Motion to approve the July, 1999 Warrant Register in the amounts, Council Member Oliver moved to approve the July, 1999 Warrant Register in the amounts, General Fund two hundred General Fund $227,954.24 and Public Facility Improvement Fund twenty-seven thousand, nine hundred fifty-four dollars, twenty-four cents ($227,954.24) and Public Facility Improvement $1,036.80. Fund one thousand thirty-six dollars, eighty cents ($1,036.80); seconded by Council Member Chandler. Discussion: None. Attorney Cook read proposed Ordinance No. 731 by title only as follows: "AN ORDINANCE CLOSING, VACATING AND ABANDONING THAT PORTION OF SOUTHEAST 4TH AVENUE (F/K/A HIWASSEE STREET) BETWEEN SOUTH PARK STREET AND 2No STREET, CITY OF OKEECHOBEE, AS RECORDED IN PLAT BOOK 5, PAGE 5, PUBLIC RECORDS, OKEECHOBEE COUNTY, FLORIDA; AND DIRECTING THE CITY CLERK TO RECORD THE ORDINANCE IN THE PUBLIC RECORDS OF THE CLERK OF THE CIRCUIT COURT IN AND FOR OKEECHOBEE COUNTY, FLORIDA; PROVIDING FOR AN EFFECTIVE DATE." 2. a) Motion to approve the first reading of proposed Ordinance No. 731. III Council Member Chandler moved to approve the first reading of proposed Ordinance No. 731; seconded by Council Member Oliver. b) Discussion. III Council Member Watford asked for clarification, the reason for closing the street is due to the oversight in 1956 and the applicant is paying only for the advertising. Clerk Thomas responded yes. c) Vote on motion. VOTE KIRK - YES CHANDLER - YES MARKHAM - ABSENT OLIVER - YES WATFORD - YES MOTION CARRIED. B. Conduct Interviews for Public Works Director - Mayor (Exhibit 2). Mayor Kirk advised the Council Members they should have before them a revised copy of the questions that will be asked of each applicant. He will explain to each candidate as they come in what the procedures will be. That he will be reading the questions. Once they respond to the question, if a Council Member wants that person to elaborate further they can ask so at that time. Council agreed with the procedures established. Candidates will be interviewed in order by the date on their application. The following is the order the candidate appeared before the Council for their interview: Dennis Horton, James Threewits and Richard Bonnell. Council then began discussion regarding the results of the interviews. Council Member Oliver suggested that the decision not be made until all Council Members were present. Council Members Chandler and Watford did not agree and wished to continue with the process. Following a brief discussion Council decided to proceed with the agenda and return to this item last. 150 AUGUST 17,1999 - REGULAR MEETING - PAGE 4 OF 10 VIII. NEW BUSINESS. A. 1. a) Motion to read by title only and set September 21, 1999 as a Council Member Watford moved to read by title only and set September 21, 1999 as a Public Hearing date, proposed Public Hearing date, proposed Ordinance No. 732 regarding Alley Ordinance No. 732 regarding Alley Closing Application No. 53 from McDonalds; seconded by Council Member Closing Application No. 53 from McDonalds - City Attorney Chandler. Attorney Cook read proposed Ordinance No. 732 by title only as follows: "AN ORDINANCE CLOSING, VACATING AND ABANDONING THE ALLEY'S OR ALLEYWAY'S LOCATED IN BLOCK 151, CITY OF OKEECHOBEE, AS RECORDED IN PLAT BOOK 5, PAGE 5, PUBLIC RECORDS, OKEECHOBEE COUNTY, FLORIDA; RESERVING UNTO THE CITY ITS SUCCESSORS AND ASSIGNS, A NON-EXCLUSIVE EASEMENT FOR PUBLIC UTILITIES PURPOSES; AND DIRECTING THE CITY CLERK TO RECORD THE ORDINANCE IN THE PUBLIC RECORDS OF THE CLERK OF THE CIRCUIT COURT IN AND FOR OKEECHOBEE COUNTY, FLORIDA; PROVIDING FOR AN EFFECTIVE DATE." 2. a)Motion to approve the first reading of proposed Ordinance No. 732. III Council Member Oliver moved to approve the first reading of proposed Ordinance No. 732; seconded by Council Member Chandler. b) Discussion. Mr. Mike Schwartz, Engineer for the applicant addressed the Council's questions. The building is twenty-six years old and has lost it's luster, McDonalds is proposing to demolish the existing building, build a new one on the same site, and reformatting the parking area by making it safer than the current situation. Construction will begin after the public hearing and should take approximately forty-five days to complete. c) Vote on motion. Motion to approve a Contract between the City and Independent Inspections, LTD. for Building Inspections Services - Ken Badke (Exhibit 4). C. 1. a) Motion to adopt proposed Resolution No. 99-10 establishing a schedule of rates for the building department - City Attorney (Exhibit 5). Council Member Watford moved to approve a Contract between the City and Independent Inspections, LTD. for Building Inspections Services; seconded by Council Member