A retirement ~stem for all eli~ble ~remen of the City of Okeechobee, ~orida, is hereby established to pro,de retirement allowances and death benefits. It shall be self ad~stered by the City of Okeechobee and shall be known as the Mu~cipal ~remen's Retirement System. SECTION 2. All Firemen of the City of Okeechobee are eligible to become included in the ~cipal ~remen's Retirement System on Janua~ l, 1972, prodded they have attained age 21 but have not attained age 56 and have co~leted at least s~ months of continuous ser~ce to the city. ~remen not eligible to be included in the system on January l, 1972, and all sub- sequently employed firemen shall become eligible to be included in the retirement system after one year continuous service, and may become participants in the retirement system on January i next following their eligibility, but no later. SECTION 3. That pursuant to Florida Statute 175.091 a sum equal to five per cent (5%) of the salary of each fireman in the City of Okeechobee Fire Department shall be deducted by the city each pay period and said sum shall be paid over to the Board of Trustees of the Municipal Firemen's Pension Trust Fund created pursuant to Ordinance No. 350 of the City of Okeechobee. The balance of the cost for future service benefits and the entire cost for past service benefits shall be contributed by the City of Okeechobee. All sums withheld from any particular Fire Department member's salary shall be credited to his retirement fund, but may be co-mingled with other monies received by the Board of Trustees of the City of Okeechobee Municipal Firemen's Pension Trust Fund. SECTION 2. There shall be a retirement trust agreement by and between the City of Okeechobee and a board of five (5) trustees for the adminstration of the Municipal Firemen's Pension Trust Fund and Retirement System. Membership on the Board of Trustees and the terms of office thereof shall be as provided by Section 175.061 Florida Statutes, with the further provision that one of the Trustees shall be neither an officer nor an employee of the City but shall be an elector thereof. SECTION 5. The City shall have the right to enter into a contract for $10,000.00 whole life insurance for each participating fireman, to be used in conjunction with the Municipal Firemen' s Retirement System. Such contract for insurance may be entered into with any qualified insurance company and such company may be changed from time to time at the discreation of the City Council. The contract for insurance to be maintained should be that which, in the judgement of the City Council, is in the best interest of the City and the participating firemen and initially will be with New York Life Insurance Company. SECTION 6. All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION 7. Councilman Douglas presented Ordinance No. 352 and moved its adoption and upon being seconded by Councilman Domer was put to a vote and unanimously adopted: ORDINANCE NO. ~.~h AN ORDINANCE ESTABLISHING A MUNICIPAL POLICE OFFICERS' RETIREMENT SYSTEM; PROVIDING THE WITHHOLDING OF A SUM EQUAL TO FIVE PER CENT (5%) OF THE SALARY OF EACH PARTICIPATING MEMBER OF THE POLICE DEPARTMENT; AND THE PAYMENT OF SAID FUNDS INTO THE MUNICIPAL POLICE OFFICERS' RETIREMENT TRUST FUND CREATED PURSUANT TO ORDINANCE NO. 351 OF THE CITY OF OKEECHOBEE, FLORIDA; PROVIDING FOR A TRUST AGREEMENT IN ADMINISTERING THE SYSTEM AND APPOINTMENT OF A BOARD OF TRUSTEES; PROVIDING FOR ENTERING INTO A CONTRACT WITH AN INSURANCE COMPANY AND THAT SUCH CONTRACT INITIALLY BE WITH NFW YORK LIFE INSURANCE COMPANY; PROVIDING FOR THE PURCHASE OF WHOLE LIFE INSURANCE BY THE TOWN FOR PARTICIPATING POLICE OFFICERS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Okeechobee desires to establish a Municipal Police Officers' Retirement System; and WHEREAS, the City of Okeechobee has heretofore passed Ordinance No. 351 creating a Municipal Police Officers' Retirement Trust Fund pursuant to Chapter 185 Florida Statutes; and WHEREAS, in addition to the one per cent (1%) excise or license tax levied pursuant to said ordinance, Florida Statute 185.07 provides for additional funds to augment said Municipal Police Officers' Retirement Trust Fund; and WHEREAS, the members of the City of Okeechobee Police Department desire to have withheld five per cent (5%) of the salary of each full-time officer for payment into said Municipal Police Officers' Retirement Fund; now therefore BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: SECTION 1. A retirement system for all full-time eligible police officers of the City of Okeechobee, Florida, is hereby established to provide retirement allowances and death benefits. Audle~ Dunham Mayor, City of Okeechobee, Florida A letter was read from Farmers Home Adminstration recommending the adoption of a revised rate ordinance. A copy of proposed rates were included. The Council instructed Attorney Curren to prepare necessary ordinance with effective date April l, 1972. Engineer Don Osha was present presenting the revised map on street re-naming for further study. Also presented plans and specifications for water works improvements with application forms and data sheets for State Board of Health. The Council authorized the Mayor and Clerk to execute the necessary forms. Mr. Osha also reported that Farmers Home Adminstration had approved water tank and transmission mains contracts and he expected to receive~eA~the approved contracts at an early date. Also present was Charles B. Anderson of Brockway, Owen and Anderson, Engineers, Inc. and with Engineer Don Osha explained a complete comprehensive sewer survey program. Estimated cost or report not to exceed $3,500.00 and it would take approximately six months to prepare report. Also reported that Farmers Home Adminstration financing was available for this kind of a program. The I I 1 ..... 