Mayor Kirk asked if there was anyone present that wished to speak for or against the
proposed ordinance. There was no public comment. Mayor Kirk then opened the floor
for discussion among the City Council.
After brief discussion with Council and Staff members including Public Works Director
Amendment to motion to adopt Ordinance 680
Chuck Elders concerning retaining the Ci y's rights by easements for drainage purposes,
Councilman Watford moved to amend the motion to include an easement for
drainage. utility installation. and repairs and maintenance purposes: seconded by
Councilman Oliver.
Mayor Kirk called for discussion on the amendment. There was no further discussion
from the public; nor from the Council. Mayor Kirk called for a vote on the motion to

The City Attorney pointed out to Council and those present that even though the title
of Ordinance No. 681 was correct as advertised, there was an error in Section 3, the
word redesigned should be changed to redesignated, therefore the motion to adopt the
Ordinance should be approved as amended to reflect that correction. Attorney Cook
Read the Ordinance Title as follows:

Mayor Kirk called for motion to adopt Ordinance No. 681. Councilman O'Connor
moved to adopt proposed Ordinance No 681 as amended: seconded
Councilman Oliver.
Mayor Kirk called for comments from the public; there were no comments. He then
asked for further discussion from Council and after brief comment by Council explaining
the purpose of the Ordinance was to amend Land Use Designations to the Future Land
Use Map through the Application process by: No. 1, App. #95-CI-001, a change from
Single Family to Multi Family by Mrs. Monica Harden; and No. 2, App. #95-CI-002, a
change from Single Family to Commercial by Big Lake Investments, (A total of 2.866
acres), Mayor Kirk called for a vote on the motion to adopt Ordinance No. 681 as
amended:

Fire Chief Tomey introduced Firefighter Bryan Stokes to the City Council

2. Update and progress report by the Citizens' Advisory Committee
Mayor Kirk called Citizens' Advisory Committee Chairman David Hazellief to come and
on the Land Development Regulations - Chairman David Hazellief -
give an update and progress report of the CAC's work on the Land Development
(E-3)
Regulations. Chairman Hazellief informed the Council that the Committee has now been
completely through the volumes once and some two or three times and are presently
going through them again. Some of the Counciimem bers have been attending the CAC
meetings which was appreciated by the Committee.
Chairman Hazellief asked whether there is a Volume IV; and if not, does the Council
want the CAC to write a volume IV? Also, do you want us to work on the zoning map?
Mayor Kirk discussed these questions with Council and staff and it was agreed that the
CAC should write Volume IV, in order for it to be compatible with the work the
Committee is doing on the other volumes. Also the CAC definitely is to work on the
Future Land Use Map (FLUM), which along with the whole Comprehensive Plan must
be updated every five years. (Possible next update by 1997).
Chairman Hazellief acknowledged the direction from the Council as to what extent they
wanted the CAC to go on with their assignment. He stated the CAC would continue to
work on all volumes and include the volume IV as directed and would get information
from the Clerk for the map updates as needed.
Councilman Watford commented that the Committee has done an outstanding and
excellent job for the City on this project. Mayor Kirk expressed the Councils' thanks to
the Committee for their valuable assistance.

4. Discuss the Animal Control Service Bids - City Administrator
Mayor Kirk presented Agenda Item G., 4, to Council for discussion. Councilman
(E-5)
Chandler moved to accept the bid from the Humane Society; seconded by
Councilman O'Connor. After discussion from representatives from the two bidders, the
Humane Society and the Okeechobee Rehab. Facility, the Public and the City Council
concerning care service for the City's animals, it was decided by Council to have certain
questions answered and that each Councilman would research the matter on his own
before the next regular meeting. Councilman Watford moved to table the motion on
the floor until the next meeting seconded by Councilman O'Connor.

Mayor Kirk stated this matter is tabled until the next meeting, and instructed the City
Administrator to get something from the County concerning what is provided by them
to the Okeechobee Rehab. Facility so the Council can make a more informed decision
on this matter at the next meetina.
5. Discuss Interiocai Agreement between the City and County
Attorney Cook informed the City Council that the County is willing to continue operating
Building Department
the City/County Building and Planning Department but that it is not as a definite
situation, but simply a compromise. They would not send the entire department back
to the City to handle, in that they will continue the licensing board functions as they've
always done. They will agree to continue whatever is their functions. They will keep their
own inspectors, but applications for building permits for the City will be obtained at the
City Hall and the City would have to set up a Planning and Development Department.

5. Discussion ofinterlocal Agreement City/County Building
Department
Mayor Kirk commented that we have drug our feet, not wanting to take this department
back. If we can reach a compromise, that would be best. What we have now has not
worked well for a long time. We the City, are open to negotiations, but that doesn't
change anything. The Interlocai Agreement tells us to reach agreement or we get it
back. It is a matter of fact. If we have no Agreement we have to take it back. It's not
open to interpretation.
Councilman Oliver commented that he would like to be appointed the Councilman
to meet with the Attorneys and Staff.
Mayor Kirk asked Commissioner Abney whether or not he thought the Interiocal could
be changed and the Commissioner stated he thought we should try and that the City
and County Attorneys could check to see what could be done about it.
After much more discussion between Council and Staff and Citizens from the Audience
Mayor FGrk instructed Attorney Cook to make arrangements to meet with the
Countv Attorney. the City and County Administrators Councilman Oliver and..a
County Commissioner as discussed to work something out on the Interlocai
Agreement And in the mean time the City Administrator was instructed to
advertise at least to fill the position discussed. even though we will be
negotiating the CitylCounty Building and Planning Department _Interlocal
Agreement.

5. Interiocal Agreement - City County Building Department
Attorney Cook commented that whether or not we take the department back or give it
to the County, it would be good to have the position of planner for the City filled. Mayor
Kirk stated that is my suggestion also. If we can reach an agreement I would vote for
it. We would address at that time whether we need the position filled or not. He further
commented perhaps the County would give us an extension of 90 days.
Attorney Cook stated that he felt the County giving the City a 90 day extension on the
Agreement would be no problem. Mayor Kirk stated he felt we had gotten some
valuable input tonight from both the Council and Citizens input on this matter. Citizen
Hazellief thanked the Council for hearing him.
There being no further items on the agenda, Mayor Kirk adjourned the meeting at 8:40
