Proclaim the month of April 2016 as "Guardian Ad Litem Month." Mayor Kirk called the April 5, 2016, Regular City Council Meeting to order at 6:00 P.M. The invocation was offered by Councilman Dowling Watford, as Reverend Shevlin was unable to attend; the Pledge of Allegiance was led by Mayor Kirk. City Clerk Gamiotea called the roll: Present Present Present Present Present Present Absent Present Present Present Present Present Mayor Kirk presented the following proclamation to Mr, Vern Melvin, Circuit Director of the Guardian Ad Litem Program, Ms. Marlene Burns, Mr. James and Mrs. Judy Jackson (local volunteers): "Whereas, the City of Okeechobee prides itself on giving back to the community, contributing to the quality of life among our citizens; and Whereas, the Guardian Ad Litem Program speaks for the best interests of abused, abandoned and neglected children who are involved in the court system; and Whereas, 114 children in the community are currently in danger of suffering from some form of abuse or neglect, and Whereas, Okeechobee community members are encouraged to join together, throughout the month of April, to raise awareness for those children fallen victim of abuse, neglect and abandonment, and Whereas, this effort will give abused, neglected, and abandoned children in our community an improved chance for a safe, permanent home and positive future. Now Therefore, 1, James E. Discuss Okeechobee Main Street's ideas for the revitalization of Downtown Flagler Parks — Jayce Fitzwater (Exhibit 1). Motion and second by Council Members O'Connor and Ritter to dispense with the reading and approve the Summary of Council Action for the Regular Meeting of March 15, 2016. There was no discussion on this item. VOTE: KIRK - YEA CHANDLER - YEA O'CONNOR - YEA RITTER - YEA WATFORD - YEA MOTION CARRIED. In 2015, two presentations were made to the City Council regarding enhancements to the downtown Flagler Parks. This presentation is a follow-up to those, as instructed by the Council. Miss Jayce Fitzwater, Director of Okeechobee Main Street (OKMS) introduced members of their Board in attendance with her: Danielle Shockley, Angie Griffin, Phil Baughman, and Mark Bragel. She then addressed the Council using a PowerPoint presentation entitled: "Why should Okeechobee invest in their downtown parks?" The reasons given were to support local economics, attract tourism, attract business investments, encourage economic development, and build a sense of community. How they propose to improve Flagler Parks is by adding dimension through increased seating and shade, incorporate subtle coloring, and various landscape. OKMS Design Team, with the help of Tree Locators, has discussed placing raised planters in the center of Parks Two through Five, with trees, low maintenance shrubs and mulch planted in the middle. A raised stone wall around the trees will create dimension and provide seating. A concrete apron could be added to meet the Americans with Disabilities Act (ADA) guidelines. In addition to the raised planters, add picnic tables with cover along South Park Street, possibly relocate the benches facing North Park Street (State Road 70), and add shade over the benches at the butterfly garden in Park Six. Subtle coloring can be added through colored tables. It was also suggested to remove the concrete pads which are not being used and replace the area with sod. In order to have a funding source for the improvements, OKMS proposed the City adopt a sponsorship plan with different levels and use funds received from the Florida Department of Transportation (FDOT) for the intersection expansion. Support from the City Council is needed to continue achieving OKMS' mission of enhancing Okeechobee's Downtown as "the heartbeat of the community". Economic Council Executive Director, Sindee Wagner, expressed their support in beautifying these parks as presented, as well as other areas in the City. The consensus of the Council was for OKMS to move forward with the project by coordinating with Administrator MontesDeOca and Public Works Director Allen to develop a plan, time line and budget. B. Consider a 19 percent reduction in parking requested by Lightsey's I Motion and second by Council Members Watford and Chandler to approve a 19 percent parking reduction for Restaurant, Inc. — City Administrator (Exhibit 2). NEW BUSINESS CONTINUED B. Consider a 19 percent reduction in parking requested by Lightsey's Restaurant, Inc. continued. C. Motion to approve repair services in the amount of up to $22,500.00 (including 10 percent contingency) to Cummins Power South, as a sole source