NOVEMBER 17, 2016 — PLANNING BOARD - PAGE 2 OF 5 99 ACTION - DISCUSSION — VOTE CHAIRPERSON HOOVER OPENED THE PUBLIC HEARING AT 6:03 P.M. Abandonment of Right -of -Way Petition No. 16- 003 -AC, to vacate the 20 -foot wide alleyway running East to West between Lots 1 to 6 and 7 to 12 of Block 44, CITY OF OKEECHOBEE, Plat Book 5, Page 5, Public Records of Okeechobee County. Chairperson Hoover yielded the floor to Planner Brisson, who explained the property owner, Okeechobee Asphalt and Ready Mixed Concrete, Inc., owns Lots 1 to 6 and 7 to 12 which are vacant and located North and South of the unimproved 20 -foot by 300 -foot alleyway that they are petitioning to vacate. The Petition was reviewed at the October 20, 2016, Technical Review Committee Meeting and a recommendation for approval to the Planning Board was made with the following special condition: The portion of Northwest 8th Avenue running North to South along Block 44 needs to remain free of equipment and debris at all times. Planning Staff is recommending approval based on the following responses to the required findings. The properties to both the North and the South are owned by Okeechobee Asphalt and Ready Mixed Concrete, Inc. and are designated Industrial on the Future Land Use Map and are also zoned Industrial. The property to be abandoned will be used for materials storage in the same manner as the surrounding properties have been used by Okeechobee Asphalt. The alleyway is not the sole access to any property, as all properties have vehicular access from either Northwest 9th Avenue, Northwest 9th Street, or Northwest 8th Avenue. The public benefits associated with the abandonment are, the existing alleyway is currently unused and has no immediate or future use. It will be a benefit to the City to remove the existing Right -of -Way which will reduce the land the City is required to maintain and the property will be subject to ad valorem taxation. No location of any utility would be jeopardized by the proposed vacation. Mr. Steven Dobbs, P.E. with SLD Engineering of 1062 Jakes Way, Okeechobee, Florida, was present on behalf of the applicant and available for questions from the Board. There were none. Chairperson Hoover asked whether there were any comments or questions from those in attendance. There were none. Special Exception Petition No. 16- 004 -SE, requests to allow a convenience store with fuel pumps within a Heavy Commercial Zoning District, (Ref. Sec. 90- 283(24), containing approximately 0.93 unplatted acres and located at 1705 South Parrott Avenue. Parcel ID No. 2- 28- 37- 35 -0A00- 00028 -A000. The petition was submitted by Mr. Kenneth Wood, Managing Trustee of Alliance Fuel Marketing, LLC. This being a quasi - judicial proceeding, Notary Public Patty Burnette administered an oath to those intending to offer testimony, all responded affirmatively, and stated their names and addresses for the record: Bill Brisson, Senior Planner, LaRue Planning and Management, 1375 Jackson Street, Suite 206, Fort Myers, Florida and Mr. Kenneth Wood, 2078 South Orange Blossom Trail, Apopka, Florida. Chairperson Hoover yielded the floor to Mr. Bill Brisson, Senior Planner for LaRue Planning and Management Services, Inc. Mr. Brisson explained the subject property has been used as a convenience store with retail fuel sales in the past, although it has been closed for more than 180 days. Therefore, Special Exception approval is required from the Board of Adjustment to re -open or operate a new convenience store with fuel pumps. The applicant has stated the business will have 10 to 15 employees, be open from 5 AM to 10 PM and fuel sales will be undertaken in the existing fuel islands. Planner Brisson recommends approval based on the findings within the Planning Staff Report. Mr. Wood was present on behalf of the property owner and available for questions from the Board. Member McCoy wanted to make the applicant aware that it was his understanding that currently the property was not connected to sewer and should the applicant wish to have food service at this location, the current septic would not support this operation. Chairperson Hoover asked whether there were any comments or questions from those in attendance. There were none. Secretary Burnette noted for the record the petition was advertised in the local newspaper, a sign was posted on the subject property and courtesy notices were mailed to 18 surrounding property owners. NOVEMBER 17, 2016 — PLANNING BOARD - PAGE 4 OF 5 1 01 Chairperson Hoover asked Board Members to disclose for the record whether they had spoken to anyone else regarding the application or visited the site. There were none. Planning Staffs recommendation for approval is based on two sets of criteria. One being the site's consistency with the current Land Development Regulations (LDR's), and the other, findings required to consider a Special Exception. Planning Staffs responses to the applicant's presentation on consistency with the LDR's are, the location and specific site are appropriate for the proposed use. The property was previously used as a convenience store with fuel pumps and this use is specifically identified as a special exception use in the Heavy Commercial (CHV) Zoning District. No specific design efforts are needed. Aside from replacing the