Co,mci!man Domer reported that the occupants in the new Daniels' building on South Park Straet were complaining abo~t cars being parked across the street and left for .long periods of time, hindering their customers parking. Councilm~n Domer suggested placing two hour parking signs. Matter postpomed fe~ ~rther consideration. Street President Burk reported a speed problem on north Meredith/and requested 2~ miles per hour signs erected on said street . Co~!ncilman Breland reported the need of speed limts signs on north Hil]sborough Street. Both request referred to Supt. Bennett. Supt. Bennett reported on the drainage problem on east Eighth Street between Cherokee Street, and Hiwassea Street, stating there was no place for the water to go. Suggested cutting paved road and install~ ng culvert. Due to rainy season being about over matter ~ostponed ~nti]. February or March. Also a drainage problem on Sixth Street in South Okeechobee needing drain d~tches and two culverts for proper drain. Approximate cost for culverts $160.00. Matter postponed until the first of year. Supt. Bennett reported a junked car parked partly on Eighth Street right of way was hindering him from cutting d~tch at this location. The Council m~thorized the Police Department to have w~ecker remove said car. Supt. Bennett presented material on backhoe and front end loader for Council"s consideration, i P~esident Burk suggested a special work shop meeting for discussion on purchase of equipment with the Deoartments outlining needed equipment for their departments. It was suggested investigatin~ lease purchase. James Attaway had previously requested a culvert on Hale Avenue for entrance to his business, anS due to some misunderstanding as to location, Mr. Attaway had prepared a map showing the location which was presented to the Council by the Clerk. The location being at Tallahassee Street and Hale Avenue. After dfscussion Councilman Dogulas was requested to contact the Florida Department of Transportation regarding this matter. A report from the Okeechobee Auxiliary Police was read and the Council authorized the $300.00 yearly contribution. For year 1970. President Burk proposed ~ving the city ompToyees November 2~ and 26 for Thanksgiving holiday. At+.orney ~]rren explained an additional insurance premium in the amount of $!,771.00 received fro~ Leonard Berger Insurance Agency being an amendment to present policy. The Council felt they needed more ~nfor~a+,~on and requested that Mr. Berger be ~nvited to next Council meeting. The Council agreed to invite Engineer Don Osha to attend next Council meeting. Councilman Domer discussed the number of grass and woods fires in the county and the City being called to ssJd fires and was of the opinion +,hat the county residents should call the Division of Forestry +,o report a fire of t,~is nature and the ci.t~v would assist if necessary. The Council a~ed that +,his matter be talked over with the Division of Forestry and was referred to Councilman Domer and Co~ncilman Hunt. The Council also felt the county should share the cost of the fire department .on a pro-rated basis. Upon motion the Council recessed to meet November 16, 1971 at 6:30 P. M. The meeting was opened by President Murk. Councilman Douglas ].ed in prayer. George Dempsey was present requesting +bat Hampton Place Street in Woodland Park Subdivis- ion be opened. Said stree*, being between Okeechobee Street and Osceo!a Boulevard. Also requested a street light, for this street. Matter to be investigated. Supt. Fortner reoorted a request for water line extension on west Seventh Street in Clay Subdivision, just west of ~ity limits, for two new services. Stating the present line was ' i~adequate for additional ~ervices ~he new extension would require approximately 1200 feet of h inch pipe. The Council agTeed +hat the new extension would not be feasible at this time. Supt. Fortner suggested an alternate lin,~, from State Road 70. After discussiop the Council agreed with Councilman Hunt"s recommendation to postpone any action at this time. Councilman Breland reported the need of shell in the east-west alley in Block l~. It, was repor+,~d that a majority of the employees favored a retirement syster~. Councilman Breland moved to set up a workshop meeting with Mr. Landriscin~I representative of New York Life Insurance Company, seconded by Councilman Douglas and unanimously carried. The Clerk was requested to make arrangements for the meeting. Clyde Durrance appeared before the Council regarding an article i~, the Okeechobee News r~.