Mayor Kirk called the July 20, 1999 Regular City Council Meeting to order at 6:00 p.m. In the absence of Reverend Eddie Lamb, Council Member Watford offered the invocation; Mayor Kirk led the pledge of allegiance. Motion to approve the June, 1999 Warrant Register in the Improvement Council Member Watford moved to approve the June, 1999 Warrant Register in the amounts, General Fund two hundred fifty-five thousand, four hundred ninety-three dollars, ninety-eight cents ($255,493.98), Public Facility amounts, General Fund $255,493.98, Public Facility Fund $491.09 and Debt Service Fund $99,682.48. Improvement Fund four hundred ninety-one dollars, nine cents ($491.09) and Debt Service Fund ninety-nine thousand, six hundred eighty-two dollars, forty-eight cents ($99,682.48); seconded by Council Member Oliver. Request for additions, deferrals or withdrawal of items on today's Mayor Kirk asked whether there were any additions, deferral's or withdrawal's of items on today's agenda. New agenda. Business item "E" was added to discuss Council Chambers Renovations. VII. OPEN PUBLIC HEARING FOR ORDINANCE ADOPTION - Mayor. Mayor Kirk opened the Public Hearing at 6:05 p.m. A.1. a) Motion to read by title only and set July 20, 1999 as a public Council Member Watford moved to read by title only, proposed Ordinance No. 730 rezoning 0.41 acres of unplatted Residential Single Family to Heavy Commercial; seconded by Council Member hearing date, proposed Ordinance No. 730 rezoning unplatted land lands along South Parrott Avenue from along South Parrott Avenue from Residential Single Family to Markham. Attorney Cook read proposed Ordinance No. 730 by title only as follows: "An Ordinance of the City of Okeechobee, Florida amending the Official Zoning Map of Okeechobee by Rezoning a certain tract of land more particularly described herein, from RSF, Residential Single Family District to CHV, Heavy Commercial District, amending the Zoning Map accordingly, Providing for Conflicts, Severability and an Effective Date." 2. a) Motion to adopt proposed Ordinance No. 730. Council Member Oliver moved to adopt proposed Ordinance No. 730; seconded by Council Member Markham. b) Public Comment. Mayor Kirk asked whether anyone from the public would like to comment on this item. No comments were stated. The Council briefly discussed with Planning Consultant LaRue, their concerns for Heavy Commercial businesses that could operate next to the existing church and school. Mr. LaRue assured the Council that a buffer will be mandatory to any development that would interfere with the existing church when a site plan is submitted for review by staff. These regulations are outlined in the Land Development Regulations. The City Planning Board recommended approval of the rezoning. c) Vote on motion. VOTE KIRK - YES CHANDLER - YES MARKHAM - YES OLIVER - YES WATFORD - YES MOTION CARRIED. CLOSE PUBLIC HEARING - Mayor. Mayor Kirk closed Public Hearing at 6.10 p.m. NEW BUSINESS. A. Set dates and time for Tentative Budget Hearings and Millage Rate Finance Coordinator Parker prepared for the Council a tentative budget calendar for Fiscal Year 1999-2000 in Exhibit for the 1999-2000 Fiscal Year - Finance Coordinator (Exhibit 2). 2. Following a brief discussion, Council Member Oliver moved to set the workshop, hearings and millage rate as set out in Exhibit 2; seconded by Council Member Watford. Motion and Second was withdrawn. Council Member Oliver moved to set August 24 1999 at 6.00 p.m. as a Budget Workshop September 7,1999 at 6.00 p.m. for the first Budget Hearing and September 21, 1999 at 6.00 p.m. for the final Budget Hearing; 11 seconded by Council Member Watford. Discuss a Street Closing matter regarding the part of Southeast 4`h Avenue (formerly known as Hiwassee Street) next to the American Legion - City Clerk (Exhibit 3). VOTE KIRK - YES CHANDLER - YES MARKHAM - YES OLIVER - YES WATFORD - YES MOTION CARRIED. Council Member Oliver moved to set the tentative milla a rate at 6.9399• seconded by Council Member Watford. Discussion: Council briefly discussed that they can lower the millage rate at the public hearing but that it could not be raised once it was set by motion. VOTE KIRK - YES CHANDLER - YES MARKHAM - YES OLIVER - YES WATFORD - YES MOTION CARRIED. Cleric Thomas explained to the Council that Okeechobee Abstract and Title Insurance, Inc. was doing a title search for the American Legion in order for them to obtain a loan. According to Deed Book 8 Page 97 dated April 16, 1956 R.E. and Annie B. Hamrick and J.H. antl Sarah Hamrick deeded Block 203 to the American Legion and a portion of Southeast 4" Avenue (f/k/a Hiwassee Street). The deed states "It is understood and agreed that the East 70 foot strip is a part of Hiwassee Street and does not become effective until the City of Okeechobee abandons the same as a street." There is no record of abandonment of the street. Attorney Cook advised the American Legion would need to go through the street closing application procedures. Mayor Kirk asked if the City could issue of a letter of intent for the American Legion to continue their loan process? Attorney Cook responded yes. Mayor Kirk instructed Clerk Thomas to prepare the letter on behalf of the City. JAN JULY 20,1999 - REGULAR MEETING - PAGE 5 OF 7 VI. NEW BUSINESS CONTINUED. B. Discuss a Street Closing matter regarding the part of Southeast 41h Council then discussed the application fees and advertising