The March 17, 2016, Technical Review Committee meeting was called to order at 10:00 a.m. by Chairperson Montes De Oca. II. STAFF ATTENDANCE — Secretary. AGENDA — Chairperson. Chairperson Montes De Oca asked whether there were any requests for the deferral or withdrawal of items on today's agenda. There being none the Agenda stands as published. IV. MINUTES — Secretary. Building Official Newell moved to dispense with the reading and approve the Minutes for regular meeting held February 18, 2016, seconded by Public Works Director Allen. Motion carried unanimously. V. NEW BUSINESS — Chairperson. A. Site Plan Review Application No. 16 -001 -TRC, second review, in regards to converting an existing 8,279 square foot building (formerly used as a bank) into a proposed restaurant with outdoor dining (occupying the drive-thru of the former bank), associated parking, and to request an 18.6 percent parking reduction, on approximately 1.858 acres, located at 1506 South Parrots. Avenue, Okeechobee, FL. (U.S. Highway 441 South), Lots 1, 2, 7 and 8, of Block 28, South Okeechobee, Plat Book 1, Page 12, and Lots 3 to 6 and 9 to 12, less the South 30 feet of Lots 6 and 12, of Block 28, First Addition to South Okeechobee, Rat Book 1, Page 17, Public Records of Okeechobee County Florida, - Senior Planner. Planning Staff Report: Planner Brisson explained the property owner, Mr. Raymond Arrants, is proposing to modify the former TD Bank building to accommodate a restaurant using 5,403 square feet for in -door dining TRC - March 17, 2016 - Page 2 of 4 V. Site Plan Review Application No. 16 -001 -TRC, second review continued. and 2,280 square feet for out -door dining (which will occupy the former drive-thru banking area) for a total floor area of 7,683 square feet. The site is provided potable water and sewer service by Okeechobee Utility Authority (OUA). The demand for services is expected to exceed the former bank use. Taking this into account, the applicant should obtain a letter from OUA documenting there is adequate capacity and facilities. The County has confirmed a considerable level of excess capacity available to serve the solid waste disposal needs. Drainage calculations were provided and as a result of increased on-site parking, the extent of impervious surfaces has increased, although still within the maximum allowed. Total traffic generated from the proposed use would be considerably less than calculated for the former bank and will not burden the City's roadway system. The revised parking plan is greatly improved over the original submission. On-site there are 78 (90 -degree) parking spaces, of which four are designated handicap, two are angled, and three are parallel. Based on the total floor area, 102 spaces are required. However, in addition to the 83 on-site parking spaces, there are 24 on -street paved parking spaces located along Southwest 2nd Avenue between 15th and 16th Streets (immediately to the West of the site). The applicant is requesting a recommendation for a parking reduction and to use 19 of the 24 on -street parking spaces toward the required total. The front of the building faces East, with 11 parking spaces along the front of the building and 21 parking spaces at the East boundary line (facing South Parrott Avenue). The south -side of the site has eight parking spaces located along the south -side of the building. At the South boundary line (facing Southwest 16th Street, starting at the southeast corner) there are four parking spaces, a 30 -foot wide ingress/egress entrance driveway, then 11 parking spaces and a 12 -foot wide egress (exit) only driveway. The West side of the site has the outdoor dining area. Ten parking spaces are located north of the outdoor dining (five along the building) and eight parking spaces located south of the outdoor dining (four along the building). On the West boundary line (facing Southwest 2nd Avenue) are the two angled parking spaces (at the Southwest corner) and the designed area for the garbage dumpster. Then at the North boundary Idle (facing Southwest 15th Street) is a 10x30 -foot designated loading space, a parallel parking space, a 30 -foot wide ingress/egress entrance driveway, then two parallel parking spaces. Vehicles can access any parking space by driving in a counter -clock wise direction on- site. The dimensional standards review appears to meet the requirements. While the amount of impervious surfaces has been increased, it remains below the maximum allowable and the Engineer's Report addresses the drainage situation. The site plan shows a sufficient number of landscaped parking islands and the extensive vegetation and landscaping on the site remains adequate. In conclusion, Mr. Brisson is