Tomlinson request for adjusted tap fee in ~nta Park S~di~sion, stating that if the Council ~anted an adjusted rate the other sub~sion developers would expect the same. After discussion the Council unanimously agreed to deny W. L. Tomlinson request and keep the tap fees the same as set forth in Ordinance No. 348. Director Fortner advised to check with Attorney Curren regarding title change and salary increase. Councilman Domer discussed the request from James Attaway for culvert on }{ale Avenue, presenting sketch of prope~y and advised of an offer from Attaway. A. Rogers appeared before the Council in regards to the water re-connection charge in the amount of $120.20 at his property 106t~ Northeast Tenth Street. President Burk explained the situation and Mr. Rogers agreed to pay bill. Councilman Domer advised that the Dog Warden had reported the need for completion of work at the dog pound. The Council agreed to have Jimmie H. Belk complete work. D. R. Daniels appeared before the Council regarding the installation of water main under the sidewalk in front of his building on East North Park Street, requesting the Council to re-route if possible, due to the business places being inconvenienced during the construction period. President Burk advised Mr. Daniels that the Council had studied this matter and had discussed an alternate route but the Engineer recommended this route due to it being the shortest distance between the main located on Parrott Avenue and the proposed tank site east of City Hall. The Council felt that they would have to comply with the Engineers recommendation. A letter from __~ Brockway, Owen and Anderson Engineers, Inc. had been received concerning this matter. The Contractor advised that the sidewalk would be torn up approximately three weeks and that temporary access would be furnished to existing businesses during this time. Mr. Daniels also asked about a sign for the Daniels building. Matter referred to Building Official Spray. Also requested 30 minute parking signs, Councilman Douglas checking into this request, and requested a street-light on Seventh Street and Tallahassee Street, request for this light had already been given to the Florida Power and Light Company. Fire Chief Godwin requested no parking signs at fire hydrant in front of Daniels Building. Director of Public Works Fortner submitted Water, Sewer and Street Department monthly report, calling attention to a letter from Apperson Chemicals, Inc., confirming that they will extend for twelve months the same price the City is currently paying for chemicals. Councilman Hunt recommended that their offer be accepted and moved to continue to purchase from Apperson Chemicals, Inc. chemicals for 12 months at the same price as quoted in 1971 seconded by Councilman Breland and unanimously carried. Director Fortner reported that he had a verbal commitment from Rockwell Manufacturing Company representative stating that they would extend their current bid price on meters for additional twelve months but advised that he would get a written confirmation from company. -- Director Fortner reported that the water main on State Road 70 west and Eagle Bay Drive had been connected and more pressure was reported, due to this tie in. Director Fortner requested permission to purchase equipment for his office at City Hall, reporting that Chief Godwin had moved. The Council authorized Director Fortner to purchase necessary equipment. Attorney Curren requested small office space for his city files. Attorney Curren reported that plans and specificatior~on second phase of water works improvement program had been sent to State Board of Health for their approval. Councilman Domer discussed a proposed sewer project with Farmers Home Adminstration financing. Councilman Hunt moved to give Attorney Curren authority to take the necessary steps to file application with F. H. A. for loan and grant monies for financing a sewer program, seconded by Councilman Domer and carried. Councilman Douglas reported that the tractor with mower attachment used by the Water and Street Department was causing a conflict due to the tractor being needed at the same time by both departments. Councilman Domer suggested that the city investigate the possibility of getting equip- ment from government surplus. Director Fortner and Street Supt. Bennett to work up specification, and to plan a trip to Camp Blanding to acquaint themselves with the available equipment. Councilman Douglas reported the cable T. V. company (OkeAirCo) were negoiating on a piece of property to erect T. V. tower. Street Supt. Bennett requested information as to who was to purchase materials for Street Department and parts for Street Department equipment Director Fortner or himself. The Council advised this would have to be worked out between himself and Director Fortner. Also Supt. Bennett asked, who the men in the street department were to take their instructions from. The Council stated that Director of Public