NEW BUSINESS CONTINUED. A. 1. c) City Attorney to read proposed Ordinance No. 792 by title only. Attorney Cook read proposed Ordinance No. 792 by title only as follows. "AN ORDINANCE CLOSING, VACATING AND ABANDONING A PORTION OF THE ALLEY OR ALLEYWAY LOCATED IN BLOCK 15, SOUTH OKEECHOBEE, AS RECORDED IN PLAT BOOK 3, PAGE 37, PUBLIC RECORDS, OKEECHOBEE COUNTY, FLORIDA; AND DIRECTING THE CITY CLERK TO RECORD THE ORDINANCE IN THE PUBLIC RECORDS OF THE CLERK OF THE CIRCUIT COURT IN AND FOR OKEECHOBEE COUNTY, FLORIDA; PROVIDING FOR AN EFFECTIVE DATE." 2.a) Motion to approve the first reading of proposed Ordinance No. 792. Council Member Oliver moved to approve the first reading of proposed Ordinance No. 792; seconded by Council Member Williams. b) Discussion. There was a brief discussion by Council and Staff regarding the language of the ordinance reading a "portion of the alley" agreeing that it is to be interpreted as the entire alley in Block 15. c) Vote on motion. VOTE KIRK - YEA CHANDLER - YEA OLIVER - YEA WATFORD - YEA WILLIAMS - YEA MOTION CARRIED. B. Consider a request from Okeechobee Jaycees to hold a Boot Drive Mr. Pat Caruso of the Okeechobee Jaycees appeared before the City Council requesting permission to hold a Boot for the purpose of raising funds for this year's fireworks - Pat Caruso Drive to raise money for the Fourth of July Fireworks Celebration at Okee Tanie Recreation Park. This years goal is (Exhibit 2). $20,000.00. They are requesting to use the intersections of Parrott Avenue and North Park Street; and Walmart and South Parrott Avenue. Following the discussion Council Member Watford moved to allowthe Okeechobee Jaycees to hold a Boot Drive at the intersections of Parrott Avenue and North Park Street; and Walmart (1st Street) and South Parrott Avenue for one day subject to approval by the Department of Transportation; seconded by Council Member Williams. Mr. Caruso asked for clarification whether that was one day for both intersections or for each intersection. Council responded that was their choice, they could have both intersections on the same day or two different days, but that each intersection would only get one day. Mr. Caruso added that they would probably split the days at the intersections so not to impact traffic on the same day. 332 MAY 21, 2002 - REGULAR MEETING - PAGE 4 OF 7 II___ AGENDA III COUNCIL ACTION - DISCUSSION - VOTE II VII. NEW BUSINESS CONTINUED. B. Consider a request from Okeechobee Jaycees to hold a Boot Drive for the purpose of raising funds for this year's fireworks continued. C. Discussion related to fire Department plans and authorization to proceed with RFP - City Administrator (Exhibit 3). VOTE KIRK - YEA CHANDLER - YEA OLIVER - YEA WATFORD - YEA WILLIAMS - YEA MOTION CARRIED. Administrator Veach advised that this will require a Temporary Use Permit with a fee of one hundred seventy-five dollars ($175.00) and asked whether the Council would want to go ahead and consider the fee waiver. Mayor Kirk noted that the fee waiver would be the City's contribution to the celebration activities. Council Member Watford moved to waive the Temoor__�y_Use Permit Fee 4175,00), seconded by Council Member Williams. VOTE _ KIRK - YEA CHANDLER - YEA OLIVER - YEA WATFORD - YEA WILLIAMS - YEA MOTION CARRIED. Council also advised that they could pick whichever dates they wanted. Mr. Caruso suggested that the Boot Drive will be held the first two Saturday's in June. He also asked how they would be contacted as to DDT's approvals. Attorney Cook stated that he would coordinate with Soecial Projects Coordinator Lydia Williams and that she would notify them of when to come in and apply for their permit. Following a brief discussion between the Council and Administrator Veach, Council Member Oliver moved to authorize the City Administrator to proceed with a Request For Proposals for the renovation of the Fire Department; seconded by Council Member Williams. Administrator Veach advised that it will take approximately forty-five to sixty days before the proposals will be sent out. Discussion related to staffs recommended street improvements for Council Member Oliver moved to authorize the City Administrator to proceed with a Request For Pro ol�sals FY 01 /02 and authorization to proceed with RFP - City Administrator for the Street Improvements for Fiscal Year 2001/02, seconded by Council Member Williams. (Exhibit 4). There was a brief discussion on this item. When the bid comes back to the Council for award, each project will be broken down by cost in order to delete streets as necessary to stay within the budgeted amount. Administrator Veach also clarified that Staffs intentions are not to be doing any street improvements during the winter/Christmas season. Oliver moved to authorize the City Administrator to proceed with a Florida Recreation with FRDAP grant application - City Administrator (Exhibit 5). Develapment Assistance Program, Grant Application for Flaaler Park "L" located between Southwest 2ae and Avenues: seconded by Council Member Watford. Administrator Veach noted that the modifications to this park was designed to work with the existing festivals that are held throughout the year. Motion to approve a right-of-way purchase located at Northwest 91' Council Member Chandler moved to approve a right-of-way purchase in the amount of three thousand dollars Street and US Highway 441 - City Administrator (Exhibit 6). 11 ($3,000.00) located at Northwest9`h Street and North Parrott Avenue (US Highway 441); seconded by Council Member Oliver. Motion to appoint Bryan Stokes a s a Trustee to the firefighters' Council Member Watford moved to appoint Bryan Stokes as a Trustee to the Firefighters' Pension Board, term Pension Board, term beginning May 21, 2002 and ending May 21, beginning May 21, 2002 and ending May 21, 2004; seconded by Council Member Oliver. Motion to appointment alternate members to the Code Council Member Chandler moved to approve appointments to the Code Enforcement Board as alternate members: Enforcement Board ( one fora term beginning May 22, 2002 and Bea Castorina for a term beginning May 22, 2002 and ending April 30, 2005 and Frank Irby for a term beginning May ending April 30, 2005 and the other for a term beginning May 22, 22, 2002 and ending April 30, 2004; seconded by Council Member Oliver. 2002 and ending April 30, 2004 - City Administrator (Exhibit 7). Council noted that each of the ten applicants were all very good and requested that letters of appreciation be sent to those who are not appointed. VOTE KIRK - YEA CHANDLER - YEA OLIVER - YEA WATFORD - NO WILLIAMS - ABSENT MOTION CARRIED. Recess at 7:00 p.m. to enter into an Executive Session regarding Mayor Kirk announced that the City Council would now enter into Executive Session and that the only members that the GRIT issue - Mayor. could remain present in the room is Mayor Kirk, Council Members Chandler, Oliver, Watford, Williams, Attorney Cook, Administrator Veach, Attorney Robbins and a court reporter.