recommending approval of the site plan, as submitted, with the following stipulations: an explanation satisfactory to the TRC is given that the parallel space on the east side closest to the Southwest 15th Street driveway is safe and convenient with respect to entering and leaving the parking space; and one more handicapped parking space is provided, either on-site or in the on -street parking along Southwest 2nd Avenue. Mr. Steven Dobbs of SLD Engineering, LLC, and Mr. Wes Abney of Abney Building & Consulting, Inc. were present on behalf of Mr. Arrants. Addressing the stipulations recommended by Planner Brisson, Mr. Dobbs commented it would not be a problem to add another handicap space to the site. A brief discussion followed regarding the parallel space located at the northeast corner of the North boundary line (facing Southwest 15th Street) and no concerns were noted. Mr. Abney added he discussed the water and drainage of the kitchen equipment areas with OUA Director Hayford and would be providing him drawings to review. County Environmental Health Department: No issues were received. OUA: Mr. Hayford noted he was in discussions with the property owner regarding the water, irrigation and meters. Public Works: No issues were received. Police Department: No issues were received. Building Official: No issues were received, Fire Department: Lieutenant Conroy read into the record some comments and questions submitted by Fire Chief Smith. They are as follows: • The dining area is a "typo" where the kitchen is located? • The area immediately on the exterior side of the exit door located in the kitchen: the plans show a square area (not the screen around the smoker) that appears to be possibly a wall or a concrete pad? If this area is not enclosed, then is it acceptable by the health department to move food from the smoker area, in order to take food inside kitchen? Please keep in mind that this exterior door is the only nearby exit for employees from the kitchen so it needs to meet any separation requirements from the smoker area. Proper separation should be considered when establishing gas tanks or gas connections. • The outside dining area: What type of barrier will this have if any? If there is a barrier, then egress shall be required. What is the occupant load of this area? If it exceeds 50, then additional requirements may be required such as an additional egress if barriers are present. Contractor should keep in mind that the door leading to this area could be used in an emergency whereas the immediate area shall require proper distance and adequate "clear space" for occupants leaving the structure. • The fire hydrants appear to be adequate in regards to location and water flow. • Builder should keep in mind the vertical clearance for any emergency vehicles or trash trucks. Chairperson Montes De Oca inquired whether the additional parking area would continue with a "d curb" or edged pavement with wheel stops tying into the existing curb. He further commented the grades need to be shown on the plans to ensure there is access and more than two percent for ADA requirements on the proposed west side sidewalk. He asked for clarification, regarding the total square footage listed on the application being different than the amount listed on the Okeechobee County Property Appraiser's website. Mr. Dobbs responded all areas inside of the building were included as well as the smoker (outside cooker) area. The reason for the difference may be the Property Appraiser's website includes over hangs in their calculations. Chairperson Montes De Oca asked whether there were any comments or questions from those in attendance. There were none. Chairperson Montes De Oca asked Committee Members to disclose for the record whether they had spoken to anyone else regarding the application or visited the site. Following is the Staff analysis of the project's consistency with the various City requirements and regulations. Instances where the Staff believes the submission to be deficient are highlighted. ADEQUACY OF PUBLIC FACILITIES POTABLE WATER AND SANITARY SEWER. The site is provided potable water and sewer service by Okeechobee Utility Authority (OUA). The demand for potable water and sewer service associated with the uses described previously are expected to incrementally exceed that associated with the former bank use. The Applicant is currently "in discussions with OUA concerning proper water and sewer service" and it is expected that the results of these discussions will be brought to the TRC at the upcoming meeting on March 17tH SOLID WASTE DISPOSAL. On a number of occasions, the County has confirmed a considerable level of excess capacity available to serve the solid waste disposal needs of other developments in the City. It appears reasonable that the volume of solid waste associated with a development of this size can also be accommodated within the capa- city of the County's Solid Waste Facility. DRAINAGE. The Applicant has provided in the Engineering Report discussion and calculations regarding water quality and quantity as relates to drainage. As a result of the increased provision of on -site parking, the extent of impervious surfaces has increased from 50.2% to 60.6 %, well within the maximum 85% allowed. Serving Florida Local Governments Since 1988 3 Staff Report Site Plan Review Applicant: Lightsey's Restaurant, Inc.