COUNCIL ACTION - DISCUSSION - VOTE Mayor Kirk called the August 1, 2000 Regular City Council Meeting to order at 6:05 p.m. Pastor Scott Seidler led the invocation; Mayor Kirk led the pledge of allegiance. Motion to dispense with the reading and approve the Summary of I Council Member Chandler moved to dispense with the reading and approve the Summary of Council Action for the July Council Action for the July 18, 2000 Regular Meeting. 1118, 2000 Regular Meeting; seconded by Council Member Oliver. Requests for the addition, deferral or withdrawal of items on today's IIIAddition: Mayor Kirk asked whether there were any requests for the addition, deferral or withdrawal of items on today's agenda agenda. Exhibit 2 under New Business item B, the Executive Session will be moved under New Business to item C VI. NEW BUSINESS. A. Discuss recommendations of evaluation period ending for Director of Public Works - City Administrator (Exhibit 1). B. Discuss setting new Public Budget Hearing dates - Finance Coordinator/City Administrator (Exhibit 2). Council Member Watford moved to remove the Director of Public Works from new hire probation status to regular City employee; seconded by Council Member Oliver. There was no discussion on this item. VOTE KIRK - YEA CHANDLER - YEA MARKHAM - YEA OLIVER - YEA WATFORD - YEA MOTION CARRIED. Mayor Kirk directed the discussion to Finance Coordinator, Lola Parker. Mrs. Parker explained the need to reschedule new dates for the 2000-2001 Tentative and Final Public Budget Hearings; Debbie at the property appraiser's office had called and advised that the County has their Tentative date set for September 5, 2000. This is the same date the City had originally scheduled. Lola further explained in scheduling the hearings, the School Board has first choice, next choice goes to the County, then all others. Council Member Oliver moved to set September 12, 2000 at 5:01 p.m. for the First Public Budget Hearing and September 19, 2000 at 5:01 p.m. for the Final Public Budget Hearing; seconded by Council Member Watford. VOTE PLEASE NOTE: WEDNESDAY AUGUST 2, 2000, THE CITY COUNCIL WAS NOTIFIED THAT THE FIRST KIRK - YEA AND SECOND PUBLIC HEARINGS ON THE CITY'S BUDGET WILL REMAIN AS ORIGINALLY SET BY CHANDLER - YEA COUNCIL AT ITS MEETING OF ,IULY 18, 2000, WHICH IS: SEPTEMBER 5, 2000 AT 5:01 PM FOR MARKHAM - YEA THE FIRST BUDGET HEARING AND SEPTEMBER 19, 2000 AT 5:01 PM FOR THE FINAL BUDGET OLIVER - YEA HEARING. IT WAS DISCOVERED TODAY THAT INCORRECT INFORMATION WAS REPORTED TO THE WATFORD - YEA PROPERTY APPRAISER BY THE COUNTY WHICH IN TURN CAUSED THE CITY TO HAVE TO CHANGE MOTION CARRIED. ITS ORIGINAL DATES WHENCALLED BY THE PROPERTYAPPRAISER'S OFFICE TO DO so. THEREFORE, THE NEED TO RESET THE HEARING DATES WAS NOT NECESSARY AFTER ALL. AG VI. NEW BUSINESS CONTINUED. C. Please add as the last item for discussion on the August 2, 2000 meeting a discussion on pending litigation by the City Attorney. At that time, I announce on the record that I need advise concerning the litigation. The Mayor then announces the meeting is to commence, and the estimated length of the session; in this case 30 minutes should do it. He also reads the names of all persons who shall remain in the room. At the conclusion, we adjourn back to an open meeting so we can announce the session has concluded, and then close our regular meeting. The other pre -requisites are: (1) Run an ad in the newspaper 7 days prior announcing our intent to enter into closed executive session, with date, time and place and names of those attending. (2) We must retain a court reporter at least a week in advance. She will record the session, not our City Clerk. We must have the meeting transcribed and filed with the Clerk. Veach, City Administrator Below is a brief summary of past and upcoming events. ADMINISTRATION 1. City Hall Park - Construction has begun. Fill dirt is being hauled in by the City Public Works Department. A groundbreaking ceremony was held on July 18t' at 5:30 p.m. at the park location. We received positive media coverage of the event. 2. Industrial Park/Sheffield Environmental - We are coordinating discussions and exploring potential development of the City's industrial park in conjunction with the Sheffield Environmental Group's proposal. An interlocal agreement with the County, which would permit Sheffield to pursue IRB's is under review by the City Attorney. Consultants have prepared final jurisdictional data for review by the SFWMD and Army Corps of Engineers. Additionally, the CDBG Economic Development Grant preparation is underway. A recent review of Sheffield's scientific processes was conducted by CAS.�--1. Their panel of experts were impressed. 3. OUA/City Workshop - The workshop will be held September 12th at 7 p.m. in t he OUA offices. 4. A budget workshop is schedule for August 22nd, CONTINUED The first budget hearing will be September 5th with the final budget hearing set for September 19th. 5. Change in trash collection billing -- We are exploring the possibility of putting City residents and business trash collection billing on the tax bills. 6. Eckerd Youth Foundation -- Eckerd Youth Foundation is assisting the City by doing the following: • Keeping the City clean (ie..picking up trash, sweeping sidewalks) • Trimming and replacing plants in the downtown area as well as adding mulch when needed. 7. FYCC - is working to help clean uptown & weed medians. 8. Police Station - The RFP package is available to contractors. Bids will be opened on August loth. CITY CLERK 1. Dispatcher Position - The City has hired a new Dispatcher for the Police Department. 