fuel tanks and cosmetic improvements to the existing building, there will be no changes to the property. The site is surrounded by other commercial uses so no special visual screening will be necessary. There should be no hazards or special problems associated with the proposed use as the subject property has previously functioned as a convenience store with fuel pumps for years without reported negative impacts. Reinstating the prior use in much the same manner should not create any additional demands for potable water, sanitary sewer services or provision of any other municipal services. Since it is unlikely that the traffic generated at the site after it reopens will exceed that which was historically experienced by the prior operation, no significant impact on the existing roadways is expected. Planning Staffs responses to the applicant's presentation on the required findings are, the property is designated Commercial on the Future Land Use Map and the proposed use is not contrary to the Comprehensive Plan. A convenience store with fuel pumps is specifically listed as a special exception use in the CHV Zoning District. The proposed use will not have an adverse effect on the public interest. The use is appropriate for the proposed location, is compatible with adjacent uses, and is not detrimental to urbanizing land use. The use will not affect property values or living conditions, nor be a deterrent to the development of adjacent property. Aside from replacing the existing fuel tanks with upgraded models and cosmetic improvements to the existing building, there will be no changes to the property. Therefore, no special visual screening or other improvements will be necessary. The proposed use is commercial and density is not a consideration. Given the use is essentially the same as has been operated in the past, the reinstatement of the use should not be expected to overburden any public facilities such as streets, schools, and utility services. The proposed use will not create traffic congestion, flooding, or drainage problems. No additional impervious surface is expected and therefore drainage should be unaffected by the change in use. The traffic generation should not exceed the levels of traffic normally associated with the previous use or other uses allowed in the CHV District. The City's Comprehensive Plan defines a Right - of Way as "Land in which the state, a county, of a municipality owns the fee simple title or has an easement dedicated or required for a transportation or utility use. Abandonment of Right -of -Way Petition No. 16- 003 -AC, to abandon the 20 -foot wide East/West alleyway between Lots 1 to 6 and 7 to 12 of Block 44, CITY OF OKEECHOBEE, Plat Book 5, Page 5, Public Records of Okeechobee County, located in the 800 block of Northwest 9th Street - Senior Planner. Planning Staff Report: Planner Brisson explained the property owner, Okeechobee Asphalt & Ready Mixed Concrete, Inc., owns all the vacant property to the north, Lots 1 to 6, and south, Lots 7 to 12, of the unimproved 20 foot by 300 foot alleyway that they are petitioning to vacate. Planning Staff's responses to the required findings are the property is designated Industrial on the Future Land Use Map and the Zoning Map. The property to be abandoned will be used for material storage in the same manner as the surrounding properties are currently being used. The alleyway TRC - October 20, 2016 - Page 1 of 3 V. Abandonment of Right -of -Way Application No. 16- 003 -AC continued. is not the sole access to any property as all properties have vehicular access from either Northwest 9th Avenue, Northwest 9th Street, or Northwest 8th Avenue. The public benefits associated with the abandonment are, the existing alleyway is currently unused and has no immediate or future use. It will be a benefit to the City to remove the existing right -of -way which will reduce the land the City is required to maintain and the property will be subject to ad valorem taxation. No location of any utility would be jeopardized by the proposed vacation. Planning Staff is recommending approval based on those findings. Project Engineer, Mr. Steve Dobbs, P.E. with SLD Engineering of 1062 Jakes Way, Okeechobee, Florida, was present on behalf of the property owner. County Environmental Health Department: No issues were received. OUA: Chairperson Montes De Oca announced Director Hayford relayed to him that Okeechobee Utility Authority had no utilities in the right -of -way. Public Works: Director Allen inquired as to whether the portion of Northwest 8th Avenue running from Northwest 9th Street South towards the railroad right -of -way would also be closed. Mr. Dobbs responded no, only the alley was being petitioned for. Administrator Montes De Oca noted for the record the right -of -way portion of Northwest 8th Avenue needs to remain open at all times, all equipment and debris needs to be removed. Police Department: No issues were received. Building Official: No issues were received. Fire Department: No issues were received. Chairperson Montes De Oca asked whether there were any comments or questions from those in attendance. There were none. He then asked TRC Members to disclose for the record whether they had spoken to anyone regarding the application or visited the site. There were none.
