Lane Gamiotea Mayor Kirk called the regular meeting to order on February 20, 1996 at 7:00 p.m. Dowling R. Watford, Jr. offered the invocation; Mayor Kirk led the Pledge of Allegiance. Motion to dispense with reading and approve the Summary of Council Member Oliver moved to dispense with reading and approve the Summary of Council Action of the Regular Meeting of January 9, 1996 and the Council Action of the Regular Meeting of January 9, 1996 and the Special Meeting of Special Meeting of January 30, 1996. 11 January 30, 1996; seconded by Council Member Chandler. REQUEST FOR THE ADDITION, DEFERRAL OR WITHDRAWAL Mayor Kirk asked if there were any requests for the addition, deferral or withdrawal of OF ITEMS ON TODAY'S AGENDA. III items for today's agenda? There were none. F. OPEN PUBLIC HEARING FOR FINAL ORDINANCE ADOPTION III Mayor Kirk opened the public hearing at 7:03 p.m. for final ordinance adoption. 1. a. Motion to read by title only Ordinance No. 688 -City Council Member O'Connor moved to read by title only, proposed Ordinance No. 688 Attorney (Exhibit 1). III concerning the amendment of the Future Land Use Map for application No. 95-CII-002 (Rucks); seconded by Council Member Chandler. KIRK CHANDLER O'CONNOR OLIVER WATFORD MOTION CARRIED. Attorney Cook read proposed Ordinance No. 688 by title only as follows: "AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA AMENDING THE CITY OF OKEECHOBEE COMPREHENSIVE PLAN ORDINANCE No. 635 AS AMENDED, BY REVISING THE FUTURE LAND USE MAP; PROVIDING FOR INCLUSION OF ORDINANCE AND REVISED FUTURE LAND USE MAP IN THE COMPREHENSIVE PLAN PROVIDING FOR AN EFFECTIVE DATE." Vote on motion. Council Member O'Connor moved to adopt proposed Ordinance No. 688; seconded by Council Member Chandler. Mayor Kirk asked if there were any comments or questions from the public, there were none. Attorney Cook then began by explaining this ordinance was read on November 7, 1995, it was sent to the Department of Community Affairs (DCA), there were no objections from DCA nor the agencies that also reviewed the proposed ordinance. However, they did offer a comment. The comment was to limit the amount of truck traffic by restricting it to 10th Avenue. Following discussion between Council and Attorney Cook on the difference between a comment and an objection by DCA a vote was taken on the motion on the floor: KIRK CHANDLER O'CONNOR OLIVER WATFORD MOTION CARRIED. CLOSE PUBLIC HEARING III Mayor Kirk closed the public hearing at 7:14 Council Member O'Connor made a motion that if the parcel was developed, the Site Plan Review Committee would address traffic flows and consider restricting truck traffic flow to Northwest 10th Avenue at that time: seconded by Council member Watford. Motion to adopt Resolution No. 96-2 City Clerk (Exhibit 2) Vote on motion is as follows: KIRK CHANDLER O'CONNOR OLIVER WATFORD MOTION CARRIED. Mr. Bobby Tucker, representing the applicant for the change in the Future Land Use Map expressed his appreciation for all of Attorney Cook's hard work on this project and that he was kept informed and it was a pleasure to work with him. Council Member Watford moved to adopt proposed Resolution No. 96-2 supporting Hospice in it's attempt to obtain a Community Services Block Grant; seconded by Council Member Oliver. Attorney Burton Connor advised he was present in representation of Hospice members and the Board of Directors of Hospice and thanked the Council for their continued support of Hospice. Attorney Cook read by title only, proposed Resolution No. 96-2 as follows: "A RESOLUTION OF THE CITY OF OKEECHOBEE, FLORIDA SUPPORTING HOSPICE OF OKEECHOBEE IN ITS ATTEMPT TO OBTAIN A GRANT FUNDED THROUGH THE COMMUNITY SERVICES BLOCK GRANT; FEDERAL FISCAL YEAR 1996." KIRK CHANDLER O'CONNOR OLIVER WATFORD MOTION CARRIED. 1nrl FEBRUARY 20 1996 - REGULAR MEETING - PAGE 6 OF IF . .......... G. NEW BUSINESS 5. Discuss Sidewalks - Councilman O'Connor (Exhibit 3). Council Member O'Connor explained that he would like to start the sidewalk project again. Exhibit Three is information he requested from Public Works Director Elders of quotes obtained a year ago with a ten percent (10%) markup. He further explained that the citizens of Okeechobee are using the sidewalks that have been installed and that the traffic on them will most likely increase with the new middle school in the Southwest section. The proposed sidewalks to be installed are: Southwest 5th Avenue from Southwest 15th Street to Southwest 21 st Street (2,120 feet); Southwest 21 st Street from Highway 441 to Southwest 7th Avenue (2,170 feet); Southwest 3rd Avenue from Southwest 15th Street to City Limits (2,525 feet); Northwest 9th Street from Northwest 9th Avenue to Northwest 10th Avenue (675 feet). The total quote with the ten percent markup is seventy-five thousand, two hundred ninety-two dollars ($75,292.00). Council Members Oliver and Watford did not oppose getting bids for these sidewalks, however, they requested that the Public Works Director set up a plan for sidewalks throughout the City similar to the plan that was set up for paving the streets. By making a plan the sidewalks will not be "piece -meal" and the Council will know how much money to budget for the plan each year. There was a lengthy discussion between Council and Staff concerning next year's revenues, if the amount of money was actually in the budget, what other items Public Works Director Elders thought might come up this fiscal year; and if other areas of the City needs the sidewalks more than the proposed area in Exhibit Three. Also discussed was the safety features the new sidewalks have added to the City as pointed out by Police Chief Mobley. Citizen Bobby Tucker also commented from a Real Estate Broker's point of view that it does add to the attraction of home buyers. FEBRUARY 20, 1996 - REGULAR MEETING - PAGE 7 OF 8 107 G. Council Member O'Connor made a motion to instruct Public Works Director Elders to put out for bids to install sidewalks as presented in Exhibit Three: seconded by Council Member Chandler. Council Member Watford made a motion to amend the motion to out the Sidewalks listed in Exhibit Three out for bid to include that the Public Works Director make a priority list of sidewalks for the future; seconded by Council Member Oliver. Vote on motion to amend: KIRK CHANDLER O'CONNOR OLIVER WATFORD MOTION TO AMEND CARRIED.
