Mayor Kirk read the following proclamation in its entirety: "Whereas, recreational boating is fun and enjoyable. We
are fortunate that we have sufficient resources to accommodatethe wide vadetyof pleasure boating demands.
While being a marvelous source of recreation, boating to the unprepared can be a risky sport. Not knowing
or obeying the Navigation Rules, drinking alcohol or taking drugs while operating a boat, or choosing not to
wear a life jacket are all examples of lack of proper judgement. One particular behavior that can reduce, by
approximately 80 percent, the number of boaters who lose their lives by drowning each year, is the wearing
of a life jacket; and Whereas, a significant number of boaters who lose their lives by drowning each yearwould
be alive today had they worn their life jackets; and Whereas, modern life jackets are more comfortable, more
attractive and more wearable than styles of years past and deserve a fresh look bytoday's boating public. Now

A. Proclaim May 19 through 25, 2001 as "National Safe Boating Week" hereby supportthe goals ofthe North American Safe Boating Campaign and proclaim May 19through 25, 2001
coninuted. as "NATIONAL SAFE BOATING WEEK," and the start of the year-round effortto promote safe boating. I urge
all of those who boat to "Boat Smart from the Start" by wearing a life jacket and practicing safe boating
habits." The proclamation was presented to members of the Coast Guard Auxiliary. One of the members, Jeanne
Jankowski stated they sincerely appreciated the commendation. They are providing boat inspections to anyone in the
community. To date they have inspected one hundred boats making them safer and explaining the proper ways to
equip ones' boat.
B. Proclaim the month of June as "Okeechobee Foster Parent Mayor Kirk read the following proclamation in its entirety: "WHEREAS, Okeechobee County has at any given time
Recruitment Month". 70 formerly abused and neglected children living in foster care. Sadly, there are fewer than 15 foster homes
available to them in the community. The majority must be sent outside of their communities to strange and
distant places or registered into group homes. Neither options are acceptable to the state of Florida, nor
should they be to the people of Okeechobee. WHEREAS, District 15 of the state Department of Children and
Family Services, the agency responsible for the care and well being of local foster children, has targeted the
month of June as Okeechobee Foster Parent Recruitment Month. During this time the community will be
heavily canvassed for more foster homes. NOW THEREFORE, I, James E. Kirk, by the virtue of the authority
vested in me as Mayor of the City of Okeechobee, do hereby proclaim the month of June, 2001 Okeechobee
Foster Parent Recruitment Month." Ms. Christina Kiaser received the proclamation. She briefly addressed the
Council regarding the shortage of Foster Homes in Okeechobee, and thanked them for taking the time to give attention
to this very important issue.

A.1. c) City Attorney to read proposed Ordinance No. 769 by title only. Attorney Cook read proposed Ordinance No. 769 by title only as follows: "An ordinance of the City of Okeechobee,
Florida amending the City of Okeechobee Comprehensive Plan, Ordinance No. 635 as amended, by revising the
Future Land Use Map; providing for inclusion of Ordinance and revised Future Land Use Map in the
Comprehensive Plan; providing for an effective date."
2. a) Motion to adopt proposed Ordinance No. 769. Council Member Watford moved to adopt proposed Ordinance No. 769; seconded by Council Member Oliver.
b) Public Comments. Mayor Kirk asked whether there were any questions or comments from the Public. There were none.
City Planning Consultant, Jim LaRue addressedthe Council regarding the Future Land Use Map Amendment. The Land'
Planning Agency is recommending approval of the change. They considered the application at their April 24, 2001
meeting. The property is located between Southwest 11°i and 12' Streets fronting Southwest 2'd Avenue. The property
is vacant. The current Zoning and Future Land Use designation is Residential Single Family. The property owner is
seeking to change the property to Multi -Family. Once the Future Land Use Map Amendment is considered, the property
owner will submit an application for rezoning. From a planning standpoint, Staff is recommending approval since the
property along South Parrott Avenue is commercial, this property is one block to the West of South Parrott Avenue, it
would act as a good transitional area into the Single Family area that is already developed further West.
Council member Watford asked whether this application required mailings to surrounding property owners? This
application does not, however, when the time comes for the re -zoning to be considered, that application will require
mailings.

approved, it is ready for funding at this time. It is in the amount of one million, one hundred twenty -five -thousand dollars
($-i ,125,000.00). There were a couple of questions, they worked through the questions with State Staff. There does not
seem to be any problems.
Mr. Milita then reviewed his questions and responses from the State Staff and answered the Council's questions
outlined as follows:
Page 3, paragraph V it is says " ... the City shall certify to OTTED that the EDTF Business referred to in Paragraph
1.0 above has secured the necessary permits, including but not limited, to, building permits, and initiated construction
of the facilities referenced. If the City fails to provide such certification to OTTED within 180 days of the contract's
execution, OTTED may, at its discretion, terminate this Agreement."We checked with them and let them know that the
transportation road fund was needed to put access into the park, that it was virtually impossible for them to begin
building prior to the grant. They said that would not be a problem, we would be glad to waive that. We asked whether'
we should send them a request and they said we would rather not, if the City would execute the agreement, then
sometime in July, closer to the project start, if the City has changes to the agreement, make several at one time.
This contract is from the Governor's Office of the Office of Tourism and Trade and Economic Development. Mr. Milita
suggested the Council go ahead, execute the agreement and get it in. He stated, as you are aware, we are working on
a series of grants for this project. One is the Economic Development Federal Grant, the other is a Communn
Development Block Grant. This is another part of that puzzle, which is the OTTED Grant. On top of that, I will go one
step further and let you know, you have already received three hundred thousand dollars (300�000 00) from a
legislature appropriation that we gotwhile I was in Tallahassee and that has been awarded by the State. The Governor
can still veto this and we are working on that as we speak to prevent a veto because you are in an area of rural
economic critical concern. We have addressed that with the Governors Office and we will continue to. On top of that
it is my understanding that the County is going to participate with three hundred thousand dollars (300 000.00). Thai
brings your grand total to three million, six hundred fifty thousand dollars ($3,650� for the project.
Paqe 3, there is a space to fill in who will be the City Agreement Administrator. This person can be whomever the
Council designates. It was suggested that it be the City Administrator as the official and Mr. Milita would assist.

A. Motion to approve the Economic Development Transportation Fund Page 4, paragraph 6.2 "All income, interest or other revenues obtained from such investment shall be considered funds
Grant continued of OTTED." That means should the City draw interest on this money they have to at least report it to the State. They
have the right to claim that interest. Sometimes they waive it just because of the amount of money and the effortit takes
to keep track of it. The Council wanted to be sure the Finance Department was aware of the reporting of this
mone .
Page 5, paragraph 6.3 Use of Funds: "... No funds shall be used for the purchase of any capital equipment,
landscaping ..." This is just for transportation related items, such as roadways, bridges, the railroad, things of that
nature. It cannot be used to pay Mr. Milita. To date, Mr. Milita has not submitted any bills for his work and will only if the
project becomes complete. The tenant (Sheffield Environmental Services, Inc.), agreed to take care of that at the
appropriate time.
Page 7, paragraph (D "... if the City spends more than $300,000 in State awards in its fiscal year, an audit conducted
in accordance ..." The City will have to have a separate audit completed by their regular auditing firm, they will do it
as a separate line item and it will have its own report. The City can assume they will charge extra for it, this does not
seem to be an issue.
Page 9, paragraph 15.0 Commencement. These dates can be amended and the State is agreeable to do that.
Page 6 of the Traffic Impact item VIII These were strictly estimates for the number of vehicles that will impact the
project involving State Highways only and they will change as we find out what they really are. A high number was used
so that DOT would pick up on traffic impacts if it was needed.
Attorney Cook commented that he had spoken with Staff in Tallahassee and they indicated a transmittal letter should
include a request to continue the dates immediately. The contract requires us to request changes to the agreement
within the time period as provided. Therefore if we wait until July it is not a problem and hold off on sending that letter
of transmittal until July.

