Attorney Curren recommended employing the City Auditors as advisor in setting up all
city accounts and funds.
Mayor Dunham recommended that the Council consider the purchase of two air conditioners
for Building Official Office and Office of Director of Public Works. President Burk recommended
that Director Fortner investigate the purchase under the State Purchase Contract. Also Mayor Dunham
reported the trash cans in front of the Chamber of Commerce needed painting. Matter referred to
Director Fortner. Mayor Dunham also discussed the need to have dogs purchased from the dog pound
inoculated by purchaser. Councilman Breland agreed to contact Veterinarian and see if a system
could be worked out on this matter. The Council agreed that the Dog Warden should be instructed
to operate the dart gun.
Director Fortner reported that the cost of repairs on tractor was doubled the expected
cost of $200.00 and recommended the purchase of a new tractor at an approximate cost of $~,900.00
less trade in. The Council instructed Director Fortner to prepare specifications on tractor for
June 27th recessed meeting. Director Fortner also reported that the bushhog was in bad condition.

Director Fortner presented specificiations on tractor. Councilman Hunt moved to advertise
for bids for the purchase of one diesel tractor as per the following specifications, seconded by
Councilman Douglas and carried.

at City Hall, until 7:30 o'clock, P. M., July ll, 1972, at which time the bids duly

Director Fortner reported that Phil Berger had requested a letter for Farmers Home
Administration, stating the City would provide streets and water in proposed subdivision in North-
west section of city. The Council agreed that Director Fortner request Mr. Berger to come before
the Council and discuss in detail the request.
Director Fortner reported the Salesman who sold the sewer cleaning machine wanted to rent
the machine for demonstration purposes in other city"s. The Council rejected request.
Director Fortner reported two accidents due to fragments being thrown from mowing machine,
stating the mowers were worn out, and the approximate cost of new mower $278.00.
Director Fortner also reported a complaint from James Enfinger on Southwest Park Street of
water from Para Marine Distributors Inc. property used to wash milk trucks drained and settled into
ditches in area causing odor and contamination. Mr. Enfinger had agreed to purchase 50 for 60 feet
of culvert fo~ drainage ditch adjoining his property is the City would install it. The City having
adopted The Sanitary Code of the State of Florida and this being a matter of health hazzard referred
co~plaint to Building Official Spray for investigation.
Upon request of the City Clerk, Councilman Hunt moved to purchase two desks for Clerk's
office, seconded by Councilman Breland and carried. Money for the desks had been appropriated for
in the 1972 budget.

The City Council of the City of Okeechobee, Florida, met in regular session at 7:00 P. M.
on the above date at City Hall with the following present: Mayor Audley Dunham, President Donald L.
Burk, Councilmen: Charles L. Breland, Russell V. Domer, Edward W. Douglas and E. H. Hunt with
Attorney J. Edward Curren, Clerk Lorena Spivey, Director of Public Works L. C. Fortner, Jr. and

President Burk opened the meeting and prayer was by Councilman Breland.
President Burk read a letter from Okeechobee Motor Company in reference to a financial
loss due to recent sewer stoppage with attached list of parts and assessories damaged beyond use or
were rendered unmarketable in the amount of $1,352.76. P~esident Burk stated that he had talked
by telephone with D. R. Watford and advised that the insurance company representative had been
contacted and the adjusters notified.
President Burk and Councilm~n Domer submitted estimated cost of $700.00 for one year
water plant and machinery insurance coverage from Leonard Berger Insurance Agency. Building and
Machinery!value $70,000 - Cholorinator $3,500 - 2 filters at $15,000 each - open holding tank
each.

requested President Burk to invite Mr. Berger to Council meeting to discuss further details.
Director Fortner presented to the Council copies of proposed Franchise Ordinance from
United Telephone Company to read and study. Matter referred to workshop and the Council requested
telephone respresentative to be present.
Director Fortner submitted monthly report on Water, Sewer and Street Departments.
Director Fortner presented copy of letter from the Department of Transportation regarding
City's request to erect "one hour parking" signs on east side of Parrott Avenue at Dainels building
and "no parking" signs next to fire hydrant on east side of Parrott Avenue 150 feet south of South
Park Street. Said Deparment granted request and agreed to install said signs.
Director Fortner submitted in monthly report July 11, 1972 Memorandums. Memorandum No. 1
needed stock items needed to be replaced at water plant in the approximate amount of $3,hh6.70.
Councilman Hunt moved to approve the purchase of items listed on Memorandum No. 1, seconded by
Councilman Domer and carried.
Memorandum No. 2 - Lawn Mowers needed for Street Department. Director Fortner recommended
at a cost of $278.50 each.