Oliver. Discussion: Council discussed specifics of the contract with the companies representative, Ken Badke. Paragraph number four was discussed at length. It reads "During the term of this agreement, and for a period of one year after termination of this agreement, the Municipality shall not negotiate with or hire any individual who was or is employed with Independent Inspections, Ltd. During the term of this agreement." Motion and second was withdrawn. Council Member Watford then moved to approve a contract between the City and Independent Inspections, Ltd., for Building Inspections Services amending paragraph number four to state: "Any individual who was employed up to five years ago or is employed with Independent Inspections"; seconded by Council Member Oliver. VOTE KIRK - YES CHANDLER - YES MARKHAM - ABSENT OLIVER - YES WATFORD - YES MOTION CARRIED. Council Member Oliver moved to adopt proposed Resolution No. 99-10 establishing a schedule of rates for the building department; seconded by Council Member Watford. b) City Attorney to read proposed Resolution No. 99-10 by title only. Attorney Cook read proposed Resolution No. 99-10 by title only as follows: "A RESOLUTION OF THE CITY OF OKEECHOBEE, FLORIDA ESTABLISHING A SCHEDULE OF RATES, FEES, AND CHARGES FOR CONSTRUCTION PLANS, BUILDING CONSTRUCTION SERVICES AND OTHER MISCELLANEOUS SERVICES; PROVIDING FOR AN EFFECTIVE DATE." c) Discussion. Administrator Bradshaw distributed copies of the County's rate schedule. These fees are comparable to them. Using 11 the new Walgreens as an example, the permit fee in the City would be $6500 and in the County is would be $6800. 152 AUGUST 17,1999 - REGULAR MEETING - PAGE 6 OF 10 VIII. NEW BUSINESS CONTINUED. C.1. d) Vote on motion. D. Consider a proposal from NEXTEL to construct a cellular tower on city property - (Exhibit 6). E. Motion to approve a two year renewal Contract between the City and J.D. Gilbert and Company for auditing services - City Administrator (Exhibit 7). F. Motion to renew a taxi cab permit to A-1 Taxi - City Administrator (Exhibit 8). VOTE KIRK - YES CHANDLER - YES MARKHAM - ABSENT OLIVER - YES WATFORD - YES MOTION CARRIED. The proposal from NEXTEL to construct a cellular tower on city property was withdrawn from the agenda. Council Member Watford moved to approve a two year renewal Contract between the City and J.D. Gilbert and Company for auditing services; seconded by Council Member Oliver. Discussion: Council discussed page three, paragraph three, the last sentence, it reads "Additional fees due to an early termination by the City will be $2,000 for the second year of the contract." Motion and second was withdrawn. Council Member Oliver then moved to approve a two year renewal Contract between the City and J.D. Gilbert and Company for auditing services amending page three, paragraph three, last sentence to include "without cause" after termination; seconded by Council member Chandler. Discussion: Attorney Cook defined for Council the term without "cause" means to fail to comply with this agreement. Mayor Kirk stated the contract should be amended to include Attorney Cook's definition as stated. Council agreed. VOTE KIRK - YES CHANDLER - YES MARKHAM - ABSENT OLIVER - YES WATFORD - YES MOTION CARRIED. Council Member Watford moved to renew a taxi cab permit to A-1 Taxi; seconded by Council Member Chandler, Discussion: Council asked Police Chief Farrenkopf whether everything checked out. Chief responded yes, including the drivers. They are the same drivers as last year. Council Member Watford commented that A-1 Taxi has a good report over a ten year period with the City. Motion to re -appoint Trustees Steve Nelson term beginning 10/1/99 and ending 9/30/01 and Steve Padgett term beginning 10/1/99 and ending 9/20/02 to the Police Pension Fund - J.P. Zeigler, Pension Fund Secretary (Exhibit 9). H. Motion to approve a Memorandum of Understanding between the City and County to establishing protocols and requirements to properly coordinate emergency services - City and County Fire Chiefs (Exhibit 10). VOTE KIRK - YES CHANDLER - YES MARKHAM - ABSENT OLIVER - YES WATFORD - YES MOTION CARRIED. Chief Farrenkopf requested Mr. Nelson's term be approved for three years rather than two. Council Member Watford moved to re -appoint Trustees Steve Nelson term beginning 10/1/99 and ending 9/30/02 and Steve Padgett term beginning 10/1/99 and ending 9/20/01 to the Police Pension Fund (Exhibit 9); seconded by Council Member Oliver. Discussion: Council expressed their appreciation to Mr. Nelson and Mr. Padgett for serving on this board. VOTE KIRK - YES CHANDLER - YES MARKHAM - ABSENT OLIVER - YES WATFORD - YES MOTION CARRIED. Council Member Chandler moved to approve a Memorandum