PRESIDENT CITY COUNCIL ATTEST: November The City Coune±l of the City of Okeechobee, Florida met in recessed workshop session at the City Hall on the above date at 6:3o P. M. with the following present: Mayor Audle7 Dunham, President Donald L. Buwk, Councilmen.' Russell 7. Domer, ~dw~d ~. Douglas and E. H. Hunt with Attorney J. F.~lward!i Curren and Clerk Lorena Spivey. Th~ purpose of the meeting was for study and discussion on aboloshing Municipal Court. pursuant to Chapter 72-203 Laws of Florida. After a lenghty discussion Mayor Dunham recommended that the Council consider aboloshing Municipal Court at the end of his present term, at which time he beleives that the details will be worked out. The Council agreed to wait and see the Supreme Courts decision as to whether a Mayor can al~o serve a~ Municipal Judge. The Council recessed to meet November 20, 1972 at 9:~0 i. Th~ City Clerk presented the petitions of candidates in the General City Election to be held December ~, 1972 and the following petitions were exam_ined by the Council and all petitions were found to contain 2~ or more qualified electors. Councilmen: Cliff Betts, Jr. Charles L. Breland Claude Gardner E. H. Hunt Councilman Domer moved to accept the petitions as presented, seconded by Councilman Hunt and carried. The Council instructed the Clerk to have necessary ballots prepared for voting machines, also to have absentee ballots printed. BALLOT NO. BALLOT NO. Officials to receive same rate of pay as used by County. Doris A. Carden, Clerk, Inspectors June N. Boromei, Violet B. Briney, Ruth D. Jeffers, and Myrna Lee Davis, Beputy Charles D. ~eaton and Voting Machine Supervisor Frank Havely. The Clerk was ~iven authority to select a substitute is necessary. Councilman Domer moved to close absentee ballot voting time at h:30 P. Mi December 4, 1972 seconded by Councilman Hunt and carried. Upon motion the Council recessed to meet November 21, 1972 at 6:30 P. M. PRESIDENT CITY COUNCIL ATTEST: CITY CLERK November 21, 1972 The City Council of the City of Okeechobee, Florida met in recessed session at the City Hall on the above date at 6:30 P. M. with the following present: Present Donald L. Burk, Councilmen: Charles L. Breland, Russell V. Domer, Edward W. Douglas and E. H. Hunt with Attorney J. Edward Curren, Clerk Lorena Spivey and Director of Public Works L. C. Fortner, Jr. President Burk opened the meeting and prayer was by Councilman Douglas. Pursuant to notice published in the Okeechobee News regarding a public hearing to consider rezoning Lots I and 2, Block 183, Original Town of Okeechobee from Residential (R-3) to Commercial, President Burk asked if there were any objections to the requested rezoning. No objection was heard or filed. Therefore, Councilman Domer moved to rezone the above described property as requested, presenting the following Ordinance and moved its adoptiou and upon being seconded by Councilman Douglas was put to a vote and unanimously adopted. ORDINANCE NO. 271 - (78) ORDINANCE AMENDING ORDINANCE NO. 271, BEING AN ORDINANCE ESTABLISHING ZONING REGULATIONS FOR THE CITY OF OKEECHOBEE, FLORIDA AND PROVIDING FOR THE ADMINISTRATION, ENFORC~WENT AND AMENDMENT THEREOF PURSUANT TO _1 THE PROVISIONS OF CHAPTER 176, FLORIDA STATUTES, 1953. WHEREAS, application has been made by R. A. Burgess requesting this Council to rezone from Residential (R-3) to Commercial Lots 1 and 2, Block 183, Original Town of Okeechobee, and WHEREAS, notice of intention to amend City Zoning Ordinance No. 271, re~arding said application was duly published according to law, and WHEREAS, on the 21st day of November, 1972, a public hearing was held in the City Council room pursuant to said notice, and WHEREAS, it is deemed to the best interest of the City of Okeechobee to grant said application; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: SECTION 1. That Lots I and 2, Block 183, Original Town of Okeechobee, be and are hereby rezoned from Residential (R-3) to Commercial, effective No~ember 21, 1972. SECTION 2. That the application requesting rezoning and proof of publication to amend Zoning Ordinance No. 271 published in connection with the above application be attached to this Ordinance and become a part hereof. Audle~ Dunham MAYOR Pursuant to notice published in the Okeechobee News regarding a public