Dir. Fortner reported that the Independent Baptist Church had requested permission to
install a si~n at intersection of Osceola Street and State Road 70 near the Okeechobee County
Bank sign. The Council a~freed provided the sign was not to big and did not cause a traffic hazzard.
Councilman Hunt moved to purchase a new air conditioner for the police department office
seconded by Councilman Douglas and carried.
The Council advised Attorney Curren to write and request an extension on date to file
Local Government Financial Questionaire and Report Form, 1972 from Department of Administration.
Upon motion the Council adjourned.

Jacob Weeks appeared before the Council requesting permission to operate a honey extracting
business at his residence on Petit Street., stating he was in the process of purchasing an adjoining
lot so that he could extend his present building and needed a commitment from the City before the
loan company would complete his loan. Mr. ~eeks stated he had been in this business as a hobby for
several years but wanted to devote his full time to it and go into it in a commercial way. After
discussion the Council requested Attorney Curren to look into this matter and requested Mr. ffeeks to
meet with the Council on November 21.
Ronnie Hunt, representing Jim Lashley President of Chamber of Commerce was present presenting
proposal for lighting tennis court located behind the Chamber of Commerce Building, estimating the
cost at $1,000.O0, $500.00 of this had been committed by the County Commissioners and requested the
Council's assistance in this project by donating $500.00. The Council agreed to examine the budget
and determine if it can be taken care of this year or include in the 1973 budget.
Frank Kapsin was present requesting a street light at corner of Main Street and Stafford
Place. The Council advised that a light had been approved for the middle of block north of his
residence on M~in Street. The Council authorized the Street Committee to check with the Florida
Power and Light Company regarding light and asked Mr. Kapsin to meet with Council on November 21.
Joe Lawson, local contractor was present submitting a proposal to sand blast and paint out-
side of City Hall building and repair window sills at a cost of $9,hhO.OO. The Council agreed to
get other proposals on this work.
A request from Fred T. Wilson to build a three apartment building on Lots ~ and 6, Block 182
was heard. Said property being a few feet short of requirement. After discussion Councilman Domer
suggested that President Burk, chairman of Zoning Committee make an investigation and report a
recommendation at November 21 meeting.
C. R. Buckner, President of OkeAirCo, Inc. was present explaind~ng to the Council new
regulations of Federal Communications Commission heine the loss of T. V. stations such as Orlando,
Tampa and Ft. Myers, leaving a total of 5 or six stations instead of ll as approved originally.
Buckner advised the Council that the franchise must be amended to conform with the F. C. C.
regulations. Mr. Buckner introduced Don Atwell, President of Ultra-Comm, Inc. located in
Landsdowne, Pennsylvania, stating that OkeAirCo, Inc. was merging with Ultra-Corem, Inc. and said
company would be financing the cable T. V. system proposed for Okeechobee. The Council discussed sev-
eral matters with Mr. Atwell and was advised of the need of a Resolution approving the new corporation
arrangements and an amendment to present Franchise deleting T. V. stations Federal Communications
Commission will not permit in this area. Atwell stated that after this is done that a certifdcate
of compliance would be issued by F. C. C. possibly in ninety days and upon receipt of said certificate
work would begin immediately and within si× months cable T. V. would be available to all customers.
The Council agreed it best to discuss new proposal with County Commissioners and requested Atwell to
furnish three letters of reference from places where he has cable T. V. systems.
Attorney Curren read Ordinance amending Ordinance No. 339, afterwhich Councilman Breland
presented the following Ordinance and moved its adoption and upon being seconded by Councilman Domer
was put to a vote and unanimously adopted:

~ DEFINING AND REGULATING THE BUSINESS OF BUILDING CONSTRUCTION
~ AND CONTRACTING IN THE CITY OF OKEECHOBEE, FLORIDA; AS AMENDED
BY ORDINANCE NO. 342, WHICH REDEFINES "CONTRACTOR"; BY AMENDING
SECTION 8 OF ORDINANCE NO. 339 AS AMENDED, TO PROVIDE FOR ANNUAL
RENEWAL OF CERTIFICATES OF COMPETENCY, ANNUAL RENEWAL FEES THERE-
FOR, AND PROVIDING FOR INACTIVE CERTIFICATES.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF OKEECHOBEE,
FLORIDA:
That Section 8 of Ordinance No. 339 as amended of the Code of Ordinances,
City of Okeechobee, Florida, is hereby amended to read as follows:
SECTION $. Certificate of Competency; issuance; duration; denial; re-
application; appeal.
(1) If, upon the examination and investigation, the Board, in the ex-
ercise of its reasonable discretion, shall ascertain and determine that the
applicant is a fit, proper and oualified person to engage in the business
of contracting or subcontracting, as the case may be, within the city, the
Board shall cause its certificate of competency to be issued to the applicant,
otherwise, the applicant shall be denied and refused. Such certificate of
competency shall specify the type or types of contracting work which the
registrant is qualified to perform in the city, and shall show upon the
face thereof that they, and the licenses issued pursuant thereto, are
subject to revocation or suspension.
(2) Each certificate of competency shall be renewable annually un-
le~s revoked or under suspension. Each contractor shall renew his certificate
during December of each year beginning December 1972, and shall be renewed
prior to January 1st. Any certificate not renewed shall be considered expired.
When a certificate has been revoked or has expired or lapsed for any
reason, the Board may require a complete reexamination before a certificate
of competency is renewed or re-installed.
Annual Renewal Fees for all contractors, electrical contractors, plumbing
contractors and specialty contractors:
Active: $2~.00 Inactive: $~.00
Any certificate of competency may be issued as an inactive certificate when
the applicant currently certified desires to retain his certified status, but does
not intend to engage in the construction industry, in any catagory, in the City of
Okeechobee during any succeeding entire annual period, and so states in writing.
Any inactive certificate may be re-activated during any year by payment of the Cull
difference for an annual renewal for that year, without proration. When a certificate
has been in inactive status for over three years, it shall be reactivated only upon
approval by the Board, which may require re-application and re-examination.
(3) If any application shall be denied and refused, the applicant may renew
his or its application at the expiration of six months from the date it was denied
or refl]sed provided~ however, the Board for good cause shown may shorten such period.
Should any applicant be denied a license the applicant may, within fifteen days from
notice of such denial, appeal the denial to the City Council who shall consider the
appeal and either affirm the action of the Board or order the issuance of a license.

INDUSTRY TRADE PRODUCTS; THE INSPECTION OF DAIRY HERDS, DAIRIES, MILK PLANTS

BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF OKEECHOBEE,
FLORIDA:
SECTION 1. DEFINITION - HEALTH OFFICER The health officer is the health
authority for the City of Okeechobee, Florida, and shall be duly appointed health
officer of Okeechobee County, Florida, or his authorized representative.
SECTION 2. AUTHORIZATION The production, processing, transportation, handling,
sampling, examination, grading, labeling and sale of all milk and milk products and
industry trade products sold for untimate consumption within the City of Okeechobee,
Florida, or its police jurisdiction; the inspection of dairy herds, dairies, milk
plants, and industry trade products plants; the issuing and revocation of permits to
milk producers, haulers, milk plants, industry trade products plants, and distributors;
and the fixin~ of penalties, shall be regulated in accordance with provisions contained
in Chapter ~02, Fl. orida Statutes, as revised in 1967 by the Florida State Legislature
and amended in 1971; and the latest edition of the Federal Food and Drug
Administration, United States Public Health Service recommended Grade "A"
Pasteurized Milk Ordinance, copies of which shall be in the Okeechobee
County Health Department.
SECTION 3. ENFORCEMENT The health officer shall determine by inspection,
or other means satisfactory to himself that provisions of the above designated
law and ordinance are being complied with before issuance of a permit. When
any producer, milk distributor, or industry trade products distributor fails
to qualify with above provisions, the health officer is authorized to suspend
his permit and/or institue court action in accordance with provisions of
applicable state law. If, after a reasonable time, correction of conditions
which resulted in suspension of permit have not been corrected, the health
officer is authorized to revoke his permit to sell products affected in the
City of Okeechobee, Florida, or its police jurisdiction.
SECTION h. PENALTIES Any person, firm or distributor who sells, offers
for sale, or has in his possession with intent to sell any of the above products
who does not possess a valid permit issued by the health officer shall be in
violation of this ordinance and shall be fined not more than two hundred dollars
($200.00), at the discretion of the court. Each day of operation without such
valid permit shall constitute a separate offense.
SECTION 5. REPEALER Ail ordinances and parts of ordinances in conflict
with this ordinance are hereby repealed; and this ordinance shall be in full
force and effect immediately upon its adoption and publication, as provided
by law.
SECTION 6. EFFECTIVE DATE '~nis ordinance shall be in full force and
effect upon its passage by the City Council and approval by the Mayor of the
City of Okeechobee.

