2.a) Motion to approve the first reading of proposed Ordinance No. 781. Council Member Oliver moved to approve the first reading of proposed Ordinance No. 781; seconded by Council
Member Chandler.
b) Discussion. Mayor Kirk opened the floor for discussion. The Council and Staff discussed the proposed amendments to the Land
Development Regulations changing home occupations from a special exception to an administrative process and
whetherthis would loosen the impactof the regulations. Council Member Watford notedthis is something each Council
Member needs to think about until the public hearing.

B. Motion to adopt Resolution No. 01-13 regarding a request for a rate Exhibit Two was not provided in the Council's agenda packets, but was provided at the meeting. Council Member

Proposed Resolution No. 01-13Tiitle: A RESOLUTION OF THE CITY OF OKEECHOBEE, FLORIDA REVISING THE
RATE SCHEDULE FOR GARBAGE AND TRASH COLLECTION WITHIN THE CITY OF OKEECHOBEE,
PROVIDING AN EFFECTIVE DATE.
Mr. Jeff Sabin of Waste Management briefly addressed the Council concerning the rate increase request, noting that
his company had not requested an increase since 1989 and even though the resolution indicates the increase is
effective October 1, 2001, the effective date has been changed to November 1, 2001.
Council Member Watford was very concerned with the fact that the Council did not received this information prior to
the meeting in their packets and that he was not able to answer questions from citizens and wanted to table the matter
until October 16 to give the Council time to review the material. Council Member Oliver noted that the City really did
not have any other options and that they should go ahead and consider the resolution tonight.
Council Member Watford moved to table Resolution 01-13, until October 16, 2001; seconded by Council Member
Williams.

Board, term beginning October 1, 2001 and ending September 30,

Council Member Watford moved to approve a request for two-hour parking signs between the hours of 8:00 a.m. and
5:00 p.m. in the 100 Block of Southwest Park Street; seconded by Council Member Oliver.
Chief Davis and the Council discussed this request made by the business owners within the 100 block. Following the
discussion, Motion and second were removed from the floor. Council Member Watford then moved to approve a
request for two-hour parking between the hours of 8.00 a.m. and 5.00 p.m. signs to be installed on the South
side of the 100 block of Southwest Park Street: seconded byCouncil MemberOliver. Council also noted thatthese
parking signs are not to be enforced during downtown festivals.

Administrator Veach explained that this is a two -fold request. One is to obtain authorization from the City Council for
the City of Okeechobee and Okeechobee County Fire Departments, Police Department and Sheriffs Office to hold a
boot drive at the Park Street and Parrott Avenue Intersection to raise money for the Firefighter and Law Enforcement
Families who lost loved ones in the World Trade Center Attack. The second request is to waive temporary use permit
fee's for the Eckerd and Walmart sites where they will be selling food and t-shirts to raise money.

E. Discuss Boot Drive Benefit for New York Firefighters continued. Council discussed this request and the fact that they had always discouraged boot drives in the past but that this was
III a different situation with the World Trade Center Terrorist Attacks and that it was an exception to the rule.
Council Member Watford moved to authorized the City and County Fire Departments to conduct a boot drive at the
intersection of Park Street (State Road 70) and Parrott Avenue (US Highway 441) on October 6, 2001 and waive the
Temporary Use Permit Fees for the Eckerd and Walmart sites on October 6, 2001; seconded by Council Member Oliver.

1. Upgrading State Road 70 to four lanes across the state.
2. Continued supportfor grants particular related to - Downtown Redevelopment; Community Development Block
Grants; Street and Drainage Improvement Assistance; FRDAP (parks and recreation related) and Historic
Building Renovation and Maintenance.
3. Legislation to collect code enforcement costs/fines via ad valorem taxes.
4. Purchase of Okeechobee Battlefield.
5. Greater Local voice on DOT prioritization.

WHEREAS, Chapter 163, Florida Statutes, provides for amendment to adopted Land
Development Regulations; and
WHEREAS, no valid objection has been made to the proposed Ordinance and it appears to
be in the best interest of the City of Okeechobee that this Ordinance be adopted;
WHEREAS, two public hearings were held by the City on September 25, 2001 and October
16, 2001;

SECTION 1. Section 320, RESIDENTIAL SINGLE FAMILYONEZON/NG DISTRICT REGULATIONS,
Subsection 322, Special Exception Uses, has been amended as follows on
the effective date of this Ordinance.
The following uses and structures are permitted after issuance of a special
exception use petition.
1. Home-eeeapetien
2. Boarding house
3. Adult Family Care Homes or Assisted Living Facilities as provided by
Law.
4. Guest house, Servant's quarters, or Pool house, provided the lot area
shall not be less than 12,500 square feet.