of Understanding between the City and County to establish protocols and requirements to properly coordinate emergency services; seconded by Council Member Watford. Discussion: Council briefly discussed the proposed agreement. Fire Chief Tomey assured the Council that capital outlay items would not be needed for the City to fulfill it's part of this agreement. Motion and second was withdrawn. Council Member Watford then moved to approve a Memorandum of Understanding between the City and County to establishing protocols and requirements to properly coordinate emergency services amending paragraph number one, last sentence replacing "a 3-man engine" to state "an engine"; seconded by Council Member Chandler. 751 AUGUST 17, 1999 - REGULAR MEETING - PAGE 8 OF 10 VIII. Consider amending the residency policy to include the Buckhead Administrator Bradshaw explained in Exhibit Eleven that due to Staff discussions he was requesting an amendment Ridge area - City Administrator (Exhibit 11). to the residency requirement of the Personnel Policies and Procedures to include the Buckhead Ridge area of Glades County. Residents of Buckhead Ridge are essentially members of the Okeechobee community frequenting Okeechobee area businesses, having Okeechobee addresses and telephone numbers and utilizing Okeechobee Utility Authority 11 services. Council Member Watford moved to amend the Personnel Policies and Procedures for employee residency requirements to include the Buckhead Ridge area; seconded by Council member Chandler. Discussion: Council Member Watford noted he thought this made sense due to the proximity of the community to us. Motion to approve a purchase of a John Deere Model 5310 Tractor Council Member Chandler moved to approve a purchase of a John Deere Model 5310 Tractor from Berggren from Berggren Equipment Company - City Administrator (Exhibit Equipment Company; seconded by Council Member Oliver. 12). Discussion: Council asked what the use of this tractor is to be and were informed by the Director of Public Works, Cleveland Lamb that It will be used for mowing purposes. Discuss the nomination of Peter Raulerson for the Great Floridian's Council Member Watford addressed the Council regarding the Great Floridians 2000 program. This program is 2000 Program - Council Member Watford. sponsored by the Florida League of Cities and the Florida Department of State. The purpose of the program is to recognize individuals important to Florida's history and culture through the placement of heritage plaques in downtown's. With the help of Mrs. Betty Williamson and Clerk Thomas a packet has been prepared for the City to 11 nominate the first Mayor, Peter Raulerson. Council Member Watford moved to mail the application packet nominating Peter Raulerson for the Great Floridians 2000 Program and approve the expenditure of one hundred seventy dollars ($170.00) to purchase the plaque; seconded by Council Member Chandler. Discussion: Mayor Kirk instructed Administrator Bradshaw to send a thank you letter on behalf of the City to Mrs. Williamson. III Council then continued with the matter of hiring a Public Works Director. Mayor Kirk had each Council Member list their choices in numerical order on a ballot and give to the City Clerk. There was no majority vote for one individual. Council Member Watford moved to appoint Jim Threewits as the Public Works Director; seconded by Council Member Chandler. One project has involved seeking grant and legislative funds to construct a community building in the Muse area. My role in this effort was as President of the Board of Directors of the Muse Community Association. As a result of Mr. Threewits' cooperation with the Muse community, a grant application was completed but, unfortunately, not funded and a legislative appropriation was made by the Florida House and Senate. Also, unfortunately, this was one of many legislative items vetoed by the Governor. The ability of Mr. Threewits to help accomplish these efforts, which increases the likelihood of this project ultimately becoming funded, was noteworthy. In another capacity, I serve as the Glades County representative on the State of Florida District 8 Health and Human Services Board of the Department of Children and Families. When the state tried to close a local community mental health center without cause in an effort to streamline services in a way that would have been detrimental to the citizens of Glades County, Mr. Threewits cooperated with my effort to actively advocate to stop this closure and, ultimately, this problem was corrected. Additionally, I am president of a non-profit organization, Floraglades Foundation, which is located in Glades County. In this role, I have helped in the acquisition and