2. Code Enforcement Board - The City has received an application an alternate member on the Code Enforcement Board. This will come before the Council during the August l st meeting. LAND PLANNING The Land Planning Agency met June 27, 2000. The Board AGENCY considered the following: • Comprehensive Plan Map Amendment Application for Property located at NW 5th Street and NW 3rd Avenue and legal '- described as Lots 7,8,9,& 10 Block 92, City of Okeechobee. The Board recommended that the Comp. Plan Map be amended. The recommendation will go before City Council for final approval. 2 MAIV YNOPSIS NT FIRE 1. Controlled Burns - Preparations are underway for the controlled bums of the houses on the 200 block of SE 3rd Street. This is tentatively set for August 12th. 1. BOARD OF The Board of Adjustment met on June 27, 2000. The Board ADJUSTMENT passed the following: • A Special Exception for lots 1, 2, 3, and adjacent alley in Block 6, Royal Oaks Addition. The owners are now able to submit plans for a car wash CODE 1. The next Code Enforcement Board meeting is August 8th at 7 ENFORCEMENT p.m. 2. Red Rooster Restaurant - The owner of the Red Rooster Restaurant, Vera Sweet, and representatives of LP Sanitation met with the City Administrator and resolved the dumpster issue. 3. Code enforcement is in the process of bringing everyone into compliance with the garbage pickup ordinance. Sixty-two letters have been mailed to businesses regarding the absence of dumpsters at their establishment. Additionally, everyone with a code violation along Rt. 70 East has been sent a notice. Violators along 441 S will be sent notification within the next 2 weeks. PUBLIC WORKS 1. Side mower - Purchase of a new side mower and tractor is complete. Delivery has been made. 2. Street Improvements - An RFP for paving and drainbLge is currently available to contractors. Bids will be opened on August 7th. 3. Maintenance Operator Positions- One position has been filled, one is still pending. K • • ".4_. DEPARTMENT DE PART _ POLICE OUTSTANDING ISSUES -CITY ATTORNEY 1. The City has filled the open dispatcher at position at the Police Department. 2. The Police Department is requesting the DOT paint lines distinguishing the second turn lane at Wal-Mart. 1. The City Attorney plans to meet with the City Administrator and Police Chief to discuss further actions to be taken in the Marvin Brantley issue. 2. Updating and modernization of City Ordinances (Code Book and LDR's • Telecommunications • Departments and Offices • Planning and Development • Streets and Sidewalks • Subdivision Regulations • Water and Sewer Regulations) The City Clerk has explored possibilities in this area as well. 3. Adelphia Cable TV Franchise Agreement Renewal. - A proposed franchise agreement is under review by the City Attorney. 4. Sprint Telephone Franchise Agreement Renewal - The City Attorney recommends obtaining the legal services of someone specializing in this complex area of law. A proposed agreement has been requested from Sprint. The new Communication Tax Simplification law may negate the need for a new agreement. 5. Referendum for Tax Abatement for Economic Development For November ballot. 6. Waste Management regarding proposed changes in the, Solid Waste Franchise Agreement - A meeting with the City Administrator, Attorney Cook and Jeff Sabinis planned. 4 • DEPARTMENT SYNOPSISAl x OUTSTANDING ISSUES CONTIUED- 7. Fire Hydrant Issue with the OUA - A meeting has been CITY ATTORNEY scheduled for September 12th at 7 p.m. at the OUA office. 8. Notice of intent to sue. (Pam Miller case) 9. Grit Bankruptcy case - Legal action regarding GRIT and Bankruptcy Court is being pursued. We have obtained the services of a bankruptcy attorney. The issue of Bettye Taylor's workman's comp case may need to be referred to an attorney who specializes in workman's comp. 10. Marvin Brantley -- An appeal brief has been prepared for the City on the Brantley appeal. The Appellate Panel should give us a decision in September. OUTSTANDING 1. Re -structure salary schedule (City Clerk , Department ISSUES Heads, City Administrator) - Review of job descriptions with Department Heads is complete. Proposals will accompany this year's budget workshop. 2. Updating required insurance programs, ie: safety, blood born pathogens, drug -free workplace (Chief Tomey & Safety Committee) - Implementation of drug -free workplace & safety policies is currently underway. Training of department heads and most of the City Staff has been completed. 4j OUTSTANDING ISSUES 3. Modernize Code Enforcement Policies and Procedures CONTINUED (Chief Tomey & Attorney Cook) 4. Enhanced 911 (City and County Staff) Long -Term: 1. Apply for CDBG Grant for continuation of Downtown Project. 2. Address traffic congestion problems due to hurricane evacuations. - The City has been asked to participate in the planning of the widening of SR ?O in Okeechobee. 3. Adopt a 5 year program addressing growth, economic development, community development and organizational development. 4. Construction of bridge over Taylor Creek for access to City property - This is being addressed in conjunction with the Sheffield p�osal. C. Vea" Date: August 1, 2000 Re: Board of Adjustment Workshop On Thursday, August 3 at 7 p.m., John Cook and Jim LaRue will conduct a workshop for the members of the Board. of Adjustment and City Council. We have advertised the meeting in this manner so Council members may attend if they choose to. Council Members should not feel obligated to attend, however, as the nature of the meeting is to train the Board of Adjustment.