Mr. Milita asked the Council whether they had any questions about legislative appropriations and if they receive any
calls from the Governors Office to please advise them of the need of these appropriation of funds. He could not foresee
any reason why they would veto the project, but anything could happen. Council Member Oliver asked whattype of time
frame is proposed. Mr. Milita responded the Governor must either veto the budget within fifteen days after he receives
it or it becomes law without his signature. However, whenever you have a governor with the same party that is in control
of the House and Senate they know he has a copy of the budget and they let him have a full review before they send
him the bill. June 30°i is the deadline for the new budget. There is also some new legislation coming down your way that
can encourage the situation that you have going on here. Hopefully that legislation will be signed into law.
Council Member Watford noted that he had sent an email to our legislators personally thanking them for assisting us
in this endeavor. Mr. Milita asked, with Council permission, he would like to go ahead and have some of the big checks
made up, let them (the legislators) come down at one time and present them (to the City) and receive the recognition
for their work. Your legislative delegation this year worked unbelievably well together considering the fact that you have
both parities and several counties involved.
Administrator Veach added for the record, he had an opportunity to work with Dale Milita in Tallahassee quite a bit this
session and wanted the Council to know what an excellent advocate in him they have in Tallahassee, he really went
to bat for the City of Okeechobee.
Motion to adopt Resolution No. 01-6 regarding the OTTED III Council Member Oliver moved to adopt Resolution No. 01-6 regarding the OTTED Transportation Fund Grant;

Attorney Cook explained that some of the things in the Resolution are a little premature, but the agreement you just
entered into with OTTED requires the City to implement resolutions. This resolution follows or tracks that agreement
with OTTED and these agreements and resolutions are necessary prior to the release of funds by the State of Florida.
Mayor Kirk asked whether Attorney Cook saw any problems with the Council adopting the Resolution at this time? He
responded, no, some of the things we can certify presently, others will be done as we reach that stage in the project.
Council Member Oliver asked, are all the date's in here subject to change, like the commencement date of construction
is August. Attorney Cook answered yes, and as Mr. Milita said on the above item, in phone conversations they (State
Staff) has assured us it is common and there will be no problems.

C. Discuss closing a portion of an Alley in Block 200 - Hamrick Estate/ Attorney Cook advised that Mr. David Hamrick, Trustee of the Hamrick Estate contacted City Planning Consultant, Jim
Department of Transportation (Exhibit 4). LaRue regarding a portion of an alley the Department of Transportation is needing to acquire due to retention areas for
the State Road 70 West widening project. The alley runs East to West in Block 200, City of Okeechobee and only the
portion between Lots 12,13,14 and 15 needs to be closed. Following a brief discussion, Council Member Watford
moved to instructthe City Attomey and City Clerk to begin the necessary paperwork to close the portion of the
alley; seconded by Council Member Chandler.

Mr. Badke addressed the Council updating them on the status of hiring a new building inspector, they have hired a local
person, Mr. Joe Boyd. Mr. Badke will continued to serve as the Building Official and fill in when necessary. As far as
he can tell, everything is running nicely. Mr. Boyd is fitting in well in his position, most everyone already knows him. He
is here Monday, Wednesday and Fridays and can be here on Tuesday's and Thursdays for emergencies.
Council thanked Mr. Badke and they were very glad he had found someone to fill the position. Administrator Veach
interjected that from a staff perspective it is working out very well. He thanked Mr. Badke for his commitment to the City
of Okeechobee and making this transition period work. Mr. Badke responded that Okeechobee was one of the best
places he has had the pleasure of working in.
There being no further items on the agenda, Mayor Kirk adjourned the meeting at 6:30 p.m.

"Whereas, recreational boating is fun and enjoyable. We are fortunate that we have sufiekrt resources to accommodate the
wide variety of pleasure boating demands. While being a marvelous source of recreation, boating to the unprepared can be a
risky sport. Not knowing or obeying the Navigation Rules, drinking alcohol or taking drugs while operating a boat, or choosing
not to wear a life jacket are all examples of lack of proper judgement. One particular behavior that can reduce, by approximately
80 percent, the number of boaters who lose their lives by drowning each year, is the wearing of a life jacket; and Whereas, a
significant number of boaters who lose their lives by drowning each year would be alive today had they worn their life jackets;
and Whereas, modern life jackets are more comfortable, more attractive and more wearable than styles of years past and
deserve a fresh look by today's boating public. Now Therefore, I James E. Kirk, by the virtue of the authority vested in me as
Mayor of the City of Okeechobee, do hereby supportthe goals of the North American Safe Boating Campaign and proclaim May
19 through 25, 2001 as "NATIONAL SAFE BOATING WEEK," and the start of the year-round effort to promote safe boating.
I urge all of those who boat to "Boat Smart from the Start" by wearing a life jacket and practicing safe boating habits."

they be to the people of Okeechobee. WHEREAS, District 15 of the state Department of Children and Family Services, the
agency responsible for the care and well being of local foster children, has targeted the month of June as Okeechobee Foster
Parent Recruitment Month. During this time the community will be heavily canvassed for more foster homes. NOW

THE CITY OF OKEECHOBEE COMPREHENSIVE PLAN, ORDINANCE
No. 635 AS AMENDED, BY REVISING THE FUTURE LAND USE MAP;
PROVIDING FOR INCLUSION OF ORDINANCE AND REVISED FUTURE
LAND USE MAP IN THE COMPREHENSIVE PLAN; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of Okeechobee recognizes the need to plan
for orderly growth and development; and
WHEREAS, Chapter 163, Florida Statues, and Rule 9J5, Florida Administrative Code
provide for amendment to Adopted Comprehensive Plans; and
WHEREAS, the City has received and reviewed certain application(s) for a small-
scale amendment to the Future Land Use Element of the City's Comprehensive Plan, and
said application(s) being reviewed by the City's Land Planning Agency at a duly advertised
meeting, and submitted by staff report, which determined such applicant(s) to be
consistent with the Comprehensive Plan and appropriate to the future land uses within the
City; and
WHEREAS, the City has agreed with the recommendations of the Land Planning
Agency that the proposed application(s) complies with the requirements of Florida Statutes
163, Part II, and that the proposed applications are consistent with the Comprehensive
Plan and appropriate to the future land uses within the City;
BE IT ORDAINED by the City Council of the City of Okeechobee, Florida as follows:
SECTION 1 SHORT TITLE.
THIS ORDINANCE shall be known as the "City of Okeechobee Small Scale
Development Activities Comprehensive Plan Amendment", pursuant to F.S.
163.3187, and shall be effective within the City limits of the City of Okeechobee,
Florida.
SECTION 2 AUTHORITY.
This City of Okeechobee Small Scale Development Activities Comprehensive
Plan Amendment is adopted pursuant to the provisions of Chapter 163.3187, Part
II, Florida Statutes.
SECTION 3 REVISIONS TO THE FUTURE LAND USE MAP.
The following described land is hereby redesignated for purposes of
the Future Land Use Map of the City of Okeechobee Comprehensive
Plan:
a. Application No. 01-003-SSA, from Single -Family to Multi -
Family: Lots 1 through 6, Block 15 of South Okeechobee,
Florida according to the plat thereof recorded in Plat Book 1,
Page 12 of the Public Records of Okeechobee County,
Florida.
SECTION 4 INCLUSION OF ORDINANCE AND REVISED FUTURE LAND USE MAP IN THE
COMPREHENSIVE PLAN.
It is the intention of the City Council of the City of Okeechobee, Florida and
it is hereby provided, that the provision of the Ordinance, and the revisions to the
Future Land Use Map more particularly described as "Future Land Use 2000: City
of Okeechobee, March 19, 1991, as amended December 6, 1994", which is

incorporated herein by reference, shall become and be made a part of the City of
Okeechobee Comprehensive Plan (City of Okeechobee Ordinance No. 635, as
amended).
SECTION 5 SEVERABILITY.
If any provision or portion of this ordinance is declared by any court of
competent jurisdiction to be void, unconstitutional, or unenforceable, then all
remaining provisions and portions of this ordinance shall remain in full force and
effect.
SECTION 6 EFFECTIVE DATE.
The effective date for the enactment of Ordinance No. 769 shall be thirty-
one (31) days after the adoption of this ordinance.

