Attorney Curren read letter that was written to A. A. Scott also a reply from Mr. Scott
regarding an offer to sell to the City of Okeechobee water line in Bet-Her Acres Subdivision
at $10, OO0. O0.
Director Fortner presented Sept. 21 Memorandum No. l, in regards to water line in Bet-Her
Acres Subdivision owned by A. A. Scott, 76 present accounts and llO potential accounts. After
discussion the Council instructed Director Fortner to prepare up to date report on water lines in
Okeechobee Estates, in order for both offers to be considered at the same time.
A discussion by the Council and Attorney was heard on the authorized use of 8th cent gas
The Council instructed the Clerk to deduct four months (June, July, August and September)
telephone bill from Donald Edgar payroll check.
Director Fortner reported a previous request from the Farmers Production Credit Association
for sewer line extension to Block 92, City of Okeechobee, requiring approximately 500 feet of pipe.
The Council instructed Director Fortner to figure cost of installation and advise the Association
they would have to assume cost of extension.
The Council recessed to meet at 6:30 P. M. September 29th, 1972.

The City Council of the City of Okeechobee, Florida met in regular adjourned session at
the City Hall on the above date at 6:30 P. M. with the following present: Mayor Audley Dunham,
President Donald L. Burk, Councilmen: Russell V. Domer and Edward W. Douglas with Attorney J.
Edward Curren, Clerk Lorena Spivey and Director of Public Works L. C. Fortner, Jr.
Mayor Dunham reported a request for a Health Club license. The Council requested Mayor
Dunham to check with Tallahassee on requirements for this particular kind of license and request
petitioner to attend October lOth Council meeting.
Director Fortner submitted September 29 report and memorandums. Memorandum No. I - Machinesi
needed to address water bills in the amount of $2,h8h.O0. The Council postponed action due to the
absence of Councilmen Hunt and Breland. For the Council's study Memorandum No. 2, 3 and ~ regarding
up to date report on Ernest Evans water system. Memorandum No. 5 and No. 6 revised report on water
lines in Bet-Her Acres owned by A. A. Scott.
Councilman Douglas presented Ordinance No. 363 for final reading and moved its adoption
and upon being seconded by Councilman Domer was put to a vote and adopted:
ORDINANCE NO. 363
AN ORDINANCE AMENDING CHAPTER 12 (LICENSES) OF
THE CODE OF ORDINANCES OF THE CITY OF 0KEECHOBEE,
FLORIDA, BY RESCINDING SECTIONS 12-2, 12-6, 12-11
AND 12-8, AND SUBSTITUTING IN LIEU THEREOF NEW
SECTIONS 12-2, 12-6, 12-11 AND 12-8; RE-ENACTING
SECTION 12-22 (LICENSE SCHEDULE); REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CORrFLICT
HEREWITH AND PROVIDING FOR THE EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF
OXEECHOBEE, FLORIDA:
SECTION 1o Section 12-2 of Chapter 12 is hereby rescinded
and a new Section 12-2 is substituted to read as follows:
Section 12-2. License tax imposed; term; half-year licenses; receipt.
(a) An occupational license tax is hereby imposed
upon each and every business, profession or
occupation engaged in or carried on within the
corporate limits of the Cit¥o Such occupational
license tax shall be levied on:
(1) Any person who maintains a permanent business
location or branch office within said munici-
pality for the privilege of engaging in or
managing any business within its jurisdiction;
(2) Any person who maintains a permanent business
location or branch office within said munici-
pality for the privilege of engaging in or
managing any profession or-occupation within
its jurisdiction; and
(3) Any person who does not qualify under the
provisions of (1) or (2) above and who ~ransacts
any business or engages in any occupation or
profession in interstate commerce where such
license tax is not prohibited by Sec~on 8 of
Article 1 of the United States Constitution°
(b) Ail licenses shall expire on the thirtieth day of
September of each year. No license shall be issued
for more than one year and for each license obtained
between the first day of October and the first day
of April, the full tax for one year shall be paid
except as hereinafter provided for, and for each
license obtained between the first day of April and
the thirtieth day of September, one-half of the ful'
tax for one year shall be paid except as hereinafte'
provided for; that upon payment of such tax the Cit
Clerk of the City shall issue to the person, firm,
association or corporation paying the same a recei~
or license signed by the City Clerk, whose fee for
issuing same shall be twenty-five cents paid by th(
licensee, which receipt or license shall expire at
the end of the period for which the same is issued
as hereinabove specified°
SECTION 2. Section 12-6 of Chapter 12 is hereby rescinded
and a new Section 12-6 is substituted.to' read as fol2ows:
Section 12-6. Payment of occupational license tax;
additional day of grace.
Ail licenses shall be sold By the City Clerk beginniy
September 1 of each year and shall be hue and payabl
on October 1 of each year and shall expire on Septem
30 of the succeeding year, Dorvided further, the
license tax may be paid on %he first business
day following the last day of the month without
penalty, provided the last day of the month falls
on a weekend or holiday.
SECTION 3o Section 12-11 of Chapter 12 is hereby rescinded
and a new 8ection 12-11 is substituted to read as follows:
Section 12-11. Transfer of license.
(a) No license shall be transferred from person to
person, place to place, or business name or
classification be changed except upon the consent
of the City' Clerk in writing, and no license
issued under the provisions of this chapter shall
protect any person from prosecution for transacting
any business, trade or profession not covered by
such license, or shall protect any merchant doing
business with a greater stock in trade than covered
by such license, or any hotel keeper or rooming
house keeper having a greater number of rooms than
is covered by such license, and any license issued
upon any~'false statement made under oath shall be
considered as void ab initio and shall not protect
the holder thereof from prosecution for transacting
business without a license. It shall be unlawful
for any person, firm, association ~r corporation to
engage in any trade, business, profession or
occupation within the City without a license as
aforesaid, or under a license issued upon false
statement made by any person engaged in any trade,
business, profession or occupation within the City
or in their behalf.
(b) All business licenses may be transferred to a new
owner when there is a bona fide sale of the business
pon payment of a transfer fee of three dollars
$3.00) a~d presentation of evidence of the sale
and the original license.
(c) Upon written request and presentation of the
original license, any license may be transferred
from one location to another location in the same
municipality upon payment of a transfer fee of
three dollars ~$3o00).
SECTION 4° Section 12-8 of Chapter 12 is hereby rescinded
and a new Section 12-8 is substituted to read as follows:
Section 12-8o Delinquent license; doing business without
license or license obtained by fraud; penalties°
(a) All occupational licenses not renewed by October 1
shall be considered delinquent and subject to a
delinquency penalty of ten percent (10X)for the
month of October, plus an additional five percent
(5%) penalty for each month of delinquency there-
after until paid; provided that the total delin-
quency penalty shall not exceed twenty five percent
(25%) of the occvp~tional license fee for the
delinquent establishment.
(b) Any person engaging in or mananging any business,
occupation or profession without first obtaining
a local occupational license, if required here-
under, shall be subject to a penalty of twenty-
five percent (25~) of the license determined to
be due, in addition to any other penalty pro-
vided by law or ordinance.
(c) Such increased tax shall be paid before issuance
of the license, but part or all of such increases
imposed in (a) of this section may be rebated or
waived by motion of the City Council reciting the
reasons therefor. In addition to the foregoing
penalties, any person engaged in any trade,
business, profession or occupation within the
City without a license, or under a license issued
upon false statement made by said person or in
his behalf, shall be subject to prosecution and
upon conviction thereof shall be punished as
provided by Section 1-8 of this Code.
SECTION 5. Section 12-22 of Chapter 12 is' hereby rescinded
and a new Section 12-22, being a re-enactment of former section 12-22
verbatim and in its entirety, is substituted to read as follows:

SECTION 6. All Ordinances or parts of Ordinances in conflict
herewith are hereby repealed.
SECIION 7. This Ordinance shall be effective immediately
upon its becoming law and licenses may be issued prior to the time
when they shall become effective. The licenses, themselves, which
may be issued under this Ordinance shall be effective only for
the period commencing October 1, 1972, and ending September 30, 1973.

The City Council of the City of Okeechobee, Florida met in regular session at the City Hall
on the above date at 7:00 P. M. with the following present: President Donald L. Burk, Councilmen:
Charles L. Breland, Edward W. Douglas and E. H. Hunt with Attorney J. Edward Curren, Clerk Lorena
Spivey, Deputy Clerk Sand~Bennett, Director of Public Works L. C. Fortner, Jr. and Building Official
Richard B. Spray.
President Burk opened the meeting with prayer.
Director Fortner reported that the meter reader had resigned and a new reader was needed,
submitting four applications: Perry C. Joseph, age 68, Buckhead Ridge; Hiram A. Wesley, age 23,
South Kissimmee Street; Willie D. Brown, age 25, Canal Point and Floyd Selph, age 24, Sw. 2nd Street.
Director Fortner recommended the employment of Hiram A. Wesley. Councilman Breland suggested that
all new employees be checked by the Credit Bureau. Councilman Hunt Chairman of the Water Committee
agreed to accept Director Fortner"s recommendation and employ Hiram A. Wesley as Meter Reader at
$120.00 per week. The Council was in unanimous agreement.
Director Fortner stated that Engineer Don Osha wanted to know if the Council had made a
decision on the sewer survey. President Burk stated that the Council had made no decision at this
time and suggested a meeting with the County Commissioners in regards to a sewer survey in the
county and agreed to call a workshop meeting in the near future on this matter.
Director Fortner discussed uniforms for the public works department and inquired if the
City would help fund. The Council referred matter to workshop meeting.
Director Fortner presented the monthly Water, Sewer and Street Department Report including
the following Memorandums:
Memorandum No. I - Machines needed to address water bills - Addressor, Cabinet and Stand,
Plate Embosser and 2000 Metal Plates at a cost of $2,484.00. Payment can be deferred to January 1.
Councilman Hunt suggested that the machine be ordered and work cost into 1973 budget. After discussion
and agreement by the Council that the equipment was needed, Councilman Hunt moved to authorize the
purchase of the above equipment, defer payment to January i 1973 and pay in three installments,
seconded by Councilman Douglas and unanimously carried.
Memorandum No. 2 - Items needed to replace stock at water plant. After discussion
Councilman Hunt moved to authorize the purchase of items as listed on Memorandum No. 2 dated, October
10, 1972, seconded by Councilman Breland and unanimously carried.
Memorandum No. 3 - Water bill at Osceola Medical Clinic showing a 237,000 gallon water
consumption for September. Average consumption during previous months 41,000 gallons. Director
