. The City will have more opportunity to gain from future businesses. Council Member O'Connor agreed. Council Member Chandler agreed. However, he did not support the proposed time of 11:00 A.M. to begin sales and suggested it be changed to 1:00 P.M. Council Member Clark stated in the past few weeks she has heard from citizens, ministers, business leaders and restaurant owners. She read all the past requests for changes to the ordinances and checked with surrounding counties. She talked to the Police Chief and the Sheriff. She knew the regulations go back many years but the population of Okeechobee has changed; 20 to 30 years ago almost all businesses were closed on Sundays and the drinking age was 18. In order to serve the citizens, the Council needs to be indicative of the demographics they serve and make sure not to maintain ordinances that cater to just one of the demographics or times past. Instead the Council needs to make sure to serve the community at large. She has received support of the existing regulations because of members practicing their Christianity on Sunday and the next day she talked to members of two other religious orders that practice their Christianity on Saturday. Hearing this reminded her that the City is a melting pot and needs to consider all the citizens in the community and the business owners. The City gives business licenses to restaurants that also have liquor licenses and she does not want to put these restaurants at a disadvantage over ones in the County or surrounding areas. Discussion then turned to the proposed language which requires restaurants, who intend to sell alcohol beverages on Sundays, to apply for a permit with an annual fee of $250.00. Council Members Ritter, Clark, and O'Connor were not in favor of this requirement. Discussion ensued. While specific amendments were not acted on, the consensus was at the final hearing, amendments would be made to change the time sales could begin and remove the fee. D. Okeechobee Chamber of Commerce Economic Development Report for the Fourth Quarter of 2016 - John Gurney, Economic Director. E. Motion to approve budget amendments for 2016-17 - Finance Director (Exhibit 5). Mr. John Gurney, Economic Director for the Okeechobee Chamber of Commerce, presented the Economic Development Report for the year ending December 31, 2016. Mr. Gurney's presentation included a list of conferences and trainings he attended to keep Okeechobee on the forefront. From January through December, 62 businesses in Okeechobee needed extended services. Of these, 22 have been completed and produced a Capital Investment of $12,568,370.00, creating 133 jobs with an average wage of $14.30 per hour. There are 20 businesses considered as works in progress and 20 failed for various reasons. He also provided basic information, guidance, and answered questions for 43 other businesses. Mr. Gurney provided an example of how the economic development program works. Two businesses he worked with came to fruition in 2016. These businesses increased property values by $1,607,042.60, which provided an increase in property tax revenue of $4,242.71. The economic development impact on our local workforce was provided and showed Okeechobee County had the lowest unemployment rates and the highest average annual wage in the Heartland Region. He also provided information from the Internal Revenue Service Division of Statistics that showed Okeechobee County as a whole gained $95.59 million dollars in annual adjusted gross income for the periods of 1992 through 2015. The Council thanked Mr. Gurney for his update and his continuous hard work for the City on economic development. No action was needed on this item. Motion and second by Council Members Ritter and O'Connor to approve the budget amendments as presented in Exhibit 5 for Fiscal Year 2016-17. Motion to approve budget amendments for 2016-17 continued ITEM ADDED TO AGENDA: F. Motion to approve an expenditure in the amount of $19,000.00 for parts and repairs to Fire Engine 6 - City Administrator (Exhibit 6). Exhibit 5 reflects the following amendments: Public Facilities Improvement (Transportation 301) Fund Line Item 301-549-6400 was reduced to $174,000.00 reflecting the removal of a half -ton pickup truck and equipment purchase; Total Expenses decreased to $690,800.00; Fund balance increased to $283,126.00. The Capital Improvement Projects (304) Fund Beginning Fund Balance increased to $5,729,685.00; Line Item 304-521-6400 increased to $369,365.00 to add an additional police vehicle and equipment; Total Expenditures increased to $1,204,165.00; Transfer -out to Other Grant Funds increased to $316,020.00; Total Transfer -out increased to $1,112,742.00; Ending Fund Balance decreased to $3,656,078.00. The Other Grants Fund Beginning Balance was reduced to $39,642.00; two grants awarded and approved on January 17, 2017, were reflected in Line Item 302-331-3903 being reduced to $183,630.00 for the Florida Department of Environmental Protection NS018 Grant, and Line Item 302-331-3904 increasing to $175,000.00 for the South Florida Water Management District #4600003556 Grant; Line Item 302-381-0000 Transfer In -Capital Assigned Funds increased to $300,000.00; Total Revenues increased to $674,650.00; Line Item 302-2000-4909 was reduced to zero; Line Item 302-2752-3100 increased to $23,100.00; Line Item 362-2752-3200 increased to $5,000.00; Line Item 302-2752-4909 increased to $1,000.00; Line Item 302-2752-6300 decreased to $175,000.00; Line Item 302-2752-6400 increased to $510,192.00; Total Expenditures decreased to $714,292.00. Council Member Ritter confirmed with the Administrator that the title, fees, and equipment were included in the amendment to the Capital Improvement Projects Fund Line Item 301-521-6400 as well as the Other Grants Fund Line Item 302-2752-3100 to include the $4,600.00 for Grant Application Services. Motion and second by Council Members Chandler and O'Connor to approve an expenditure in the amount of $19,000.00 for parts and repairs to Fire (Truck) Engine 6. Administrator MontesDeOca explained these repairs were in the projected Capital Outlay Budget for Fiscal Year 2018-19. However, it cannot be certified unless these repairs are made now. Fire Chief Smith explained the repairs will take approximately two to three weeks. This is not the Fire Engine being replaced upon delivery of the new Engine (anticipated to arrive in August). Planning Staff's findings are as follows: The requested rezoning of the five lots would be consistent with the Comprehensive Plan and will in fact eliminate existing inconsistencies between the Future Land Use Map and the Zoning Map. The proposed use of outdoor sales and storage is permitted as a Special Exception Use in the CHV Zoning District. Any future uses of the remaining properties located at 703 and 709 North Parrott Avenue would be governed by the Permitted and Special Exception Uses in the CHV Zoning District. The proposed use will not have an adverse effect on the public interest as the future use of the properties will be more consistent with the types of commercial uses typically expected along a major commercial corridor as opposed to the current Industrial Zoning. The subject properties are more suitably located for heavy commercial use than industrial use and more consistent with land use patterns in the area and therefore the requested rezoning will contribute to encourage the preferred urbanizing land use pattern in the area. The proposed use will not adversely affect property values or living conditions, or be a deterrent to the improvement or development of adjacent property. The proposal will actually raise the value of each property. All properties in the neighborhood, if not vacant, are currently developed with either commercial or industrial uses. There should be little or no need to buffer surrounding uses from the proposed use on the property although, Special Exception uses involve greater scrutiny than permitted uses and buffering could be required at the time of consideration or if applicable during site plan review. The proposed use will not create a density pattern that would overburden public facilities such as schools, streets, and utility services as the proposed use is not residential. The proposed uses should result in little to no incremental increase on the demand for potable water, wastewater treatment and disposal, solid waste collection and disposal, or impact on the local roadway system. A potential traffic impact could be delivery of materials via semi -tractor trailer. Suggestion would be to have deliveries and/or pickups via semi -tractor trailer limited to/from Northwest 7th Street. Should deliveries be conducted from North Parrott Avenue (US Highway 441), then they should be limited to non -peak traffic hours. The proposed use should not create flooding problems and has not been inordinately burdened by unnecessary restrictions. c) Vote on motion. Planning Staff's findings are as follows: The requested rezoning of the five lots would be consistent with the Comprehensive Plan and will in fact eliminate existing inconsistencies between the Future Land Use Map and the Zoning Map. The proposed use of outdoor sales and storage is permitted as a Special Exception Use in the CHV Zoning District. Any future uses of the remaining properties located at 703 and 709 North Parrott Avenue would be governed by the Permitted and Special Exception Uses in the CHV Zoning District. The proposed use will not have an adverse effect on the public interest as the future use of the properties will be more consistent with the types of commercial uses typically expected along a major commercial corridor as opposed to the current Industrial Zoning. The subject properties are more suitably located for heavy commercial use than industrial use and more consistent with land use patterns in the area and therefore the requested rezoning will contribute to encourage the preferred urbanizing land use pattern in the area. The proposed use will not adversely affect property values or living conditions, or be a deterrent to the improvement or development of adjacent property. The proposal will actually raise the value of each property. All properties in the neighborhood, if not vacant, are currently developed with either commercial or industrial