Item before the Council:
The matter for consideration by the City Council and Land Planning Agency is an
application for an amendment to the City of Okeechobee Future Land Use Map (FLUM),
previously adopted by this Board in conjunction with the adoption of the Comprehensive
Plan. This application qualifies under Florida Statutes 163 as a "Small -Scale Amendment"
to the Plan.
The subject property is approximately 1.1 acre(s). The applicant intends to develop the
property for multi -family dwellings. This development will have public utilities. Adjoining
property uses are as follows:

The property has a zoning classification of Residential Single Family (RSF) and this area is
designated Single Family Residential on the Future Land Use Map (FLUM). The applicant
proposes to amend the FLUM to allow Multi -Family Residential as a land use designation
on the property. This would provide consistency with the land uses in the area. A
subsequent rezoning to Multi -Family must follow this action if approved.
Comprehensive Plan Analysis:
The City Council and Land Planning Agency are required to address certain areas in
conjunction with the Comprehensive Plan, which may be categorized as follows:

A. Consistency with the Land Use Categories and Plan Policies.
The Future Land Use for this property is Single -Family Residential. This is not
compatible with the applicant's intentions to build multi -family dwellings. For the
applicant to complete these plans and remain consistent, the Future Land Use Map
will need to be amended to Multi -Family Residential. The proposed change is
consistent with the Land Use Categories and Plan policies. A multi -family
development at this location would provide for a graduated decrease in density and
intensity from Parrot Avenue and into the adjacent single-family neighborhood.
B. Concurrency ofAdequate Public Facilities.
Before the property is developed, they will be required to have water, sewer,
electricity, traffic, drainage, and emergency services. At this time, there is no need
to require further approvals. Water, sewer and electricity currently serve the area.
All other requirements will be addressed at the time of site plan review.
C. Compatibility with Adjacent and Nearby Land Uses.
The proposed Multi -Family Residential land use designation is a better use for this
land than it has been currently designated. With a Single -Family land use
designation, these homes will be located immediately behind the longest
commercial street within the City of Okeechobee. With commercial to the west and
single family to the west, the multi -family creates a transition between these two
uses that currently does not exist. This would provide a consistent decrease in
density away from Parrott Avenue. This pattern has been used on several sites
behind Parrott Avenue and, to this point, has been successful.
D. Compliance with the Specific Standards of the Plan.
The development of multi -family dwellings is allowed in areas designated Multi -
Family on the Future Land Use Map (Policy 2.1(b)). Locating one-half of a block
with multi -family developments is concurrent with Policy 8.1 of the Comprehensive
Plan which states:
The City will amend its land development regulations to encourage development
techniques which mix and distribute land uses to accomplish the following:
a) make the most efficient possible use of existing public facilities;
b) recognize and preserve distinctive natural features of the development site;
c) protect environmentally sensitive areas within the site;
d) preserve open space;
e) meet specific needs of the City, such as affordable housing;
j) promote a sense of pride and communityfor its residents.

Notice of Proposed Action:
This application and its appearance before the City Council and Land Planning Agency
were duly noticed for the public, and were the LPA to make a finding that this application
is consistent with the Comprehensive Plan, the matter will be set for a public reading in
accordance with public notice requirements under Florida Statutes, Chapter 163.
Assessments and Conclusions:
Based upon the Comprehensive Plan, its goals, objectives, and policies, the location of this
property, and due consideration of the adjacent land uses, it is recommended that the Land
Planning Agency, find the application to be consistent with the Comprehensive Plan.

John Domer of LaRue Planning and Management Services, City Planning Consultant, addressed
the Agency stating that the applicant is requesting a change in the Future Land Use Designation
from Residential Single Family (RSF) to Multi -Family (MF). He stated that Mr. Utt owns Lots 1
through 4 and Mr. Cook owns Lots 5 and 6. Mr. Domer stated that the subject property has
adequate public facilities, such as water, sewer and electricity all other requirements will be
addressed at the time of Site Plan Technical Review. The proposed change to Multi -Family is
more compatible with the surrounding properties than the current designation. The application and
subject change to the future land use map is in compliance with the comprehensive plan.
The Agency had some discussion about the boundary survey that was submitted with the
• application and why it only showed lots 1 through 4 and not all six lots that are applied for, and
whether the Agency can approve the petition and limit the lots approved.
It was said that just one of the property owners had a survey for their property but if the Agency
wanted one for all six lots then the applicant would have to comply with their request. It was noted
that if the Agency wanted to they could approve just the lots with the survey.
Member Mueller motioned that as a finding of fact Application 01-003-SSA is in conformance and
that as a matter of law that approval be determined; Member Hoover seconded the motion.
The application will be forwarded to the City Council in Ordinance form with a recommenda-
tion of approval by the Land Planning Agency. This recommendation is based on information
submitted by staff.

ECONOMIC DEVELOPMENT TRANSPORTATION FUND
AGREEMENT
This Agreement (OT01-096) is entered into this day of ,
2001, between the State of Florida Office of Tourism, Trade, and Economic Development
(OTTED) and City of Okeechobee (City) on behalf of Sheffield Environmental Services, Inc.
(EDTF Business).
OTTED has determined that the transportation project described in the Economic
Development Transportation Fund (EDTF) Application, incorporated herein and attached as
"Exhibit A" and hereinafter referred to as the "Project," is necessary to facilitate the economic
development and growth of the State as contemplated by Section 288.063, Florida Statutes.
The City is prepared to complete the Project at an estimated total cost of $1,425,000.00.
OTTED is prepared to provide $1,125,000.00 toward the total project cost of construction
of the transportation project described in Section 1.0.
In consideration of the mutual undertakings and agreements hereinafter set forth and
agreed between the parties as follows:
1.0 PROJECT DESCRIPTION: The Project, identified as Project Number 00/0147A,
is described as follows and is in connection with the location of facilities by the EDTF Business:
Upgrade and pave N.E. 9th Street from the boundary of the
industrial park to State Road 441 for an approximate distance
of 2,000 feet; construct an access road from the boundary of
the industrial park for an approximate distance of 150 feet;

and, construct a rail spur to the Seaboard Coast Line Railroad
tracks for an approximate distance of 1,600 feet.
2.0 TERti1: The term of this Agreement shall commence upon execution and continue
through March 17, 2003, unless terminated at an earlier date as provided herein. Only project
costs incurred on or after the effective date of this agreement and on or prior to the termination
date of the agreement are eligible for reimbursement.

4.0 NOTICES: All notices pertaining to this Agreement shall be in writing and shall be
transmitted either by personal hand delivery; United States Post Office, return receipt requested;
or, overnight express mail delivery. Facsimile transmission or confirmed e-mail may be used if
the notice is also transmitted by one of the preceding forms of delivery. The addresses set forth
above for the respective parties shall be the places where notices shall be sent, unless prior
written notice of change of address is given.

