Mayor Kirk called the November 9, 1999 Regular City Council Meeting to order at 6:00 p.m.

A. Proclaim the week of November 19 - 25, 1999 as Farm -City Week. Mayor Kirk read the following proclamation for Farm -City Week: "WHEREAS, the prosperity and well-being of this
community are dependent upon understanding and cooperation between the two great elements of our society; farmers
and non -farm people, and WHEREAS, the complexities of their individual endeavors and the divergence of their
activities with decreasing opportunity for interaction could lead to areas of misunderstanding, and WHEREAS, this
misunderstanding must be avoided, and each group must understand its interdependency one with the other if our
American way of life is to endure, and WHEREAS, Farm -City Week provides an unparalleled opportunity for farm and
city people to establish communication to become acquainted, NOW, THEREFORE, I, James E. Kirk, Mayor of the City
of Okeechobee, do hereby proclaim the period of November 19 through November 25, 1999 to be Farm -City Week;
and I do further call upon all citizens of this community to participate in joint visits, seminars, pageants, fairs, civic and
social events conducted during Farm -City Week."

Mayor Kirk read the following Commendation in it's entirety: "Whereas, the Communities In Schools, National Make
a Difference Day was held on October 30, 1999 and is a program that focuses on encouraging citizens to volunteer
to perform a service in their City for the betterment of the community; and Whereas, Wal*Mart is a member of the
Okeechobee community and has become a good neighbor by participating and giving to many causes in the
community; and Whereas; Wal*Mart participated in the National Make a Difference Day by donating a $1,000.00
Grant for the project. The grant funded landscaping of the medians on South Parrott Avenue from South 21" Street
to South 23`d Street. Now, Therefore, we the City Council of the City of Okeechobee, Florida, do hereby commend
Wal*Mart for their excellent record of service to the Okeechobee Community, their participation in the National Make
a Difference Day and extend the thanks of the citizens of the City of Okeechobee for their unceasing commitment and
dedication to our City."
Wal*Mart Manager, Randy Locklear and Bruce Hovey, Co -Manager were present to receive the certificate and
thanked the Council, commenting further they are proud to be a part of the Okeechobee Community and enjoy
contributing to events throughout the year.

Attorney Cook called paragraph number six to the Council's attention, noting that from the way he interprets the

of those. Council instructed Clerk Thomas to research how close the City is to the fifteen hundred limit. Council also
instructed the Clerk to research whether or not they collect cardboard.

Council Member Markham explained to the Council that due to several complaints from citizens regarding the canals

of each street. The Church is taking the responsibility of putting the signs up and taking them down at the appropriate

beyond the 1999-2000 school year it will be their responsibility to come to the Council with that request.

Council Member Chandler moved to award a Vehicle Bid to Okeechobee Ford Motor Company for the purchase of
twenty Crown Victorians; seconded by Council Member Oliver. Motion and second were withdrawn.
Council received a revised bid sheet. Attorney Cook stated in the future the City should not rely on the State Contract
Book but forward the bid package to the dealer in our zone in order to get a more accurate bid. He continued further
by stating that the Council is within its right to bypass the state purchasing bid.
Council Member Chandler moved to award a Vehicle Bid to Okeechobee Ford Motor Company for the purchase
of twenty 2000 Crown Victorians; seconded by Council Member Oliver.