The appointment of members for the Board of Adjustment and Appeals was discussed. A list
of qualified persons to serve on Board was presented for Councils' study. The Council agreed to
study list and make recommendation to Board. M~tter referred to November 21 meeting. Joe L. Lawson
had been appointed to fill the unexpired term of Jim Hammond, the Council discussed reappointing
Mr. Lawson for one year in accordance with Southern Standard Building Code.
Joe L. Lawson inquired if the Council planned any improvements such as street lighting,
streets and drainage in the Dean Court area, stating he was negotiating the purchase of property
where a pond is located, fill it in and build apartments around it with recreation center in the
center requesting the Council to bring area up to standard. The Council agreed to bring up to
standard the streets when Lawson gets into project and they will make an investigation at this time.
President Burk commended Mr. Lawson on trying to build up area.
Dr. H. H. Raulerson appeared before the Council regarding $215.09 water bill at Osceola
Medical Clinic, stating that he had a plumber check for leaks and found nothing. The ~ater Supt.
was requested to make a ,~urvey of area and see if a leak or washed out hole could be located. In
view of no one being able to determine where the water went, Council agreed to adjust bill as follows:
charge $~3.90 for average month water bill, deduct from $21~.09, plus one half of balance.
Attorney Curren offered recommendation in reference to Article V and urged the abolition
of Municipal Court stating the need of the Council's certifying their intention by December 2, 1972.
The Council dSscussed their feelings concerning this and referred matter to November 14th worksho.~
meeting.
The Council authorized Attorney Curren to assist in filing the Local Government Financial
Questionnaire and Report Form 1972.
Director Fortner presented Water, Sewer and Street Department monthly report.
Director Fortner reported that he had sent Pittsburg-Des Moines Steel Company a statement
covering the city's expense in finalizing work on water tank and altitude valves in the amount of
$.~9. ~_8.
Memorandum No. 1 / 11-7-72 specifications for new truck for water department. Director
Fortner stated the present truck needs many repairs and tires and it will take two months for delivery
of new truck and in consideration of this requested permission to advertize for bids on new truck.
The Council granted request and authorized the bid notice to be published with bid date December 7,
1972.

The Council agreed to reschedule the December 5, 1972 regular Council meeting to
December 7, 1972.
Councilman Hunt expressed his appreciation for the floral arrangement for his brother.
The Fire Department Report for the month of October was presented by the Fire Department.
Councilman Domer reported a request from Frank Altobello for the city to burn off some
of his property in the southwest section of city. Councilman Domer stated the Forestry Service
would burn it providing the city agrees for them to do it. No action taken.
Fire Department each
Councilman Domer reported the/needed ~ nozzles for booster hose at a cost of $65.00/for
stainless steel or $25.00 each for brass. After discussion Councilman Domer moved to authorize the
purchase of 2 stainless steel nozzles at $65.00 each, seconded by Councilman Breland and carried.
Councilman Domer also reported that Fire Chief Godwin had requested permission to update
Volunteer Firemen telephones. The Council requested Councilman Domer to work with Chief God~rin and
find out the additional cost and report to Council.
Director Fortner reported that the master meter located at Royal's Shopping Center had
proved to be incorrect. Matter referred to Water Committee.
Director Fortne~ inquired if the Council wanted to dispose of old fire siren stored in
city barn. The Council requested Dir. Fortner to find out if the Basinger Fire Department was
interested in it.
The Council req~ested Director Fortner to get another price on paving area behind City Hall.
Director Fortne~ reported the Street Department employees had requested a 20 hour work week.
No action taken.
The Council recessed to meet November 12, 1972 at 6:30 P. M. in workshop session to

The City Council of the City of Okeechobee, Florida met in recessed workshop session at the
City Hall on the above date at 6:30 P. M. with the following present: Mayor Audley Dunham, President
Donald L. Bu~k, Councilmen: Russell V. Domer, Edward ~. Douglas and E. H. Hunt with Attorney J. Edward
Curren and Clerk Lorena Spivey.
The purpose of the meeting was for study and discussion on aboloshing Municipal Court.
pursuant to Chapter 72-hO3 Laws of Florida.
After a lenghty discussion Mayor Dunham reconuuended that the Council consider aboloshing
Municipal Court at the end of his present term, at which time he beleives that the details will be
worked out.
The Council agreed to wait and see the Supreme Courts decision as to whether a Mayor can
also serve a.~ Municipal Judge.
The Council recessed to meet November 20, 1~72 at 9:30 A. M.f.

The City Council of the City of Okeechobee, Florida met in recessed/at the City Hall on the

Th~ City Clerk presented the petitions of candidates in the General City Election to be
held December 5, 1972 and the following petitions were examined by the Council and all petitions were
found to contain 25 or more qualified electors.

Councilman Domer moved to accept~ the petitions as presented, seconded by Councilman Hunt ~1i
and carried. The Council instructed the Clerk to have necessary ballots prepared for voting machines,
also t,o have absentee ballots printed.