~ative to remarks ~ade by two Cmmcilmen in reference to a dog situation involving a county commissior ~r. Mr. Durrance stated t. bat he felt the rema~Ws were ~rtended fmr bi.~. and endeavored to explain the dog sit.~mtion, stating that he did not Feel that he had done anything illegal. After a lenghty discussion a~d a be+..te~ ~derstandipg ~f si+,-,ation, P-=stalest Burk offered bis apology as the information he had received was hear-say and req-,osted Wt. West the Ok~eehob~o News reporter to retract the state- ment that he had made. The Council discussedvith Commissioner Durrance the dog problems in the city and cmmty and advised that, the city was in the process of preparing a dog ordinance and requested contr~] btm. to discuss ~M. th fellow Commissioners adopting a dog/ordinance. Leonard Berzer wa~; present as requested by the Council, to explain the $1~77!.00 additiomal premi~.~ on Insurance Policy CGl19237 dated 2-2-71 to 2-2-72. Stating that this was due to insorance audit amd additional covera~e. After discussion Councilman Dom. er ~oved to pay additional premiz~m,. in +.be amount, of $] ~771.00 ~n Comprehensive General Liability policy, seconded by Councilman Breland ~--~ and ~manimously carried. Councilman Hunt. requested Mr. Berger +,e furnish the city a last of all inspired item,s and personel. Donald Edgarj Dog Warden presented ~nformation on dog coptr~! ordinance in effect at Fort . Pierce also presented State Statutes numbers ~-l~ws gover~ ng dog control. Councilman Breland rem:ested the Clerk to make copies of these laws. Attorney Cu~ren e~laJned the Fire Control Agreements with the County and Division of 1379 Forestry~ prasentinC a 1971 Memorandum from Div~.sion of Forestry to clari~y agreement between the 6N. ty and saJ d Department. It was pointed out that in the past county residents had called the City Fire Department for grass and woods fires but in view of having the Division of Forestry located here it wo~!d be proper for ali. county residents to call the Division of Forestry on all grass and woods fi_res in the county and the city wou].d assist when necessary. In so doing it would help eliminate the ex?erisa, ye cost in +,be City Fire Deoartment. After discussion and a better understanding of the agreement, Councilman Domer moved to authorize Fire Chief Godwim +,o execute the 1971 Memorandum of Understandirg between the Okeechobee Fire Department and the Division of Forestry, said agreement to supersede other agreements, seconded by Councilman Breland and unanimously carried. FC-22 }~EMORANDUM OF UNDERSTANDING Rev. 6/71 between the OKEECHOBEE FIRE DEPARTMENT and the STATE OF FLORIDA Department of Agriculture and Consum~.r Services DIVIS~0N OF FORESTRY INTRODUCTION Because of the inter~d, ng]~ng of st~n~ctures and natural cover _~als in un- ~norporated areas of Okeechobee County, the objectives of the two above- na~ed orgainzations are inseparable, i.e., to minimize the loss of life an~] property as a result of uncontro]].ed fire. Recognizing this we, the undersigned, agree to the prov~'.sions of this Memorandum of Understanding fo'r the primary pu~oses listed below. !. Provide for closest possible coop~ra+.ion on ~l~tua! objectives. ~.Prevent. misunderstandings as to operational areas and responsibilitdes of our respective organizations. 3.Make possible effective support, when either organJ, zation is committed to or beyond its capacity. AREA COVERED (Narrative description of each area, and attach map) Fire Department: 1. Primary Area: Oke~chobee City 2. Secondary Area: (Note: May include all ~nin¢orporated areas of the County wherein fire department is located and has juri sdi ction.) Will respond to calls for assistance from the Division of Forestry provided local conditions, men and equipment are availabl e. Division of Forestry: 1.The County of Okeechobee, e~cept for incorporated areas, and federal ~.ands not under specific agreement. OPERATIONAL PROCEDURES The Fire Department will dispatch manpower and equipment, to an~ known fire wi~hSn ±.he primary area (previously described), and will, if local