VI. PUBLIC HEARING ITEMS.
A. Disposition of Cases presented by Code Officer Sterling: This being a quasi-judicial proceeding, an oath was administered to those offering testimony, all responded affirmatively. Officer
11 Sterling advised all events occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony,
photographs, and supporting documents were all entered as part of the official record.
Case No. 15-013 Officer Sterling testified service of Notice of Violation/Notice of Hearing sent via certified mail was returned, therefore notice was
Anthony Bertram. 1105 SW 7`h Avenue. posted. He stated this case was before the board on August 11, 2015 and May 10, 2016 both times the board granted property
Ch 30 Sec 30-43 Public nuisance owner an extension in order to get storage containers and commercial vehicles removed from his property. Anthony Bertram
Ch 54 Sec 54-51 Parking in residential neighborhood addressed the board informing them he has a contract on some property which would give him a place to store his equipment.
He told the board he is trying to make a living and doesn't feel his property is a public nuisance. He feels for some reason the
City is making it difficult for him to run his business in the City. Chairperson Gamiotea assured Mr. Bertram they were not trying
to put him out of business, but due to the property being located in a residential area the main issue is the detrimental effect
of the commercial vehicles on other properties in the area and safety concerns with the storage containers. Mr. Bertram said
he doesn't leave the commercial vehicles parked for long periods of time, only to wash them or do maintenance and he believes
the storage containers are safer than a shed. After some discussion among the board, Chief Smith suggested the board allow
thirty to sixty days for staff to work with Mr. Bertram to help find a feasible solution.
Member Conrad moved to find Case No.15-013, Anthony Bertram,1105 SW 7`h Avenue, in violation of Ch 30 Sec 30-43
Public nuisance and Ch 54 Sec 54-51 Parking in residential neighborhood, based on the testimony of Code Officer
Sterling, allowing sixty days for him to work with City Staff to find a solution, then at the first regularly scheduled
meeting after sixty days the case will be put back on the agenda for review, barring any natural disasters that would
require Mr. Bertram to be working out of town; seconded by Member Boak.

Officer Sterling testified notice of violation/notice of hearing sent via certified mail was returned, therefore notice was posted.
The Code Officer said there is a disabled van, trailer and other debris in the yard. He added no contact has been made with
the property owner and nothing has been done to bring the property into compliance..
Member Close moved to find Case 16-029, Syed Alam, 1012 SW 6" Avenue, in violation of Ch 30 Sec 30-41 Disabled
vehicle and Ch 30 Sec 30-44 General cleaning & beautification, based on the testimony of Code Officer Sterling,
imposing a fine of fifteen dollars per day beginning seven days after receipt of proper notification; seconded by
Member Conrad.

Officer Sterling testified property located at 1002 SW 6" Avenue has a structure that was posted by the building cfficial as unfit
for human habitation and the property is very overgrown. A fine of fifteen dollars per day has been accruing since May 5, 2015.
As of today the amount of the lien is $6,945.00 and it continues to accrue daily.
Member Close moved to have Case 15-010, Crystal 1 LLC,1002 SW 6th Avenue, placed on the City Council agenda with
a recommendation to begin foreclosure proceedings, based on the testimony of Code Officer Sterling; seconded by
Member Denisuk.