5.0 ADMINISTRATORS: The State EDTF Grant administrator is Wynnelle Wilson,
Chief Analyst for Policy & Incentives The City Agreement Administrator is
. All approvals referenced in this agreement
must be obtained in writing from the parties' agreement administrators or their designees.
6.0 RELEASE OF FUNDS: Project funds made available by OTTED shall not be
released until the following have been satisfied:
(a) The City shall agree by resolution to accept future maintenance and other
attendant costs occurring after completion of the Project for the portion of the Project on the City
system and forward said resolution to OTTED;
(b) The City shall certify to OTTED that the EDTF Business referred to in
Paragraph 1.0 above has secured the necessary permits, including but not limited to, building
permits, and initiated construction of the facilities referenced. If the City fails to provide such
certification to OTTED within 180 days of this contract's execution, OTTED may, at its
discretion, terminate this Agreement;
(c) The City shall verify all invoices, statements or other related documents duly
submitted to the City for pre -audit and approval by the City;
(d) The City shall certify that its adopted local government comprehensive plan is
in compliance with Chapter 163, Part H, Florida Statutes, and that any amendments to the
adopted plan related to the transportation Project or EDTF Business facility have been
determined by the Department of Community Affairs to be in compliance with Chapter 163, Part
H, Florida Statutes;

(e) The City shall provide to OTTED certification and a copy of appropriate
documentation substantiating that all required right-of-ways have been obtained and meet the
definition of right-of-way set forth in Section 334.03(22), Florida Statutes; and,
(f) Provide OTTED with written notification of either its intent to:
(i) Award the construction of the transportation project to the lowest and
best bidder in accordance with applicable state and federal statutes, rules and regulations. The
City shall then submit a copy of the bid tally sheet(s) and awarded bid contract, or
(ii) Construct the transportation project utilizing existing City employees,
if the City can complete said project within the time frame in Section 15.0 of this Agreement.
6.1 TRANSFER OF FUNDS: Upon execution of this Agreement by OTTED and upon
written request from the City, OTTED will transfer funds to the City to be applied toward direct
Project costs on a quarterly basis consistent with project needs.
6.2 INVESTMENT OF FUNDS: Funds transferred to the City by OTTED shall be
invested by the City until their actual expenditure, in such income or revenue producing
investments as authorized by law for other City funds. All income, interest or other revenues
obtained from such investment shall be considered funds of OTTED. The income, interest or
other revenues shall be remitted to OTTED on a quarterly basis within fifteen (15) days of the
close of the months March, June, September, and December, regardless of the month in which
funds were received. Upon completion of the project, all remaining income, interest, or other
revenues shall be returned to OTTED. All refund or interest checks shall be made payable to:
EOG/OTTED, and mailed to the OTTED address in Section 3.0 of this Agreement; with the
Project Number referenced and information that identifies the grant, interest period, amount of
interest earned by account, name of depository, and interest rate. The documentation submitted
to support interest earnings should include copies of bank or investment account statements,
computational work sheets, etc.
6.3 USE OF FUNDS: Funds made available by OTTED pursuant to this Agreement
shall be expended in a timely manner and solely for the purpose of the Project. No such funds
shall be used for the purchase of any capital equipment, landscaping, mitigation planting, water
and sewer lines, for any legal action against OTTED, for the administration of the project fund or
costs associated with preparation of the application.
7.0 LQBBYING: Funds may not be used for the -purpose of lobbying the Legislature,
judicial branch, or any state agency, per Section 216.347, Florida Statutes.
8.0 ASSURANCES:. As an inducement to the transfer of funds referred to in Paragraph
6.1 above, the City grants the assurances that, if initiated, the Project will be carried through to its
completion and will not require the expenditure of any additional funds from OTTED. The City
shall be liable for all cost overruns on the Project.
9.0 DESIGN AND CONSTRUCTION STANDARDS: The City agrees to design and
construct the Project in accordance with standards promulgated by the Florida Department of
Transportation (DOT) in accordance with Section 336.045, Florida Statutes, and to provide
certification of same to OTTED upon completion of the Project. Such certification shall be
provided by a professional engineer registered in Florida who shall certify that all design and
construction for the Project meets minimum construction standards established by DOT pursuant
to Section 336.045, Florida Statutes.
10.0 MINORITY VENDORS: The City is encouraged to utilize "minority business
enterprises," as defined in Section 288.703, Florida Statutes, as subcontractors or sub -vendors
when permitted under this Agreement and shall report the same to OTTED.

11.0 ACCOUNTING, REPORTS AND AUDIT REQUIREMENTS: The City agrees:
(a) To maintain books, records, documents and other evidence according to
generally accepted governmental accounting principles, procedures and practices which
sufficiently and properly reflect all costs of any nature incurred by the City in the performance of
this Agreement and to retain said books, records, documents and other evidence for a period of
three (3) years after termination of this Agreement.
(b) That aforesaid records, books, documents and other evidence shall be subject
at all times to inspection, review or audit by state personnel of the Office of Auditor General,
Office of Comptroller and other state personnel authorized by OTTED.
(c) To include these aforementioned audit and record keeping requirements in
contracts and subcontracts entered into by the City with any party for work required in the
performance of this Agreement.
(d) That three (3) months after the date of execution of this Agreement and every
three (3) months thereafter, the City will provide OTTED with quarterly progress reports. Each
quarterly report shall contain a narrative description of the work completed according to the
project schedule; a description of any change orders executed by the City; a budget summary
detailing planned expenditures versus actual expenditures; and identification of minority business
enterprises used as contractors and subcontractors. Records of all progress payments made for
work in connection with such transportation projects, and any change orders executed by the City
and payments made pursuant to such orders, shall be maintained by the City in accordance with
accepted governmental accounting principles and practices and shall be subject to financial audit
as required by law.

(e) The City shall submit to OTTED a financial audit, pursuant to Section
288.063(8), Florida Statutes, within three (3) months of the Project's completion.
(f) In the event the City expends a total amount of State awards (i.e., State
financial assistance provided to a recipient to carry out a State project) equal to or in excess of
$300,000 in any fiscal year of such receipt, the City shall have a State single or project -specific
audit for such fiscal year in accordance with Chapter 215.97, Florida Statutes; applicable rules of
the Executive Office of The Governor and the Comptroller; and Chapter 10.600, Rules of the
Auditor General. In determining the State awards expended in its fiscal year, the City shall
consider all sources of State awards, including State funds received from OTTED, except that
State awards received by a non -state entity for Federal program matching requirements shall be
excluded from consideration. However, if the City expends less than $300,000 in State awards in
its fiscal year, an audit conducted in accordance with the provisions of Chapter 215.97, Florida
Statutes, is not required. In connection with the audit requirements, the City shall ensure that the
audit complies with all requirements of Section 215.97, Florida Statutes, including submission of
a reporting package to OTTED and the Auditor General.
(g) The City shall provide each sub -recipient of State awards information needed
by the sub -recipient to comply with the requirements of Section 215.97, Florida Statutes.
Pursuant to Section 215.97(6), Florida Statutes, the City shall review and monitor sub -recipient
audit reports, and perform other procedures as specified in the agreement with the sub -recipient,
which may include on -site visits. The City shall require that sub -recipients, as a condition of
receiving State financial assistance, permit the independent auditor of the recipient, the State
awarding agency, the comptroller, and the Auditor General access to the sub -recipient's

215.97, Florida Statutes.

