The City Council of the City of Okeechobee, Florida, met in regular session at 7:00 P. M.
on the above date at City Hall with the following present: Mayor Audley Dunham, President Donald
L. Burk, Councilmen: Charles L. Breland, Russell V. Domer, Edward W. Douglas, and E. H. Hunt with
Attorney J. Edward Curren, City Clerk Lorena Spi~ey, Deputy Clerk Sandra Bennett, Director of
Public Works L. C. Fortner, Jr. and Building Official Richard B. Spray.
President Burk opened the meeting and prayer was led by Councilmen Douglas.
Minutes of the meetings held June 1, 6, 1 3, 20, 27 and July 11, 1972 were read and upon
motion by Council Breland, seconed by Council Douglas were approved as read.

Mr. Elli Mills, representating Mc Arthur Properties Inc. was present petitioning for
~ecpmsoderatopm pf water ~-~rpject tp Oak Lake Apartments located on Wolff Road, apoligizing for not
attending workshop meeting on July 18th also stated his appreciation for the city's cooperation in
providing te~oorary water set-up. Councilman Hunt discussed the project with a ~eneral over all
discussion with Counci.], ~'~tr. P~ills and Mosely Collins~ County Engineer. CounciLman Domer suggested
considering ; one year brial period to see how system works out. After a lenghty discussion it was
tentatively a~reed to provide ~.~ater service to Oak Lake Development through two - 2 inch meters which
will connect to a 2 inch PVC loop system, running to each of the eight residential buildings and to
one recreation facility. A base rate of $~%.~0 tines h9 units as occupied and all over this amount

Mar~xn Arrants, Manager of Florida Power and Light, Company and W. C. Sherman, Tax Assessor
were present in regards ~o a cut off date for using old addresses, suggesting the month of
November. Mr. Arrants stated that the Post Office was issuing the new addresses and the City
Director had used some of the new addresses. Attorney Curren stated that the City adopted a
Resolution on March 7, 1972 resolving to adopt the street and numbering system as set forth on
street map and by adoption all present designations were discontinued.
Th~ Council authorized the purchase of ~O0 additional maps to be prepared by Brockway, Owen and
Anderson Engineers, Inc.
Mr. William Farbarik appeared before the Council requesting street maintenance on Vivian
Place and Second Street in Wilcox Shores Subdivision. Matter to be investigated.
Harry B. Elliott was present requesting permission to open his recreation hall located on
South Park Street on Sunday from 2:00 P. M. to lO:O0 P. M. Stating at present he had pool tables,
ping pong tables and pin ball machines and no alcoholic beverage was sold. Councilman Domer
suggested a public hearing on this request. Matter to be discussed further at August 10th meeting.
Building Official Spray requested to check the requirements on restroom facilities for this
e stab li shment.
Attorney Curren reported the contract document "Notice of Award" on water treatment plant
improvements to Big Four Construction Company of West Palm Beach, Florida in the amount of'
$~07,010.20 had been executed by the city.
Attorney Curren read Resolution assuring Farmers Home Administration that the Oity had
sufficient funds in reserve to pay all costs of the acqui~tion, construction and erection of
extensions and improvements to the water distribution facilities which should exceed the amount of
Four Hundred Thousand Dollars in loan funds from Farmers Home Administr~ation. Councilman Hunt
presented the following Resolution and moved its adoption and upon being seconded by Councilman
Breland was put to a vote and unanimously adopted:

SECTION 1. The City of Okeechobee, Florida (hereinafter called the "City")
has heretofore by Ordinance No. 356, duly adopted on February 22, 1972, auth-
orized the acquisition, construction and erection of extensions and improvements
to the water distribution facilities of the City's water and sewer system and
the issuance by the City of not exceeding Sho0,o00 ~Vater and Sewer Revenue Bonds
of the City, through which bonds the City of Okeechobee is borrowing the amount of

SECTION 3. One June 29, 1972, the City of Okeechobee withdrew from said
loan funds the amount of $161,9h9.32, representing f~ds advanced by the City to
that date, and transferred said funds to its Cig~ette Tax ~nd. As part of the
same transaction the City of Okeechobee invested $300,000 of said loan proceeds,
into $100,000 do~nations time certificates of deposit designated as water and
se',.~er system conr::truction funds. ~e balance of $38,0~0.68 was n~withdrawn but