— Raymond Arrants Petition No.: 16- 001 -TRC TRAFFIC, INGRESS AND EGRESS TRAFFIC GENERATION The Applicant has calculated the likely traffic generation of the proposed 7,683 square feet of indoor and outdoor dining and associated restaurant uses. Using the ITE's 8th Edition Trip Generation Report, a high quality restaurant will generate about 7.49 trips in the PM peak hour per 1,000 square feet of floor area. Based on this, the total peak hour traffic for the restaurant is estimated at about 59 trips in the PM peak hour. This is considerably less than the 201 trips calculated for the former drive -in bank. INGRESS AND EGRESS The on -site parking areas on the north, south and east sides of the building will provide ingress and egress via the main two -way driveways on SW 15th and SW 16th Streets. Patrons wishing to park on the west side of the building, the area closest to the out -door dining area, can be expected to primarily access the site via the driveway on SW 15th Street. Those parking on the north side of the outdoor dining area will exit via the 15th Street driveway, while those parking on the south side can exit via either the one -way or two -way driveways to SW 16tn Street. The interior circulation system now allows for a complete loop system around the building such that if one parking area is full, a customer can access all other parking areas without leaving the site. PARKING, LOADING ZONE, AND DUMPSTER NUMBER OF PARKING SPACES NEEDED The minimum parking requirement for a restaurant is one space for each 75 square feet of restaurant floor area, whether it is indoor space or outdoor space. Based on the 7,683 square feet of floor area, the restaurant needs to provide 102 off- street parking spaces. PARKING SPACES — LOCATIONAL CONSIDERATIONS The proposed number and layout of the onsite parking areas are greatly improved over the original submission. The revised site plan now shows 83 parking space on the site, four of which are designated for the handicapped. All but five of these spaces are 90° spaces. Two are angled space in the southwest corner of the property near the dumpster location. Access to and egress from these spaces is a simple matter. All 90° and angle spaces meet or exceed the minimum dimensions of 9' x 18'. All are located parallel to SW 15th Street and on either side of the main two -way drive. While accessing the parallel space on the west side of the driveway may be cumbersome, it does not appear to be unsafe. On the other hand, we do have some concern over the parallel space on the east side closest to the driveway; it appears to be both cumbersome and unsafe. With 83 on -site spaces, another 19 are needed to meet the 102 required for the proposed restaurant. To address the additional parking required by the proposed change in use, the Applicant is requesting a recommendation by the TRC and approval by the C't Council to count 19 of the 24 on- street parking spaces located on the east side of Ed Avenue across from the library. Vi HANDICAPPED SPACES The Applicant shows a total of 19 on- street spaces and 83 off - street parking spaces for a total of 102. The requirement for handicapped parking spaces is one per each 25 required spaces or fraction thereof. Therefore, a total of five handicapped accessible spaces are required. Only four such spaces are shown; one more must be provided. Presumably one of these could be located in the on- street parking area. LOADING ZONE The loading zone is proposed to be located along the north side of the western driveway. There appears to be adequate maneuvering room and when the loading vehicle wishes to exit the property, there is unimpeded travel way of adequate width along the western drive to allow exiting from either of the driveways to SW l6t Street. DUMPSTER LOCATION The dumpster is located in the same location as it was for the former bank, at the southwest corner of the parking lot just south of the proposed outdoor dining area. Access is provided via the driveway off SW 15th Street, passing under the overhang of the