12.0 TERMINATION REPORT: Upon termination of this Agreement, the City will
provide the following:
(a) Certification that the Project has been completed in compliance with the terms
and conditions of this Agreement, and meets minimum construction standards established in
accordance with Section 336.045, Florida Statutes.
(b) A report which shall specify (i) the total funds transferred to the City by
OTTED pursuant to this Agreement; (ii) the total income, interest or other revenues obtained
from the investment of said funds; (iii) the total direct Project costs paid from funds made
available by OTTED pursuant to this Agreement; (iv) the balance of any unexpended Project
funds; (v) the actual amount of the EDTF Business' capital investment, and, (vi) the actual
number of permanent full-time jobs created by the EDTF Business.
13.0 FOLLOW-UP REPORT: Two (2) years after the EDTF Business has completed
the construction associated with this Project, the City will provide OTTED with the actual
number of new, permanent, full-time jobs created by the EDTF Business.
14.0 INDEPENDENT CAPACITY: The City shall act as an independent contractor
and not as an employee of OTTED in the performance of this Agreement. To the extent
permitted by law, the City covenants and agrees that it will indemnify and hold harmless OTTED
and all of OTTED's officers, agents, and employees from any claim, loss, damage, cost, charge or
expense arising out of any act, action, neglect or omission by the City during the performance of
the contract, whether direct or indirect, and whether to any person or property to which OTTED,
or said parties may be subject to, except that neither the City nor any of its sub -contractors will
be liable under this section for damages arising out of injury or damage to persons or property
directly caused or resulting from the sole negligence of OTTED or any of its officers, agents or
employees.
15.0 COMMENCEMENT: Unless terminated earlier, the construction of the Project
shall commence no later than August 27, 2001, and shall be completed on or before March 15,
2002. OTTED shall have the immediate option to terminate this Agreement should the City fail
to meet either of the above -required dates.
16.0 UNEXPENDED FUNDS: Upon termination or expiration of this Agreement, any
funds made available by OTTED pursuant to this Agreement but have not been expended at that
time, shall be returned to OTTED. All investment earnings realized pursuant to paragraph 6.2
above shall be returned to OTTED.
17.0 EXPENDITURES IN VIOLATION OF AGREEMENT: Any Project funds
made available by OTTED pursuant to this Agreement which are determined by OTTED to have
been expended by the City in violation of this Agreement, other applicable law or regulation shall
be promptly refunded in full to OTTED. Acceptance by OTTED of any documentation or
certifications required or permitted to be filed by the City shall not constitute a waiver of
OTTED's rights as the funding agency to verify all information at a later date by audit or
investigation.
18.0 TERMINATION OF AGREEMENT: Either party may terminate this Agreement
upon no less than 24 hours notice in writing delivered by certified mail, return receipt requested,
or in person with proof of delivery. In the event the City fails to perform or honor the
requirements and provisions of this Agreement, the City shall return funds in accordance with
paragraphs 16.0 and 17.0 of this Agreement, within 30 days of the termination of this Agreement.
19.0 TRAVEL: There shall be no reimbursement for travel expenses exceeding the all-
inclusive funds allocated in the Grant Agreement.
20.0 MODIFICATION OF AGREEMENT: In the event the City desires to modify
any of the terms and conditions of this Agreement, the City shall make such request for
modification in writing to OTTED at anytime during the term of this Agreement. However,
where the request for modification relates to changes in the project commencement and/or
project completion dates, such request must be received by OTTED prior to the expiration of the
current commencement or project completion date. If the request for modification of the
commencement or completion date is made after the expiration of such date, OTTED shall have
the option to terminate this Agreement.
21.0 ATTORNEY FEES: Unless authorized by law and agreed to in writing by the
OTTED, OTTED will not be liable to pay attorney fees, interest, or cost of collection.
22.0 WAIVER: The failure of either party to this Agreement to object to or to take
affirmative action with respect to any conduct of the other which is in violation of the terms of
this Agreement shall not be construed as a waiver of the violation or breach, or of any future
violation, breach or wrongful conduct.

23.0 ENTIRE AGREEMENT: This instrument embodies the entire agreement of the
parties. There are no provisions, terms, conditions, or obligations other than those contained in
this agreement; and this agreement supersedes all previous communication, representation, or
agreement, either verbal or written, between the parties. No amendment will be effective unless
reduced to writing and signed by the parties.
24.0 SEVERABILITY: If any term or provision of the agreement is found to be illegal,
invalid, or unenforceable, the remainder of the agreement shall remain in full force and effect
and such term or provision shall be deemed stricken.
25.0 STRICT COMPLIANCE WITH LAWS: The City agrees that all acts to be
performed by it in connection with this agreement shall be performed in strict conformity with all
applicable laws and regulation of the State of Florida.
26.0 NON-DISCRIMINATION: The City will not discriminate against any employee
employed in the performance of this agreement, or against any applicant for employment because
of age, race, creed, color, handicap, national origin, or sex. The City shall insert a similar
provision in all subcontracts for services by this Agreement.
Pursuant to Section 287.134, Florida Statutes, an entity or affiliate who has been placed
on the discriminatory vendor list may not submit a bid on a contract to provide any goods or
services to a public entity, may not submit a bid on a contract with a public entity for the
construction or repair of a public building or public work, may not submit bids on leases of real
property to a public entity, may not be awarded or perform work as a contractor, supplier,
subcontractor, or consultant under a contract with any public entity, and may not transact
business with any public entity.

27.0 AVAILABILITY OF FUNDS: The State of Florida's performance and obligation
to pay under this agreement are contingent upon an appropriation by the Legislature. In the event
that the state funds on which this agreement are dependent are withdrawn, the agreement is
terminated and the State has no further liability to the City beyond that already incurred by the
termination date. In the event of a State revenue shortfall, the total grant may be reduced
accordingly.
28.0 PUBLIC ENTITY CRIME: A person or affiliate who has been placed on the
convicted vendor list following a conviction for a public entity crime may not submit a bid on a
contract to provide any goods or services to a public entity, may not submit a bid on a contract
with a public entity for the construction or repair of a public building or public work, may not
submit bids on leases of real property to a public entity, may not be awarded or perform work as
a contractor, supplier, subcontractor, or consultant under a contract with any public entity, and
may not transact business with any public entity in excess of the threshold amount provided in
Section 287.017 for CATEGORY TWO for a period of 36 months from the date of being placed
on the convicted vendor list.
29.0 UNAUTHORIZED ALIENS: OTTED will consider the employment of
unauthorized aliens by any contractor a violation of Section 274A(e) of the Immigration and
Nationalization Act. Such violation shall be cause for unilateral cancellation of this contract.
30.0 PUBLIC RECORDS: OTTED may unilaterally cancel this Agreement for refusal
by the City to allow public access to all documents, papers, letters, or other material subject to
the provisions of Chapter 119, Florida Statutes, and made or received by the City in conjunction
with this agreement.

31.0 SIGNATORIES AUTHORITY: By the execution hereof, the parties covenant that
the provisions of this Agreement have been duly approved and signatories hereto are duly
authorized to execute this Agreement.

Lake Okeechobee watershed, de -water, treat it thermally with other soils and create an enriched top soil for
marketing nationally and internationally. This process will also reclaim up to 12,000,000 gallons per month
of water at the FDEP "Drinking Water Quality" Standard.

A. Briefly describe the transportation problem which is an impediment to the company described above and
give its importance to the company's decision.
Access to the site I only through a residential neighborhood. The new industrial access must be from US
441 N via NE 9h Street. At the E. end of 9th Street, where it enters the industrial site. There is a small non-
navigatble waterway (Taylor Creek).There is no crossing (bridge or box culverts). Inside the industrial
park site, there is no rail spur and there is not an access road to the proposed rail spur site.
B. Briefly describe the transportation project which will alleviate the transportation problem.
(a) Re -construct NE 9`h Street from US 441 into the industrial park site, including a box culvert or small

Dear Ms. Simmons:
Please accept this request for an addendum to the City of Okeechobee's request for
funding with the Economic Development Transportation Fund Program. This request is
for a waiver to the cost per job criteria requirement.
The basis for this request is that Okeechobee County is a REDI County that has been
designated by the state of Florida as a Rural Area of Critical Economic Concern. Our
County's annualized unemployment rate or 7.5% exceeds the state's annualized
unemployment rate of 3.9% by nearly 4 percentage points.

Dear Ms. Simmons:
Thank you for providing us this opportunity to submit a completed
application for funding from the Economic Development Transportation Fund
on behalf of Sheffield Environmental Services, Inc. Sheffield has provided
information documenting that they will create up to 150 new, year-round, full-
time jobs in the new treatment and manufacturing facility they will construct in
the site we set aside as our City Commerce Center.
This project will also provide for solutions to the wastewater residuals
leaching into the Lake Okeechobee watershed mentioned in the 2000-2001
Legislation, known as the Lake Okeechobee Protection Act. At the same time
the processed product will provide 150 new jobs and produce a soil
enhancement product from the mixture of soils being treated in the thermal
section of this facility, with the de -watered wastewater sludge residue. This
product will be packaged, marketed and shipped nationally and it is our
understanding that it may be also marketed on the international markets. One
of the major positive points of this process is that it de -waters the sludge and
also processes the water to FDEP Drinking Water Quality, while all other sludge
treatments basically heat treat their process and lose the water in doing so.
Approximately 12,000,000 gallons per month of Drinking Water Quality water
will be available for re -use from this process. This is important at a time when
water conservation is so highly sought.