protection of 400 acres of wilderness land in the western part of the county through obtaining donation of land and placing it under appropriate deed restrictions. I have also explored donating or selling a parcel of land to the county for government use. In both of these regards, the advice and cooperation of Mr. Threewits has been extremely helpful. Finally, I was active in advocating for the creation of an emergency medical services station in western Glades County. This project was successfully funded and is now a reality largely due to Mr. Threewits' contribution. Except for cause, either. the Municipality or the Agency may terminate this agreement after six months of the date of this agreement and upon 30 days written notice to the other party of the intention to terminate. At the time of termination, uncollected fees shall be retained by the Municipality. Collected fees shall be paid as provided herein and all inspections relating to those fees shall be performed by the ,Agency. Either party may terminate this agreement for cause with a 5-day notice of termination. Cause shall be defined as failure to adhere to the terms of this agreement. Any notice to the Municipality shall be sent to the Municipal authority directly in charge of inspection procedures. Any notice to die Agency shall be sent to Independent Inspections, Ltd., W241 S4135 Pine Hollow Court, Waukesha, WI 53189. 6. The Agency shall implement and enforce the building codes of the Municipality and shall engage such personnel and equipment as, in its opinion, is deemed adequate for such purposes. Should the Municipality object to the method and manner of the implementation of the codes by the Agency, the Municipality shall notify the Agency, in writing, specifically identifying areas of inadequacy and the Agency shall have thirty (30) days after receipt of the notice to cure such inadequacies. If the inadequacies have not been corrected within the time period provided, the Agency shall be deemed to have breached the contract and the Municipality will have cause to terminate. 7. This agreement shall not authorize the performance of any construction work within the Municipality by persons or organizations not duly licensed. The Agency shall not issue a building permit to any contractor, subcontractor, or others for the performance of work in the Municipality who are not properly licensed and authorized to do such work. The Agency will not authorize or allow any development which is in violation of any Municipal, State or Federal law. 8. The Agency agrees to indemnify the Municipality, its employees and agents from and against any and all claims, suits, demands or causes of action, arising out of any act or omission of the Agency, and causing injury to any person or persons or property, whomsoever and whatsoever. Correspondingly, the Municipality agrees to indemnify, save and hold harmless the Agency from and against any claims, suits, causes of action or expense, arising out of any act or omission of the Municipality or its employees, and causing injury to any person or persons or property, whomsoever and whatsoever, to the extent allowed or permitted by applicable law. The Agency agrees to, at all times, at its expense, carry comprehensive general liability insurance in the amount of not Iess than one half million dollars. A certificate of Insurance indicating that such policies are in full force and effect will be supplied to the Municipality. The Municipality agrees to provide to the Agency proof of the existence of comprehensive general liability insurance. 9. All fees for any services rendered in the Municipality shall be collected by the Agency, who shall retain ninety percent (90%) of the funds collected as compensation for its responsibilities outlined herein. The remaining ten percent (10%) of funds collected shall be forwarded to the Municipality. The Agency will charge fees pursuant to the attached Exhibits 1-5 which are trade a part hereof. This agreement may only be modified by a written agreement of the parties executed as an amendment to this agreement. 15. The terms of this agreement may not be assigned by either party. 