1972-09-12 Regular1500 Councilman Domer reported the need of wheel alignment on Dog Warden Truck. The Council authorized the truck to be taken to Gilbert Chevrolet Company for wheel alignment. The Council instructed the Clerk to request Charles A. Royal to attend September 12th regular Council meeting in regards to letter received from him in relation to water meter and water situation at Royal's Shopping Center. Upon motion the Council adjoured. PRESIDENT CITY COUNCIL ATTEST: CITY CLERK September 12, 1972 The City Council of the City of Okeechobee, Florida, met in regular session at the City Hall on the above date at 7:00 P. M. with the following present: President Donald L. Burk, Council- men: Charles L. Breland, Russell V. Domer, Edward W. Douglas and E. H. Hunt with Attorney J. Edward Curren, Clerk Lorena Spivey, Deputy Clerk Sandra Bennett and Director of Public Works L. C. Fortner, J~.. President Burk opened the meeting with prayer. Pursuant to notice published in the Okeechobee News regarding a public hearing to consider rezoning from Residential (R-2) to Commercial Lots 7 to 12 inclusive, Block ]340, Original Town of Okeechobee, President Burk asked if there were any objections to the requested rezoning. No objection was heard or filed. Councilman Douglas moved to rezone the above described property from Residential (R-2) to Commercial, presenting the following Ordinance and moved its adoption and upon being seconded by Councilman Domer was put to a vote and unanimously adopted: ORDINANCE NO. 271 - (77) ORDINANCE AMENDING ORDINANCE NO. 271, BEING AN ORDINANCE ESTABLISHING ZONING REGULATIONS FOR THE CITY OF OKEECHOBEE, FLORIDA, AND PROVIDING FOR THE ADMINISTRATION, ENFORCEMENT AND AMENDMENT THEREOF PURSUANT TO THE PROVISIONS OF CHAPTER 176, FLORIDA STATUTES, 1953. WHEREAS, application has been made by Ralph N. Harper, President of Okeechobee County Bank, requesting this Council to rezone from Residential (R-2) to Commercial Lots 7 to 12 inclusive, Block lb0, Original Town of Okeechobee, and WHEREAS, notice of intention to amend City Zoning Ordinance No. 271, regard- ing said application was duly published according to law, and WHEREAS, on the 12th day of September, 1972, a public hearing was held in the City Council room pursuant to said notice, and WHEREAS, it is deemed to the best interest of the City of Okeechobee to grant s~id application; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: SECTION 1. That Lots 7 to 12 inclusive, Block lbO, Original Town of Okeechobee, be and are hereby rezoned from Residential (R-2) to Commercial, effective September 12, 1972. SECTION 2. That the application requesting rezoning and proof of publication to amend Zoning Ordinance No. 271 published in connection with the above application be attached to this Ordinance and become a part hereof. Audley Dunham MAYOR Engineer Don Osha was present presenting status report on water treatment plant contract as being approved and executed. All inspections have been made on water main as per contract. Also discussed the installation of altitude valves on water tanks. The Council agreed that any cost for installation incurred by the City would be back charged to Pittsburg-Des Moines Tank Co. Councilman Hunt recommended that Engineer Osha encourage the Contractor on the water treatment plant improvements to begin with the construction of the filter first. Engineer Osha reported on the meeting with Farmers Home Administration representatives in regards to necessary requirements for loan or grant to finance sewer system, recommending that the City apply for miximum amount also stated a preliminary report was required and that a comprehensive report would cost approximately $5,000.00 to $7,000.00 and it would take about six months to prepare said report. This amount would come out of percentage fee if construction is merited. The Council agreed to discuss this matter in more detail at workshop meeting. Charles Royal was present in regards to water situation at North Shore Shopping Center being an excessive amount of gallons on master meter that could not be accounted for, requesting a new lb inch master meter. Mr. Royal stated that he had his engineers working on this but they were unable to find the trouble~ reporting the meter valve at Touchton Drugs could not be turned off. After discussion the Council requested Director Fortner to work with Mr. Royal on this matter in an effort to eliminate the problem. Mr. Royal offered a copy of blue prints of water lines to help him in the investigation. Mr. Royal agreed to pay his fair share of cost for the investigation and city's help to correct this situation. Bob Harris, Superintendent with