costs. Council Member Chandler moved to waive the Avenue (formerly known as Hiwassee Street) next to the American application fees but the cost of advertising would be up to the property owner-, seconded by Council Member Legion continued. Oliver. Discussion: Council noted this was a special case and it should have been taken care of after the deed was issued in 1956. Consider Applications received for the Public Works Director - City Administrator Bradshaw supplied the Council with a memorandum of the Selection Committee's recommendation, after Administrator (Exhibit 4). reviewing the five applications for the Public Work's Director. Consider Applications received for the Public Works Director continued. E. Council Chambers Renovations - City Clerk (Exhibit 5). Council Member Oliver moved to follow the selection committee's recommendation to hire Mr. Dennis Horton; seconded by Council Member Markham. Discussion: Council Member Watford suggested that the applications be ranked and the top three be interviewed by the Council since this is a Department Head position. Motion and Second was withdrawn. The following applicants will be invited to be interviewed at the August 17, 1999 meeting: D. Horton, J. Threewits, R. Bonnell. Mayor Kirk explained they would follow the normal interview process. One applicant at a time will be interviewed. Four or five questions will be given, these questions will be in the agenda packet. Council Members may add questions to the list. Clerk Thomas updated the Council by memorandum of the renovations to the City Council Chambers. The project is in full swing. There has been some unexpected surprises resulting in unplanned expenses during the project. We will not be able to completely finish the work this budget year as originally anticipated without additional funding. The current budget is for fifteen thousand dollars ($15,000.00). There are funds available in the General Services Budget, Operating Supplies and Repairs and Maintenance of Building, to cover the total cost of the project which is thirty-four thousand, nine hundred ninety-seven dollars, ninety-nine cents ($34,997.99). Council discussed this matter and expressed their appreciation that Clerk Thomas was keeping them informed and was doing a very good job and that she should continue on with the renovation project to its completion. Council Member Oliver moved to increase the renovation budget to thirty-five thousand dollars ($35 000.00); seconded by Council Member Markham. The Future Land Use Map designates the property Commercial. Most of the properties fronting Parrott Avenue are existing commercial businesses with the exception of two (2) single family structures adjacent to the subject property. Therefore, the proposed change would not be contrary to the established land use pattern. 2. The Proposed Change Would Create an Isolated District Unrelated to Adjacent and Nearby Districts. The land is currently an isolated district without the rezoning. To rezone the property to Commercial would bring it into compliance with the surrounding properties fronting Parrott Avenue. 3. Existing District Boundaries Are Illogically Drawn in Relation to Existing Conditions on the Property Proposed for Change. The existing district boundaries appear to be illogically drawn. Only three (3) houses along Parrott Avenue are currently designated single family. All other properties are designated commercial. 4. The Proposed Change Would Be Contrary to the Proposed Land Use Plan and Would Have an Adverse Effect on the Comprehensive Plan. The proposed change would not be contrary to the land use plan nor create an adverse effect on the Comprehensive Plan. Changed or Changing Conditions Make the Passage of the Proposed Amendment Necessary. It is the primary intent of the applicant to develop the property for commercial purposes. Without the proposed rezoning, this is not possible. 6. The Proposed Change Will Not Create a Drainage Problem. Presently there are no drainage problems associated with the site. Furthermore, the land development regulations require that on -site retention/detention be provided. Depending on the Water Management District review, other drainage concerns may need to be addressed at the time of construction. 7. The Proposed Change Will Seriously Reduce Light and Air to Adjacent Areas. The proposed change should not create a reduction in light and air to adjacent areas. At the time of site plan review, the applicant will be required to comply with height and setback requirements outlined in the City's Land Development Regulations. 8. The Proposed Change Will Adversely Affect Property Values in the Adjacent Area. It is difficult to determine whether the actual use will have an adverse effect on surrounding commercial property values. However, it is reasonable to assume that property values can, and will only, increase because of the rezoning. Commercial properties typically have higher property valuation than single family. Without discounting the rezoning, actual use of the property also plays a factor in the property's value. 