H. Discuss Cellular Tower Ordinance - Council Member Watford. Council Member Watford addressed the Council regarding an application for variance that is scheduled before the
Board of Adjustment on Tuesday, November 23, 1999. This variance is to increase the height of a cellular tower that
is being proposed for 319 B Northwest 8`h Street (Block 58, East Y2 of Lots 15 and 16, City of Okeechobee). At the
October 5, 1999 City Council Meeting the Council voted unanimously to deny a request from Nextell to construct a
cellular tower on City property. The Council has instructed Staff to begin the process of obtaining information to draft
an ordinance for the City to adopt regulations on cellular and telephone towers within the City. Council Member Watford
wanted to know what could be done to put this variance application on hold until the City Land Development
Regulations could be amended to specifically address these types of towers.
Attorney Cook advised the Council could enact a moratorium on granting any permits of this type. He also added that
by allowing any applications regarding towers to be approved until regulations were adopted by the City, would set a
precedence of how the city ordinance would have to be written. Discussion ensued. Council instructed Attorney Cook
to draft an emergency ordinance imposing a moratorium on cellular tower applications and hold the meeting
on November 17, 1999 at 12 o'clock noon.
Discuss Firefighter Ropee Sanders Sick Leave Request - Fire Firefighter Ropee Sanders was in a off -duty accident and has used all of his accrued Sick and Annual Leave. His doctor
Chief (Exhibit 7). has not released him to date. He has not abused his leave in the past and his fellow employees wish to donate one
shift of their sick leave to Mr. Sanders in order to allow him to continue receive a check.
Council Member Chandler commended the Fire Department employees for helping. Council discussed this issue briefly
and decided to handle these request on a case by case basis.
Council Member Chandler moved to allow Keith Tomey, Billy Douglas, Jeff Baugh, Herb Smith, Phil Conroy,
Glen Hodges, Alan Clark and Brian Stokes to donate one twenty-four hour shift of sick time to Ropee Sanders,
if a ninth shift is necessary Keith Tomey will donate two shifts; seconded by Council Member Markham.

INTERLOCAL AGREEMENT
THIS AGREEMENT entered into this _ day of October, 1999, by and between the Board
of County Commissioners of Okeechobee County, Florida (hereinafter referred to as the "COUNTY")
and the City of Okeechobee (hereinafter referred to as the "CITY") and
WHEREAS, the Solid Waste Management Act of 1988 as codified by Part IV of Chapter
403, Florida Statutes, (hereinafter referred to as the "Act"), places responsibility upon counties to
provide for the operation of solid waste disposal facilities to meet the needs of all incorporated an
unincorporated areas of the county; and
WHEREAS, the Act further requires counties to develop and implement recycling programs
within their jurisdictions to return valuable materials to productive use, to conserve energy and
natural resources, and protect capacity at solid waste management facilities; and
WHEREAS, the Act encourages counties and municipalities to form cooperative
arrangements for implementing solid waste recycling and education programs; and
WHEREAS, the Act created the Solid Waste Management Trust Fund to provide incentive
grants to assist qualifying counties and municipalities in the operation of solid waste management
recycling and education programs; and
WHEREAS the CITY and COUNTY have for some years jointly participated in a solid
waste recycling and education program (hereinafter referred to as the "Program") with grant
assistance from the Solid Waste Management Trust Fund; and
WHEREAS, it is in the best interests of the residents of the CITY and COUNTY to continue
to jointly participate in the Program as well as continue to apply for assistance grants which in turn
make continuation of the Program possible; and
WHEREAS, it is the desire of the CITY that the COUNTY continue to apply for available
recycling and education incentive grants to the benefit of all residents of the CITY and COUNTY.
NOW, THEREFORE, in consideration of the premises and of the terms, conditions and
covenants herein contained, it is agreed by and between the parties hereto, as follows:
This Agreement shall be effective from the date it is filed with the Clerk of the Circuit
Court of Okeechobee County and shall remain in effect until September 30, 2002. The
agreement may be terminated in writing by either party at least sixty (60) days prior .,
to the end of any grant year which terminates on the 30' day of September each year.
2. The CITY shall cooperate with the COUNTY to the fullest extent practical in