16. This agreement shall be governed by the laws of the State of Florida with respect to the interpretation and performance. Be it resolved by the City Council of the City of Okeechobee, Florida that the rates, fees and charges for building construction shall be as follows: Section One: Residential Building - One and Two Family 1. Kirk, Mayor Mr. Robert Bradshaw, City Administrator City of Okeechobee 55 SE Third Avenue Okeechobee, FL 34974-2932 This letter serves as amendment and restatement of our auditing agreement dated July 8, 1996 wherein we agreed to audit the financial statements (exclusive of the pension funds) of the City of Okeechobee for the three years ending September 30, 1998, with renewal for two more years through September 30, 2000. This amendment will serve as a recapitulation of our agreement for the two year renewal period. We arc pleased to confirm our understanding of the services we (AUDITORS) are to provide for the City of Okeechobee (CITY) for the three years ending September 30, 2001. We will audit the general purpose financial statements of the City of Okeechobee as of and for the years ending September 30, 1999 and 2MO. The document AUDITORS submit to CITY will include the following additional information that will not be subjected to the audit procedures applies: Summary of Insurance coverage; schedule of assessed values, tax levies and rates; and schedule of certain revenue. The audits will be conducted in accordance with generally accepted auditing standards and Government Auditing StandAWs issued by the Comptroller General of the Untied States; and will include tests of the accounting records of the CITY and other procedures we consider necessary to enable us to express an unqualified opinion that the financial statements are fairly presented, in all material respects, in conformity with generally accepted accounting principles and to report on the Schedule of State Financial Assistance and on CiTY's compliance with laws and regulations and its internal controls as required under Gent Auditintr Standards. If in the course of the audit AUDITORS discover factors which would prevent them from issuing an unqualified opinion on these statements, beyond the exception for fixed assets, as has been in the past, AUDITORS will discuss the qualification with appropriate management. Also, AUDITORS will plan and perform the audit to obtain reasonable assurance about whether the financial statements are free of material misstatement. However, because of the concept of reasonable assurance and because AUDITORS will not perform a detailed examination of all transactions, there is a risk that the material errors, irregularities, or illegal acts, including fraud or defalc:utiuns, may exist and not be detected by AUDITORS. AUDITORS will advise CITY, however, of any matters of that mature that come to our attention. The responsibility as auditors is limited to the period covered by the audit and does not extend to matters that might arise during any later periods for which AUDITORS are not engaged as auditors. It is understood that CITY will provide AUDITORS with the basic information required for the audit and that CITY is responsible for the accuracy and completeness of that information. This responsibility includes the maintenance of adequate records and related internal control structure policies and procedures, the selection and application of accounting principles, and the safeguarding of assets. The CITY understands that this agreement does not include services to be rendered for the CITY's three pension funds, (retirement system and employee pension trust funds). Our audit will not include fiduciary funds or disclosure items in the financial statements related to those funds. References will be included in the AUDITORS' report on the responsibilities of the pension auditors. The CITY understands that the fee quoted is based upon no significant changes in operations of the CITY, adequate internal control and proper maintenance of accounting records. Should the CITY be required to obtain an audit under OMB Circular A-133 ("Single Audit"), we will negotiate an addition to our fee to cover these additional procedures. However, during the audit, if AUDITORS become aware of such reportable conditions or ways that they believe management practices can be improved, they will communicate them to CITY in a separate letter. AUDITORS expect to begin each audit on approximately September 15, and to issue the report no later than March 29 of the following year. If AUDITORS should encounter a problem with the audit reasoruably beyond their control where the March 29 deadline cannot be met, the CITY may extend the deadline date that is agreeable to both parties and waive the liquidated damages through the agreed upon new deadline date. The CITY will not unreasonably withhold the extension of the deadlines. Reasonable cause for delays would include, among others, such issues as failure of timely responses or representations from actuaries, attorneys, other CPA firms involved with the CITY's financial statements or problems with the financial record keeping of the CITY. Respectfully Submitted, %�icKz A�< - ohn Paul Zeigler, trund Secretary MEMORANDUM OF UNDERSTANDING " 1r1J i h, This Agreement has been made and entered into this day of