uses. There should be little or no need to buffer surrounding uses from the proposed use on the property although, Special Exception uses involve greater scrutiny than permitted uses and buffering could be required at the time of consideration or if applicable during site plan review. The proposed use will not create a density pattern that would overburden public facilities such as schools, streets, and utility services as the proposed use is not residential. The proposed uses should result in little to no incremental increase on the demand for potable water, wastewater treatment and disposal, solid waste collection and disposal, or impact on the local roadway system. A potential traffic impact could be delivery of materials via semi -tractor trailer. Suggestion would be to have deliveries and/or pickups via semi -tractor trailer limited to/from Northwest 71h Street. Should deliveries be conducted from North Parrott Avenue (US Highway 441), then they should be limited to non -peak traffic hours. Mr. Brisson noted a correction on page five of the Staff Report stating his response to number eight should be the use is not the same as before and there will be a potential traffic impact with the delivery of materials via semi -tractor trailer truck. He suggests deliveries or pickups are limited to/from Northwest 7t1 Street. Should deliveries be conducted from North Parrott Avenue (US Highway 441), they should be limited to non -peak traffic hours. Planning Staff is recommending approval based on the findings within the Planning Staff Report. Ms. Troxell, business owner of Millie Troxell Sheds, was present on behalf of the applicant and available for questions from the Board. In response to Mr. Brsson's comment regarding the deliveries, she responded the semi drivers will come in on Northwest 711 Street, never on North Parrott Avenue and always before noon. Chairperson Hoover asked whether there were any comments or questions from those in attendance, There were none. Chairperson Hoover asked Board Members to disclose for the record whether they had spoken to anyone else regarding the petition or visited the site. There were none stated. Planning Staffs findings are as follows: The requested rezoning of the five lots would be consistent with the Comprehensive Plan and will in fact eliminate existing inconsistencies between the Future Land Use Map and the Zoning Map. The proposed use of outdoor sales and storage is permitted as a Special Exception Use in the CHV Zoning District. Any future uses of the remaining properties located at 703 and 709 North Parrott Avenue would be governed by the Permitted and Special Exception Uses in the CHV Zoning District. The subject properties are more suitably located for heavy commercial use than industrial use and more consistent with land use patters in the area and therefore the requested rezoning will contribute to encourage the preferred urbanizing land use pattern in the area. The proposed use will not adversely affect property values or living conditions, or be a deterrent to the improvement or development of adjacent property. The proposal will actually raise the value of each property. All properties in the neighborhood, if not vacant, are currently developed with either commercial or industrial uses. There should be little or no need to buffer surrounding uses from the proposed use on the property although, Special Exception uses involve greater scrutiny than permitted uses and buffering could be required at the time of consideration or if applicable during site plan review. The proposed use will not create a density patter that would overburden public facilities such as schools, streets, and utility services as the proposed use is not residential. The proposed uses should result in little to no incremental increase on the demand for potable water, wastewater treatment and disposal, solid waste collection and disposal, or impact on the local roadway system. A potential traffic impact could be delivery of materials via semi -tractor trailer. Suggestion would be to have deliveries and/or pickups via semi -tractor trailer limited to/from Northwest 7h Street. Should deliveries be conducted from North Parrott Avenue (US Highway 441), then they should be limited to non -peak traffic hours. The business will have one employee with outdoor operating hours from 10 AM to 4 PM Tuesday through Saturday. Sales inventory items will be delivered to the site by semi -tractor trailer once or twice per month plus local delivery/shed pick-up. All criteria required for granting a Special Exception in the Land Development Regulation is met with the exception of needing to provide new paving of parking spaces and driveways. Planner Brisson recommends approval based on the findings within the Planning Staff Report and the condition of the exception listed above Ms. Troxell, business owner of Millie Troxell Sheds, was present on behalf of the applicant and available for questions from the Board. Secretary Bumette noted for the record the petition was advertised in the local newspaper, a sign was posted on the subject property and courtesy notices were mailed to 18 surrounding