SECT'[ON ~. On the same date of June 29, 1972, the amount of $161,9h9.32
transferred from the Water and Sewer Construction Fund to the Cigarette T~ ~nd
~,.r~s combined with other Cigarette T~ Funds in the amo~t of $38,0~0.68, and the
total amount was then invested in two time certificates of deposit in the amount
of $100,000 each desi~ated as Cigarette T~ Fund.
SECTION [. ~e lowest base bid on ~ase 2, which was received from Big Four
Construction in the amount of $333,960.20 considerably exceeded preli~na~ cost
estimates. ~e City's en~neers evaluated the bids received on May 9, and by
letter dated May 23 reco~eded that the low base bid plus ad. tire a~ternate
nu~er one be accepted as a ~mum. ~e en~neers further reco~ended that the
possibility of awarding a contract including all of the alternates be considered.
~ereafter the City Council determined on June 13, 1972, that with the approval

Attorney C~ren also discussed the adoption of new occupational license Ordinance to be
effective October 1, 1972 for the period of one year, stating that it would be necessary to publish
notice for a public hearing. Council~n H~t moved to authorize Attorney Curren to publish notice
for public hearinq, seconded by Council~n Domer and ~a~mously carried. Attorney Curren also
discussed with the Council and Building Official Spray establishing a Certificate of Cogency fee.

Director Fortner also presented memorandum dated August 8, 1972 for material needed to
replace stock at water plant: 2000 feet of 2 inch PVC pipe $3~0.00 and 2 - 2 inch water meters $~50.00.
Councilman Hunt moved to approve memorandum as stated above in the total amount of $790.00, seconded
by Councilman Breland and unanimously carried.
Building Official Spray presented demolition bid stating that he had received only one bid,
being from Rock-A-day, Inc. Also requested permission to begin proceedure on demolition of condemned
building on Lot 7, Block 177, Original Town of Okeechobee, assessed to Zollie Aldridge, Etux, for
which bid stated a demolition price of $780.00. Building Official Spray stated there was no way to
repair said building. After discussion and all legal requirements in order, Councilman Breland moved
to proceed with demolition of condemned building on Lot 7, Block 177, Original Town of Okeechobee at
a cost of $780.00, seconded by Councilman Domer and unanimously carried. President Burk instructed
Building Official Spray to work with Attorney Curren on proceedure.
Councilman Domer reported the need of a fan to circulate air in jail, suggesting a 20 inch
high volume fan installed behind shower - ~760 cu. feet in jail, stating the cost of said fan to be
$5~.6~ also ~uggested employing Jimmie Belk to install fan. After discussion Councilman Domer moved
to purchase a 20 inch high volume fan at $~5.6~ with installation by Jimmie Belk, seconded by Council-
man Douglas and unanimously carried.
Councilman Domer requested Director Fortner to check the alley in Block 168 and see if the
fill can be leveled off for drainage purposes. Also reported a request from J. P. Deloney to grade
Oak Drive with a crown for drainage purposes, Director Fortner requested to check this out. Director
Fortner also was requested to investigate a request from Dr. Paula Frances to mow grass on side street.

Councilman Douglas reported a recuest to open alley between north 16th Street and 17th Street~
It was reported that the alley was full of rubbish and a hog sty. Building Official Spray to investi-
gate the violation of City Code and opening of the alley re£erred to Director Fortner for luther

Councilman Breland reported the need of street apron repair at Third Street and Parrott
Avenue. Matter to be investigated by Councilman Douglas

Councilman Breland reported that Richard J. Black, Radio Dispatcher was working an average
of two shifts per week and had requested full time employment, recommending that the three full time
Dispatchers be put on 5 day week or ~0 hours a week schedule and the above relief Dispatcher be on
full time and this schedule would eliminate several relief Dispatchers. After discussion Councilman
Breland moved to put the three regular Dispatchers on a five day a week schedule and to employ Richard
J. Black as regular full time relief Dispatcher seconded by Councilman Domer and carried.
A re-zoning application from Okeechobee County Bank was presented requesting that Lots
7 to 12 inclusive, Block l~O, Original Town of Okeechobee be rezoned from Residential (R-2) to
Commercial. Councilman Breland moved to advertize the notice of public hearing, seconded by Council-
man Domer and unanimously carried.