SECTIONS. Section 650, ACCESSORY USES AND STRUCTURE'S, Subsection 65Z Home
Occupation, has been amended as follows on the effective date of this
Ordinance.
A home occupation may be permitted by speeial exeeption administratively
in a dwelling subject to the following Regulations:
1. Only the resident who is licensed to do so shall be engaged in the
home occupation.
2. A home occupation shall be clearly incidental to the residential use,
and shall not occupy more than 20 percent of the total building floor
area, nor more than 300 square feet.
3. There shall be no alteration in the residential character, or visible
evidence of the conduct of such occupation.
4. No equipment or process shall be used in the occupation which
creates interference to neighboring property due to noise, vibration,
glare, fumes, odors or electrical disturbance.
5. Outdoor storage of materials used in the occupation is prohibited,
except for garden produce.
6. No good or services shall be sold on the property.
7. Individual instruction in art, music or education may be give to one
person at a time.
8. Following shall not be permitted as home occupations; beauty shop,
barber, group band, dance or swimming instruction, dining facility or
tea room, antique or gift shop, fortune telling or similar activity;
photographic studio; outdoor repair; retail sales; nursery school.

SECTION 6. SEVERMUTY.
If any provision or portion of this Ordinance is declared by any court of competent
jurisdiction to be void, unconstitutional, or unenforceable, then all remaining
provisions and portions of this Ordinance shall remain in full force and effect.
SECTION 7. Effective Date.
The effective date for the enactment of this Ordinance shall be immediately upon
its passage.

III. UNFINISHED BUSINESS CONTINUED.
A. Consider amending Volume One of the Unified Land Development Code (Land Attorney Cook described the proposed amending ordinance. There are small businesses whose
Development Regulation's - LDR's), continued. operations do not significantly impact the surrounding properties, these would be ideal for home
occupations. Most of these businesses do not sell a product. It seems unfair to make the someone
pay a special exception application fee and go through the process if there will be no major impacts
to the surrounding properties. Also the proposed ordinance is very specific as to which businesses
would require administrative approval and those with special exception approval. There were no
comments from the Board.
IV. ADJOURNMENT -CHAIRPERSON.
PLEASE TAKE NOTICE AND BE ADVISED that if any person desires to appeal any decision made by the Land Planning
Agency with respect to any matter considered at this proceeding, such interested person will need a record of the proceedings, and
for such purpose may need to ensure a verbatim record of the proceedings is made, which record includes the testimony and evidence

OF OKEECHOBEE, PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT RESOLVED by the City Council, City of Okeechobee,

Section 1: Pursuant to Section 8-36 of the Code of Ordinances of the City of
Okeechobee, the charges and rates for garbage and trash collection shall
be as follows:

Greetings,
This letter is to inform and update you as to recent changes on the Board of Trustees of
the City of Okeechobee Municipal Police Officers Pension Fund.
In a recent election held at the city police department, Tommy Raulerson was elected as a
member trustee to the City of Okeechobee Municipal Police Officers Pension Fund Board
of Trustees, and will serve a two-year term beginning October 1, 2001 through September
30, 2003. Tommy Raulerson will be filling the vacancy of John Zeigler, who submitted
his resignation as a member trustee, with such resignation to become effective on
September 30, 2001.
Dennis Davis continues to serve as a member trustee, having been duly elected to that
position last yca . Davi.-' current term of office is from October 1, 2000 through
September 30, 2002.
On September 24, 2001, Larry Mobley submitted his letter of resignation from the City of
Okeechobee Municipal Police Officers Pension Fund Board of Trustees, with such
resignation to become effective on September 30, 2001. Larry Mobley is the fifth trustee,
and currently serves as the Fund Chairman.
Trustees Steve Padgett and Steve Nelson have indicated their desire to continue serving
as resident trustees and are seeking reappointment to their positions at this time. If
reappointed, their terms of office would be from October 1, 2001 through September 30,
2003.
Due to the resignation of Larry Mobley from the Board of Trustees, I have been asked by
the other trustees unanimously if I would consider serving as the fifth trustee on the City
of Okeechobee. Municipal Police Officers Pension Fund Board of Trustees. After careful
consideration, I h-ve deul �c: 1 would accept such an appointment.
I am therefore requesting, on behalf of the Board of Trustees of the City of Okeechobee
Municipal Police Officers Pension Fund, that the Okeechobee City Council, in their
October 2, 2001 City Council Meeting, reappoint Steve Padgett and Steve Nelson as
resident trustees, and also reappoint me, John Paul Zeigler, as the fifth trustee to the City

organization. Carnival circus, fair or other special event operated by a non-profit organization or abutting their principal use.
Commercial carnival, circus or fair in commercial or industrial districts. Similar temporary structures where the period of use
will not exceed thirty days a year. Please note that if you intend to use any portion of a City street or sidewalk a separate permit
will have to be granted by the City Council.

I Donny Arnold, Vice President of the Okeechobee County Fire Rescue Volunteer Division, ask
that the $175.00 fee be waived for our non-profit organization to have a fund raiser to sell hot
dogs, chips, drinks and have a "Boot Drive" to benefit the fallen firefighters and policemen in
New York. We will be placing a food cart at the Walmart Super Center located at 2101 S.
Parrott Avenue on Saturday, October 6, 2001 from 9:00 a.m. to 4:00 p.m. Should you have any
