The city shall provide a bill of sale clearly stating that the sale is subject to any and all liens. The rightful owner of the property may claim the balance of the proceeds within one year from the date of the above stated deposit by making appli- cation to the city. If no rightful owner comes forward with a claim to the property within the designated year, the balance of the proceeds shall be deposited into the state school fund. (e) The owner of any abandoned or lost prop- erty who, after notice as provided in this section, does not remove such property within the speci- fied period shall be liable to the city for all costs of removal, storage, and destruction of such prop- erty, less any salvage value obtained by disposal of the property. Upon final disposition of the property, the code enforcement officer shall notify the owner, if known, of the amount owed. In the case of an abandoned boat or motor vehicle, any person who neglects or refuses to pay such amount is not entitled to be issued a certificate of regis- tration for such boat or motor vehicle, or any other boat or motor vehicle, until such costs have been paid. The code enforcement officer shall supply the state department of highway safety and motor vehicles with a list of persons whose boat registration privileges or whose motor vehi- cle privileges have been revoked under this sub- section. Neither the department nor any other person acting as agent thereof shall issue a cer- tificate of registration to a person whose boat or motor vehicle registration privileges have been revoked, as provided by this subsection, until such costs have been paid. (f) Whoever opposes, obstructs, or resists any code enforcement officer or any person authorized by the law enforcement officer in the discharge of their duties as provided in this section, upon conviction, is punishable as provided in section 1 -15 of this Code. § 30 -43 (g) Any code enforcement officer or any person authorized by the code enforcement officer is immune from prosecution, civil or criminal, for reasonable, good faith trespass upon real prop- erty while in the discharge of duties imposed by this section. (h) The rightful owner shall be liable for the city's costs for transportation and storage of lost or abandoned property and the city's cost for publication of notice of disposition of lost property. If the rightful owner does not pay such costs within 30 days of making claim to the property, title to the property shall vest in the city. (a) "Public nuisance" as defined in this section, means the existence of excessive accumulation of litter or untended vegetation, garbage, weeds, or other dead or living plant life; or places holding stagnant water, and all other objectionable, un- sightly or unsanitary matter upon any lot, track of land within the city, whether uncovered or under shelter, to the extent and in the manner that such lot or parcel of land is, or may reason- ably become infested or inhabited by rodents, vermin or wild animals, or may furnish a breed- ing place for mosquitoes, or threatens or endan- gers the public health, safety or welfare, includ- ing such condition causing or tending to cause disease, or by reason of such a condition, tends to impair the economic welfare of adjacent property; including abandoned or junk property as defined by this article; unsightly, derelict or unsafe build- ing or structure which may constitute a hazard to safety health, welfare or sense of public aesthet- ics by reason of inadequate maintenance, dilapi- dation, obsolescence, or abandonment. (b) All nuisances are declared to be a public nuisance and illegal within the municipal bound- aries of the city, and shall be removed, corrected or otherwise satisfied at the direction of the city as provided in this article. A solicitation of funds is complete when the solicitation is commu- nicated to any individual then located within the corporate limits of the city. Solicitor means any person who, for compensa- tion, offers for sale, sells, or delivers any wares, merchandise, goods, or services. (Code 1982, § 10 -1) Cross reference — Definitions generally. § 1 -2. Sec. 50 -32. License tax imposed. An occupational license tax is hereby imposed upon each and every business, profession or occu- pation engaged in or carried on within the city. Such occupational license tax shall be levied on: (1) Any person who maintains a permanent business location or branch office within the city for the privilege of engaging in or managing any business within its juris- diction; (2) Any person who maintains a permanent business location or branch office within the city for the privilege of engaging in or managing any profession or occupation within its jurisdiction; and (3) Any person who does not qualify under the provisions of subsections (1) or (2) of this section and who transacts any busi- ness or engages in any occupation or pro- fession in interstate commerce where such license tax is not prohibited by Section 8 of Article 1 of the United States Constitu- tion. (Code 1982, § 10 -2) State law reference — Similar provisions, F.S. § 205.042. Sec. 50 -33. Presumption of engaging in busi- ness; liability for license. In any prosecution under this article, any sign, advertisement, building occupancy of commercial property, directory listing or activity indicating that a business, calling, profession or occupation is being conducted at a location within the city, § 50-36 shall be prima facie evidence that the person is