August, 1999 by and between Okeechobee County Fire -Rescue, hereinafter referred to as "County", and City of Okeechobee Fire Department, hereinafter referred to as "City", to establish dispatch protocols, first responder responsibilities, first responder qualifications and patient care documentation requirements to properly coordinate emergency services at an emergency scene pursuant to Section 401.435(b), Florida Statutes. DISPATCH PROTOCOLS 1. The City will respond to medical emergencies only when dispatched or requested by the County. To that end, the City will be dispatched to all vehicle accidents within the corporate limits of the City to which a County ambulance is dispatched and, upon County request, to other medical emergencies occurring therein. It is hereby acknowledged that the City will respond to such medical emergencies with a 3-man engine company. 2. The City engine company will communicate with the County ambulance on the County EMS frequency in radio language which complies with current local practice and Federal Communications Commission regulations. All radio transmissions shall comply with the Florida EMS Communications Plan. 3. Communications between the City engine company and the County ambulance, while either is en route to a medical emergency, shall occur only when the patient is unstable or the emergency scene is unsafe and only when such communication can be expected to affect the outcome of the patient or the safety of responding personnel. FIRST RESPONDER RESPONSIBILITIES 1. If the City engine company is first to arrive at the emergency scene and the scene is not safe, the City shall immediately advise the responding County ambulance of the unsafe condition(s) and initiate efforts to make the scene safe. 2. if the City engine company is first to arrive at the emergency scene and the scene is safe, or is made safe prior to arrival of the County ambulance, City personnel shall begin patient assessment, observing universal precautions and maintaining ABC's (airway, breathing, circulation) and spinal immobilization when indicated. a) If the patient is determined to be unstable, City personnel shall initiate appropriate treatment and advise the responding County ambulance of the unfavorable conditions. b) if the patient is determined to be stable, City personnel shall initiate appropriate treatment and advise County personnel of conditions upon their arrival at the emergency scene. 3. Following arrival of the County ambulance at the emergency scene, City personnel shall assist with treatment and preparation of the patient for transport as directed by County personnel., 4. All on -scene treatment shall be rendered in accordance with County EMS protocols. FIRST RESPONDER QUALIFICATIONS All persons functioning as first responders pursuant to this Memorandum of Understanding shall: have successfully completed a course which meets or exceeds the requirements of the 1979 U.S. J 0 Department of Transportation Emergency Medical Services First Responder Training Course; 2. have successfully completed a course which meets or exceeds the requirements of the Emergency Vehicle Operators Course (EVOC); 3. maintain competency through continuing emergency medical education, to include at least twenty- four (24) hours per year of in-service training on a County ambulance. PATIENT TREATMENT DOCUMENTATION The City will document patient condition(s) found and treatment rendered by first responder personnel prior to arrival of a County ambulance at all medical emergencies to which the City has been dispatched. A copy of all such documentation shall be made available to the County. COORDINATION WITH LAW ENFORCEMENT W EMS personnel (including first responders) shall: upon arrival, obtain an initial report on patient and scene status from the on -scene law enforcement officer; 2. comply with law enforcement requests with respect to scene control; 3. maintain the integrity of a known or potential crime scene that may require further investigation. If patient treatment results in alteration of the physical scene, EMS personnel will advise the on -scene law enforcement officer of the nature of such alteration(s); 4. draw blood for forensic testing (paramedics only) at the request of the on -scene law enforcement officer. The paramedic will adhere to chain -of -custody procedures applicable to blood tubes and kit as requested by the law enforcement officer. In addition to this, residents of Buckhead Ridge are essentially members of the Okeechobee community frequenting Okeechobee area businesses, having Okeechobee addresses and telephone numbers as well as utilizing OUA services and Okeechobee County Public schools. As such, this area should be included in the policy manual.
