Mayor Kirk called the July 6, 1999 Regular City Council Meeting to order at 12 o'clock noon. II. OPENING CEREMONIES: Invocation offered by Reverend Dick Gillen; Reverend Dick Gillen offered the invocation; Pledge of Allegiance led by Mayor Kirk. 11 Mayor Kirk led the pledge of allegiance. III. Motion to dispense with the reading and approve the Summary of III Council Member Chandler moved to dispense with the reading and approve the Summary of Council Action for the Council Action for the Regular Meeting of June 15, 1999. Regular Meeting of June 15, 1999; seconded by Council Member Markham. Discussion: A correction was noted on Page 13 of 16, the second vote, should indicate Watford as voting no. None were stated. A.1. a) Motion to read by title only and set July 20, 1999 as a public Council Member Watford moved to read by title only and set July 20, 1999 as a public hearing date, proposed hearing date, proposed Ordinance No. 730 rezoning unplatted land Ordinance No. 730 rezoning unplatted land along South Parrott Avenue from Residential Single Family to Heavy along South Parrott Avenue from Residential Single Family to Commercial; seconded by Council Member Markham. Heavy Commercial - City Attorney (Exhibit 1). b) Vote on motion to read by title only and set public hearing date.. VOTE KIRK - YES CHANDLER - YES MARKHAM - YES OLIVER - YES WATFORD - YES MOTION CARRIED. c) City Attorney to read proposed Ordinance No. 730 by title only. Attorney Cook read proposed Ordinance No. 730 by title only as follows: "An Ordinance of the City of Okeechobee, Florida amending the Official Zoning Map of Okeechobee by Rezoning a certain tract of land more particularly described herein, from RSF, Residential Single Family District to CHV, Heavy Commercial District, amending the Zoning Map accordingly, Providing for Conflicts, Severability and an Effective Date." 2. a) Motion to approve the first reading of proposed Ordinance No. 730. Council Member Watford moved to approve the first reading of proposed Ordinance No. 730; seconded by Council Member Markham. b) Discussion. Council Member Watford stated he would reserve his comments to the public hearing. c) Vote on motion. Motion to approve a request from Hospice to temporarily close SW Council Member Markham moved to approve a request from Hospice to temporarily close SW 2"1, 3'd and 41h Avenues 2"1 3' and 4ch Avenues between North and South Park Streets on between North and South Park Streets on November 20 and 21, 1999 from 6:00 a.m. to 4:00 p.m. daily; seconded by November 20 and 21, 1999 from 6:00 a.m. to 4:00 p.m. daily - City Council Member Chandler. Administrator (Exhibit 2). Discussion: Staff advised Council the only change in this years Annual Craft Fair for Hospice is they will be displaying antique cars in the avenues during the fair and will remove them each night, the cars are not for sale, they are only on display as an attraction. Mayor Kirk asked whether the City had received any complaints in regards to this fair. Staff responded no. VOTE KIRK - YES CHANDLER - YES MARKHAM - YES OLIVER - YES WATFORD - YES MOTION CARRIED. C. Discuss a Memorandum of Understanding between the City and County Commissioner Hazellief addressed the Council stating the Commission has discussed the possibility of asking County regarding First Responder Procedures - Commissioner the if the City Fire Department could be the first responder to auto accidents. The County feels that this is part of the Hazellief, County Administrator Long and County Fire Captain City's fire/rescue duties and it will help the County greatly. Right now as it is, when an accident happens in the City, Hopkins (Exhibit 3). the County gets called, they send out the emergency vehicle, firefighters/EMT's, then they transport. This ties up four of our people. We are asking for you to consider sending your fire department first, then if transport is required, the County would send the ambulance and certainly still back up one another. With the County's limited staff, the fire study and all that has been going on, and our workshop meetings, we have a problem being able to cover all our territory. We have asked several times and you have graciously responded to back up in those situations. This would greatly free up some of the County's personnel and it is going to certainly help the unity of working together, it would be good for the public to see the County and City working together. There are some details to work out. We are asking for you to approve both the Administrator's and Fire Chiefs to work out the details together. Following a lengthy discussion, Council instructed Administrator Bradshaw and Fire Chief Tomey to work with the County Staff to work out the details of the Memorandum of Understanding and bring it back to the Council for final approval. JULY 6,1999 - REGULAR MEETING - PAGE 4 OF 4 J7.W Pll NEW BUSINESS CONTINUED. C. Discuss a Memorandum of Understanding between the City and County regarding First Responder Procedures continued. D. Update regarding Christmas Decorations - Council Member Markham. Discussion was also held regarding Council discussions with staff at a previous meeting as to the need to purchase a "Jaws of Life" piece of equipment for rescuing trapped victims and the time frame if such a purchase was to be made. No action was taken by Council on this matter at this meeting. Council Member Markham updated the Council in regards to the Christmas Decoration Committee's first meeting. The County has asked to spend thirty thousand dollars to put transformers on the light poles on 441 and 70 and purchase lighted Christmas decorations for those poles. The City would take the banners that we have used and extend them out wherever their lighting stops. The committee will also be working out details for putting the decorations up and taking them down by either contracting or getting someone to volunteer an electric truck to put those type of decorations up, our department is not qualified to do it. Housing of the decorations is also being worked out. We are currently looking at housing all the decorations at the City bam. Mayor Kirk commented he thought this was great and extended a thank you to the County on behalf of the Council. VII. EXIEIIBIT 1 - JUL 6 AGENDA ORDINANCE NO. 730 AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA AMENDING THE OFFICIAL ZONING MAP OF OKEECHOBEE BY REZONING A CERTAIN TRACT OF LAND MORE PARTICULARLY DESCRIBED HEREINs FROM RSF, RESIDENTIAL SINGLE FAMILY DISTRICT TO CHV, HEAVY COMMERCIAL DISTRICT, AMENDING THE ZONING MAP ACCORONGLY, PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Okeechobee, Florida has adopted Ordinance Number. 