The applicant will be responsible for costs associated with the event, including damage of property. By receipt of this permit, the applicant agrees and shall hold the City harmless for any accident, injury, claim or demand whatever arising out of applicant's use of location for such event, and shall indemnify and defend the City for such incident, including attorney fees. The applicant shall be subject to demand for, and payment of, all of the actual cost incurred by the City pertaining to the event including, but not limited to, Police, Fire, Public Works or other departmental expenses. The City reserves the right to require from an applicant a cash or cashier's check advance deposit in the sum approximated by the City to be incurred in providing City services. Patty spoke with the City Administrator this morning regarding whether we need the "additional insured" on the COI. His answer is YES we do. That is the only way the City can be protected from potential claims when anything occurs on City property during events. I believe there was just a lot of confusion earlier in the year when it was discussed because we were trying to compare City Centennial with County Centennial, vendors and other issues. I apologize if I am incorrect. It's been my understanding that if we are not listed as additional insured and a claim would arise from the actions of a vendor, subcontractor, supplier, tenant, etc on our City Streets then the City would have no coverage or rights. When First Baptist Church closes streets for events and when Central Elementary School closes streets each year for their fall festival we ask for the COI to state "additional insured ". Let me discuss this with Patty and see why this decision was made. So you'll just need to do the temporary street closing request through Patty /Jackie since that has to go to city council. The Temporary Use Permit won't be required for the event. The only thing we're supposed to check to see what certificate of insurances were required for any of the vendors at the Frolic, I think they were all non - profits & they had to do a certificate with the County as additional insurance, but can't fully remember since each event was different depending on where it was located. Given these events are for the County's Centennial I am not aware if special concessions are being made. You might want to speak to Lane, our City Clerk, about it and see if she can advise further. I know in the past our annual festival events are coordinated through Main Street and it has always been my understanding that Main Street collected all the insurances needed from the vendors and such. Will we be extending the same procedure to the County for their Centennial Events? Is this something that should be discussed at the staff meeting on 5/31? I ca n obtain a list of the events and locations if you need to know in order to make a better formed decision. was the whole nightmare of getting notarized permission from the property owners when having events not on city property, and then they are a non - profit so there's not a charge to process it, and we didn't require site plans, the Fire Ft Police dept's were at all events so the issue of having medic's /security wasn't an issue and its my understanding the county is doing the same. I don't recall asking about insurance. But I think the city centennial had a blanket insurance policy that covered all events. If you want, we can add a requirement that food vendors have their own insurance for the event. Most who regularly do food events probably have some kind of policy." If required we can request a certificate of insurance but not sure how many nonprofits actually have one. Please advise. So you'll just need to do the temporary street closing request through Patty /Jackie since that has to go to city council. The Temporary Use Permit won't be required for the event. The only thing we're supposed to check to see what certificate of insurances were required for any of the vendors at the Frolic, I think they were all non - profits & they had to do a certificate with the County as additional insurance, but can't fully remember since each event was different depending on where it was located.