Also the Council discussed contacting the Department of Transportation Division of Maintenance
and see if they would take over the maintenance of the islands. After discussion Councilman

additional cost to get Briggs and Stratton motor, seconded by Councilman Breland and carried.
Memorandum No. 3 - Air Conditioner for Clerk's office. Councilman Hunt moved to approve
the purchase of 1 - 15,000 BTU Emerson Air Conditioner for the Clerk's office at the State Contract
Price $190.80 as listed on Memorandum No. 3, seconded by Councilman Douglas and carried.
Pursuant to notice published in the Okeechobee News bids were received, opened and read
for the purchase of one diesel tractor. President Burk requested Director Fortner to assist in the

President Burk requested Director Fortner to check specificatio~ and tabulate bids and
report to the Council later on during meeting. Director Fortner reported that the low bid was from
Pippen Tractor and Equipment Company, Inc. and met all specification~ therefore, recommended that
the bid from Pippen Tractor and Equipment Company, Inc. in the amount of $3,200.00 be accepted.
Upon recommendation of Director Fortner, Councilman Douglas moved to accept the low bid being from
Pippen Tractor and Equipment Company, Inc. for the purchase of one Massey Ferguson diesel tractor in
the amount of $3,200.00 as per specifications, seconded by Councilman Breland and unanimously carried.
Building Official Spray submitted quarterly Building Department report. Councilman Domer
commended Building Official Spray. on a job well done.
President Burk recommended a special workshop meeting to study the housing and gas codes in
two or three weeks. The Council requested Building Official Spray to present at workshop meeting
the bids he had received on demolition of condemned buildings. Mr. Spray reported the clean-up
pro,ram was progressing according to schedule.
Jir~ie Belk was present stating that Councilman Breland had contacted him in regards to
installing a chain link fence around both water tanks. Mr. Belk stated that a six foot fence could
be purchased for approximately $2.48 per foot. After discussion, President Burk recommended to the
Council to consider a workshop meeint in approximately six weeks on this matter. The Council thanked
Mr. Belk for his presence.
Mr. R. E. Hamrick was present suggesting in the future planning to consider extending water
line to the east and around eastern lake area. President Burk expressed his appreciation to ~.
Hamrick for h~s interest and presence.
Director Fortner reported a tenative date of July 17th to commence the sewer plant digester
cleaning.
Director Fortner reported a request from Phil Berger for a letter for Farmers Home Admini-
stration purposes stating the City would provide stree~ and water to proposed subdivision development
in northwest section of city. The Council instructed Director Fortner to request Mr. Berger to attend
Council meeting for detailed discussion.
Director Fortner reported Mc Arthur Properties~ Inc. located on Wolff Road had requested
a master meter for development. Director Fortner recommended seperate meters. The Council agreed
that they would have to pay all cost of a six inch water installation. Councilman Hunt, Chairman of
Inc.
the l~ter Co~mittee recommended that Mc Arthur Properties/representative come before the Council and
explain exactly what they want.
Director Fortner reported the Farmer's Production Credit Association had requested sewer
line extensi~n to their property east of hospital. Councilman Hunt recommended that the Council
investigate this matter.
Department from Florida School
Director Fortner' reoorted that Mr. Sparkman, Maintenance
for Boys had requested that the City run tests on the schools water and sewer, due to insufficient
help. After discussion the Council agreed that time and man hours was not available.
Director Fortne? reported a request to open Southwest Tenth Street, west of Miami Street,
Director Fortner discussed discontinuing the signal light at Third Street and Osceola
Street during the summer months. Councilman Domer moved to discontinue light now and turn back on
one week before school be.~ins, seconded by Councilman Breland and carried.
Director Fortner reported the traffic light at Eighth Street and Osceola Street had been
damaged beyond repair by a sem.i truck, stating that he was now using the city's only spare light
at this location and suggested checking with Fort Pierce for a stand by light. The Council was in
accord with this suggestion.
Fire Department Report for June was submitted by the Fire Department.
Donald Edgar, Dog Warden, and Mrs. Austin were present regarding a misunderstanding
between them in regards to the purchase of two dogs which were purchased personally from Mr Edgar
and did not involve the dog pound. President Burk reminded Mr. Edgar that he had been instructed
by the Council not to deal in dogs outside of city business and he had not adhered to instructions
advising him to work out the above matter ~,rith parties involved. Councilman Breland discussed a
ouestion asked previously by Mr. Edgar, as to who is Dog Warden's boss, also stating that Mr.