providing information necessary to (a) complete the grant applications in accordance
with the requirements of Section 403.7095(6) Florida Statutes, (b) develop a
recycling Program to be implemented by the COUNTY within the COUNTY and
CITY; and (c) prepare the COUNTY's annual report to FDEP on recycling activities
as required by Section 403.706(7) Florida Statutes.
3. The COUNTY shall submit the incentive grant applications to FDEP on behalf of the
COUNTY and the CITY during the period covered by this Agreement and by the
application deadlines to be established by FDEP.
4. The COUNTY shall, by October 1, of each year report to FDEP the COUNTY's
annual solid waste management and recycling activities for the duration of the period
covered by this Agreement
The COUNTY shall continue to administer the Program during the term of this
Agreement provided anticipated grant funding continues.
6. From the anticipated grant funds, the Program shall provide weekly curbside
collection of recyclable materials for 1,500 homes/units located within the city limits.
The current cost to the COUNTY of this collection is $1.90 per unit per month.
Should the grant award be reduced or the cost of collection be increased, the CITY
shall have the option to either reduce the number of units collected or reimburse the
COUNTY for its pro-rata share of the deficiency not reimbursed by the grant.
7. The continuing goal of the recycling program designed and implemented by the
COUNTY and CITY shall be to provide for sufficient reduction of the amount of
municipal solid waste being disposed of at the solid waste facilities in order to meet
state mandated reduction goals.
The recycling program shall also continue to include a public education program to
promote recycling, participation in the established recycling programs, volume
reduction, and proper methods of waste disposal in accordance with rule 62-716,
F.A.C..
9. To the fullest extent permitted by law, the COUNTY and the CITY each agree to
hold each other harmless as to the full and faithful performance of this Agreement, the
application, development, implementation, and operation of any grant program in
furtherance of the Act and applied for and receive pursuant to this Agreement. To the
fullest extent permitted by law the COUNTY and the CITY each agree to indemnify
the other parry for any errors, omission, negligence, malfeasance, misfeasance, or
nonfeasance, including the payment of any joint recycling programs implemented
pursuant to this Agreement or any actions by either party hereunder in regard to
application, implementation, and operation of any grant program made by the
COUNTY to FDEP or any other governmental entity in furtherance of this
Agreement. As "grantee" for similar status under any grant secured pursuant to this

Agreement of the Act, the COUNTY agrees to timely and properly comply with all
operating and reporting requirements of the grant.
10. Obligations. Obligations under this Agreement are not an indebtedness of the
COUNTY or CITY. The respective obligations of each party hereto under this
Agreement shall not be an indebtedness within the meaning of any constitutional,
statutory, charter or ordinance provision or limitation of any party hereto. Neither of
the parties hereto are obligated to pay or cause to be paid any amounts due under this
Agreement except in the manner provided herein, and the faith and credit of any party
hereto is not pledged to the payment of any amount due under this Agreement. This
Agreement shall not require any party hereto to levy or pledge any taxes whatsoever
for the payment of any amount due under this Agreement.
11. Relationship of the Parties. Except as set forth herein, neither party to this Agreement
shall have any responsibility whatsoever with respect to services provided or
contractual obligations assumed by the other party and nothing in this Agreement shall
be deemed to constitute any party a partner, agent or local representative of the other
party, or to create any type of fiduciary responsibility or relationship of any kind
whatsoever between the parties.
12. Notices. All notices, consents, or other communications required, permitted or
otherwise delivered under this Agreement, except correspondence and transmittals
relating to specific development orders and permits, shall be in writing and shall be
delivered either by hand with proof of delivery or certified mail, return receipt
requested, postage prepaid, to the parties at the addresses indicated below:

13. Changes in the respective addresses of the parties may be made from time to time by
either party by notice to the other party given by mail. Notices given in accordance with
this section shall be deemed to have been given five (5) business days after the date of
mailing; notices and consents given by any other means shall be deemed to have been
given when received.
14. Incorporation of Agreements. This document supersedes all prior negotiations,
correspondence, conversations, agreements, or understandings applicable to the matters
contained herein. Accordingly, it is agreed that no deviation from the terms of hereof
shall be predicated upon any prior representations or agreements, whether oral or written.
It is further agreed that no modification, amendment or alteration in the terms or
conditions herein shall be effective unless contained in a written document executed by
the governing bodies of the parties and filed with the Clerk of the Circuit Court of
Okeechobee County.
15. Severability. In the event that any provision of this Agreement shall, for any reason, be
determined to be invalid, illegal or unenforceable in any respect, the parties hereto shall
negotiate in good faith and agree as to such amendments, modifications or supplements
of or to this Agreement or such other appropriate actions as shall, to the maximum extent
practicable in light of such determination, implement and give effect to the intentions of
the parties as reflected herein, and the other provisions of this Agreement shall, as so
amended, modified or supplemented or otherwise affected by such action, remain in full
force and effect.

ways, are asking their city and
county officials to solve the
problem.