property owners. Planning Staffs recommendation for approval is based on two sets of criteria. One being the site's consistency with the current Land Development Regulations (LDR's), and the other, findings required to consider a Special Exception. Previously zoned IND, the site is situated along the City's commercial corridor with/without special conditions. and is better suited to a commercial use. The CHV Zoning District specifically identifies outdoor sales and storage as a Special Exception Use. No specific design efforts are needed, The applicant does not envision any new construction or structural changes to the existing building that has existed on the property. The display of sheds, gazebos and similar items is compatible with adjacent and nearby commercial uses. The visual appearance of the subject property is expected to be an improvement over the existing situation. No special landscaping is necessary. The only potential hazard that Planning Staff envisions would be the delivery of materials to the property by semi -tractor trailers. Planning Staff suggests deliveries or pickups by semi -tractor trailers are limited to/from Northwest 71, Street. Should deliveries be conducted from North Parrott Avenue (US Highway 441), they should be limited to non -peak traffic hours. The use should not create any additional demands for potable water, sanitary sewer services or provision of any other municipal services. The property owner will need to provide adequate parking that meets City standards to accommodate the office use and outdoor storage as well as paving the driveway access to accommodate delivery by semis. Planning Staffs responses to the applicant's presentation on the required findings are, the property is designated Commercial on the Future Land Use Map and the proposed use is not contrary to the Comprehensive Plan. Outdoor sales and storage is included under the list of Special Exception Uses in the CHV Zoning District. The proposed use will not have an adverse effect on the public interest. The use is appropriate for the proposed location, is compatible with adjacent uses, and is not detrimental to urbanizing land use. The use will not affect property values or living conditions, nor be a deterrent to the development of adjacent property. Aside from improving the parking and driveways) to/from the site, there will be no significant changes to the property. Therefore, neither special visual screening nor other improvements will be necessary. The proposed use is commercial and density is not a consideration. The use should not be such that it would be expected to overburden any public facilities such as streets, schools, and utility services. The proposed use is not expected to create traffic congestion. Additional impervious surfaces will be increased by the paving of driveways and parking spaces, which may involve attention to drainage requirements. (f) Limitation on package or off -premises sales For a bona fide restaurant qualifying for Sunday liquor sales it shall be unlawful to make package sales of liquor by the bottle or single drinks to be taken off -premises, except as provided in subsection (c) herein (q) Limitations on location of establishment. No establishment which qualifies as a bona fide restaurant to sell and serve liquor on Sunday as provided herein shall be physically located within 100 feet of a church, school or day care center, measured from the front door of the establishment to the front door of the church school or day care center. Exempted from such requirements are any currently existing and permitted establishments that were in place prior to the establishment of the church school or day care center. Such distance shall be measured by a straight line from door to door, and not along streets or rights -of -way. (h) Qualifying establishment permits As a prerequisite to operation an establishment that qualifies under this section and wishes to sell or serve liquor by the drink on Sunday, shall obtain a permit from the City of Okeechobee with the following information: 1. Current business tax operation license with fictitious name registration if applicable, or certificate of incorporation with registered agent. Current license issued by State of Florida permitting sale of alcohol, beer, wine, and liquor. 5. Payment of special permit fee calculated at $ 250.00 annually. (i) Permit suspension. The City of Okeechobee Code Enforcement board, may issue fines permit suspension or recommend license revocation to the City Council of any permit issued hereunder any of the following circumstances: 1. Loss of business tax license alcohol sales license, or lapse of liability insurance. 2. Arrest or conviction of staff members for sale of alcohol to underage persons. 3. Failure to adhere to permitted hours or conditions of operation. 4. Failure to maintain control and order at the establishment, including repeated necessity for law enforcement to respond or intervene at the establishment. 5. Permitting off premises consumption or open container violations, or loitering in the outside walkway, common areas or parking lot of the establishment. 