Okeechobee Beach Water Association was present requesting permission to install a larger pump at water plant to service Taylor Creek and Taylor Creek Isles, and the present pump service west of water plant and Buckhead Ridge area. It was agreed there was no extra space to install additional pump inside of the water plant building. Director Fortner suggested installing pump on top of clearwell, also reported that the pumping capacity is near maximum with present filters. Mr. Harris stated that the Association wanted to go along with City and upgrade their system and requested permission at present time to install larger pump for a stand by unit, reporting that the Association had 1290 meters at present and gaining approximately 150 per year. The Council agreed to postpone matter for further consideration and investigation and to call a special workshop meeting for further discussion and agreed to notify Mr. Harris date of meeting. Attorney Curren reported Building Official Spray had requested that the Southern Standard Gas Code be studied further as he had new information on subject. Councilman Domer presented Ordinance No. 362 (Occupational License) for first reading and moved that it be passed to final reading on September 29, 1972, seconded by Councilman Breland and unanimously carried. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: WHEREAS, within the area of jurisdiction of the City of Okeechobee, Florida there are or may be dwellings, dwelling units and accessory structures which are unfit for human habitation and use due to inadequate maintenance, obsolescence or abandonment; containing defects which increase the hazards of fire, accident, or other calamities, and which by reason of the lack of maintenance, inadequate ventilation, light and sanitary facilities or other conditions render such dwellings and accessory structures unsafe, unsanitary and dangerous or detrimental to the health, safety, morals, and general welfare of the community; and '~I4EREAS, e.rperience and accepted national housing surveys have clearly demonstrated that such conditions result in a large measure from improper main- tenance, inadequate sanitary facilities, overcrowded conditions in residential occupancies, buildings and premises and from general neighborhood neglect; and, WHEREAS, it has now become common knowledge that these conditions can be relieved, in a measure prevented and often eliminated through planned and properly enforced minimum housing standards, resulting thereby in the upgrading of living conditions and over-all enhancement of the general health, safety and welfare of all residents and property owners of the community; and TWHEREAS, the Southern Building Code Congress, a non-profit association, has developed and made available a set of minimum housing standards which have been recognized as being acceptable as a model housing code; and WHEREAS, Chapter !6~, Section 165.191 of the General Statutes of the State of F3..orid~ pro.~ides ,~,hat such mode], codes may be adopbed be reference: Now, Therefore Be It Enacted, That, Section 1, The Southern Standard Housinog Gode, being particularly the 1969 edition +,hereof and the whole thereof, save and except such portions as may hereinafter be amended, of which not ],ess than three (3) copies have been and are now fi]ed in +,he office of the City Clerk of the City of Okeechobee, Florida and the same are hereby adopted and incorporated as fully as if set forth at lenght herein, and from +.,he date on which this ordinance shall take effect, the pro~risions therein shall be controlling in the use, maintenance and occupancy of all dwellings, dwelling units and/or structures within the area of jurisdiction of the City of Okeechobee, Florida. SECTION 2. Nothing in this ordinance or in the code hereby adopted shall be construed to affect any suit or proceeding now pending in any court, or any rights acquired or liability incurred, nor any cause or causes of action accrued or existing, under any act or ordinance repealed hereby. Nor shall any right or remedy of any character be lost, impaired or affected by this ordinance. SECTION 3. The invalidity of any section or provision of this ordinance or of the code hereby adopted shall not invalidate other sections or provisions thereof. SECTION h. All ordinance or parts of ordinances in force at the time that this ordinance shall take effect and inconsistent here- with are hereby repealed. SECTION 5. Audley Dunham Mayor, City of Okeechobee Director Fortner presented Water, Sewer and Street Departments monthly report in- cluding the following September 12th memorandums: Memorandum No. i - purchase of new tractor to replace old tractor