outdoor dining area. Egress will involve backing up and exiting either via the western 12 -foot driveway to SW 16th Street or via the wider two -way drive to the east. COMPARISON OF PROPOSAL WITH DIMENSIONAL STANDARDS, CHV ZONING Minimum Parcel Size and Width, Setbacks, Lot Coverage, Impervious Surface Coverage and Landscaping Requirements: The restaurant use is being introduced into an existing building with no external modifica- tions. While the amount of impervious surfaces has been increased, it remains below the maximum allowable and the Engineer's Report addresses the drainage situation. As a result, there are no changes to the above requirement with the exception of the parking area landscaping. The site plan shows a sufficient number of landscaped parking islands and the extensive vegetation and landscaping on the site remains adequate. Project Description: This parcel is 1.86 acres in size and is located in Sections 28, Township 37 South, Range 35 East. It is located in the City of Okeechobee, on Highway 441S between SW 15d' and SW 16th Street, on the following parcel (Parcel ID 3- 28- 37 -35- 0050- 00280 - 0030). The site was originally developed as Riverside National Bank, TD Bank then took over, but kept the use as a bank. The current owner wishes to change the use to restaurant and retail. The site currently has a fully constructed 8,279 sf building (According to the Okeechobee Property Appraiser) including drive thru and canopy areas. The parking area, and drainage system discharge into FDOT's drainage system at the southeast corner of the property. Proposed Modifications: This request is for a single phase construction permit modify the site by adding additional parking in currently and proposed additional asphalted areas as shown on the Paving, Grading, and Drainage Plan and closing the drive thru lanes and convert that area to outdoor seating as shown on the floor plan. Potable water and gravity wastewater will continue to be provided by Okeechobee Utility Authority (OUA) at the existing tie in locations east of the building for potable water and northeast of the building for the wastewater and we are currently in discussions with OUA concerning proper water and sewer service. An inline grease trap for the kitchen wastewater stream will be added as required by the health department. This project will incrementally increase the existing potable water demand on OUA. Drainage Considerations: A request was made to the City for the previous drainage calculations, which could not be found and a search of the SFWMD database only yielded a landscaping water use permit 47- 00643-W. Without the original drainage calculations, and attempt was made to recreate the Stage Storage for the original site and from this calculation, the water quality stage was met at elevation 25.11, while the water quality elevation from the existing drainage structure was 25.2. Under the revised stage storage scenario, the water quality stage was met at elevation 25.25 or approximately 0.14' higher than what I calculated from the original Stage Storage calculation. In order to be conservative, I am adjusting the existing weir by 0.15' from the original design to add additional water quality. Technical Data Total Site Area: Project Drainage Area: 1.86 acres 1.86 acres See attached spreadsheet for stage storage information. Determine Curve Number: All the soil onsite is Immokalee Fine Sand which has a hydrologic soil group of B/D. The curve number was taken from TR55 for the Commercial Land use for pre and post calculations and the B soil condition was used which has a curve number of 92 up to 85% impervious. A. Water Quality Water quality treatment is provided in the form of wet detention for the project drainage area. The above ground impoundment is only for attenuation B. Water Quantity Since the original calculations could not be located, as described above I ran a comparative analysis between existing conditions and proposed conditions with the additional 8,435 sf of impervious onsite. As shown below, while the elevation of the pond increased the head over the weir was Less thereby limiting the discharge to pre improvement levels. The increased water levels still meet the original design criteria of the parking being out of the water for the 10 year — 24 hour event, not exceeding the existing perimeter condition of elevation 27 for the 25 year — 3 day event, and the finished floor at 28.5 is well above the 100 year glass wall calculation of 27.45 The 10 -year, 24 -hour storm (4.0 ") w /discharge, the 25 -year, 72 hour storm (9.0 ") w /discharge, and the 100 year, 72 hour storm (10.0 ") w/o discharge have been evaluated based on the proposed plan. Please refer to