conditions per~tt, answer calls within the Secondary Area (presivously described), ~lpon request of the Div~sion of Forestry. The Division of Forestr~f will, when equipment is available, dispatch a crew tn ~r4v known forest/brush/grass f~re, or to a.n,v f~.re of unknown character. Fmu~pmeut may a~so be sent into incorporated areas upon r~oj~est of +,he municipal fire department. When both agenc~ es are represented at the same fire, the over-all supervisional --~ responsibility shall lie with the agency concerned most directly with area and object on fire. This agreement ,~hall be effective from the date of execution by the District Forester, Divisdon of Forestry. It will continue in force unless terminated by either party upon a sixty (60) day written notice to the other. The Co~nn.~ gave Su?t. Bennett authority to proceed wfith cleaning drainage ditch providing it is a dedicated street. Co~mc.~lman Douglas reported that markers had been instal]ed in the center of Riverview Drive at ~ ntersaction ~f State Road 70. M. for preliminary work on 1972 Water & Sewer Budget. ~n reference to the water line extension request from Buford Wharf on November 9, 1971, it was suggested that Mr. -~harf make survey, grade streets and put money in escrow for payment, in f%~]] to cover cost of water line extension to his property on west State Road 70. Councilman Domer moved to adopt sick leave policy and furndsh copies to all employees seconded by Councilm~n Bre]and and unanimously carried. SICK LEAVE POLICY A. METHOD OF EARNING STCK LEAVE fl) A]~ ~]]. t~me emp].oyees ~]lin~ established positions, working a forty / (hO) hour per week sched~]e shall earn si~ (6) days sick leave per year. (2) During leaves of absence with pay, an employee shall continue to earn sick leave credit. (Vacations, paid official business, etc.) (a) Sick leave shall be earned an~ credit, ed to the e~loyee four (;~) bouts es~,h ~pth on the last day of the month. (b) F,~:~loyees workin~ orver forty (~,0) hours will be credited with (h.7) hours sick leave each month on the last day of the mopth. (~) The limit on accrued sick leave shall be (!20) days for ali employees. Bo USE OF EARNED SIC}( LEAVE (1~ Use of sick leave shall not be authorized prior to the time it is earned :! and credited to the employee, and shall only be used with the aonroval of ~ the proper authority (your department, supervisor). (a) Sick leave may be authorized only for the following purposes; 1. The employee's personal i.llness, injury or exposure to a ~ contagious disease which would endanger others. ~ ?. The e~ployee's p~rsona] appointments with a doctor, dentist, ~ or other recogr~zed practitioner when it is not possible to arrange such appointments for off-duty hours. Not to exceed the extent of time required to complete each appointment. 3. Notification of absence due to illness, injury or exposure, shall be ~.ven to the appropr~ ate supervisor by the employee or his representative as soon as possible on the first da~ of absence. [~. Prior ?,o authorizing the use of any s~.ck leave, the appropriate department head shall require the employee to certify that his absence was in accordance with the provisions of paragraphs ~-- (a) 1 & 9 above. The department head ma~ require written certification from the practitioner that the employee was under his care. 5. It may be required of the employee to present medical certification that he or she is physically ~ mentally fit to continue working. If such medical certification is not acceptable to the department head~ any subseq~ont e×am~nation shall be paid for by the City with a !i~it of $~O.00 total. (a) If it is determined that the employee is physically or mentally unfit to continue working, the department head may require the er~oloyee to use any part.~ of his accrued sick leave. C. FORFEITURE OF SICK LEAVE (1) An e~ployee who terminates fro~ City Government shall foreeit all : ~n~s~ sick leave. (2) An employee shall, not be paid for unused sick leave Working parents hav~ng to accompany their own children to a oractitioner may elect to use earned sick leave if approved by the department head. An application for leave of absence form must be placed on file with the City Clerk's office for recording. Death leave for i~ediate family two (2) days in state and. five (5) days out of s*,ate.