1 I ...... 13!)7 Council agreed to study matter further. Supt. Fortner reported it was time to renew the water tank m~intenance agreement. Odum Tank Company had submitted their renewal maintenance agreement. The original maintenance agreement was with K. L. "Jack" Sharpe and transferred to Odum Tank Company. The Council authorized Supt. Fortner to get bids from several companies for tank maintenance. Supt. Fortner presented December 21, 19?l memorandum for replacement of stock items, 36 - 5/8" x 3/~" meters and three fire hydrants. Said hydrants approximate cost $181.00 each and needed to replace ones not in operation which Supt. Fortner recommended to be replaced. After discussion Councilman Domer moved to purchased necessary items as listed on December 21 memorandum seconded by Councilman Breland and carried. Supt. Fortner reported a water line extension request from Hubert Harden on Eighteenth Street and Chokaloskee St. Approximate cost of material $250.00. T~o houses already constructed and several more to be constructed. Councilman Domer moved to grant request and authorized extension of water line seconded by Councilman Douglas and carried. Supt. Fortner also discussed the requested water line extension west on State Road 70 for Mr. Buford Warf. After discussion Councilman Domer moved to make the extension providing the owner agrees to pay all cost of such installation, including, but not limited to, cost of materials, labor, permits and State Board of Health approval, engineering fees and deposit $5,000.00 in escrow account for the purpose of paying all costs, upon completion any overage shall be refunded to owner and the agreement of the owner to execute document to convey said water line to city, seconded by Councilman Breland and carried. Attorney Curren instructed to prepare contract and authorize Resolution for contract to be executed by President Burk. The Council approved the use of P. V. C. pipe. Supt. Fortner reported that the "Wash B~l Laundromat" had made application for water service and requested the Council to determine the amount for a water deposit as provided for in Ordinance No. 3~8. An average consumption was calculated on the other laundromats, afterwhich Councilman Domer moved to require $160.00 water deposit for said "Wash Bowl Laundromat" 'bo be located in North Shore Shopping Plaza, seconded by Councilman Breland and carried. water Councilman Domer reported that he had received complaints on low/pressure on the west side of town. Supt. Fortner agreed to install line connecting Eagle Bay Drive water line with line on west State Road 70 as soon as possible. D~vid Storey appeared before the Council regarding the charges for restoration of water service at IO~_N. E. 10th Street in the amount of $150.20 plus water bill. Mr. Storey stated that he did not turn the water on or break the locks. It was the consensus of the Council that the bill would have to be paid in full before water service could be restored due to the reason the water service was discontinued as related in December lb, 1971 minutes. The Council agreed this bill to be between the landowner and renter. The Council authorized a two year subscription to Southern Standard Building Code magazine upon request of Building Official Spray. M. / ~' CI~ CLF~j~ December 28, 1971 The City Council of the City of Okeechobee, Florida, met in regular recessed session at the City Hall on the above date at 6:30 P. M. with the following present: President Donald L. Burk, Councilman Charles L. Breland, Russell V. Domer and Edward W. Douglas with Clerk Lorena Spivey, Deputy Clerk Sandra Bennett, Water Supt. L. C. Fortner, Jr., Chief of Police C. A. Thomas, Fire Chief Olen Godwin and Building Official Richard B. Spray. President Burk opened the meeting with prayer by Councilman Brel~nd. Mrs. Delight Kennedy appeared before the Council stating that she operated an alteration shop and answering phone service in the Daniels building on east south Park Street and was having a customers parking problem due to persons parking and leaving cars for long period of time and requested that one parking space be designated for her customers. Mrs. Kennedy agreed to pay for sign to this effect or for having curb painted. The Council agreed if there was no legal hinderance there would be no problem. Councilman Douglas requested to check with Attorney Curren on this matter and contact Mrs. Kennedy on cost. W. G. and Marvin Brantley of 1905 south Parrott Avenue were present regarding a permit for sign that they had placed on their property according to set back approved by Department of Transportation, stating that they had been advised by Building Official Spray that a $3.00 permit was necessary to erect the sign on property and wanted to know if they had to purchase the permit. The Council advised that Building Official Spray was acting in accordance with Southern Standard Building Code in requiring the purchase of a $3.00 permit to erect sign on property. Building Official Spray reported that he had checked on the jail door in the old county jail building and the door could be used but would need a steel frame. Councilman Breland requested to ~h~ct with Co~l,y Commissioners regarding door.
