August 12, 1971 The City Council of the City of Okeechobee, Florida, met in workshop session at 6:00 P. M. at the City Hall on the above date with all Council members present except Councilman Douglas, also present Clerk Spivey and Deputy Clerk Bennett, for the purpose of preliminary work on 1972 General Budget. M. at the City Hall on the above date with all members of the Council present also Clerk Spivey and Deputy Clerk Bennett, for the purpose of preliminary work on 1972 General Budget. August 2h, 1971 The City Council of the City of Okeechobee, Florida, met in regular adjourned session at the City Hall on the above date at l:O0 P. M. with the following present: Mayor Dunham, President Burk, Councilman Domer, Douglas and Hunt with Attorney Curren and Clerk Spivey. Pursuant to notice published in the Okeechobee News the meeting was for the purpose of accepting sealed proposals for the purchase of all, but not less than all, of $h80,~00, City of Okeechobee General Obligation Refunding Bonds, dated January l, 1971. The notice of sale and notice of proof of publication in due form, all requirements of Florida State Statutes having been met and it being the hour of l:00 P. M. the time for opening sealed proposals and there being no bids received at public sale called for this date and time; tkeLaw provides the bonds may be sold without notice at private sale at anytime within one year; Councilman Domer moved to apply to Arch W. Roberts & Company to assist the City in negotiating a private sale within such time as to provide funds by December 1971, so as to meet the conditions of the bond issue of 19h2 being refunded, seconded by Councilman Hunt and unanimously carried. Arch W. Roberts was present submitting a proposal to purchase $h80,500 par value, Okeechobee, Florida, General Obligation Refunding Bonds dated January l, 1971, with a check in the amount of $9,610.00 to be returned to Arch W. Roberts & Company upon award of said Bonds, provided this proposal is not accepted; otherwise to be retained by the City until the delivery of said bonds and payment therefore, and to be retained as and for liquidated damages in case of the failure of Arch W. Roberts and Company to make such payment. After discussion and due consideration, Councilman Hunt moved to accept the proposal in form submitted by Arch W. Roberts RESOLUTION OF AWARD WHEREAS, pursuant to notice heretofore duly published for the sale of $480,500.00 General Obligation Refunding Bonds of the City' of Okeechobee, Florida, the City Council of the City of Okeechobee, Florida met on August 24, 1971 at l:O0 o'clock P.M. Eastern Daylight Savings Time to open and consider all bids submitted for said bonds; and WHEREAS, the following bids were submitted; NONE. Then, there bein~ no bids received, the Fiscal Agents for the City: ARCH W. ROBERTS & CO. 605 N. E. First Street ?. O. Drawer 1586 Gainesville, Florida 32601 were requested to assist the City in negotiating a private sale within such time as to I - 1 .... .... provide funds by December 1971. The said Arch W. Roberts & Co. thereupon submitted its proposal in the form of a bid with bid bond in accordance with the notice of sale, the bid being in proper form in all respects and being acceptable as a bid or as the lowest and best proposal for private sale, which bid is hereto attached and made a part hereof; and WHEREAS, after due consideration it appears to the City Council of the City of Okeechobee, Florida that the bid of ARCH W. ROBERTS AND CO. in the amount of $480~500.00 and accrued interest for the $480,500.00 General Obligation Refunding Bonds, bearing interest as hereinafter stated is the best bid received; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA, that: SECTION 1. The $480,500.00 General Obligation Refunding Bonds be awarded to ARCH W. ROBERTS & CO. at the price of $480.500.00 and accrued interest for said bonds bearing interest as follows: Bonds Maturing Interest Rate 1972 through 1982 7.50% 1983 through 1990 6.75% 1991 through 1995 6.875% 1996 6.75% SECTION 2. The proper officers of the City of Okeechobee be and they are hereby authorized and directed to execute said bonds when prepared and to deliver same to said purchaser upon payment of the purchase price pursuant to the conditions stated in the Notice of Sale without further authority from this Council. SECTION 3. The said bonds will be payable at American National Bank and Trust Compan~ of South Passadena; South Pasadena; Florida 33707 SECTION 4. The action of the City Clerk publishing the Notice of Sale of said bonds in The Okeechobee News, Okeechobee, Florida, and the preparation of the Official Statement for said bonds is hereby, in all respects, ratified and confirmed. SECTION 5. The City Clerk of the City of Okeechobee be and is hereby authorized and directed to return forthwith the good faith checks of all unsuccessful bidders. SECTION 6. Bonds maturing in the years 1982 through 1996, both inclusive, shall be redeemable at the option of the City, on July 1, 1981, or on any interest payment date thereafter, at the price of par and accured interest to the date of redemption, plus the following premiums, expressed as a percentage of the par value thereof, if redeemed at the following times: Three per centum (3%) if redeemed on Jnly 1, 1981, to and including January 1, 1986, two per centum (2%) if redeemed on July 1, 1986, to and including January 1, 1991, one per centum (1%) if redeemed on July 1, 1991, or thereafter prior to maturity. No bid for less than 100% of the par value thereof will be considered. Each proposal must be accompanied by a Certified or Bank cashier's or Treasurer' s check in the amount of $9,610.00 payable to the order of the City of Okeechobee, on which no interest will be allowed. The check of the successful bidder will be retained and applied on the purchase price of the bonds pending full performance of said successful bidder, or will be forfeited to the City as and for full liquidated damages upon failure to take up and pay for the bonds. Roberts Councilman Hunb~ recomended the removal of shields from signal light and no turn on red from West side of light at intersection of Ocseola Street and North Park Street. Councilman Douglas moved to accept the above recommendation, seconded by Councilman Domer and carried. Councilman Hunt moved to authorize Attorney Curren to take necessary action to defend the City in the Godwin case and to retain Brennon Law Firm to assist him, seconded by Councilman Domer and carried.