repair for Fire Engine 7 — City Administrator and Fire Chief (Exhibit 3). D. Consider appointments for the Code Enforcement Board and Planning Board/Board of Adjustment/Design Review Board — City Clerk (Exhibit 4). COUNCIL ACTION - DISCUSSION — VOTE Plat Book 1 Page 12; and Lots 3-6 and 9-12 of Block 28, First Addition to South Okeechobee Plat Book 1, Page 17, Okeechobee County Public Records) as recommended by the Technical Review Committee (TRC). Mr. Ray Arrants purchased the former TD Bank property. He is proposing to remodel the 8,279 square foot building into Lightsey's Restaurant, Inc. The TRC made a recommendation at their March 17, 2016, meeting to approve the parking reduction when they approved Site Plan No. 16-001-TRC. Council Member Watford asked whether there was anything else the Council needed to be made aware of. Administrator MontesDeOca replied no, the matter is straight forward, the site plan was reviewed twice, and the approved plans are on file. Council Member Watford expressed his appreciation for a long time business relocating to the City. VOTE: KIRK — YEA CHANDLER — YEA O'CONNOR — YEA RITTER — YEA WATFORD — YEA MOTION CARRIED. Motion and second by Council Members Watford and O'Connor to approve estimated repair services in the amount of twenty-two thousand, five hundred dollars and zero cents ($22,500.00) to Cummins Power South, as a sole source repair for Fire Engine 7. Fire Engine 7 has a Cummins diesel engine. Damage occurred to the upper portion of the engine which requires major repairs, and it does not qualify for a replacement. The vehicle is considered high priority and very important to the Fire Department's response capabilities, which creates a more urgent reason for expediting the repairs. Cummins Power South was contacted for the initial evaluation and located nearest to Okeechobee. It would be time consuming and impractical to request evaluations and quotes from other dealers at this point. Council Member Watford asked whether the repairs were guaranteed and how long it would take. Chief Smith answered that it will extend the life of the engine by several years. It has very low mileage, approximately 19,000, and was the Fire Engine created by merging a 2000 chassis body with the old Engine 4 body parts. The repairs should take 30 days or more. Clerk Gamiotea provided in Exhibit 4 a memorandum explaining after advertising through various media sources, the City did not receive any new applications for the Citizen Boards. Three Code Enforcement Board Members terms sunset April 30, 2016. They have expressed their interest to be reappointed. Their attendance record is as follows over the current term (3-years): In 2013, eight meetings were held, absences: Boak 1, Close 0, Pippin 2. In 2014, eight meetings were held, absences: Boak 2, Close 1, Pippin 4. In 2015, 10 meetings were held, absences: Boak 3, Close 1, Pippin 3. The Mayor and Council expressed their appreciation for each person's service to these boards. Council was reminded there is still a vacancy on the Code Enforcement Board, as well as a replacement needed for the General Employee's Pension Trustees. Motion and second by Council Members Ritter and Watford to approve a Temporary Street Closing Application, closing Southwest 4th Avenue between North and South Park Streets from 9:00 a.m. to 2:00 p.m. on April 9, 2016, for the 19th Judicial Circuit Victims' Rights Coalition, Treasure Coast Motorcycle Rally. Council Member Watford expressed that this is a great event and he appreciates them coming to Okeechobee. VOTE: KIRK — YEA CHANDLER — YEA O'CONNOR — YEA RITTER — YEA WATFORD — YEA MOTION CARRIED. (Project Authorization No. 3 and amended April 7, 2015) to complete the project design and for construction administration. Assisting with the expense of this, the City was awarded a FDOT Small County Outreach Program Grant on June 3, 2015, in the amount of fifty-seven thousand, seven hundred fifty dollars and zero cents ($57,750.00). This is a budgeted project that has been pending for several months and needs to be finalized to meet the grant time frames. Jayce Fitzwater, Director of OKMS introduced members of the board in attendance with her, Danile Shockley, Angie and Mark. PowerPoint presentation: Why invest in the downtown parks? Support local economics attract tourism attract business investments encourage economic development building a sense of community. How can we improve the parks? The parks are boring as they are, we need to add dimension to the parks, increase seating, shade, incorporate subtle coloring to attract attention, and diversify