Okeechobee City desperately needs these new jobs and we have a
substantially higher unemployment rate than the State of Florida (City = 7.2%
vs. State = 3.9%). Also our per capita income rate is lower than State averages
(City = $18,725 vs. State = $26,845). The overall poverty rate for Okeechobee is
21.6%. One identified reason for this negative impact is the lack of
diversification of employment from the basically single source agriculture. This
new facility can provide many (up to 150) additional full-time, year-round jobs
and at the same time provide for a solution to the wastewater residual, sludge,
that is being trucked into our area from the metropolitan areas of Dade,
Broward and Palm Beach Counties.
In order for the City of Okeechobee to accommodate Sheffield, we must
develop our 127 acre parcel of land that had previously been reserved for
industrial uses by the City. Our entire project will require approximately
$3,825,000. The City Industrial Park, known as the Okeechobee Commerce
Center (OCC), design permitting, water, sewer, interior street, lighting, and
wetland mitigation is being financed through the following means: CDBG-ED
$600,000 (water/sewer and interior streets) Federal EDA $1,525,000 (design
costs, roadway drainage, surface -water management) Okeechobee County
$300,000 toward the waterway crossing. EDTF $1,125,000. (a) The
improvements to 9th Street from US 441 to and including box culverts or bridge
over the waterway (Taylor Creek). (b) Construct roadway access to the rail spur.
(c) Construct 1,600 linear feet of rail spur including switches and signals that
may be required).
As Mayor, I believe that this project, involving 4 agencies from the public
and one company from the private sector, may be the best City, County, State,
Federal and private sector partnership we have ever seen in our area.
Sheffield Environmental Services has an office in Lakeland, Florida.
However, this facility is the first one in Florida and only one seeking funds from
the EDTF, even if other facilities may be necessary in other areas of the State at
a later time. Lakeland was chosen as a central office due to its location in the
State and our facility is in no way competing with that area, as there is no
manufacturing facility planned there. Sheffield will be making a capitol
investment of $7,800,000 in their construction of the facility. The reasonable
estimate of the projected employment to be created by this project and company
is 150 employees within a 3 year period.
None of the transportation related portions of this project are scheduled
in the County, City or the State Department of Transportation's Plan.
This transportation solution will not only alleviate the problem for this
City Commerce Center, it may well provide a solution for a future for
Okeechobee County and FDOT in their provide alternate emergency by-pass
traffic during emergency situations such as the total grid -lock that occurred
during Hurricane Floyd. The improvements to NE 9th Street can provide for an
outlet for a County by-pass in the future. The County also is providing some
funds ($300,000) toward the water -crossing portion of the project.
This transportation project is required in order that the company has
access, ingress and egress, to the 50 acre parcel of property and have adequate
rail spur access. Without this EDTF grant, the project will not be able to
proceed, because the remainder of agency grant funds will not cover enough to
see the project to fruition.
One other very important document I am enclosing as attachment "A" to
this letter is page 1076 of the Laws of Florida. I call particular note to the
marked paragraph, Section 18, (1) (2). The Florida Legislature passed this
legislation specifically for Okeechobee because of the enormous negative impact
that the environmental clean-up initiative has and is having upon land uses in
most of our. area. Our set -aside industrial area is one of the,. very few areas that
can accept industry. Any consideration that can be offered'by utilizing this
section of the laws of Florida will be greatly appreciated.
The entire City Council is supporting this project and I am very excited
about what it can do for the future of our small rural City. We would
appreciate your every consideration of our grant packet and ask that due to the
schedule of Sheffield Environmental Services that you might expedite
processing in order that we may begin as soon as possible. Please feel free to

(4) An application for anNPDES permit and other approvals from the state relating to the permitted
actiNnty shall be granted or denied by the department within the brie allowed for permit review under
40 C.F.R- part 123, subpart C. Other than for stormwater discharge permitting. the decision
on issuance or denial of such permit may not be delegated to another agency or governmental
authority. The department is specifically exempted from the time limitations provided in ss
5.120.60 and 403.0376. However, if the department fails to render a permitting decision
within the time allowed by 40 C.F.R. part 123, subpart C, or a Memorandum of Agreement
executed by the department and the U.S. Environmental Protection Agency, whichever is
shorter, the applicant may apply for an order from the circuit court requiring the department
to render a decision within a specified time. i
(5) The department shall respond, in writing, to any written comments on a pending
application for a state NPDES permit which the department receives from the Executive
Director, or his designee, of the Game and Fresh Water Fish Commission or the Department
of Natural Resources, on matters within the commenting agency's jurisdiction. The
department's response shall not constitute agency action for purposes of s. 120.57 or other
provisions of chapter 120.
Section 17. The sum of $250,000 is appropriated for fiscal year 1992-1993 from the
Operating Permit Fee Trust Fund, and four positions are authorized, for the Department of
Environmental Regulation to develop an application for receipt of delegation of the National
Pollution Discharge Summation Program from the Environmental Protection Agency and to
develop the necessary procedural and data management changes heeded to implement the
program in this state. The department shall issue a report and recommendations by December
1.1992, for further legislative changes needed to implement the program by January 1, 1994.
t Section 18. (1) It is the intent of the Legislature to vigorously protect and restore the
environment of this state, However, the Legislature recognizes that in some instances such
fiWe protection and restoration efforts may adversely affect the local economy in certain areas and
s.e -bus the present and future revenue sources of the local government in such areas. Further, it is
par rapk the intent of the Legislature to minimize such adverse economic impacts. (2) To the greatest
extent practicable, and where consistent with criteria otherwise set forth by law, a state
agency which awards or recommends any grant, loan or other financial aid to municipalities
or counties is encouraged to give preferential consideration to municipalities or counties
which have been adversely affected by an environmental cleanup .initiative conducted by a
state or regional agency.
Section 19. Paragraph (a) of subsection (1) of section 403.914, Florida Statutes, is amended
to read: 403.914 jurisdictional declaratory statements- (1) Before applying for a permit to
dredge or fill, a property owner, an entity which has the power of eminent domain, or
another person with a legal or equitable interest in property may petition the department for
a declaratory statement of the dredge and fill jurisdiction of the department. The department
shall, by rule, specify information which must be provided and may require authorization to
enter upon the property. The department may require a fee of at least $250 and not more
than $10,000 to cover the direct costs of acting upon the petition.

Dear Mayor Kirk:
Sheffield Environmental Services, Inc. is a new firm in Florida and we are seeking a
location for our first Wastewater Residual (Sludge) Processing Plant. We have researched
several locations in other states and in several foreign countries, returning to Okeechobee
because there is not only a product, wastewater residual (sludge) coming into your area,
but also because there is a need to control wastewater residuals from entering the Lake
Okeechobee watershed, and the entire ecosystem of the Everglades.
We have a Lakeland address for our Corporate Offices. There are no plans to have a
processing facility in or near our present Corporate Headquarters. Our first site
procurement is looking at Okeechobee and sites in other states. While our Corporate
Headquarters will remain in Lakeland, we will have an office at or near our processing
facility.
Sheffield's key staff and I have been associated with the technology known as thermal
processing and incineration for many years, involving the treatment of contaminated soils
and other contaminated materials. We have the technology and ability to dewater and
treat wastewater residuals (sludge's and other waste streams). The water acquired
through the dewatering process will be treated to the Florida Department of
Environmental Protections' standard of drinking water, now allowing us to save millions
of gallons of previously disposed drinking water, one of natures most precious resources.
In addition to the recovery of drinking water, our process, utilizing the sludge we will
create another valuable resource, energy, either in the form of gas or electricity.
Our initial construction will require a facility on approximately 50 acres of land in an area
reserved as industrial. Sheffield will employ 100 to 150 employees within the first 3 years
of operation. We will provide job training and will hire and employ as many local
residents as possible. Our salary range is projected to be from $8.00 to $12.00 per hour.