liable for a license and the burden shall be upon the defendant to rebut the same. (Code 1982, § 10 -4) Sec. 50 -34. License expiration; limited to one year; partial -year licenses. All licenses shall expire on September 30 of each year. No license shall be issued for more than one year, and for each license obtained between October 1 and October 31, the full tax for one year shall he paid except as provided in this article, and for each license obtained between November 1 and September 30. The tax to be paid shall be calculated by adding the number of months from the month in which the premises to be taxed opens for business through the month of September and multiplying that sum by 1/12 of the full tax for one year for such license, but in no event shall less than 1/12 tax be paid for any license. Time for sale of licenses; when due and payable. (d) Application of superseding city ordinances and state laws. This subsection is primarily for the purpose of protecting residential zoning. There- fore, any ordinances of this city or laws of this state providing for the regulation of motor vehi- cles are in addition to this subsection, and wher- ever primarily for the regulation of motor vehicles or for the purposes of zoning, imposes more strin- gent requirements, regulations, restrictions or limitations than are imposed or required by the provisions of this subsection, then more stringent requirements, regulations, restrictions or limita- tions shall apply. (e) Exceptions. The provisions of this section shall not apply to recreational vehicles used ex- clusively for recreational purposes. (f) Nonconforming use. The nonconforming use provisions of this chapter shall not apply to these sections. (g) Conformity with existing ordinances. This section shall not be construed as authorizing trucks to utilize any street or other public thor- oughfare of the city over which such vehicular traffic is now or hereafter prohibited by ordi- nance, or lawful order of the police department. No recreational vehicle shall, at any time, be used as a residence, temporarily or permanently. (Code 1982, § 17 -40) Sec. 54-82.. Parking on streets. Stat. "), the State of Florida Department of Environmental Protection ( "Department ") gives notice to Mr. Dan Buchanan and Advanced Maintenance Systems, Inc., ( "collectively referred to as Respondents ") of the following findings of fact and conclusions of law with respect to violations of Chapters 376 and 403, Fla. Stat., and Chapter 62 -710, Florida Administrative Code ( "Fla. Admin. Code "). FINDINGS OF FACT PARAGRAPHS APPLICABLE TO ALL COUNTS 1. The Department is the administrative agency of the state of Florida having the power and duty to protect Florida's air and water resources and to administer and enforce the provisions of Chapters 376 and 403, Fla. Stat., and the rules promulgated thereunder in Florida Administrative Code Title 62. To ensure consistency between the state and federal used oil programs, the text of relevant provisions of 40 Code of Federal Regulations ( "C.F.R. ") Part 279, has been adopted by reference in Chapter 62 -710, Fla. Admin. Code. 2. Respondent Advanced Maintenance Systems, Inc., ( "AMS ") is an active Florida for - profit business, organized under the laws of the state of Florida on or about January 5. 2005. Advanced Maintenance Systems, Inc. operates as a mobile oil change and repair service for construction equipment, farm equipment, and large trucks on a parcel of real property located at 801 NW 8th Ave, Okeechobee, Florida, 34972 ( "Facility "). 3. Respondent Dan Buchanan ("Buchanan ") is a natural person who is the President and on -site manager of Advanced Maintenance Systems, Inc., and is responsible for managing the facility's overall operations, including environmental compliance issues. 4. Respondent Buchanan holds the record title to the real property located at 801 NW 8th Ave, Okeechobee, Okeechobee County, Florida, 34972 and has owned the property since approximately June 2004. 5. On February 5, 2007, the Department inspected the Facility and its surrounding area in response to a complaint. The Department's inspection revealed several fifty -five (55) gallon used oil drums and four (4) used oil drip pans, all of which were observed to be open, unlabelled, unprotected from the elements, and placed directly on the soil in the area of an easement that is located adjacent to the Facility and owned by the City of Okeechobee. Evidence of used oil discharged to the unpaved ground was also observed in this area. Department personnel discussed the need for removal of the drums with Respondent Buchanan at this time, OGC #08 -0725 Page 2 of 12 11. The Respondents failed to clean up and properly manage the release of used oil in a timely manner. COUNT V 12. The Department has incurred expenses to date while investigating this matter in the amount of not less than $500.00. CONCLUSIONS OF LAW The Department has evaluated the Findings of Fact with regard to the requirements of Chapters 376 and 403, Fla. Stat., and Fla. Admin. Code Title 62. Based on the foregoing facts, the Department has made the following conclusions of law: 13. Respondent is a "person" as defined in Sections 376.301(28), 403.031(5), and 403.703(4), Fla. Stat. 14. Respondent's facility is a mobile oil change and repair service that generates used oil during the normal course of business. Furthermore, used oil is considered a "pollutant" within the meaning of Section 376.301(36), Fla. Stat., as well as a "hazardous substance" within the meaning of Sections 376.301(21) and 403.703(12), Fla. Stat. 15. Respondent is a "generator" of used oil within the meaning of Fla. Admin. Code Rule 62- 710.210(2) (adopting 40 C.F.R. Part 279.1). 