Edgar had been instructed to mark vehicle and put a permanent cage on truck and to date he had/done
as instructed. President Burk advised I~. Edgar that the Council is the policy making body and that
he is under direct, supervision of Mayor and is to take orders from the Mayor and Councilman Breland.

dog food and not to pickup dogs in the county unless specifically instructed by the Bheriff's
Department or County Commissioner.
Attorney Curren read culvert Ordinance. Councilman Domer presented the following Ordinance

AN ORDINANCE ESTABLISHING STANDARDS OF CONSTRUCTION FOR PRIVATE DRIVE-
~AYS UPON OR ACROSS PUBLIC PROPERTY; PROVIDING FOR PERMITS AND FEES
THF_~EFORE; ESTABLISHING JURISDICTION UNDER TH~ DIRECTOR OF PUBLIC IdORKS;
ESTABLISHING MINIMUM REQUIREMENTS; AND PROVIDING FOR FUTURE MAINTENANCE
BY THE PERSONS CONSTRUCTING OR USING THE SAME AS ADJUNCT OR APPURTENANT
TO LANDS OR PROPERTIES /MMEDIATELY ADJACENT THERETO.
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF 0KEECHOBEE,
FLORIDA:
Section 1. No person, firm or corporation shall hereafter construct, build,
establish or maintain any driveway over, across or upon any portion of the public
sidewalk or public parkway, including public drainage ditches, without first
having obtained a written permit to do so from the Director of Public i~orks.
No such permit ~hall be issued for construction or establishment of any such
driveway except in accordance with the provisions herein contained.
Application for permit must be made in writing upon forms furnished by the
cindy. S~id application shall contain the name and address of the person,
fi~m, or corporation making the application, the name of the contractor or
pe~son who is ~.o construct said driveway and the proposed location and
dimensions of such driveway.
Section 2. Fees. Before any work is started, the contractor shall pay
to the city, permit and inspection fees as follows:
(a) For all new driveway construction the fee shall be five dollars.
(b) For all resurface work of an existing driveway, the fee shall be
tw.~ dollars.
(c) For all ordinary maintenance of an existing driveway, the fee shall
be one dollar.
Section 3. Ail such work shall be done under the jurisdiction of the
director of public works and in accordance with this ordinance and with
o~her ordinances of the city; and shall be inspected upon completion by the
constitu±~ed member of the Department of public works.
Section ~. Ail plans and specifications must conform to the following
minimum requirements before permit for construction or reconstruction shall
be permitted:
(a) Ail Driveways shall be constructed in a manner and of such materials
an~ of such thickness as determined by the Director of Public Works.
(b) No part of any driveway shall interfer with or obstruct the free
flow of water in gutters and drainage ditches.
(c) Where driveways cross open ditches in the parkways, culverts shall
be installed. Said culverts shall be of such size and such material as deter-
mined by the Director of ~h~blic ~orks, depending on the conditions existing.
In no instance shall the size of opening be less than that obtained by a
twelve-inch diameter pipe. The lenght of culvert shall be determined by the
following method: For ditch depth of two feet or less the culvert shall ex-
tepid no~ less tha~ four feet beyond both edges of the driveway where it crosses
the ditch. For each additional foot depth of ditch add two feet to the above
figure, except that no culvert shall be less than twenty feet long and except ·
that where headwalls are constructed at the ends of the culvert the lenght
sh~ll' be as determined by the Director of Public ~"~orks.
Section ~. Ail driveways constructed or reconstructed over, acro~-~s or
upton any public street or public par~r~ay in 'the city shall be kept and
ma~ ntained at all times in accordance with the provisions hereof by the
persons so constructing, reconstructing or using the same as an adjunct or
ap.~'~rtenance to lands or properties i~aediately adjacent thereto.
Section 6. No Certificate of Occupancy shall be issued until this
or~!l, nance has been fully complied with.
Section 7. Any person who shall violate any of the provisions of
thf s ordinance or fail to comply with any of its requirements, or who shall
bufld or alter any driveway or culvert contrary to the intent herein expressed
an~t approved, shall, upon conviction thereof, be fined not more than five
hundred dollars, and each day such violation continues shall constitute a
seperate offense. The owner of any building or premises or part or area
adjacent thereof where any violation of this chapter shall occur, and any
architect, builder, contractor, agent, person or corporation employed in
connection with such violation who shall be found guilty of participating
therein shall be guilty of a seperate offense, and suffer the penalties
herein provided.