the attached AdICPR flood routing input/output parameters. Since the existing parking onsite is not enough to supply all the parking for the building, the owner request the TRC to recommend to the City Council a 19% parking reduction as allowed by the City's LDRs. Construction Recommendations: Runoff and/or any water generated by short-term dewatering, if required during construction will be contained on -site. However, there is some potential for transport of sediment to off -site areas should heavy rainfall occur. In order to reduce the potential of any off -site transport of sediment or turbidity we recommend installation and maintenance of temporary silt fence inside the southerly property line in the area of the proposed paving of the existing rock road and upstream of the existing control structure until site work has been completed and the site has been stabilized. (The existing perimeter berm should prevent any potential off -site transport of sediment from other areas of the site during construction.) Conclusions: In my professional opinion, the proposed construction should have no impact to existing drainage patterns off -site and should have no impact on off -site areas. The recommendations above should be followed during and after the site work until such time as the ground surface has been adequately stabilized to prevent the off -site transport of any soil or suspended solids. Motion carried unanimously. V. NEW BUSINESS — Chairperson. A. Site Plan Review Application No. 16- 001 -TRC, second review, in regards to converting an existing 8,279 square foot building (formerly used as a bank) into a proposed restaurant with outdoor dining (occupying the drive -thru of the former bank), associated parking, and to request an 18.6 percent parking reduction, on approximately 1.858 acres, located at 1506 South Parrott Avenue, Okeechobee, FL. (U.S. Highway 441 South), Lots 1, 2, 7 and 8, of Block 28, South Okeechobee, Plat Book 1, Page 12, and Lots 3 to 6 and 9 to 12, less the South 30 feet of Lots 6 and 12, of Block 28, First Addition to South Okeechobee, Plat Book 1, Page 17, Public Records of Okeechobee County Florida, - Senior Planner. Planning Staff Report: Planner Brisson explained the property owner, Mr. Raymond Arrants, is proposing to modify the former TD Bank building to accommodate a restaurant using 5,403 square feet for in -door dining TRC - March 17, 2016 - Page 2 of 4 V. Site Plan Review Application No, 16 -001 -TRC, second review continued. and 2,280 square feet for out -door dining (which will occupy the former drive -thru banking area) for a total floor area of 7,683 square feet. The site is provided potable water and sewer service by Okeechobee Utility Authority (OUA). The demand for services is expected to exceed the former bank use. Taking this into account, the applicant should obtain a letter from OUA documenting there is adequate capacity and facilities. The County has confirmed a considerable level of excess capacity available to serve the solid waste disposal needs. Drainage calculations were provided and as a result of increased on -site parking, the extent of impervious surfaces has increased, although still within the maximum allowed. Total traffic generated from the proposed use would be considerably less than calculated for the former bank and will not burden the City's roadway system. The revised parking plan is greatly improved over the original submission. On -site there are 78 (90- degree) parking spaces, of which four are designated handicap, two are angled, and three are parallel. Based on the total floor area, 102 spaces are required. However, in addition to the 83 on -site parking spaces, there are 24 on- street paved parking spaces located along Southwest 2nd Avenue between 15th and 16th Streets (immediately to the West of the site). The applicant is requesting a recommendation for a parking reduction and to use 19 of the 24 on- street parking spaces toward the required total. The front of the building faces East, with 11 parking spaces along the front of the building and 21 parking spaces at the East boundary line (facing South Parrott Avenue). The south -side of the site has eight parking spaces located along the south -side of the building. At the South boundary line (facing Southwest 16'h Street, starting at the southeast corner) there are four parking spaces, a 30 -foot wide ingress /egress entrance driveway, then 11 parking spaces and a 12 -foot wide egress (exit) only driveway. The West side of the site has the outdoor dining area. Ten parking spaces are located north of the outdoor dining (five along the building) and eight parking spaces located south of the outdoor dining (four along the building). On