16. The Department is imposing an administrative penalty, which is less than $10,000.00, in this Notice of Violation, as calculated in accordance with Section 403.121, Fla. Stat. 17. The facts in Count I constitute a violation of Fla. Admin. Code Rule 62- 710.401(2), which prohibits the discharge of used oil into soils. The facts also constitute a OGC#08-0725 Page 4 of 12 also constitute a violation of Section 403.161, Fla. Stat., which makes it a violation to fail to comply with Department rules. 24. The violation in Count IV requires the assessment of an administrative penalty under Section 403.121(4)(e), Fla. Stat., of $1000.00 for failure to adequately respond to the used oil spill. 25. The administrative penalties assessed for Counts I - IV total $7,500.00. 26. The costs and expenses related in Count V are reasonable costs and expenses incurred by the Department while investigating this matter, which are recoverable pursuant to Section 403.141(1) Fla. Stat. ORDERS FOR CORRECTIVE ACTION The Department has alleged that the activities related in the Findings of Fact constitute violations of Florida law. The Orders for Corrective Action state what you, Respondents, must do in order to correct and redress the violations alleged in this Notice. The Department will adopt the Orders for Corrective Action as part of its Final Order in this case unless Respondents either file a timely petition for a formal hearing or informal proceeding, pursuant to Section 403.121(2)(c), Fla. Stat., or file written notice with the Department opting out of this administrative process, pursuant to 403.121(2)(c), Fla. Stat. (See Notice of Rights). If Respondents fail to comply with the corrective actions ordered by the Final Order, the Department is authorized to file suit seeking judicial enforcement of the Department's Order pursuant to Sections 120.69, 403.121, and 403.131, Fla. Stat. Pursuant to the authority of Sections 403.061(8) and 403.121, Fla. Stat., the Department proposes to adopt in its Final Order in this case the following specific corrective actions that will redress the alleged violations: OGC #08 -0725 Page 6 of 12 upon notification by the Department that the presence of contaminants has been confirmed and that such corrective actions are necessary. 32. Within 30 days of the effective date of this Order, Respondents shall pay $7,500.00 to the Department for the administrative penalties imposed above. Payment shall be made by cashier's check or money order payable to the "State of Florida Department of Environmental Protection" and shall include thereon the notations "OGC Case No. 08- 0725" and "Ecosystem Management and Restoration Trust Fund." The payment shall be sent to the State of Florida Department of Environmental Protection, Southeast District, 400 N Congress Ave Ste 200, West Palm Beach, Florida 33401. 33. In addition to the administrative penalties, within 30 days of the effective date of this Order, Respondents shall pay 5500.00 to the Department for costs and expenses. Payment shall be made by cashier's check or money order payable to the "State of Florida Department of Environmental Protection" and shall include thereon the notations "OGC Case No. 08- 0725" and "Ecosystem Management and Restoration Trust Fund." NOTICE OF RIGHTS Respondents' rights to negotiate, litigate or transfer this action are set forth below. Right to Negotiate 34. This matter may be resolved if the Department and Respondents enter into a Consent Order, in accordance with Section 120.57(4), Fla. Stat., upon such terms and conditions as may be mutually agreeable. Right to Request a Hearing OGC #08 -0725 Page 8 of 12 d. A statement of when petitioner received the Notice; and e. A statement requesting an administrative hearing identifying those material facts that are in dispute. If there are none, the petition must so indicate. A petition is filed when it is received by the Department's Office of General Counsel, 3900 Commonwealth Boulevard, MS -35, Tallahassee, Florida, 32399 -3000. The Department will not entertain a request for extension of time to file a Petition for Administrative Proceeding. Right to Mediation 38. If Respondents timely file a petition challenging the Notice, the Respondents have the right to mediate the issues raised in the Notice. If requested, a mediator will be appointed to assist the Department and Respondents reach a resolution of some or all of the issues. The mediator is chosen from a list of mediators provided by the Florida Conflict Resolution Consortium ( "FCRC "). The FCRC will provide up to eight hours of free mediation services to the Respondents. A mediator cannot require the parties to settle the case. If mediation is unsuccessful, both parties retain their full rights to litigate the issues before an administrative law judge. The Respondents must select the mediator and notify the FCRC within 15 days of receipt of the list of mediators. The mediation process does not interrupt the time frames of the administrative proceedings and the mediation must be completed at least 15 days before the date of the final hearing. 39. The written request to appoint a mediator must be made within 10 days after receipt of the Initial Order from the administrative law judge appointed to hear the case.