Works Fortner would do the planning in the department and the Superintendent would be in charge of the men. Supt. Bennett reported the need of a 20 ft. 36 inch culvert at Hillsborough Avenue and Sixteenth Street at an approximate cost of $391.00. Councilman Douglas moved to purchase necessary culvert, seconded by Councilman Breland and carried. Attorney Curren advised that two items were needed for F. H. A. loan closing, stating that copies of all bond ordinances were required and an Ordinance adopting new water rate schedule. Attorney Curren read Ordinance promulgating the rates to be charged for use of the municipal water- works system; outlining means of enforcing payment for water service; promulgating requirements for connection to the municipal waterworks system~ setting up maintenance requirements; prohibiting free water service; providing penalties for violation; and providing an effective date. Councilman Hunt presented Ordinance No. 355 and moved its adoption and upon being seconded by Councilman Domer was put to a vote and unanimously adopted: ORDINANCE NO. 355 AN ORDINANCE PROMULGATING T~E RATES TO BE CHARGED FOR USE OF THE MUNICIPAL WATERWORKS SYSTEM; OUTLINING MEANS OF ENFORCING PAYMENT FOR WATER SERVICE; PROMULGATING REQUIREMENTS FOR CONNECTION TO THE MUNICIPAL WATERWORKS SYSTEM; SETTING UP MAINTENANCE REQUIREMENTS; PROHIBITING FREE 'WATER SERVICE; PROVIDING PENALTIES FOR VIOLATION; AND PROVIDING AN EFFECTIVE DATE THEREOF. BE IT ORDAINED by the Mayor and City Council of the City of Okeechobee, Flo ri d a: Section 1. CONNECTIONS WITH WATERWORKS SYSTEM. Where the same shall be available, the o~mer of every lot or parcel of land within the City of Okee- chobee, Florida, may connect, or cause the plumbing of any building or build- ings thereon to be connected, with the municipal water~zorks system of the City of 0keechobee, and use the facilities of such water system. All such connections shall be made in accordance with the rules and regulations which shall be adopted from time to time by the City Council of the city, which rules and regulations shall provide for a charge or connection fee for 1_41 making any such connections in such reasonable amount as such Council may fix and determine. Provided, however, that this Ordinance shall not be construed to entitle any person to cross the private property of another to make such water connections. SECTION 2. CHARGE OR RATE FOR WATER SERVICE. Any user of the services of the waterworks system shall pay therefor a monthly charge or rate as follows: Rate Monthly Basis First 3,000 gallons or less, within the city li~ts $ h.O0 (minimum bill) First 3,000 gallons or less, outside the city limits $ ~.50 (minimum bill) Next h,O00 gallons $ .80 per 1,000 gallons Next 8,000 gallons $ .65 per 1,000 gallons Next 35,000 gallons $ .60 per 1,000 gallons Ail over 50,000 gallons $ .~5 per 1,000 gallons SECTION 3. UNLAWFUL CONNECTION. No person shall be allowed to connect into the waterworks system without the written consent of the city, and then the connection witb such system shall only be made under the direction and super- vision of the city. Any property owner or plumber who shall make any connection without such consent of the city shall, upon conviction, be subject to the penalties hereinafter provided. SECTION ~. CONNECTING OLD PLUMBING. Whenever it is desirable to connect existing plumbing with the city waterworks system, the owner or plumber contemplating doing such work shall notify the city Plumbing Inspector who will ins~eeSe~w~,-wi~ inspect said plumbing and notify the owner or plumber what alterations will be necessary to place said plumbing in an acceptable condition for connection with the waterworks system. Any owner or plumber who shall make any connection without the approval of the Plumbing Inspector shall, upon con- viction be subject to the penalties hereinafter provided. SECTION 5. MAINTENANCE OF PLUMBING. The owner of the property shall be responsible for maintaining all plumbing on such property and the pipe leading and connection from the waterworks system distribution lines. SECTION 6. PAYMENT OF FEES AND BILLS REQUIRED. Bills for the monthly charges and fees hereinbefore mentioned shall be submitted by the city and shall be paid by the users monthly. If any monthly bill for water service shall be and remain unpaid on or after l~ days from the date of submission of said bill for such service, a penalty of ten percent of said bill shall be imposed and be added to said bill; and, if said bill shall continue and remain due and u~aid for a period of 30 days from the date of submission of such bill, the water service to the consumer shall be discontinued and shall not be re-connected until all past due charges shall have been fully paid, together with a re- connection charge of Five Dollars ($5.00). SECTION 7. NO SERVICE FREE. No water shall be furnished free of charge to any person, firm or corporation whatsoever, and the City of Okeechobee