During the week of August 24, 2009, I stopped by the subject property to discuss the owner's request to appear at the City Council meeting. I spoke with Ralph Watts and he indicated that in lieu of coming to the meeting he would remodel the banner and complete a sign permit application. On December 16, 2009, I contacted the subject property owners again and found that they have no intention of completing the application due to the following: *the expense of remodeling the sign and the permit, in connection with their non - profit status *the inability to accomplish the sign remodel without the use of expensive outside labor *observation that there are several other locations in the City that are non- compliant I informed the party that they could expect to receive further clarification on Code compliance such as a meeting notice and or fine. 12/10/2009 9:36:42 AM BANNER INFORMATION (Definitions) BANNER: A sign having letters, illustrations or ornamentations applied to paper or fabric of any kind, with only such material for a backing. A flag is not a banner. PORTABLE SIGN: Any sign not permanently attached to the ground or other permanent structure, or a sign designed to be transported, including, but not necessarily limited to signs on wheels and on trailers, and sandwich board signs. It does not, however, include vehicle signs. Sec. 90 -568 Prohibited signs. (2) Any signs that present safety, traffic or pedestrian hazard, including signs which Obstruct visibility or are located in the clear visibility triangle. (20) Signs placed, erected or posted on trees, telephone or utility poles, lampposts, hydrants, fences, or any public building, or within the public park, > xep t for banners that celebrate an event, season, community, neighborhood, or district which is sponsored by the City of a recognized not - for - profit community agency or organization. Sec. 90 -570 Permitted temporary signs (no permit required). (2) The following temporary signs are permitted without a sign permit, provided that the sign conforms to the requirements associated therewith. (b) Signs, portable signs, temporary banners, and not - inflatable wind signs, to indicate a new business, the grand opening of a business or other activity, or that indicate a special business sales event, provided that sign is not placed on the public right -or -way. (c) Signs, including portable signs, to announce or advertise such temporary uses as fairs, carnivals, circuses, revivals, sporting events, festivals or any public, charitable educational or religious event or function, provided that the sign: 1. is located on the same property where the event will occur or, if located elsewhere, the written consent of the property owner on which the sing(s) will be located has been obtained, 2. is not displayed more than 14 days prior to the event, and 3. is removed within three days after the event. Sec. 90 -584 Violation constitutes nuisance; abatement. Any advertisement, advertising sign or advertising structure which is constructed, erected, operated, used, maintained, posted or displayed in violation of this code is hereby declared to be a nuisance, and shall be forthwith removed, obliterated or abated. Any portable sign such as snipe signs or real estate signs may be removed without notification of the property owner, or such advertiser, if such sign is place in a public ROW. 2009 06 13 CITY OF OKEECHOBEE CODE ENFORCEMENT Application for Banners and Instructions Note: Applicant shall have current Business Tax License for proposed location Applicant shall have passed a current Fire Safety Inspection 1) Banner application not allowed unless /until property is in compliance with all city ordinances and requirements. 2) All banners shall be professionally printed and tasteful in color and design. Banners which become tattered or tom while being displayed shall be immediately replaced or removed. 3) The Code Enforcement Officer shall have the latitude to determine if a banner meets the appropriate aesthetics and size for that particular location. 4) All approved banners shall require permits issued and regulated by the City of Okeechobee. 5) One (1) Banner may be displayed up to 14 days four times a year. 6) Proposed banner shall be calculated into the total square footage allowed for signs 7) Banner shall be attached securely using all corners of the banner and shall rest flatly against the building wall to minimize banner movement. 8) Banner shall have a permit sticker visible at all times (issued with permit) 9) Permit subject to revocation upon Code Enforcement Officers discretion 10) Banner shall not extend above the roofline or beyond the edges of the building to which it is attached. 1 1) The holder of this permit shall be responsible for the attachment and removal of the banner in accordance with the display dates as specified on the permit. 12) Banner shall not augment existing permanent signs by advertising the same message. 13) Banner shall not be placed on fences, signs, poles, vehicles or other surfaces not authorized by the City.