402 in which a revised Official Zoning Map was adopted for said City; and WHEREAS, the owner of the property more particularly described hereafter, has heretofore filed a petition pursuant to the Land Development Regulations of the City of Okeechobee for the purpose of rezoning a certain tract of land consisting of 0.41 acre(s) from Residential Single Family (RSF) District to Heavy Commercial (CHV) District and that this request be removed from the boundaries of the above mentioned zone to allow for the processing of the rezoning application; and WHEREAS, the City Council finds such rezoning consistent with the City's Comprehensive Plan and deems it in the best interest of the inhabitants of said City to amend aforesaid revised Zoning Map as hereinafter set forth: Now THEREFORE, be it ordained by the City Council of the City of Okeechobee, Florida that: SECTION 1. All of said land being in Section 21, Township 37 South, Range 35 East. SECTION 2. ZONINe MAP AMENDMENT That the aforesaid Revised Zoning Map of the City of Okeechobee be amended accordingly. SECTION 3. CONFLICT Page 1 of 2 All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. SEVERABILITY If any provision or portion of this ordinance is declared by any court of competent jurisdiction to be void, unconstitutional, or unenforceable, then all remaining provisions and portions of this ordinance shall remain in full force and effect. The Future Land Use Map designates the property Commercial. Most of the properties fronting Parrott Avenue are existing commercial businesses with the exception of two (2) single family structures adjacent to the subject property. Therefore, the proposed change would not be contrary to the established land use pattern. 2. The Proposed Change Would Create an Isolated District Unrelated to Adjacent and Nearby Districts. The land is currently an isolated district without the rezoning. To rezone the property to Commercial would bring it into compliance with the surrounding properties fronting Parrott Avenue. 3. Existing District Boundaries Are Illogically Drawn in Relation to Existing Conditions on the Property Proposed for Change. The existing district boundaries appear to be illogically drawn. Only three (3) houses along Parrott Avenue are currently designated single family. All other properties are designated commercial. 4. The Proposed Change Would Be Contrary to the Proposed Land Use Plan and Would Have an Adverse Effect on the Comprehensive Platt. The proposed change would not be contrary to the land use plan nor create an adverse effect on the Comprehensive Plan. On the contrary, the change would bring the property into compliance with the Comprehensive Plan and the Future Land Use Map. -2- Staff Report Petition No. 99-002-R 5. Changed or Changing Conditions Make the Passage of the Proposed Amendment Necessary. It is the primary intent of the applicant to develop the property for commercial purposes. Without the proposed rezoning, this is not possible. 6. The Proposed Change Will Not Create a Drainage Problem. Presently there are no drainage problems associated with the site. Furthermore, the land development regulations require that on -site retention/detention be provided. Depending on the Water Management District review, other drainage concerns may need to be addressed at the time of construction. 7. The Proposed Change Will Seriously Reduce Light and Air to Adjacent Areas. The proposed change should not create a reduction in light and air to adjacent areas. At the time of site plan review, the applicant will be required to comply with height and setback requirements outlined in the City's Land Development Regulations. 8. The Proposed Change Will Adversely Affect Property Values in the Adjacent Area. It is difficult to determine whether the actual use will have an adverse effect on surrounding commercial property values. However, it is reasonable to assume that property values can, and will only, increase because of the rezoning. Commercial properties typically have higher property valuation than single family. Without discounting the rezoning, actual use of the property also plays a factor in the property's value. 9. The Proposed Change Will Be a Deterrent to the Improvement or Developed of Adjacent Property in Accord with Existing Regulations. There are three (3) properties including the applicant's that are zoned RSF but have a -3- Staff Report Petition No. 99-002-R AV Commercial land use designation. By rezoning the Property to Commercial, this would provide consistency with the Future Land Use Map and comply with existing regulations. 10. The Proposed Change Will Constitute a Grant of Special Privilege to an Individual Owner as Contrasted with the Public Welfare. The proposed change will not convey a special privilege to the applicant. In fact, the rezoning would bring the property into compliance with the Comprehensive Plan and Future Land Use Map. 11. There Are Substantial Reasons Why the Property Cannot Be Used in Accord with Existing Zoning. Without the rezoning, the property can only be used for single family residential purposes. Since the underlying land use is commercial, using the property for residential purposes would essentially mean the property is nonconforming. This puts the property owner in a rather peculiar position. 12. Whether the Change Suggested Is Out of Scale with the Needs of the Neighborhood or the City. The requested change is not out of scale with the needs of the City. Good planning principles recommend that adequate commercial use be provided to off -set the costs of residential development, thus making a viable economic base.