hearing to consider rezoning Lot 5, Block B, South Okeechobee from Residential (R-l) to Commercial, President Burk asked if there were any objections to the requested rezoning. A written petition signed by eight property owners objecting to the resorting was presented to the Council. Councilman Hunt stated that he felt the petition spoke the feeling of the people. After discussion and consideration, Councilman Breland moved to deny the petition seconded by Councilman Douglas and unanimously carried. David B. Smith, Consulting Engineer of Okeechobee Beach Water Association, Inc., Leland Pearce, President, several directors of said association and Mr. Eldridge, Farmers Home Administration representative, were present discussing water matters concerning Okeechobee Beach Water Aasociation. ~'~i~) Smith gauze a brief history of Okeechobee Beach ~ater Association, stating the need of assurance from the city that it will be able to furnish adequate water to the Association in the future with the projected growth, suggesting that the city enter into additional expansion program so it will have adequate water in the future. Mr. Eldridge stated he was concerned with the future of the city and association, stating that 5% loan money was available for expansion and suggested that the Association Engineer and City Engineer get together and determine the projected needs of city and association, offering to work with groups. Leland Pearce requested that the Council take action and get engineers together and work out program stating that according to ~ Smith present facilities will not last through 1980. Also stated Okeechobee Beach Water Association was willing to pay fair share of study to see the projected need and estimated cost. Also it was brought out that the Association was pressed for time as they needed to spend a considerable amount on improvements to present system. Gene Woods and Mr. Broome spoke on present growth and projected growth. Councilman Domer suggested a workshop with City En~dneer. President. Burk requested Leland Pearce to furnish report on projected growth of his development. After further discussion President Burk advised that the City would have a workshop meeting in future. Frank Kapsin wa~ present, again regarding his request for street light at corner of Main Street and Stafford Place. Councilman Douglas reported that he had contacted Engineer Mc Arthur of Florida Power and Light Company and was told that the Florida Power and Light Company would like to install light on transforr~er pole on south side of Stafford Place providing the county will authorize light.. Mr. Kapsin was referred to Florida Power and Light Company and County Commissioners. Jacob Weeks was present regarding his request to have a honey extracting house on lot adjacent to his residence property. Mr. Weeks stated that he needed O. K. from city to close loan that he was negotiating to build larger building and purchase additional lot. Councilman Domer suggested rezoning to Agricultural. The Council requested Attorney Curren to pursue matter further and asked Mr. Weeks to bear with the Council for a couple more weeks and advised him he would be notified when meeting would be held. ~tated President Burk/that his recommendation on the request from Fred T. Wilson to build three apartment, building on Lots 5 and 6, Block 182 be referred to Board of Adjustment and Appeals for their recommendation. Building Official Spray requested to present the request to the Board and Mr. Fred Wilson to be notified of decision of Board. Dd, rected Fortner presented November 21, 1972 Memorandum No. 1 - Two - 2 inch SR Water Meters at $228.33 each. Councilman Hunt. moved to approve Memorandum No2 and authorized the purchase of the two meters as listed on said memorandum; seconded by Councilman Domer and unanimously carried. Director Fortner reported on lift station problems. Councilman Hunt suggested that Director Fortner look int~ the feasibility of installing a screen on the county jail and hospital sewer outlets. A re~oning application from ~ilbert Culbreth was presented requesting that Lot 9, Block 29, ~o~ Addition to Okeechobee be rezoned from Residential (R-l) to Commercial. The Council authorized that the notice of public hearing to consider rezoning the above described property be published.