and _1417 each and every agency, department or instru~nentality which uses the water- works system shall pay therefore at the rates fixed by this Ordinance. SECTION 8. SYSTEM TO BE FULLY METERED WITH SEPARATE CONNECTIONS FOR EACH SEPARATE UNIT. Each lot or building site shall be considered a separate unit for the payment of the water fees herein established~ and separate connections will be required for each of such units. Every connection shall be separately metered. SECTION 9. PENALTIES. Any person, firm or corporation violating the provisions of Section 3, or Section h of this Ordinance shall, upon conviction thereof, for each such offense, be subject to a fine of not to exceed Three hundred Dollars ($300.00) or by i~prisonment for not to exceed ninety (90) days, or by both such fine and imprisonment in the discretion of the Municipal Judge. SECTION 10. All ordinances or parts of ordinances and all sections or parts of sections of the Code of Ordinances of the City of Okeechobee in conflict herewith are hereby repealed. SECTION 11. EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after April l, 1972. Councilman Breland reported that in an effort to up grade the Police Department it was suggested that two police officers be prompted to rank of Sergeant and a $1~.00 per month uniform allowance for regular radio dispatchers. Councilman Breland moved to promote Police Officer Gary Eubanks and Archie Hancock to rank of Sergeant and to increase their salary to $1hO.O0 and $13~.00 respectively and to grant each regular radio dispatcher $1~.00 per month clothing allowance, effective immediately, seconded by Councilman Domer and unanimously carried. Councilman Breland reported he would like to have a ceremony at a later date, also complimented the suxilary police in their performance of duties. The Council approved two more microphones for Council room not to exceed $100.00. Director Fortner reported the County was going to pave additional city streets and will need culverts. The Council requested Director Fortner to prepare list of needed culverts for street improvement. Director Fortner advised that Motorola Representative would meet with the Council Feb. 22. Director Fortner requested the Council to consider promoting Assistant Water Supt. John to water superintendent ~ith salary as set up in the budget and to promote one of the other department employees to Assistant Superintendent with a $5.00 week increase in salary. Matter referred to February 22nd meeting. The Clerk reported the license fee for fair had been paid in the amount of $169.00. Upon motion the Council recessed meeting to February 22, 1972 at 6:30 P. M. PRESIDENT CITY COUNCIL February 22, 1972 The City Council of the City of Okeechobee, Florida, met in regular recessed session at the City Hall on the above date at 6:30 P. M. with the following present: President Donald Burk, Councilman Charles L. Breland, Russell V. Domer, Edward W. Douglas and E. H. Hunt with Attorney J. Edward Curren, Clerk Lorena Spivey, Deputy Clerk Sandra Bennett, Director of Public Works L. C. Fortner, Jr. and Building Official Richard B. Spray. President Burk opened the meeting with prayer by Councilman Douglas. Dave Evans, representative of Motorola Inc., was present as requested by the Council in re~ards to the radio equipment not in proper working order and being unable to get in contact with him when needed. Mr. Evans explained that the interference on Police Department radios had dept. dept. been corrected by Motorola at no expense to the city. The water/and fire/radios were also receiving interference and stated that he would endeavor to speed up the correction of this problem. Also advised that he had a 2~ hour answering service now and would furnish his number to the Police Department. The Council advised Mr. Evans that the city was paying a large monthly radio maintenance charge and desired service when needed. Director of Public Works Fortner presented memorandum, February 22, 1972, including a list of needed culvert to be used on streets under the secondary road improvement project so proper drainage can be maintained under the streets before being paved. Approximate cost of needed culverts $h,057.98. After discussion Councilman Douglas moved to advertize for bids on culverts as listed in the memorandum, seconded by Councilman Breland and carried. After consideration Councilman Douglas moved to purchase 2 of the above size tractor tires, seconded by Councilman Breland and carried. February 22, 1972 memorandum stated items needed to be purchased for water department stock replacement. Councilman Hunt moved to purchase water department stock replacement items as listed on memorandum, seconded by Councilman Domer and unanimously carried. Also included in the memorandum Feb. 22, 1972, was quotations on drapes for Building Official Office and Director of Publid Works office from Treasure Island Drapery Services $197.97 and Dixie Home Furniture Store $206.96.