by adding various landscape. Demension: OKMS design team with help of tree located disucssssed planed a raised plater of the incetne r th to parks two to five around the oak trees. Seating in addition to the raised planter we would also like to include picinic tables along park street with cover. Any bences facing state road 70 will be relocated ... Small details, concrete pads along 70 not being used and replace with sod. Expansion with 70 would suggest relocating the seats that are now close to the state roadway. Funding propose to raise funds through sponsorships by putting together a sponsorship packet with different levels. Sponsorh as planter, seating, etc. OKMS is aksing for your support to continue achieving our mission of enchanign Okeechobees downtown as the heart beat of the community. We need to get people in the downtown and see the number of new businesses that have recently located. MDO met with OKMS on this and thought it was something that needed to come uup to you guys for discussion. Watford certain amount of funds for the landscaping when FDOT took out the trees. Some of the owners were upset when the trees were taken out and now they like it as people can see their stores now. My main concern, spoke with OKMS member on this. Careful with structures not to hide the view of the businesses on South Park Street. Agree the pads there haven't been used and suggest instead of taking them out utilize them within the plan. Think we need an idea budget wise and it all needs to be discussed at the saem time and come up with a plan. I like having a passive park and never been in favor of putting too much structures within the parks. Shaded area are needed. Amazed at the amount of people passing through stop there and visit the veterans park. That has surprised me and agree with adding some shade and seating. Needst o be coordinated so it isn't done hodgepodge. Have Admin and PW director and see what they can come up with, and need to look at the funding. Angie , don't want to get to many colors, want to see whether school clubs could be more involved in helping keep the landscaping nicer looking, especially the butterfly garden. Ritter, OKMS brought to us months ago and we asked them to bring back a plan, which now you have done and like these ideas. I like this idea, all for it, want the additionaly tables and shading. Kirk next step would be work with Admin and PW director to develop a specific plan with a budget. Didn't see anything that I would object to within the presentation. Jaycee we will definitely work with both the City staff members. If this area is not enclosed then is it acceptable by the health department to move food from the smoker area in order to take food inside kitchen? Please keep in mind that this exterior door is the only nearby exit for employees from the kitchen so it needs to meet any separation requirements from the smoker area. Proper separation should be considered when establishing gas tanks or gas connections, • The outside dining area: What type of barrier will this have if any? If there is a barrier then egress shall be required. What is the occupant load of this area? If it exceeds 50 then additional requirements may be required such as an additional egress if barriers are present. Contractor should keep in mind that the door leading to this area could be used in an emergency whereas the immediate area shall require proper distance and adequate "clear space" for occupants leaving the structure. • The fire hydrants appear to be adequate in regards to location and water flow. • Builder should keep in mind the vertical clearance for any emergency vehicles or trash trucks. This rate was 1.1 percentage points lower than the region's year ago rate of 6.7 percent. Out of a labor force of 77,792 there were 4,329 unemployed residents in the region. • DeSoto and Okeechobee Counties had the lowest unemployment rate (5.1 percent) in the CareerSource Heartland region followed by Hardee County (5.2 percent), and Highlands County (6.1 percent). • Employment by industry in the CareerSource Heartland region totaled 51,207 jobs in September 2015 (the latest available data). Industry employment increased by 2.4 percent over the year. • The annual job growth rates for construction (+14.5 percent); professional and business services (+6.3 percent); education and health services (+6.2 percent); and government (+1.3 percent) exceeded those of the state. • The CareerSource Heartland region's industry employment increased by 1,199 jobs over the year in September 2015. Eight out of 11 industries added jobs over the year.