that had been wrecked. After discussion and the emergency need of a tractor, Councilman Douglas moved to purchase one - Farmall Cub Tractor and 22 inch mower to be mounted under tractor at $2,500.00 less trade-in of one - Farmall Cub Tractor with h2 inch woods mower $650.00 a total of $1,850.00, seconded by Councilman Breland and unanimously carried. Memorandum No. 2 - Water used by Okeechobee Beach Water Association. Memorandum No. 3 - Items needed for stock at water plant in the amount of Sh68.hg. Councilman Hunt moved to authorize the purchase of items as listed on Memorandum No. 3 to replace stock at water plant in the amount of Sh68.hg, seconded by Councilman Domer and unanimously carried. Memorandum No. h - Mrs. J. R. Minehan, Sr. meter readings and consumption from December 16, 1971 through August 15, 1972. President Burk stated that Mrs. Minehan had requested a rebate on water bill as she felt the meter was incorrect. After study of the readings and in view of the fact that the meter did not exceed average use the Council unanimously agreed that the petition for rebate be denied. Memorandum No. ~ - Report on water used at North Shore Shopping Plazza from December 16, 1971 through September 12, 1972. Memorandum No. 6 - The need of air conditioner at sewer plant. After discussion the Council a~reed to postpone purchase until after January 1, 1973. Memorandum No. 7 - One year Membership to the American Public Works Association in the amount of $25.00. The Council postponed matter until after the first of year. The Council discussed the need of additional street sweeping. Director Fortner reported the need of~ additional personel. Director Fortner reported some of the problems incurred by the City in the county road paving program. The Council advised Director Fortner to do the best he can through this first phase and if second phase com~ up matter to be taken up with the County Commissioners. The Fire Report for month of August was submitted by the Fire Department. WHEREAS, the State of Florida Department of Transportation has located and proposes to construct or reconstruct a part of State Road Okeechobee Ave. & 15 Ave. AND WHEREAS, in order for the State of Florida Department of Transportation to further and complete said project it is necessary that certain utilities and/or facilities within the Right-of-Way limits of said State Road --~ Okeechobee Ave. & 15 Ave., be adjusted, changed or relocated, AND ~EREAS, the State of Florida Department of Transportation having requested the City of Okeechobee, Florida, to execute and deliver to the State of Florida Department of Transportation a Utilities Termination Agreement, agree- ing to make or cause to be made such adjustments, changes or relocations of said utilities and/or facilities as set out in said Agreement, and said request having been duly considered, NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Okeechobee, Florida, that the President of City Council and Clerk be and they are hereby authorized and directed to make, execute and deliver to the State of Florida Department of Transportation a Utilities Termination Agreement for the adjustment, change or relocation of certain utilities within the Right-of-Way limits of said State Road Okeechobee Ave. & 15 Ave. Section 91~30-6628; BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded to the State of Florida Department of Transportation at Tallahassee, Florida. President Burk read September llth letter from Brockway, Owen and Anderson, Engineers, i: Inc., advising that Contract 70-1006 Division "A" Trans~ission Main System constructed under above contract had been completed to their satisfaction in substantial compliance with contract ~ and the Palm Beach County Health Department had conducted bacteriological testing of the system and released it for service to the full extent of the approved plans. The Clerk instructed to notify Charles Royal of action. Councilman Domer reported a request for street light at the corner of Avenue D and Taylor Street. Matter to be investigated and surveyed. The Council discussed installing some manner of device at the corner of Avenue D. and Taylor Street to keep automobiles from turning corner to short and cutting into Mrs. R. Hare's property! Councilman Douglas reported the drainage was also bad at this location. Matter referred to Director Fortner for investigation. The month of August report for dog kennel was submitted. The Council agreed on a workshop session on matters pertaining to the caine department. Councilman Breland reported a request from the Civil Defense for $300.00 to purchase radio to connect with the Dire Department. Matter to be studied further.