It is our understanding that through some agencies of the State and Federal Government
that there may be grant funds available for providing infrastructure that support new
industry/business. With our own initial capital investment of $7,800,000 we would need
some assistance in solving what is seen to as transportation related impediments with
support infrastructure. We believe that the problem(s) is;
a) The City's land, that is available for industrial use is lo'trated in an area that
has access only through a residential area, which is not available to or
acceptable for heavy truck traffic. The appropriate access would be from US
441 N. at NE 9t' Street. However this street does not meet standards for
industrial use and there is no available crossing of Taylor Creek where 9t'
Street would enter the industrial park area.
b) There is a CSX railroad line adjacent to our industrial site, however there is
no rail spur access to this track at this time.
c) There is no interior access to the proposed rail spur area for industrial use by
clients of the industrial part.
If the items outlined above can be alleviated, we can conclude our decision to locate this
facility on your site in Okeechobee. A decision on this matter as soon as possible will be
appreciated in order that we may limit our site search and eliminate other sites that are
under consideration in other States and the Bahamas. While there are other areas of the
State of Florida under consideration as future sites, your location is the only one for
which we would seek this type of transportation assistance. We plan to develop the
proposed 50-acre site, within the industrial park ourselves. It is also our understanding
that in the middle of the available site there is a wetland area. As a good neighbor to the
environment this wetland area provides us with an opportunity to show FDEP, EPA and
others that our facility will not compromise environmental issue. We plan to keep this
wetland as a wetland park within our facility area.

for our new facility and finally a big thank you to your staff, as I know how valuable a

THE GOVERNOR, STATE OF FLORIDA, THROUGH THE STATE OF
FLORIDA OFFICE OF TOURISM, TRADE & ECONOMIC
DEVELOPMENT (OTTED) ON BEHALF OF EDTF BUSINESS
SHEFFIELD ENVIRONMENTAL SERVICES INC.; PROVIDING FOR
APPROVAL OF THE OTTED AGREEMENT IDENTIFIED AS PROJECT
NUMBER 00/01147A; PROVIDING FOR NECESSARY AGREEMENTS
TO OBTAIN RELEASE OF FUNDS UNDER THE GRANT; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the City of Okeechobee, Florida has applied for an economic development
grant from the Office of the Governor, State of Florida, under the Florida Office of
Tourism, Trade and Economic Development (OTTED), to provide funds for certain development
on behalf of a qualifying business, Sheffield Environmental Services Inc., under a project
identified as number 00/01147A, and is in receipt of an agreement for adoption of same; and
WHEREAS, the agreement with OTTED requires certain assurances by the City in order
to obtain release of funds under the agreement; and
WHEREAS, the assurances that are required are within the authority of the City to grant,
and are in the best interests of the City and the economic vitality of the City as a whole;
THEREFORE, be it resolved and adopted by the City of Okeechobee Florida as
follows:
1. The City of Okeechobee, Florida accepts and enters into by separate document the
agreement with OTTED under project number 00/01147A to obtain grant funds to assist in
economic development in conjunction with Sheffield Environmental Services, Inc.
2. That once the subject project is completed, the City of Okeechobee accepts and shall
agree to provide future maintenance and attendant costs thereof of the infrastructure or
improvements made thereon.
3. That the City shall certify to OTTED, within 180 days of the execution of the OTTED
agreement, that Sheffield has secured necessary permits, including but not limited to building
permits, and initiated construction of the referenced facilities in this project.
4. That all invoices, statements and related documents generated during implementation
of the project shall be submitted to the City for pre -audit and approval by the City prior to
release of funds.
5. That the City of Okeechobee certifies that its adopted local government comprehensive
plan is in compliance with Chapter 163 Part II, Florida Statutes, and that any amendments to the
adopted plan related to the transportation project or EDTF business facility have been
determined by the Department of Community Affairs to be in compliance with Chapter 163 Part
II, Florida Statutes.
6. That within 180 days of execution of the OTTED agreement, the City will certify to
OTTED , and provide copies of appropriate documentation, which substantiates that all required
right-of-ways have been obtained, and meet the definition of right-of-ways set forth in
334.03(22), Florida Statutes.
7. The City certifies to OTTED that it will award the construction of this transportation
project to the lowest and best bidder in accordance with applicable state and federal statutes,
rules and regulations. Upon execution, the City will provide a copy of all bid tally sheets and
awarded bid contract to OTTED.
8. That the construction of this transportation project shall commence no later than
August 27, 2001, and shall be completed by March 15, 2002. The City reserves the right to
requests extensions of these dates by OTTED, but shall submit such requests prior to the
expiration of the current commencement or project completion dates.
9. That the City of Okeechobee agrees to comply with all other contract provisions set
out in the OTTED agreement executed this date, and as hereafter amended.

SUBJECT: Status Report

Below is a brief summary of past and upcoming events.
DEPARTMENT I SYNOPSIS
ADMINISTRATION 1. Industrial Park/Sheffield Environmental - We have
submitted the EDA grant. John Cook is reviewing the
Transportation Grant contract and we plan to bring it before the
City Council on May 15th. Dale Milita informs me that the
private sector tax exempt bonds/funding have been guaranteed
and should therefore be approved. When this occurs, and it
looks as though it will, this project should become a reality. The
Wastewater Residual Reduction Act passed the House and
Senate and awaits the Governor's signature. This bill offers
public and private utilities an alternative to land application of
sludge. It was supported strongly by the Okeechobee delegation.
Additionally, a $300,000 appropriation was approved for
industrial site development/ preparation. Attorney Cook is
preparing the contract for the sale of land to Sheffield
Environmental Services.
2. The City Administrator and City Attorney met with Steven
Robbins, an attorney who specializes in insurance matters.
He may be retained to assist the City in regard to recouping
our expenditures related to Bettye Taylor's claim.

DEPARTMENT SYNOPSIS
ADMINISTRATION We continue to review the documentation which could
CONTINUED support our claim for reimbursement of expenses incurred
as a result of lapsed reinsurance. The City will be
submitting a proof of claim for the bankruptcy proceeding in
late June.
1. Police Station - Final work continues on the new Police
Station. Furnishings are being assembled inside the building
and site work will be completed soon. We plan to dedicate the
facility on May 31st at 5:00 p.m. The job continues to be ahead
of schedule. Our oversite engineer reports we are getting an
excellent job.
2. Tank Tech - We are working with Ardaman & Associates
regarding the tank removal/ spillage issue at the City Barn.
Funding applications have been ranked by DEP and we are
not scheduled for funding at the current time. It still
appears obligation will not exceed $10,000.
3. Lawsuit ~ We have officially been served in the Pam Miller
lawsuit. Through our liability insurance, we will be provided
with attorney services. That attorney is Brian Walsh. Chief
Davis and Patrolman Tamer have met with the attorney. I will
keep you posted as this issue moves forward.
4. Safety Program - The Safety Manual has been prepared and
is being reviewed by PRM. When approval is received, we will
be able to move forward with the implementation of a new
safety program. This program should help make the City's
work environment safer and will qualify us for a reduction in
our insurance rates (the same way implementing a drug -free
program did).