Councilman Lowry Markham
and Okeechobee County Engi-
neer Tom Masterson met with
representatives from the U.S.
Army Corps of Engineers In the
first step toward finding a solu-

considered an add on with the Florida Sheriff's Association bid. Attached are the

I, the undersigned, hereby certify that I am the Clerk of the above names City (hereinafter
called "City'; that the following is a true copy of resolutions duly adopted by the City Council
of this City at a meeting duly held on the 91 day of November, 1999 at which a quorum
was present and acting throughout, and that such resolutions have not been rescinded or
modified and are now of full force and effect:
RESOLVED, that this City enter into an Equipment Lease to acquire 20 police cars to be
purchased in the Spring of 2000 with Skvlake State Bank/Kislak National Bank, (hereinafter
called "lessor" and that this City lease equipment from Lessor pursuant to the terms of
such Equipment Lease; and that James E. Kirk be and hereby is authorized and directed
in the name and on behalf of this City to execute an Equipment Lease with Lessor in
substantially the forms presented to this meeting with such changes therein and additions
thereto as shall be approved by the officer who executes the same, with such execution
to be conclusive evidence that each such document so executed has been authorized and
approved by this vote.
FURTHER RESOLVED, that the Equipment Lease be designated "Qualified Tax -Exempt
Obligations" within the meaning of S 265 (b) of the Internal Revenue Code of 1986.
FURTHER RESOLVED, that they Mayor of this City be and each of them hereby is
authorized to execute and deliver such other instruments and take such other actions as
he shall deem necessary and desirable for the purpose of carrying out the foregoing votes.
FURTHER RESOLVED, that the foregoing resolutions shall remain in full force and effect
until written notice of their amendment or rescission shall have been received by Lessor
and that receipt of such notice shall not affect any action taken by Lessor prior thereto; and
FURTHER RESOLVED, that the Clerk of this City be and hereby is authorized and directed
to certify to said Lessor the foregoing resolutions and that the provisions thereof are in
conformity with the charter of this City.
I further certify that there is no provision in the charter of this City limiting the power of the
City Council to pass the foregoing resolutions and that the same are in conformity with the
provisions of said charter.
I further certify that the following are the names and official signatures of those person
authorized to act by the foregoing resolutions.

The following employees have agreed to donate one twenty --four hour shift to Roppy Sanders:
Chief Tomey, Lt. Douglas, Lt. Baugh, Lt. Smith, FF Conroy, FF Hodges, FF Clark, and FF Stokes. We
would like this to come out of our sick time and if a ninth shift is necessary the Chief will donate two
shifts. This should give Roppy through December 16, 1999 without deductions being taken from his
salary.

Attached is a list of issues and projects that the City is currently working on. As
noted on the list, these issues and projects are being handled competently and
without problem by respective City staff. Until a new Administrator can be hired,
the City can run effectively and without consequence on "auto -pilot". Furthermore,
to give an additional stabilizing effect, the Mayor has agreed to spend more time at
City Hall and be available to the department heads and staff if the need arises.
OUTSTANDING ISSUES
Short-term
1. Continuation of Police Station project. (Fire Chief, Police Chief, Craig

3. Continuation of leasing program for law enforcement. (Julie, Police

3. City Hall Park - Contract has been approved; Julie and Lydia are
implementing the project. The next steps are survey work, title

4. PRM Interlocal Agreement - Consolidate policies between the City,
County, and Sheriff's Office to achieve lower premiums. (John