NOTICE is hereby given that the City Council of the City of Okeechobee, Florida,
a municipal corporation, will consider rezoning from Residential (R-2) to Co~uercial
and to amend accordingly the Comprehensive Zoning Ordinance ~271 adopted November 21,
1955, the following described real property, situate, lying and being within the
corporate limits of the City of Okeechobee, Florida, to-wit:

PUBLISH IN THE OKEECHOBEE NEWS: August 17, 1972
Councilman Hunt moved to authorize the payment of $500.00 to Okeechobee Chamber of
Commerce as provided in budget, seconded by Councilman Breland and unanimously carried.
Councilman Hunt moved to approve Change Order No. 3, to adjust contract price to final
field measurements of quantities actually installed Contract No. ?0-1006, Division "A" Transmission
Main, LaGrow Irrigation Systems, Inc., in the a~ount of $1,891.31 and send to F. H. A. for
approval, seconded by Councilman Breland and unanimously carried.
A copy of letter to Aetna Insurance Company from Okeechobee Motor Company was read to
the Council regarding claim settlement on financial loss due to sewer stoppage. The letter was
ordered filed.
Estimate No. 5 from Pittsburg-Des Moines Steel Company in the amount of $5,895.00 for
work accomplished on Contract No. 70-1006, Division "B" Elevated Storage was presented for payment
by Brockway, Owen and Anderson Engineers, Inc. Council~n Domer raoved to postpone approval until
next meeting seconded by Councilman Breland and carried.
Payment reqUest No. ~ from Brockway, Owen and Anderson Engineers, Inc. in the amount of
$16,399.72 for Engineering services in connection with Waterworks Improvement Program and Water
Treatment Plant Expansion was presented for payment. The Council agreed to withhold payment at
present time.
A letter was read from Ralston Purina offering dog chow for dog kennel at $5.50 per 50
pound bag. Matter referred to Mayor Dunham.
The Fire Report for month of July was presented by the Fire Department.
The Clerk submitted six months Revenue and Expense Report in relation to budget.
Building Official Spray reported that Herbert Nix was doing trailer repair at his property
on Northeast Park Street. The Council advised Building Official Spray to notify Mr. Nix that this
must be temporary and suggested Official Spray keep this matter under surveillance.

The City Council of the City of Okeechobee, Florida, met in recessed session at 6:30 P. M.
on the above date at the City Hall with the following present: President Donald L. Burk, Councilmen:
Charles L. Breland, Russell V. Domer, Edward ~. Douglas and E. H. Hunt with Attorney J. Edward Curren
and City Clerk Lorena Spivey.
Elli Mills and Mosely Collins were present in regards to water project to Oak Lake
Development. It was agreed by the Council and Petitioner to install 2 - 2 inch at $355.00 each,
2 - 2 inch meter deposits on each meter $170.00 ($320.00), minimum charge to all units as occupied,
one time occupied the minimum charge will continue, both meters to be read and reading combined and
charged accordingly on regular rate. Notification of occupancy shall be made by McArthur Properties
and shall be subject to verification by the City. A"Memorandum of Understanding" was presented for
approval. The Council recommended several changes and after a lenghty discussion Councilman Hunt
moved to accept the "Memorandum of Understanding" subject to the Council's recommended changes,
seconded by Councilman Domer and unanimously carried.
The request from Harry B. Elliott as noted in August 8th minutes, to open recreation hall
on Sunday from 2:00 P. M. to lO:OO P. M. was discussed. Afterwhich the Council agreed unanimously
to the enforcement of Ordinance prohibiting the operation' of any pool or billiard parlor to be
operated on Sunday.
County Commissioner Jack 4illiamson appeared before the Council reporting that the County
had entered into an agreement with firm of Kendree and Shepherd Planning Consultants for a comprehensive

this amount and the County contributing twenty-five per cent. Also Commissioner Williamson stated
that the compiled information and anticipated projection would benefit in problems of growth and
prepare for tile anticipated need for services such as water, sewer, utilities, highways and maps for