Attorney Curren reported that Ernest Evans was still interested in negotiating with the

City on water system in ,~i.._cox Shores and 0keechobee Estates subdivision. The Council agreed on
special workshop meeting to discuss this matter in detail.
Attorney Curren reported a drive sponsored by the Supervisor of Registration to get the
public out to register and vote, stating a request from the Key Club of 0keechobee High School for
~ permission to paint a neat stencil sign on side walk reminding the public to register and vote.
President Burk recommended that representatives from club meet with Mayor Dunham and Councilman Hunt
and present details of program.
Attorney Curren reported that under a new state law the city was required to adopt an
occupational license fee ordinance by October l, 1972 for period of one year. President Burk re-
commended two or three workshop meetings on this matter.
Councilman Domer reported that he had submitted a six months report of Fire Department
expenses and six months fire report to County Commissioners for budget purposes. President Burk
expressed his appreciation to Council Domer for taking care of this detail.
Councilman Douglas reported a request from Franklin Walker for the city to mow right of
way between his and Leon Williams property in South Okeechobee. Drainage ditch between hth and ~th
Street in South Okeechobee discussed. Matter to be investigated.
Councilman Douglas inquired if the condition at the end of west Eighth Street had been
corrected. Director Fortner to check this out.
Councilman Douglas reported a request from Larry Mobley to purchase the eleven foot strip
of land between alley and street south of his new house on south Hillsborough Street. No action taken.
President Burk recommended blocking drive east of City Hall. Matter to be investigated.
Councilman Hunt expressed his appreciation for flowe~ sent during his illness.

A letter to Olen Godwin, Fire Chief from Sheriff John W. Collier/commending the Fire
Department for their assistance and services provided following the disastrous tornado.
A letter was rea~ from OkeAirCo, Inc. asking the Council to confirm that their acceptance
of the Franchise was timely made. The date that the Franchise was granted was as indicated in the
Ordinance, May 23, 1972. Final Typographical changes by the City Council caused 0keAirCo, Inc. not

to receive an executed copy until late June and they accepted July 7, 1972. Therefore, this
Resolution validates the Franchise and it is valid in accordance with Section 20 of said Franchise.

'il'lac City Council of the City of Okeechobee, Florida, met in recessed workshop session at
6:30 P. M. on the above date at City Hall with the follo~,,~[ng present: President Donald L. Burk,
Councilmen: Russell V. Domer, Edward W. Dou~ias and E. H. Hunt with Deputy Clerk Sandra Bennett and
~.ractor of Oublic Works L. C. Fortner, Jr.
A discussion was heard on water for Mc Cathur Properties, Inc., located on Wolff Road.
Director Fortner reported that they had requested a master meter. The Council did not agree to this
request but decided on 9 - 2 inch meters to be installed along front of property with a six inch line
to cross ~olff Road and two inch line from meter to each unit. Mc Arthur Properties, Inc. to pay
$3~.OO for each tap fee, $85.00 for each deposit and all cost of pipe and labor to cross' Wolff Road
to their property.
President Burk asked Donald Edgar, Dog Warden several questions concerning the disposal of
dogs on Friday. The Council requested that a letter be written to Mr. Edgar for auditing purposes
asking for a monthly report of the following:
1. Daily entry of dogs picked up in city and county
2. Number of Do~s sold
3. Amount received from sale of dogs
~. Number of dogs disposed of each Friday
A proposed telephone franchise discussed. Copies of Section 167.22 and 167.23 Florida
State Statutes relating to franchise to be made for the Council.
Councilman Domer discussed a new fire truck. Chief Godwin to present specifications on new
truck.
President Bark reported that Building Official Spray was planning vacation and Mr. ~ells
will take his place while on vacation. President Burk to see about pay and transportation.
Councilman Douglas agreed to make another list of street lights that had been requested to
be installed by Florida Power and Light Company.