9. I was asked by Charles Hart of the American Legion to present this item for consideration by City Council on the July 20 agenda. For more information, as far as the American Legion is concerned, Mike Barber was doing a title search in order for them to obtain a loan. He could go no further until the question concerning the abandonment was answered. Both the City Administrator and City Attorney were out of town this week when this matter came up. Therefore, it appears that the second "paragraph" stating. "It is understood and agreed that the East 70 foot =jp is a U= of Hi oassee Stree a z� and does not become Cffwd nil the City of Okeechobee abandons the same a a stree ", still stands. Or so it appears since as far as a record of minutes showing action by the City Council to abandon it has not been found in our research. We have looked in other records we thought might shed some light on the matter to no avail. As you probably already know the subject property is listed by the Property Appraiser as being owned by the American Legion due to the recorded deed. Several years ago the question came up concerning ownership of this property and the City was given a copy of the recorded deed mentioned above by one of the American Legion members to "prove "their ownership. Apparently this ended the discusslon and this may be due to the understanding that the City has had concerning the Hamrick subdivisions, "City of Okeechobee", and "First Addition to Okeechobee ", regarding the reverter clause included upon the original plat maps for a City of Okeechobee from Col R.E. Hamrick, et. al. In later years to present day, when a street, alley or other thoroughfare is closed or abandoned it is done only through a formal application process from my office then it is submitted to the City Council at a regular scheduled meeting, (Advertised Public Hearing). Prior to this public hearing, a considerable amount of paperwork is done. Therefore, records and minutes now plainly sped approval or non - approval by the City Council to close or abandon such by its recorded action case by case. The application process takes approximately six to eight weeks to accomplish. In this particular case, however, the City Council should be informed of the situation through an agenda item for their discussion and/or resolution. It needs to be cleared up because it keeps coming up with no apparent closure and marry hours are spent re -researching the matter just "in case " something might have been overlooked last time around (and since the deed was given over forty-three years ago). The purpose of this document is to provide you with a narrative explanation of job skills and experience you acquired while on active duty that may have application to employment in the private sector. The document is provided to all separating/retiring soldiers who have served 180 consecutive days of active duty. The Army is also providing the document to soldiers who have separated/ retired from active duty retroactive to 1 October 1990 when the federal mandate went into effect. This document was designed as a tool for you to use in concert with evaluation reports, training certificates, performance awards, Army/American Council on Education Registry Transcript System (AARTS) transcripts, and other pertinent documents in completing job applications, resumes, and college entrance applications. The document consists of information retrieved from various automated sources. The Defense Manpower Data Center (DMDC) receives Service File information and centrally manages the databases for all the services. The Army cannot add to the document any education or training experience that does not already exist in an automated format. For example, only training data after 1984 and experience history after 1975 will be listed. It may not be complete in all cases but willreflect everything that is currently in the bMDC file. Historically, the work experience updates provided to the DMDC were conducted annually from 1975 - 1980, semi-annually from 1981 - 1985, and quarterly from 1986 to present. (Block 7, DD Form 2586 will indicate date of last information update). Historical Army training data is extracted from the Army Training Requirements and Resources System (ATRRS) and experience history is extracted from automated military personnel files. The frequency of the automated updates used for the generation of work experience data will effect the way the document lists the experience. The experience episodes are distinguished from each other if any of the following identifiers change: Service, component, primary, duty or secondary occupation, skill level, pay grade, or additional qualifications. If you look closely at two consecutive episodes shown on the document, you will see that one or more of these identifiers has changes between the two episodes. Your traininglexperience episodes were supplemented with other information to provide you with descriptions of both the occupations you held and the courses you attended, as well as any college credits the American Council on Education (ACE) has recommended for those occupations/courses. However, due to some unexpected surprises and unpleasant discoveries resulting in unplanned expenses we will notbe able to completely finish the work this budget year as originally anticipated without additional funding. I have discussed this with the Administrator and several of you and it has been expressed to me that you want the work completed without interruption if possible. I certainly agree and will continue if that is the consensus of the Council for me to do so. I refuse to say I am sorry we got into this remodeling in the first place. It is a job that needed to be done and obviously we aren't a minute too soon in getting it done.