1. The Director of Public Works and the City Administrator met
with our engineering consultants and an RFP containing the
street project priorities of the City Council is being prepared.
2. Public Works is beginning site work on the new Police Station.
CODE
ENFORCEMENT
1. The Code Board met on May 81. Attorney Cook was instructed
to have all the preliminary paperwork, regarding Marvin
Brantley, ready to move forward with foreclosure proceedings
within 60 days. The Board plans to review this situation on a
month to month basis.
2. Lake-Okee, Inc. / Pogey's Plaza was tabled until the next Code
Board meeting. The owners requested more time to have their
sign in compliance with sign regulations.
3. Barbara Roof was given a reduction of the existing lien to $500
for her property located in the 100 block of NW 5' Street.
FIRE DEPARTMENT
1. Chief Tomey will be attending the Governor's Hurricane
Conference from May 14t' thru May 18t'.
PLANNING BOARD
1. Meeting May 22, 2001 at 7:15 p.m. - Planning Board will hear a
rezone from the existing classification of Residential Single
Family (RSF) to Heavy Commercial (HVC), located at the corner
of SW 151 Street and South Parrott Avenue, legally described as
lots 7 through 12, block 23, South Okeechobee. David Conlon,
Rose Conlon and Handy Food Stores, Inc. are the property
owners. David and Rose Conlon are the applicants.
DEPARTMENT
SYNOPSIS
BOARD OF 1. Meeting May 22, 2001 at 7:00 p.m. - Board of Adjustments
ADJUSTMENTS will hear a variance for the replacement of a billboard with
one that over exceeds the allowable sign frontage for the size
of the lot in Commercial zoning located on lot 7, block 58,
City of Okeechobee.
2. Board of Adjustments will also hear a variance for the South
setback to be changed from 10 feet to 3 feet for an addition
onto an existing non -conforming single family dwelling
located on lots 4 and 5, block 4, Royal Oak Addition. Vince
and Donna Padgett are the property owners. The property
address is 2212 SW 3rd Avenue.
OUTSTANDING

Solid Waste Franchise Agreement - Attorney Cook and the
Administrator met with Jeff Sabin of Waste Management and
a new contract is being prepared for the Council's
consideration.
4. Grit Bankruptcy case ~ Legal action regarding GRIT and
Bankruptcy Court is being pursued. We have obtained the
services of a bankruptcy attorney. Attorney Cook is working
closely with them.

Project. The City Administrator has had preliminary
discussions with DCA. We may be a year or two away
from the next phase of this project. However, the
Administrator has begun discussion which will hopefully
lead to business/volunteer participation.
2. Address traffic congestion problems due to hurricane
evacuations. - The City has been asked to participate in
the planning of the widening of SR 70 in Okeechobee.
The Police Chief, Public Works Director and Administrator
recently took part in DOT discussions regarding
improvements to 441 North.
3. Adopt a 5 year program addressing growth, economic
development, community development and organizational
development.
4. Construction of bridge over Taylor Creek for access to City
property - This is being addressed in conjunction with
the Sheffield proposal.

I am writing this letter to provide you with the attached update on the closure of G.
Pierce Wood (G.P.W.) Memorial hospital. Feel free to pass this information on to
interested parties in your area. Since our last written communication we:
• completed a Macro -level needs assessment
• continued to bring additional Assertive Community Treatment Teams (ACT) online;
and
• worked with stakeholder groups to ensure a smooth transition
The Governor has also has released his fiscal year 2001/2002 budget
recommendation. His budget proposes $34.2M, of which $26.9 million is specifically
for the G. P.W. service area. The funding will help develop the community mental
health capacity needed to provide more cost-effective and less restrictive treatment
alternatives to hospitalization.
Currently the House and Senate committees are involved in the appropriations
process. As such, the final mental health budget has yet to be decided. It is
anticipated that we will receive appropriate resources to complete the closure plan and
fund the necessary additional community resources.
Concern for the safety and well being of those living with severe and persistent mental
illness and the communities to which they will return continues to be at the forefront of
our pia^. As such, we are also realigning the state rr►Pntal health hospital system to
ensure that Floridians who require state hospitalization have access to that level of
care. We hope this information answers your questions and alleviates many of your
concerns.

Demographics & Reasons for Transition to Community Based Care
• G. Pierce Wood Memorial Hospital (GPW) is located on State Hwy 31, seven miles east of
Arcadia, Fla., in DeSoto County. Opened.in 1947 as an extension of Florida State Hospital,
GPW currently has an operating budget of $43 million and has served approximately 600
patients per year.
• Counties in the hospital service area include Pasco, Pinellas, Hillsborough, Manatee,
Sarasota, DeSoto, Charlotte, Lee, Collier, Hendry, Glades, Highlands, Hardee, Polk, Indian
River, Okeechobee, St. Lucie and Martin.
• Persons with severe and persistent mental illness can be safely served in the community. The
effectiveness of treatment and supports is substantiated in the Surgeon General's Report on
Mental Health (1999). The cost of community services, on the average is less than hospital
costs.
• About three people with like conditions can be served in the community for the annual cost of
one person in a state hospital.
How Will the Hospital be Successfully Closed? - Planned Activities for Closure
• A careful plan to close the hospital and simultaneously build commun`fty capacity has been
developed. Planning activities are coordinated using three major workgroups - Community
Development, Hospital Utilization and GPW Closure. Membership of these groups is
comprised of stakeholders and departmental staff with a heavy focus on involvement at the
local level. Interagency Teams have been developed in each district as well.
• The Community Development workgroup is charged with ensuring that the needs of residents
leaving the hospital are met. This group focuses heavily on allocating and ensuring that
needed services are developed in the community. A major activity of this group is to develop
a planned discharge process for residents leaving GPW. The process that has been
developed commands accountability through integrated steps between district staff, hospital
staff and community providers. This accountability extends into the community after the
sresidents-leave, with built-in checkpoints that -promote continuity of care.
• No person will be returned to the community without an individual plan for appropriate
community services, including a place to live and on -going psychiatric cares. If necessary, the
Department has state hospital capacity to serve persons in other state mental hospitals.
• The Hospital Utilization workgroup is charged with realigning district catchment areas to
ensure beds are available for people who require an acute long-term care in a hospital setting.
Also, an important task is to improve facility performance by implementing a utilization
management system for the remaining hospitals.
• The last group, the GPW Closure Team, is charged with maintaining a safe, therapeutic
environment for all residents during the bed phase down of GPW. Activities include
coordinating moving residents into the community or other hospital settings, transitioning
GPW staff into other positions in the area and closing and transferring ownership of the
physical plant.
• The closure of the GPW Hospital is moving according to schedule. Currently the hospital has
934 employees and 261 patients, which exceeds the target of 275.
• On July 1, 2001, we will discontinue admissions. At that time we will have at least 69 short-
term residential beds operational. Another 31 beds will be ready by September.
• The planned activities are consistent with the Governor's recommendations for $26.9 million
added resources for the 18 county GPW area. These resources include:
1. Continuation of 21 Assertive Community Treatment (ACT) Teams throughout
the state. Ten of these teams will be located in the GPW catchment area;
2. Ten additional ACT teams to serve approximately 1,000 persons within the
GPW catchment area;
3. Additional Crisis Stabilization Units for 21 beds for persons in the GPW
1 :; catchment area;
4. 100 Short-term Residential beds;
5. Services to 216 individuals in a group home settings in the GPW catchment
area;
6. Supported housing for approximately 800 people;
7. Medication for 468 people living in the GPW catchment area who are not .
Medicaid eligible;
8. Case management for at least 1,125 persons; and
9. Community development for services and supports to develop community
capacity.
Activities to Assist Affected Employees
• Over 1,000 jobs have been projected for the area with negotiations with the Department of
Juvenile Justice and the Sexually Violent Predator Program. The Department has developed
detailed plans, partnering with these employers, to ensure job opportunities will be available.
The new employers will align their hiring dates with the reduction of hospital positions. These
plans also provide employees with transition time for training and will assist them in finding
equitable employment in their perspective job classifications.
• DJJ will announce the positions for GPW employees only. Advertisement will begin by the
end of April. Interviews will occur in June for the 150 vacancies to be filled 10-1-01.