6. Complaints verified by law enforcement of adverse affects on neighboring properties whether commercial or residential including noise, trash, and vandalism. 7. Imposition of violation by the State against the establishment for any violation of the provisions of F.S. ch. 509. The penalties available to the Citv of Okeechobee for any such violation shall include: 1. Warning letters to cease and desist. 2. Imposition of a fine against the establishment up to $250.00 for a first violation and up to $500.00 for any subsequent violation. 3. Suspension of permit to sell alcohol on Sundays for up to 5 days for a first violation and up to 30 days for any subsequent violation. 4. Revocation of permit. Any of these penalties may be imposed commensurate with the severity of the violation, and need not be imposed in the order they are listed. Anv recommendation to the City Council by the City Code Enforcement board to suspend or revoke such permit shall first be made in writing to the establishment, directing that they cease the unauthorized activities: upon a second verified violation by the establishment within a 60 day period the establishment shall be provided a notice of intent to revoke the permit The owner or authorized representative of the establishment shall be notified by notice of public meeting that this decision is placed on the agenda of the City Council who shall have final decision as to such suspension. The decision of the City Council shall be supported by substantial competent evidence, which may be appealed by the violator to the Circuit Court. In the past few weeks I have heard from citizens of Okeechobee, Ministers, business leaders and resataurant owners. I read all the past request for changes to the ordiances and I have checked with counties surrounding Okeechobee. I have talked to the Police Chief and the Sheriff of Okeechobee. I know this ordianance goes back many years but the population of Okeechobee has changed. 20 to 30 years ago almost all business' were closed on Sundays and the drinking age was 18. In order to serve the citizens we need to be indicative of the demographics we serve. We need to make sure that we are not maintaining ordinances that cater to just one of the demographics or times past. Instead we need to make sure that we are serving the community at large. On this issue I received support of the existing ordinance because of practicing their Christianity on Sunday and the next day I talked to members of two other religious orders that practice their Christianity on Saturday. Hearing this reminds me that we are a melting pot and we need to consider all the citizens in the community and the business owners. We have given business licenses to restaurants in the city that also liquor licenses and I do not want to put any business in the City at a disadvantage over resaturants in the county or surrounding areas. After speaking to the Police and Sheriff I do not feel that drinking on Sunday is the major issue in our community. This firefighting vehicle is considered one of the most essential trucks (next to Ladder truck) that are utilized for fire suppression within the City of Okeechobee centered upon the fire protection rating of the ISO (Insurance Service Organization). ISO requires annual documentation for each fire suppression unit. This documentation must include the three consecutive years prior to ISO's request. The testing is conducted utilizing the suction capabilities of the pump and discharges that can meet specific pressures for a minimum period of time successively delivering the required water flow. All structural firefighting vehicles shall be required to pass annual testing of the fire pumps located within the truck. The City Fire Department has a history of directing this testing or "contracting" the testing each year. We have received full credit for fire suppression apparatus since the procurement of Engine six. Recently, the fire department has discovered the fire pump and/or water tank on engine 6 leaking water in large amounts. The apparatus requires daily "fill ups" in order to keep tank full. It is getting progressively worse and we have had the truck sent to the nearest certified pump dealer in order to be evaluated for repairs. The fire department requests the immediate approval for repairs on Engine 6 based on the attached report from Ten-8 Equipment, Inc... The fire department is presently using the crossbreed constructed truck (2000 freightliner chassis with 1972 La France body) or Engine 7 (normally the second out or back-up engine) as the primary engine. The 1980 pumper or Engine 5 is being utilized as our second out truck. Needless to say, the age and condition of the primary and secondary engine is not good and the expediting of repairs for engine 6 should be done as soon as possible. The attached report from Ten 8 fire equipment explains or shows the problems and corrections needed. We were advised that the engine would not pass the annual pump testing in its current condition. This company is the nearest factory trained center for Waterous Pumps which is the type of fire pump inside Engine 6. The company is where we purchased Engine 6 originally.
