VII. PUBLIC HEARING ITEMS. A. Disposition of Cases presented by Code Officer Sterling: This being a quasi-judicial proceeding, an oath was administered to those offering testimony, all responded affirmatively. Officer Sterling advised all events occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony, photographs, and supporting documents were all entered as part of the official record. Case No. 15-013 Officer Sterling testified service of Notice of Violation/Notice of Hearing sent via certified mail was received by property owner. Anthony Bertram. 1105 SW 7`h Avenue. He stated this case came before the board on August 11, 2015. At that time the property was found in violation and Anthony Ch 30 Sec 30-43 Public nuisance Bertram was given a six month extension in order to build a storage area for his equipment and remove the unpermitted Ch 54 Sec 54-51 Parking in residential neighborhood containers and commercial vehicles from his property. However, he was unable to purchase the land to build a storage area until a few days ago. Therefore Mr. Bertram has requested more time to complete the construction of a storage area. Chairperson Gamiotea asked if the storage containers and equipment were noticeable from the road. Officer Sterling said it was noticeable from SW 7`h Avenue, but the tarp has been removed from the storage containers making it less noticeable than before. Chief Smith stated he has received complaints from the neighbors, they would like something to be done to clean it up. Member Abney moved Case No.15-013, Anthony Bertram, 1105 SW 7th Avenue, be given sixty days to provide a plan of action to the City staff that meets their satisfaction and place Case No.15-013 back on the agenda for further review at the first regularly scheduled meeting after the sixty day period; seconded by Member Denisuk. Leon & Tisha Edouard. 903 SE 8`h Avenue Officer Sterling stated no one is living at this address and he has had no contact with the property owner. At this time there are Ch 30 Sec 30-41 Disabled vehicle several disabled vehicles and a shed which was installed without a permit. Ch 70 Sec 70-302 Permit Member Close moved to find Case 16-015, Leon & Tisha Edouard, 903 SE 8th Avenue, in violation of Ch 30 Sec 30-41 Disabled vehicle and Ch 70 Sec 70-302 Permit, based on the testimony of Code Officer Sterling, imposing a fine of twenty five dollars per day beginning seven days after receipt of proper notification; seconded by Member Pippin. VOTE GAMIOTEA - YES BOAK - ABSENT CLOSE - YES CONRAD-YES DENISUK - YES PIPPIN - YES SWEDA - ABSENT ABNEY - YES MOTION CARRIED. Case No. 16-016 Officer Sterling testified notice of violation/notice of hearing sent via certified mail was returned, therefore notice was posted. Jonathon Norton & Tanya Huff. 1107 SW 5ch Street Officer Sterling stated the house has been vacant for about three years. However, someone is mowing the front yard and the Ch 30 Sec 30-43 Public nuisance roof was replaced last year. The code violations are in reference to the back yard which is very overgrown. Ir: addition, the Ch 30 Sec 30-44 General cleaning & beautification neighbor is complaining of rodents coming from the overgrown property onto her property. Member Conrad moved to find Case 16-016, Jonathon Norton & Tanya Huff, 1107 SW 5" Street, in violation of Ch 30 Sec 30-43 Public nuisance and Sec 30-44 General cleaning and beautification, based on the testimony of Code Officer Sterling, imposing a fine of twenty five dollars per day beginning seven days after receipt of proper notification;', seconded by Member Abney.