the West boundary line (facing Southwest 2nd Avenue) are the two angled parking spaces (at the Southwest corner) and the designed area for the garbage dumpster. Then at the North boundary line (facing Southwest 15'h Street) is a 10x30 -foot designated loading space, a parallel parking space, a 30 -foot wide ingress /egress entrance driveway, then two parallel parking spaces. Vehicles can access any parking space by driving in a counter -clock wise direction on- site. The dimensional standards review appears to meet the requirements. While the amount of impervious surfaces has been increased, it remains below the maximum allowable and the Engineer's Report addresses the drainage situation. The site plan shows a sufficient number of landscaped parking islands and the extensive vegetation and landscaping on the site remains adequate. In conclusion, Mr. Brisson is recommending approval of the site plan, as submitted, with the following stipulations: an explanation satisfactory to the TRC is given that the parallel space on the east side closest to the Southwest 15th Street driveway is safe and convenient with respect to entering and leaving the parking space; and one more handicapped parking space is provided, either on -site or in the on- street parking along Southwest 2nd Avenue. Mr. Steven Dobbs of SLD Engineering. LLC, and Mr. Wes Abney of Abney Building & Consulting, Inc. were present on behalf of Mr. Arrants. Addressing the stipulations recommended by Planner Brisson, Mr. Dobbs commented it would not be a problem to add another handicap space to the site. A brief discussion followed regarding the parallel space located at the northeast corner of the North boundary line (facing Southwest 15th Street) and no concerns were noted. Mr. Abney added he discussed the water and drainage of the kitchen equipment areas with OUA Director Hayford and would be providing him drawings to review. County Environmental Health Department: No issues were received. OUA: Mr. Hayford noted he was in discussions with the property owner regarding the water; irrigation and meters. Public Works: No issues were received, Police Department: No issues were received, Building Official: No issues were received. Fire Department: Lieutenant Conroy read into the record some comments and questions submitted by Fire Chief Smith. They are as follows: • The dining area is a "typo" where the kitchen is located? • The area immediately on the exterior side of the exit door located in the kitchen: the plans show a square area (not the screen around the smoker) that appears to be possibly a wall or a concrete pad? If this area is not enclosed, then is it acceptable by the health department to move food from the smoker area, in order to take food inside kitchen? Please keep in mind that this exterior door is the only nearby exit for employees from the kitchen so it needs to meet any separation requirements from the smoker area. Proper separation should be considered when establishing gas tanks or gas connections. • The outside dining area: What type of barrier will this have if any? If there is a barrier, then egress shall be required. What is the occupant load of this area? If it exceeds 50, then additional requirements may be required such as an additional egress if barriers are present. Contractor should keep in mind that the door leading to this area could be used in an emergency whereas the immediate area shall require proper distance and adequate "clear space" for occupants leaving the structure. • The fire hydrants appear to be adequate in regards to location and water flow. • Builder should keep in mind the vertical clearance for any emergency vehicles or trash trucks. Chairperson Montes De Oca inquired whether the additional parking area would continue with a "d curb" or edged pavement with wheel stops tying into the existing curb. He further commented the grades need to be shown on the plans to ensure there is access and more than two percent for ADA requirements on the proposed west side sidewalk. He asked for clarification, regarding the total square footage listed on the application being different than the amount listed: on the Okeechobee County Property Appraiser's website. Mr. Dobbs responded all areas inside of the building were included as well as the smoker (outside cooker) area. The reason for the difference may be the Property Appraiser's website includes over hangs in their calculations. Chairperson Montes De Oca asked whether there were any comments or questions from those in attendance. There were none. Chairperson Montes De Oca asked Committee Members to disclose for the record whether they had spoken to anyone else regarding the application or visited the site.
